What it does
This Regulation sets out procedural, technical and operational requirements for the fluoridation of public water supplies in New South Wales, by prescribing forms, approval processes, technical standards and ongoing operational obligations that water supply authorities must follow. It gives legal effect to duties referenced in the Fluoridation of Public Water Supplies Act 1957 (the Act) by making many obligations conditional on and to be performed in accordance with a separate Fluoridation Code published by the Secretary (see s 3 and repeated cross-references throughout the Regulation). Key regulatory levers in the text are: prescribed application form and supporting documents for approval to fluoridate (s 4); mandatory use of equipment designed to ensure accurate dosing and meeting the Code (s 5); a prohibition on non-qualified persons performing fluoridation except as permitted by the Code (s 6); requirements to obtain the Secretary’s written approval before making plant alterations that would contravene an approval or would be required by the Code (s 7); mandatory sample collection, analysis, reporting and provision of samples and results in specified form and times as required by the Code (s 8); security measures for premises that contain fluoridation plant, agents or equipment and restricted entry rules (s 9); recordkeeping obligations in accordance with the Code and a duty to provide records on request to the Secretary (s 10). The Regulation also repeals and replaces the 2017 Regulation and saves existing acts or matters under the old instrument (s 11), and it commenced on publication on the NSW legislation website (s 2). Mechanically, the Regulation delegates detailed technical standards and many procedural particulars to the Fluoridation Code (s 3 definition of Fluoridation Code), and makes non-compliance in a number of these areas an offence subject to stated maximum penalties (see s 5-s 10).
