Flora and Fauna Guarantee Regulations 2020

The core legal concepts deployed in the Regulations are eligibility for listing, nomination content, decision‑making criteria for approvals, habitat conservation order notification, and prescribed forms. Each concept is given operational content in a Schedule or a regulation.

Eligibility for listing: Regulation 6 prescribes that eligibility for specifying taxa on the Threatened List (taxa of flora or fauna), communities of flora or fauna, and potentially threatening processes is to be determined by the criteria in Schedules 1, 2 and 3 respectively (reg 6(1)-(3)). Schedule 1 sets out primary criteria and subcriteria mapped to the Act’s threat categories (extinct, extinct in the wild, critically endangered, endangered, vulnerable, conservation dependent). These criteria define factual thresholds: e.g. exhaustive surveys that fail to record individuals (extinct/extinct in the wild), reductions in population size, restricted geographic distribution, extreme fluctuations, low numbers of mature individuals, or quantitative probability of extinction (Schedule 1, various primary criteria and subcriteria). Schedule 2 does the same for communities, linking to s 14 of the Act by providing concrete criteria for demonstrable decline or susceptibility to threats. Schedule 3 provides criteria for listing potentially threatening processes, focusing on whether a process poses or could pose a significant threat to multiple taxa or a community (Schedule 3, Criteria 1.1-1.3; 2.1-2.3).

Nomination content: Regulation 7 prescribes Schedule 4 as the mandatory list of information for nominations under s 16A(4)(a) of the Act. Schedule 4 requires identification and contact details of nominators, signatures, and particular evidentiary materials depending on whether the nomination concerns a taxon, a community, or a potentially threatening process. For taxa, Schedule 4 distinguishes between conventionally accepted taxa (requiring evidence of conventional acceptance) and taxa not conventionally accepted (requiring a manuscript-quality description and a voucher specimen lodged with a relevant scientific institution). Schedule 4 also requires nominators to provide evidence that the taxon satisfies any of the primary criteria in Schedule 1 when nominating for addition, and similarly for communities (evidence against Schedule 2) and processes (evidence against Schedule 3).

Decision-making criteria for licences/permits/authorisations: Regulation 9 requires that relevant decision-makers under ss 48(3), 48A(2), 53(2) and 53A(2) of the Act take into account: the objectives of the Act; the category of threat (if any) for the taxon; any relevant action statements, critical habitat determinations, habitat conservation orders, management plans or public authority management agreements made under the Act; the acceptability of impacts on the taxon (explicitly listing long/short-term, beneficial/detrimental, direct/indirect, cumulative impacts, and the impact of potentially threatening processes); and any possible social and economic effect of issuing the licence/permit/authorisation (reg 9(a)-(e)). The Note to reg 9 flags that the cited sections of the Act include restrictions on issuing licences/permits/authorisations.

Form standardisation and procedural templates: Schedule 5 supplies Form 1 (notice of making of a habitat conservation order), Form 2 (application for a certificate under s 65 indicating whether land is subject to a habitat conservation order), and Form 3 (the certificate issued under s 65). The forms specify minimum contents and procedural elements: Form 1 requires details for inspection, addresses for submissions and a closing date at least 30 days after receipt; Form 2 requires a land description sufficient for ready identification including maps and title details; Form 3 records whether land was or was not the subject of a habitat conservation order.

Interplay with Act provisions: The Regulations repeatedly reference the Act for limits and procedural contexts. For example, reg 6 carries notes pointing to sections 13-16 of the Act as limitations on eligibility and to s 4B(4) on public authorities’ consideration of objectives. Reg 6 and Schedule 1 explicitly connect the criteria to the Act’s categories of threat (see Schedule 1 notes).

Evidential standards and discretionary phrases: The Schedules frequently require evidence and use discretionary phrases such as “any other circumstance that demonstrates to the satisfaction of the Committee” (Schedules 1-3). Schedule 1 also permits quantitative analyses to establish extinction probability. Schedule 4 requires varying quality of evidence depending on the status of the taxon (conventionally accepted versus not). These features frame a mixed evidentiary regime combining prescriptive tests and open-ended evaluative judgements.

The Regulations assign responsibilities and impose documentary obligations that affect multiple groups; who pays, who decides, and who must provide evidence is identifiable from the text.

Nominators: Individuals and incorporated bodies who propose taxa, communities or processes for listing under s 16A of the Act must supply the information specified in Schedule 4 (reg 7). Nominators must provide name, contact details and signature(s) (Schedule 4 cl 1). Corporations must nominate an appointed representative and provide that person’s name/contact details and signature (Schedule 4 cl 2). For taxa not conventionally accepted, nominators must produce a manuscript-quality taxonomic description and evidence of a voucher specimen lodged with a scientific institution (Schedule 4 cl 4(2)). Nominators therefore bear the cost of assembling scientific, taxonomic and survey evidence to meet the Schedules’ standards.

Scientific institutions and voucher specimen holders: Schedule 4 requires evidence that at least one voucher specimen is lodged with a relevant scientific institution where the taxon is not conventionally accepted (cl 4(2)). Institutions maintaining voucher specimens will be involved as custodians and may be asked to confirm holdings; researchers relying on physical specimens are implicated.

The Committee (the statutory body under the Act): The Committee uses the eligibility criteria in Schedules 1-3 when assessing nominations (reg 6 and Schedules). Several provisions phrase tests as satisfaction of the Committee (Schedules 1-3 “demonstrates to the satisfaction of the Committee”), placing evaluative discretion on it. The Committee must also apply s 16C(3) and (4) of the Act concerning assessment first on the basis of risk of extinction in Australia and, only in specified circumstances, on the basis of risk in Victoria (note to reg 6; Schedule 1 note).

Decision-makers issuing licences, permits and authorisations: Regulation 9 requires the "relevant decision maker" under ss 48, 48A, 53 and 53A of the Act to take the listed criteria into account when deciding whether to issue a licence, permit or authorisation. This captures departmental officers, delegated statutory decision-makers and potentially the Minister, depending on the Act’s delegation scheme. Those decision-makers must weigh scientific evidence, the category of threat, existing action statements/habitat determinations, impacts (including cumulative and indirect effects and impacts of threatening processes), and social and economic effects (reg 9).

Landowners and applicants for certificates: Landowners and prospective purchasers who need to determine whether land is the subject of a habitat conservation order can apply to the Secretary to the Department using Form 2 (reg 10(1), Schedule 5 Form 2). The Secretary issues a certificate in Form 3 (reg 10(2), Schedule 5 Form 3). Owners seeking clarity on the existence of a habitat conservation order bear the cost of submitting the application and providing precise land descriptions; the Department bears the administrative cost of issuing certificates.

Minister and Department: Form 1 requires that notices of the making of a habitat conservation order include the name of the Minister, inspection details, where submissions can be sent, and a closing date at least 30 days after the notice is received (Schedule 5 Form 1). The Minister and the Department are the formal addressees and administrators of public submissions and of making notices available for inspection.

Public authorities generally: The Regulations note that s 4B(4) of the Act concerns guidelines for public authorities on properly considering the Act’s objectives and instruments made under it (note to reg 6). Schedule 5’s forms and the decision criteria in reg 9 will be material information for public authorities whose actions intersect with listed taxa, communities or threatening processes.

Licence/permit applicants and industries: Applicants for licences and permits whose activities might affect listed taxa must anticipate decision-makers considering the category of threat, action statements and the acceptability of impacts including long-term, cumulative and indirect impacts, and social/economic effects (reg 9). This affects a wide set of activities (development, land management, resource extraction, agriculture, infrastructure) without the Regulations specifying sectors; the Act limits and contexts (ss 48, 48A, 53, 53A) determine specific coverage.

Researchers, ecologists and consultants: Because the Schedules make specific evidentiary demands , e.g. exhaustive surveys appropriate to the taxon’s life cycle, manuscript-quality taxonomic descriptions, quantitative analyses of extinction probability , scientific practitioners are implicated. The draft and final nomination packages will often require professional ecological surveys and taxonomic work to meet the Schedule thresholds.

Legal and compliance advisers: Practitioners advising nominators, landholders, industry proponents, and decision-makers must interpret the primary/subcriteria thresholds, assemble evidence that aligns with Schedules 1-4 and prepare submissions that address reg 9’s decision-making criteria.

In short, the Regulations allocate evidence-preparation costs to nominators and applicants, decision burdens to the Committee and authorised decision-makers, and administrative duties to the Department and Minister. The balance of administrative costs versus private compliance costs will vary with the complexity of the taxon/community/process and whether additional survey, taxonomic or quantitative analysis is required.

The Regulations create a set of prescriptive duties (what must be supplied, what must be considered) and enable rights (to nominate, to apply for a certificate, to make submissions on habitat conservation orders). Those duties and rights are embedded in the Schedules and the forms.

Duties on nominators and applicants

• Provide prescribed information in nominations. Regulation 7 makes Schedule 4 mandatory for nominations under s 16A(4)(a). Schedule 4 requires nominators to supply contact details, signatures and, depending on the subject, specific evidence: taxonomic identification, evidence of conventional acceptance or manuscript description and voucher specimens (cl 3-4); evidence satisfying Schedule 1 for taxa proposed for addition (cl 4(3)); evidence for recategorisation, removal, or for taxa below subspecies level including a special need to conserve (cl 5-7). For communities and processes, Schedule 4 requires identification, distinguishing descriptions and evidence against Schedules 2 and 3 respectively (cl 8-13). These are documentary duties with clear checklists.

• Corporations must appoint and identify a representative. Schedule 4 cl 2 requires corporates to supply the appointed representative’s name/contact details and signature, thereby fixing an accountable signatory.

Duties on the Committee and decision-makers

• Apply eligibility criteria. Regulation 6 requires the Committee to determine eligibility to list taxa, communities or processes using the criteria in Schedules 1-3. The Committee must first assess risk of extinction in Australia (s 16C(3) of the Act is noted in Schedule 1), and may only assess risk of extinction in Victoria in prescribed circumstances (s 16C(4) reference in Schedule 1 note). The Committee thus has a statutory duty to use those criteria and to follow the Act’s national/Victorian assessment order.

• Take account of specified matters when issuing licences, permits or authorisations. Regulation 9 obliges the relevant decision-maker to take into account the Act’s objectives, threat category, relevant action statements etc, the acceptability of impacts including cumulative and indirect effects, and social/economic effects. That is a mandatory consideration duty; decisions must explicitly take those factors into account.

Duties on the Minister/Department for notifications and certificates

• Publish notice of habitat conservation orders in the Form 1 format. Regulation 8 prescribes that notices of the making of a habitat conservation order must be in Form 1 (Schedule 5). Form 1 requires that the notice state where the habitat conservation order may be inspected, where to send submissions, and a submissions closing date at least 30 days after the notice is received.

• Process certificate applications and issue certificates in Form 3. Regulation 10 prescribes the Form 2 application for a certificate under s 65(1) and the Form 3 certificate to be issued under s 65(3)/(4). The Department/Secretary has a duty to provide a certificate indicating whether specified land is subject to a habitat conservation order once an applicant has lodged Form 2.

Rights conferred

• Right to nominate. Schedule 4 and reg 7 operationalise the procedural right to nominate taxa, communities or processes for listing under s 16A of the Act; any person or incorporated body who satisfies Schedule 4 may lodge a nomination.

• Right to make submissions on habitat conservation orders. Form 1 explicitly grants the public a right to make submissions and fixes a minimum 30-day period (Schedule 5 Form 1).

• Right to obtain a certificate. Section 65 of the Act (not reproduced in full here) is operationalised by Forms 2 and 3; applicants may request an official certificate indicating whether land is subject to a habitat conservation order.

Limitations and conditions noted in the Regulations

• The Regulations repeatedly reference limitations in the Act (reg 6 notes limits on eligibility via ss 13-16). For example, the “conservation dependent” category is applied only to taxa of fish and only in respect of risk of extinction in Australia (Schedule 1 note under Category 6). The Committee’s assessment order , Australia first , is mandated by the Act (Schedule 1 note on s 16C).

• Discretion and evaluative language. The Schedules include open-ended clauses such as “any other circumstance that demonstrates to the satisfaction of the Committee” (Schedules 1-3). That language gives the Committee scope to accept evidence that falls outside the enumerated subcriteria, so long as the Committee is satisfied.

What the Regulations do not do (and therefore limit rights/duties)

• The Regulations do not themselves prescribe penalties. They specify procedural and evidentiary obligations and forms; enforcement, restrictions and penalties are matters reserved to the Act and the specific sections cited (reg 9 note; regs 8 and 10 referencing Act provisions). Consequently, sanctions for non-compliance with the Act are not set out in these Regulations.

• The Regulations do not set substantive conservation measures, funding obligations, land-use prohibitions or compensation mechanisms. They create eligibility tests, nomination requirements and decision criteria but leave substantive consequences to the Act and to subsequent action statements, habitat conservation orders, determinations and management plans.

The Regulations themselves do not create express offences or specify penalty amounts. The instrument operates primarily by setting evidentiary rules and procedural templates; enforcement and sanctions are referenced back to the Act.

Relationship to the Act’s enforcement regime

• Regulation 9 includes a Note stating that ss 48, 48A, 53 and 53A of the Act include restrictions on issuing licences, permits or authorisations, implying that sanctions or legal limits relevant to those authorisations are established in the Act, not the Regulations. The Regulations therefore instruct decision-makers on what factors to take into account (reg 9) but do not add new penal sanctions.

• Regulation 8 prescribes the form of a notice of the making of a habitat conservation order for the purposes of s 29(4) of the Act. Section 29 of the Act (not reproduced in full in the Regulations) governs the making and publicising of habitat conservation orders and will include any enforcement implications associated with contravening a habitat conservation order. The Regulations ensure that the notice of an order contains details necessary for public inspection and submissions (Schedule 5 Form 1), and thus the Regulations support procedural fairness and public participation in enforcement processes.

Administrative enforcement mechanisms

• Certificates under s 65: Regulation 10 prescribes application and certificate forms (Schedule 5 Forms 2 and 3). The availability of an official certificate indicating whether land is subject to a habitat conservation order is an administrative mechanism that reduces uncertainty and supports later enforcement or compliance actions. The Secretary to the Department must process applications in the prescribed form (Form 2) and issue certificates in Form 3.

• Committee’s evaluative role: The Committee’s satisfaction-based determinations under Schedules 1-3 operate as gatekeeping enforcement: if the Committee is satisfied that criteria are met, the Committee can recommend listing, triggering statutory consequences under the Act. The Regulations’ criteria therefore structure how and when statutory protections come into force, which has enforcement implications under the Act.

Practical enforcement consequences (as derived from the instrument)

• Listing triggers statutory instruments and actions under the Act (action statements, habitat conservation orders, critical habitat determinations, management plans). The Regulations make it more administratively straightforward for the Committee to determine eligibility and for decision-makers to consider the status of taxa in exercising delegation powers. This can increase the frequency or certainty of enforcement actions under the Act once a taxon or community is listed. However, the Regulations themselves do not specify the enforcement steps or penalties , those are deferred to the Act’s operative provisions.

Limitations on available information

• Because the Regulations reference sections of the Act for enforcement and penalties without reproducing those sections, one must consult the Act to identify specific criminal or civil penalties, injunction powers, or administrative penalties. The Regulations are procedural and evidentiary; they enable enforcement by clarifying evidence thresholds and administrative forms but do not themselves prescribe penalties.

The Regulations are a subordinate instrument made under s 69 of the Flora and Fauna Guarantee Act 1988 (reg 2). They interact with the Act and with other statutory instruments through cross-references, procedural dependencies and the presence of public authority obligations.

Primary interaction with the Act

• Delegated function: The Regulations give operational effect to the Act’s Part 3 Division 2 listing regime by prescribing criteria and nomination requirements (reg 6, reg 7). They operate within the Act’s statutory framework and rely on the Act for ultimate authority to list taxa/communities/processes, issue habitat conservation orders and impose restrictions via licences/permits/authorisations.

• Cross-references to Act sections: The Regulations reference specific Act provisions , s 16A (nominations, reg 7), s 29 (habitat conservation orders, reg 8), ss 48/48A/53/53A (licences and authorisations, reg 9), and s 65 (certificates, reg 10). They also note the Act’s definitional and limiting provisions (ss 13-16 referred to in reg 6 notes) and s 4B(4) regarding public authorities' proper consideration of the Act’s objectives.

• Limits on categories: Schedule 1 contains a note that in accordance with ss 13(a)-(b) of the Act, the “conservation dependent” category is applied only to fish and only with respect to risk of extinction in Australia. The Regulations therefore use the Act’s internal limitations to constrain application of certain categories.

Interaction with subordinate and interpretative legislation

• Subordinate Legislation Act 1994: The endnotes record that the Regulations were made on 26 May 2020 and will sunset 10 years after making under s 5 of the Subordinate Legislation Act 1994. The Regulations must therefore be interpreted and managed within the lifecycle rules that govern subordinate legislation (endnotes).

• Interpretation of Legislation Act 1984 (ILA): The endnotes include standard interpretative directions (ILA provisions relating to headings, examples, punctuation, provision numbers) which affect how the Regulations and their Schedules are read as part of Victorian statutory interpretation principles.

Interaction with public authority duties

• The Regulations’ note to reg 6 references s 4B(4) of the Act which concerns guidelines for public authorities in properly considering the Act’s objectives and instruments made under it. This points to an interlocking duty: the Regulations set criteria and forms that public authorities should consider and incorporate under s 4B(4) guidelines.

Interaction with administrative decision-making and other regulatory regimes

• Decision criteria in reg 9 require decision-makers to take into account social and economic effects of issuing licences/permits/authorisations (reg 9(e)). This creates a structured point of contact between environmental listing decisions and economic/regulatory decision-making across other regimes, such as planning, resource management, or statutory approvals under other Acts. Though the Regulations do not explicitly prescribe how conflicts between regimes are resolved, reg 9 ensures that decision-makers must account for economic considerations alongside conservation objectives.

Limits of interaction evident from the text

• No express cross‑reference to compensation or land acquisition regimes. The Regulations do not engage or alter other statutes that regulate compensation or property rights; any interface with property law, planning law, or native title would operate under those regimes and via the Act’s substantive provisions.

• No express delegation or application to Commonwealth regimes. The Regulations operate within Victoria’s statutory framework and do not purport to coordinate with Commonwealth threatened species laws; Schedule 1 notes require the Committee to assess risk of extinction in Australia first, indicating an awareness of broader jurisdictional assessments but not creating binding interstate or Commonwealth mechanisms.

In sum, the Regulations are tightly coupled with the Act. They supply procedural and evidentiary detail that decision-makers and nominators must follow. They also interact procedurally with administrative law principles and with public authority obligations under the Act, but they leave substantive enforcement, penalties and inter-regime conflict resolution to the underlying Act and to other applicable laws.

The Regulations were made on 26 May 2020 and came into operation on 1 June 2020 (endnotes). Regulation 4 revokes the Flora and Fauna Guarantee Regulations 2011. The version provided is Version No. 001 as at 1 June 2020.

The Endnotes include a “Table of Amendments” entry indicating that there are no amendments to the Flora and Fauna Guarantee Regulations 2020 by statutory rules, subordinate instruments or Acts (endnotes Part 2). The “Amendments Not in Operation” section states there are no amendments not yet in operation (endnotes Part 3). Explanatory details in the endnotes record the making date and commencement, the sunset provision applicable under the Subordinate Legislation Act 1994, and note a style change under the Interpretation of Legislation Act 1984 (endnotes Part 1 and 4).

Key timestamps and actions in the document:

• Made by Governor in Council: 26 May 2020 (endnotes).
• Commencement date: 1 June 2020 (reg 3; endnotes).
• Revocation of prior instrument: revokes Flora and Fauna Guarantee Regulations 2011 (reg 4).
• Sunset: 10 years after making, i.e. 26 May 2030, under section 5 of the Subordinate Legislation Act 1994 (endnotes).

There is no in-text history of prior versions of these particular Regulations other than the revocation of the 2011 Regulations. The Table of Amendments indicates no subsequent statutory rule or Act amendments as at the version date. No transitional provisions are set out in the Regulations themselves; revocation is stated simply (reg 4). The absence of amendment records in the “Table of Amendments” suggests that the instrument as presented was the first version and remains unamended at the date of this version.

Practical consequence for users: legal advisers and practitioners should confirm whether the Regulations have been amended or superseded post-1 June 2020 by checking the consolidated legislation database or official Gazettes, because the Regulations will sunset in 2030 and may be subject to later amendment before that date.

The Regulations themselves do not record any litigation history. The endnotes do not cite any cases or judicial determinations. The text contains no references to judicial decisions that interpret the Regulations or the Schedules. Where the Regulations reference sections of the Act (for example, s 13, s 14, s 16, s 16C, s 29, ss 48/48A/53/53A, s 65), the litigation history relevant to those Act provisions would sit in decisions that address the Act generally rather than these Regulations specifically; such decisions are not listed in the instrument.

Implications for practitioners

• No internal case law: Because the Regulations do not themselves include or summarise judicial interpretations, practitioners must look to any relevant case law on the Act and on prior Regulations (including the 2011 Regulations) for binding and persuasive precedent. The Regulations’ operative content , criteria and forms , will be given effect by administrative decision-makers and, where challenged, by courts or tribunals interpreting the Act and its subordinate instruments.

• Points likely to attract litigation: The Regulations create eligibility criteria and use discretion-conferring phrases such as “to the satisfaction of the Committee” and “any other circumstance” in Schedules 1-3. Those clauses and the Committee’s evidential assessments are the kinds of administrative decisions that can be challenged on judicial review grounds (procedural fairness, reasonableness, errors of law) where the Committee’s satisfaction standard is alleged to be irrational or procedurally flawed. Similarly, reg 9’s requirement to take into account social and economic effects could be a ground for challenge if a decision-maker fails to take required considerations into account.

• Evidentiary disputes: The Schedules require technical scientific evidence (exhaustive surveys, quantitative extinction analysis, voucher specimens). Disputes about sufficiency and interpretation of scientific evidence are predictable in any litigation challenging listing decisions or related permits and could require expert evidence and judicial deference to scientific expertise.

Because the Regulations do not report or summarise litigation, the absence of case citations in the instrument should not be taken as evidence there has been no litigation regarding the Act or related administrative decisions; it only reflects the content and purpose of the statutory instrument itself.

The Regulations contain several features that can produce practical surprises for nominators, applicants, landowners, decision-makers and advisers. These are concrete drafting and procedural points that can lead to risk or delay if overlooked.

1. Evidence quality and taxonomy requirements for non-conventionally accepted taxa (Schedule 4 cl 4(2)). If a nominator proposes a taxon that is not “conventionally accepted,” the Regulations require a manuscript-quality taxonomic description and evidence that a voucher specimen is lodged with a scientific institution. That is a higher bar than merely supplying observational records. Obtaining a manuscript-quality description and lodging a voucher specimen can be time-consuming and costly; failure to provide these materials may mean a nomination is not considered complete.

2. Exhaustive surveys for extinct/extinct in the wild categories (Schedule 1 Primary criteria 1.1 and 2.1). The criteria require “exhaustive surveys throughout the taxon’s historic range” conducted over time frames appropriate to the taxon’s life cycle and life form. The term “exhaustive” implies a high standard of survey effort. Practitioners should expect challenges about what constitutes sufficient survey effort, especially where historic ranges are large or poorly documented. The Regulations do not quantify survey effort, leaving that to scientific judgement and Committee assessment.

3. Open-ended “satisfaction” clauses (Schedules 1-3). Multiple places allow “any other circumstance that demonstrates to the satisfaction of the Committee” that criteria are met. These clauses give the Committee discretion to accept non-enumerated evidence but also create uncertainty for nominators and stakeholders about which novel evidence the Committee will accept.

4. Conservation dependent applied only to fish and only for Australian risk (Schedule 1 note). The “conservation dependent” category is strictly limited to fish and to assessments about risk of extinction in Australia. Nominators or managers seeking to classify other taxa as conservation dependent will not meet the Regulation’s intended scope.

5. Distinguishing process from cause or symptom (Schedule 4 cl 12(2)). For potentially threatening processes, Schedule 4 states the process “must be identified as a process and not as a cause or a symptom of a process.” This drafting requires nominators to think carefully about conceptual framing: a submission framed incorrectly as a cause rather than a process may be ruled out as not meeting the Schedule’s identification requirement.

6. Special need requirement for taxa below subspecies level (Schedule 4 cl 6). Nominations for taxa below subspecies level must show both that the primary criteria are satisfied and that there is a special need to conserve the taxon. This two-step bar can be overlooked and may result in otherwise meritorious micro‑taxa being declined if nominators do not articulate the “special need.”

7. Form 1’s minimum 30-day submissions timeline (Schedule 5 Form 1). The notice of making of a habitat conservation order must set a submissions closing date of at least 30 days after the notice is received. Administrative errors that shorten the submissions period could render process vulnerable to procedural fairness challenges.

8. Form 2’s requirement for a land description “sufficient to be readily identified” (Schedule 5 Form 2). Applicants seeking a s 65 certificate must supply a precise description , maps, title details and the address , or risk delays. Incomplete land descriptions will impede the Secretary’s ability to issue an accurate certificate.

9. Decision-maker’s obligation to consider social and economic effects (reg 9(e)). While this requires balancing environmental and socio-economic considerations, the Regulations do not set a weighting formula or threshold. This leaves decision-makers with discretion that may be tested in judicial review if decision-making appears to neglect relevant socio-economic factors or the Act’s objectives.

10. Potential for duplicated work across jurisdictions. Schedule 1 notes require the Committee to assess eligibility first on the basis of extinction risk in Australia (s 16C(3)). Where national assessments or Commonwealth listings exist, nominators may need to supply or reconcile interstate or Commonwealth evidence. The Regulations do not create a mechanism to avoid duplication of scientific input or to defer to Commonwealth assessments.

11. No penalty detail in Regulations. Because penalties and specific enforcement measures are in the Act, stakeholders must consult the Act when considering the legal consequences of non-compliance. Overlooking this could produce improper assumptions about liabilities or remedies.

12. Administrative burden and cost allocation. The Regulations place documentation and evidence burdens on nominators and applicants, while the Department/Committee must evaluate often technical materials. The Regulations do not supply funding or resource allocations for these administrative tasks, creating potential capacity constraints.

13. Ambiguity about procedural sequencing: The Regulations require forms and evidence but do not always define timelines for Committee consideration, time allowed for submissions beyond 30 days for HCO notices, or timelines for the Secretary to issue s 65 certificates. Practitioners should not assume fixed timelines beyond those specified.

Addressing these gotchas requires careful pre-submission planning: assemble taxonomic and voucher evidence early, budget for comprehensive surveys, ensure corporate nominators appoint and document a representative, and include socio-economic evidence where relevant to anticipate reg 9’s requirements.

Complying with the Regulations involves two complementary tracks: (A) preparing compliant nominations and supporting materials to satisfy Schedules 1-4, and (B) procedural compliance for interactions with habitat conservation orders, certificates and licence/permit/authorisation applications. Below is a practical compliance checklist and recommended practices grounded in the Regulations’ requirements.

A. Preparing nominations (reg 7 and Schedule 4)

1. Use Schedule 4 as a checklist for content

• Always include the nominator’s full name, contact details and signature(s) (Schedule 4 cl 1). If the nominator is a corporation, include the appointed representative’s name, contact details and signature (cl 2).

2. Identify the subject unambiguously

• For taxa: provide either the scientific name with a reference text or a common name plus a description that unambiguously distinguishes the taxon (Schedule 4 cl 3(a)(i-ii)). State whether the taxon is vascular/non-vascular plant, vertebrate/invertebrate animal or other (cl 3(b)).

• For communities: specify the community in accordance with a relevant text or reference and describe how it is distinguished from other communities, naming characteristic species, structure or environmental conditions (cl 8(1)).

• For processes: specify or describe the potentially threatening process so it is distinguishable from all others and ensure the description identifies it as a process, not a cause or symptom (cl 12(1)-(2)).

3. Provide required scientific evidence

• For taxa conventionally accepted: include evidence of conventional acceptance and sources (cl 4(1)).

• For taxa not conventionally accepted: provide a manuscript-quality taxonomic description and evidence that at least one voucher specimen is lodged with a relevant scientific institution (cl 4(2)). Arrange for specimen deposition and obtain documentation from the institution confirming the voucher.

4. Map the evidentiary standard to the appropriate Schedule criteria

• If nominating a taxon for addition, provide evidence that it satisfies any of the primary criteria in Schedule 1 (cl 4(3)). This may require ecological survey reports, population estimates, range maps, evidence of fragmentation, or quantitative extinction analyses.

• If nominating a community, supply evidence against Schedule 2 criteria (cl 9).

• If nominating a potentially threatening process, supply evidence against Schedule 3 criteria and indicate the range and significance of the threat (cl 13(2)(a-b)).

5. For recategorisation or removal nominees

• For recategorisation (higher or lower): include evidence showing eligibility in the proposed category or that the current category is no longer met (cl 5).

• For removal: provide evidence that the taxon or community can no longer be described distinctly or no longer satisfies the relevant Schedule criteria (cl 7 and cl 11).

6. Special cases

• For taxa below the level of subspecies: include both evidence that primary criteria are met and a statement of the “special need to conserve” the taxon (cl 6).

Practical tips: engage ecologists and taxonomists early, ensure survey protocols meet “exhaustive” or appropriate sampling standards (Schedule 1), assemble quantitative analyses where extinction probability is asserted, and secure institutional confirmation for voucher specimens.

B. Interacting with habitat conservation orders and certificates (regs 8, 10; Schedule 5 Forms 1-3)

1. Notices of habitat conservation orders

• Expect notices in the Form 1 format. Notices must include inspection details, submissions address and a closing date at least 30 days after receipt (Form 1). Monitor notices and calendar the submissions window; late notices or shortened windows can form procedural challenge points.

2. Applying for a certificate under s 65

• Use Form 2 (reg 10(1), Schedule 5). Provide a land description that allows ready identification: maps, title details, address and any plan identifiers. Include full name and contact details and sign the application.

• Anticipate administrative processing time with the Department. Form 3 will confirm whether land was or was not the subject of a habitat conservation order as at a stated date.

C. Preparing for licence, permit and authorisation processes (reg 9)

1. Anticipate mandatory decision considerations

• Decision-makers must take into account: the Act’s objectives; the category of threat; relevant action statements, critical habitat determinations, habitat conservation orders, management plans or public authority management agreements; the acceptability of impacts including long/short-term, beneficial/detrimental, direct/indirect, cumulative impacts and the impact of potentially threatening processes; and social and economic effects (reg 9(a)-(e)).

2. Build dossiers that address each criterion

• Submit technical assessments that quantify ecological impacts, including cumulative and indirect effects. If relevant, supply an action statement or a management plan that shows mitigation.

• Include social and economic impact statements and any evidence of benefits or costs to stakeholders, because reg 9(e) requires decision-makers to consider these effects.

3. Documentation for mitigation and offsets

• Where mitigation is proposed, document the effectiveness and timeframes of measures, and how they interact with any relevant action statements or habitat conservation orders referred to in reg 9(c). Decision-makers will weigh these against the acceptability of impacts.

D. Administrative and procedural risk management

1. Provide complete and high-quality submissions

• Missing signatures, incomplete land descriptions, lack of voucher specimen evidence, or failure to attach necessary maps or quantitative analyses are procedural defects that can delay consideration or lead to rejection.

2. Anticipate discretionary tests and be explicit

• When relying on “any other circumstance” or “special need” arguments, set out the reasoning explicitly and reference comparable precedents or scientific literature to help the Committee exercise its satisfaction standard. Describe survey methodologies, effort, and constraints to pre-empt challenges about adequacy.

3. Keep records and institutional confirmations

• Maintain copies of submissions, deposition confirmations for vouchers, and correspondence with the Department. These records are necessary if an administrative decision is challenged or if follow-up information is requested.

4. Seek early engagement with decision-makers

• Where activities may be affected by listing or habitat conservation orders, engage with the Department early to clarify expectations, timelines, and what management agreements or action statements might be relevant.

5. Legal review for complex cases

• For high-stakes nominations or where livelihoods or significant economic activities are affected, obtain legal advice to ensure procedural protections are observed and to plan for potential reviews or appeals under administrative law.

Complying with the Regulations means aligning scientific evidence, administrative forms and submissions with the precise wording and thresholds set out in Schedules 1-4 and Schedule 5 forms. Early planning, use of subject-matter experts, precise land and taxonomic descriptions, and explicit socio-economic analysis where relevant will reduce procedural risk and improve the likelihood that nominations and applications are accepted and processed efficiently.
