62C Proceedings for contravention (1) While an enforceable undertaking is in force, a proceeding may not be brought for any offence constituted by the contravention or alleged contravention of this Act or the regulations in respect of which the enforceable undertaking is given. (2) If a person withdraws an enforceable undertaking before the undertaking has been fulfilled, proceedings may be brought for any offence constituted by the contravention or alleged contravention in respect of which the enforceable undertaking was given. (3) If a person complies with the requirements of an enforceable undertaking, no further proceedings may be brought for an offence constituted by the contravention or alleged contravention in respect of which the enforceable undertaking was given.
