33 Defects in procedure (1) A person cannot bring an action in respect of a failure to comply with the procedure for making a habitat conservation order unless the person is substantially or materially disadvantaged by the failure. (2) A habitat conservation order or an amendment to a habitat conservation order is not made invalid by any failure to comply with the procedure for making or amending a habitat conservation order. (3) A person may apply to the Tribunal for review of a decision to make a habitat conservation order if that person is substantially or materially disadvantaged by a failure to comply with the procedure for making the order.
