What it does
This Act alters the legal status and management framework for a specified parcel of Crown land in the Parish of Doutta Galla, by revoking an 1886 permanent reservation, confirming a separate 1889 permanent reservation as a public park, confirming an historic Crown grant, declaring the City of Melbourne corporation to be the committee of management, and authorising limited leasing of a hatched portion of the land for bowling-related uses.
Mechanically, the changes are these. Section 2 revokes the Order in Council dated 30 December 1886 that related to the land described in the Crown grant recorded at Office of Titles volume 2441 folium 488130, and confirms the Order in Council dated 30 September 1889 that permanently reserves that land as a site for a public park (s 2). Section 3 confirms that Crown grant recorded at volume 2441 folium 488130 and declares it to be and to have always been valid and effectual according to its tenor (s 3). Section 4 declares that the corporation of the City of Melbourne is the committee of management for that land (s 4). Section 5 creates a statutory power for that corporation, notwithstanding any other Act, to grant leases of the whole or any part of the land delineated and shown hatched on the plan in the Schedule, for the purposes of a bowling green and amenities connected therewith including the erection of buildings (s 5(1)).
Leases under s 5 are subject to three statutory limits. First, the corporation can impose such covenants, conditions and reservations as it thinks fit (s 5(2)(a)). Second, any lease term is capped at 21 years (s 5(2)(b)). Third, leases require approval by the Governor in Council (s 5(2)(c)). Rents received under those leases must be applied by the corporation towards maintenance and improvement of any part of the land permanently reserved by the 30 September 1889 Order in Council that is not leased, or used for another purpose approved by the Minister (s 5(3)). Section 5(4) declares that no compensation shall be payable by the Crown in respect of any act, matter or thing done under or arising out of s 5.
