Fishing and Related Industries Compensation (Marine Reserves) Regulations 1998

The Regulations build on a small set of core administrative concepts and convert them into concrete procedural steps. Those concepts, as expressed in the Regulations and Form notes, are: prescribed time, application form, triggering event, eligible authorisation, entitlement to compensation, administrative decision and negotiated settlement, and access to the State Administrative Tribunal for review or determination.

Prescribed time: regulation 2 states the period that the Act references at s 5(7) is 30 days. The Regulations thereby fix a time limit that will be applied in the Act’s unspecified procedural context. The Form notes also contain multiple time prescriptions: an applicant must lodge within the period specified in the Minister’s notice of the event (note 1); the Minister has 30 days to decide entitlement after receiving the application (note 2); after the Minister advises entitlement or after the Tribunal determines entitlement, the parties have 60 days to negotiate an amount before either may apply to the Tribunal to determine amount (note 2); and appellate or review applications to the Tribunal generally must be made within 21 days of the relevant decision or expiration (note 2).

Application form and substantial compliance: regulation 3(1) prescribes Form 1 in Schedule 1 as the required application form; regulation 3(2) preserves administrative discretion by allowing an application to be dealt with even if it has not been made “substantially in the prescribed form”. The Form requires the applicant to specify the authorisation, the triggering event, the dollar amount claimed and the method of calculation.

Triggering events: Schedule 1 note 4 lists specific statutory or regulatory changes that may trigger a compensation claim. These are drafting references to other instruments and are expressed in the Regulations themselves: the coming into operation of section 10 of the Acts Amendment (Marine Reserves) Act 1997; an order under s 13(1) of the Conservation and Land Management Act 1984 constituting or adding to a marine nature reserve or marine park; an amendment or substituted management plan under Division 1 of Part V of the Conservation and Land Management Act 1984 that makes renewal of an authorisation inconsistent with a management plan; and the classification of an area of a marine park under s 62 of the Conservation and Land Management Act 1984 as sanctuary, recreation or certain special purpose areas where a specified commercial activity is declared incompatible with a conservation purpose.

Eligible authorisations: Schedule 1 note 3 enumerates the classes of authorisations by reference to licensing and leasing categories, listing aquaculture leases and licences, commercial fishing licences, fishing boat licences, fish processor licences, managed fishery licences, interim managed fishery permits, farm leases, hatchery licences and permits, and pearling licences and permits. The Regulations therefore limit applicants to holders of those defined categories.

Entitlement and compensation measurement: the Regulations adopt the language “you are entitled to fair compensation for any loss suffered as a result of the event” (note 5). The Regulations do not define “fair” or specify a valuation methodology; instead they embed an administrative negotiation process with fallback to adjudication by the State Administrative Tribunal for either entitlement (if Minister fails to advise within prescribed periods or decides entitlement negatively) or amount (if parties cannot agree within the specified negotiation window).

Administrative decision versus adjudicative review: the Minister for Fisheries is the decision-maker and negotiating counterparty under the Regulations (Form and notes). The State Administrative Tribunal is the adjudicative backstop: applicants may seek review of a negative entitlement decision and either party may seek Tribunal determination of the amount if negotiations do not settle it within the negotiation window. The Tribunal time limits and pathways are set out in the Form notes rather than by reference to Tribunal rules, so the Regulations intentionally integrate administrative timelines with Tribunal review windows.

Collectively these concepts convert statutory triggers created elsewhere into an administrative claim-pathway: applicant identifies an authorisation and an event listed in note 4, lodges Form 1 within the notice period, the Minister decides within 30 days and negotiates amount where entitlement exists, and unresolved questions may be presented to the State Administrative Tribunal within prescribed windows.

The Regulations directly affect three categories of actors: holders of the specific authorisations listed in Schedule 1 note 3; the Minister for Fisheries (and the administrative staff who process and negotiate compensation claims); and the State Administrative Tribunal, which is established as the review and dispute resolution forum for entitlement and compensation amount disputes. The Regulations also indirectly affect third parties with commercial interests dependent on those authorisations, such as employers, lessees or investors whose income or investment value may be implicated in a claim, but the Regulations themselves are addressed to the applicant and the Minister.

Applicant profile: Schedule 1 note 3 specifies the exact classes of authorisations whose holders may apply for compensation. The list comprises twelve categories: (a) aquaculture lease; (b) aquaculture licence; (c) commercial fishing licence; (d) fishing boat licence; (e) fish processor’s licence; (f) managed fishery licence; (g) interim managed fishery permit; (h) farm lease; (i) hatchery licence; (j) hatchery permit; (k) pearling licence; and (l) pearling permit. The Regulations therefore confine access to the compensation pathway to persons holding those enumerated authorisations; the Regulations do not extend the right to apply beyond that list.

Triggering events and affected operations: Schedule 1 note 4 identifies the events that generate claims, and all are tied to marine reserves and related conservation planning instruments. They are: the coming into operation of s 10 of the Acts Amendment (Marine Reserves) Act 1997; the coming into operation of an order under s 13(1) of the Conservation and Land Management Act 1984 that constitutes or adds to a marine nature reserve or marine park; the coming into operation under Division 1 of Part V of the Conservation and Land Management Act 1984 of an amendment to, or substituted, a management plan so that renewal of an authorisation would no longer be consistent with that management plan; and the classification of an area of a marine park under s 62 of the Conservation and Land Management Act 1984 as a sanctuary area, a recreation area, or a special purpose area (or part of it) where the Minister for the Environment has declared in the notice that a specified commercial activity would be incompatible with a specified conservation purpose. Those events connect regulatory change in other statutes to the compensation mechanism in the Act and the Regulations.

Minister as decision-maker and negotiating counterparty: the Minister for Fisheries is the addressee of applications (r 3(1) and Form 1 heading). Schedule 1 note 2 makes clear the Minister must decide within 30 days whether the applicant is entitled and must advise the applicant in writing; where entitlement is recognised the Minister must conduct negotiations with the applicant with a view to settling the amount and enter into an agreement if the parties agree. Consequently the practical implementation burden , decision-making, negotiation, agreement drafting and payment (if any) , sits with the Minister’s office.

State Administrative Tribunal: the Regulations provide applicants with access to the State Administrative Tribunal for two types of actions: review of a Ministerial decision that the applicant is not entitled to compensation; and determination of the amount of compensation if negotiations fail to produce agreement within 60 days of advice that the applicant is entitled or of a Tribunal determination of entitlement. The Regulations prescribe time limits for these Tribunal steps (note 2). Thus the Tribunal becomes the standing adjudicative forum for unresolved entitlement and amount disputes arising under the Act and Regulations.

Publication and notice: the applicant must make the application “within the period specified in the notice of the event published by the Minister for Fisheries” (Form note 1). That links liability to apply with the Minister’s publication practice: who is affected depends on whether the Minister publishes notice, the content of that notice, and the period specified in that notice.

Secondary stakeholders: while not mentioned explicitly, entities such as accountants, valuers, legal advisers and industry organisations will be economically affected as claimants and respondents prepare valuations, legal arguments and negotiations. The Regulations mandate an information field in the Form describing “the manner in which amount of compensation claimed was calculated” which will invite evidentiary material, valuation methodology and financial records from applicants.

Geographical and temporal scope: the Regulations are targeted at events creating marine reserves or classifications under the Conservation and Land Management Act 1984 and at the specific categories of authorisations. They are not framed as universally applicable compensation rules for all regulatory change in fisheries law; their scope is bounded by the triggering events listed in note 4 and the authorisations in note 3.

The Regulations allocate particular duties to the applicant and to the Minister for Fisheries and create specific rights for the applicant, including access to the State Administrative Tribunal. The duties and rights are procedural and confined to the claims pathway under the Act.

Duties of the applicant

• Lodge within prescribed windows: an application must be made within the period specified in the notice of the event published by the Minister for Fisheries (Schedule 1, note 1). The Regulations do not define the content or length of that notice period; it is whatever the Minister specifies in the published notice.
• Use the prescribed form: regulation 3(1) prescribes the Form 1 in Schedule 1. The applicant must provide identifying information, details of the authorisation held, the event on which the claim is based, the dollar amount claimed and the manner of calculating that amount (Form 1).
• Provide a calculation method and supporting particulars: the Form requires the applicant to state “Manner in which amount of compensation claimed was calculated”, which creates an evidentiary expectation that the applicant sets out the basis of the claimed loss.
• Observe Tribunal time limits: where Tribunal review is sought (for either entitlement or amount), the applicant must observe the 21‑day time limits specified in Schedule 1 note 2 to maintain standing for review.

Duties of the Minister

• Decision duty within 30 days: Schedule 1 note 2 requires the Minister to decide within 30 days after receiving the application whether or not the applicant is entitled to compensation under the Act and to advise the applicant in writing of that decision.
• Negotiation duty where entitlement exists: if the Minister decides the applicant is entitled, or the Tribunal determines entitlement, the Minister must conduct negotiations with the applicant with a view to settling the amount of compensation.
• Contracting duty if agreement reached: if the Minister and applicant agree on an amount, the Minister “must enter into an agreement with you setting out the terms of the agreement” (Schedule 1 note 2).

Rights of the applicant

• Right to apply: holders of the enumerated authorisations have the right to apply for compensation when one of the listed events occurs (Schedule 1 notes 3 and 4).
• Right to “fair compensation”: Schedule 1 note 5 states applicants are “entitled to fair compensation for any loss suffered as a result of the event on which the claim for compensation is based.” The Regulations do not define “fair compensation”; the term anchors an expectation that compensation will aim to make good loss.
• Right to negotiate and agree: where entitlement is found (by Minister or Tribunal), the applicant has the right to negotiate with the Minister about the amount and, if agreed, to have the agreement entered into by the Minister (Schedule 1 note 2).
• Right to Tribunal review and determination: the applicant may apply to the State Administrative Tribunal to review a negative entitlement decision of the Minister (within 21 days of advice) and may apply to the Tribunal for determination of compensation amount if negotiations do not resolve the matter within 60 days of advice that the applicant is entitled or of a Tribunal determination (Schedule 1 note 2). Additionally, if the Minister fails to advise the applicant within the 30‑day decision period, the applicant may apply to the Tribunal to determine whether they are entitled to compensation (note 2).

Discretion and substantial compliance

• The Regulations confer administrative discretion by allowing an application to be “dealt with” even if it has not been made substantially in the prescribed form (r 3(2)). This grants the Minister operational flexibility to accept imperfect submissions but does not prescribe the scope of that discretion.

Limits and omissions

• No valuation methodology mandated: the Regulations require a statement of the manner in which the amount is calculated but do not prescribe a valuation method, source, discounting approach or entitlement formula.
• No payment mechanism specified: while the Minister must enter into an agreement if an amount is agreed, the Regulations do not specify the funding source, payment timing, or enforcement mechanism for payment beyond the agreement itself.
• No criminal or pecuniary penalties created: the Regulations do not impose fines or criminal sanctions; enforcement is by administrative decision and Tribunal review.

Collectively the duties and rights establish a structured claim pathway: applicant files Form 1 within the notice period; Minister decides within 30 days; if entitlement found, parties negotiate; unresolved entitlement or amount may be litigated before the State Administrative Tribunal within the prescribed windows.

The Regulations do not create criminal offences, monetary penalties, or enforcement powers beyond administrative decision-making and referral to the State Administrative Tribunal. Enforcement under the Regulations is procedural and adjudicative rather than penal.

No new offences or fines: the text of the Regulations (rr 1-3 and Schedule 1) contains no provisions establishing criminal liability, administrative fines, licence cancellation powers, or infringement notice regimes. The Regulations are limited to procedural requirements for making and processing compensation applications.

Administrative enforcement path: enforcement of the rights and duties established by the Regulations is achieved through administrative obligations upon the Minister and recourse to the State Administrative Tribunal:

• Ministerial obligations: the Regulations require the Minister to decide on entitlement within 30 days after receiving an application and to advise the applicant in writing (Schedule 1 note 2). If entitlement is recognised, negotiation and agreement duties apply (Schedule 1 note 2). The duty to enter into an agreement where parties agree is mandatory: “the Minister must enter into an agreement with you setting out the terms of the agreement” (note 2).
• Tribunal as enforcement and adjudicative backstop: the State Administrative Tribunal is prescribed as the forum for review and determination. If the Minister advises that the applicant is not entitled, the applicant may apply to the Tribunal for review of that decision within 21 days (Schedule 1 note 2). If the Minister fails to advise within the 30‑day decision period, the applicant may apply to the Tribunal to determine entitlement, and such an application must be made within 21 days of expiry of the Minister’s decision period (note 2). For amounts, if the parties do not enter into an agreement within 60 days of advice of entitlement, either the applicant or the Minister may apply to the Tribunal for a determination of amount (note 2). Thus the Tribunal enforces compliance by determining disputed questions of entitlement and amount where administrative process does not produce agreement.

Time-limited rights as enforcement risk: the Regulations set strict time limits for moving disputes to the Tribunal. Missing those time limits is a procedural risk that can foreclose Tribunal review or determination. The Form notes require Tribunal applications to be lodged within 21 days of receiving advice or within 21 days of the expiry of the Minister’s decision period. For amounts, either party’s right to apply to the Tribunal arises only after the 60‑day negotiation window has expired. These time constraints act as a procedural enforcement mechanism: rights are preserved only where deadlines are observed.

Discretionary handling of non‑compliant forms: regulation 3(2) gives the Minister a discretion to deal with applications that are not substantially in the prescribed form. That discretion can operate as an informal enforcement filter: defective applications may be accepted or rejected at the Minister’s discretion, and the Regulations do not provide an appeals route specifically to challenge the Minister’s exercise of that discreet discretion beyond the general Tribunal review rights on entitlement and amount. However, where a defective form is treated as conforming and processed, the same substantive time limits and Tribunal rights apply.

No express remedies for Minister non‑compliance: the Regulations require the Minister to decide and advise within 30 days, but they do not set out specific statutory consequences for Ministerial failure other than the applicant’s ability to apply to the Tribunal after the expiration of the decision period (Schedule 1 note 2). The Regulations therefore rely on Tribunal review as the primary remedy for administrative non‑performance or contested decisions.

In summary, enforcement under the Regulations is channeled through administrative deadlines, negotiation obligations, and Tribunal review and determination. There are no express penalties for non‑compliance beyond the availability of judicial/administrative review through the Tribunal, and the Regulations emphasise procedural time limits that applicants and the Minister must observe to preserve rights.

The Regulations are explicitly structured to operate in close conjunction with the Fishing and Related Industries Compensation (Marine Reserves) Act 1997 (the Act) and with several provisions of the Conservation and Land Management Act 1984 and the Acts Amendment (Marine Reserves) Act 1997. The Regulations do not alter substantive provisions of those Acts; they supply procedural detail and reference points that make the compensation pathway functional.

Direct link to the Act: regulation 2 is framed “for the purpose of section 5(7) of the Act” and regulation 3 prescribes the form and handling of applications “under section 7(1)” of the Act. Thus the Regulations operate as subordinate legislative instruments that give effect to procedural requirements in the Act by setting concrete timeframes and forms. The text of the Act itself is not reproduced in the Regulations, but the Regulations assume the existence of s 5(7) and s 7(1) and set out how those provisions will be implemented administratively.

References to marine reserves legislation: Schedule 1 note 4 lists the events that support a claim and these are defined by reference to other statutes:

• The coming into operation of section 10 of the Acts Amendment (Marine Reserves) Act 1997;
• The coming into operation of an order under s 13(1) of the Conservation and Land Management Act 1984 constituting or adding to a marine nature reserve or marine park;
• The coming into operation under Division 1 of Part V of the Conservation and Land Management Act 1984 of an amendment to a management plan or a substituted management plan so that renewal of an authorisation would no longer be consistent with a management plan;
• The classification of an area of a marine park by notice under s 62 of the Conservation and Land Management Act 1984 as a sanctuary area, recreation area or certain special purpose areas with a declaration that specified commercial activity is incompatible with the conservation purpose.

These cross‑references mean that the Regulations will be engaged only when the listed external statutory events occur. The Regulations do not create those events; they respond to them by providing a claims mechanism. Consequently, any substantive tests, definitions or thresholds for creating marine reserves, classifying areas or changing management plans remain governed by the referenced Acts; the Regulations simply provide the administrative procedure by which persons affected by those Acts may claim compensation under the Act.

Integration with the State Administrative Tribunal: the Regulations incorporate the State Administrative Tribunal’s jurisdictional role by providing timeframes and rights to apply to the Tribunal for review of entitlement or determination of amount. The Regulations thus operate with the Tribunal’s statutory role and procedures: they do not displace the Tribunal but set the windows in which Tribunal applications must be lodged in relation to decisions and negotiation timeframes under the Act and Regulations.

Interaction with Gazette practice and reprints: the compilation table and the reprint notes indicate that the Regulations have been subject to amendment and reprinting under the Reprints Act 1984. The Schedule 1 amendments are recorded as Gazette notices (Gazette 30 Dec 2004 p. 6967-8; reprint as at 15 Dec 2006). That demonstrates the Regulations’ interaction with general statutory procedures for amendment, gazettal and reprint, which affect how forms and notes are updated and how practitioners locate the current form.

Absence of interaction with licensing or payment statutes: the Regulations require the Minister to enter into an agreement when the parties agree on the amount, but they do not reference other statutes that might control payment sources, compensation account management, or budget appropriations. The Regulations therefore interact with other laws only to the extent that those laws define the triggering events and provide the Tribunal jurisdiction; they do not specify funding mechanisms or payment enforcement provisions that might exist elsewhere.

In short, the Regulations are procedural instruments that sit as subordinate law to the Act and that reference marine reserves and management plan provisions in the Conservation and Land Management Act 1984 and the Acts Amendment (Marine Reserves) Act 1997. They rely on those statutes to create compensable events and on the State Administrative Tribunal to resolve disputes about entitlement and amount.

The Regulations’ official compilation information is included in the text and shows a short amendment history and a reprint. The key documentary events are listed in the compilation table and in in‑text amendment notes to Schedule 1.

Original instrument and commencement

• The Fishing and Related Industries Compensation (Marine Reserves) Regulations 1998 were gazetted on 28 August 1998 (Gazette p. 4745-7) and commenced on that date, as recorded in the compilation table.

2004 amendment

• The Regulations were amended by the Fishing and Related Industries Compensation (Marine Reserves) Amendment Regulations 2004, gazetted 30 December 2004 (p. 6967-8). The compilation table records that the amendment commenced on 1 January 2005 (see r. 2 and Gazette 31 Dec 2004 p. 7130). The in‑text note following Schedule 1 states “Schedule 1 amended: Gazette 30 Dec 2004 p. 6967-8.” The 2004 amendment therefore modified Schedule 1, which contains the application Form and its notes.

Reprint

• A reprint of the Regulations was prepared: Reprint 1 is the Fishing and Related Industries Compensation (Marine Reserves) Regulations 1998 as at 15 December 2006 and includes the 2004 amendments. The reprint note at the end of the document states this compilation date and records that the reprint includes the amendments listed in the compilation table.

What the amendments show

• The only amendment recorded in the supplied compilation material is the December 2004 change to Schedule 1. The text does not include a Schedules comparison, so the specific words changed in 2004 are not identified within this supplied version beyond the note that Schedule 1 was amended. The reprint as at 15 December 2006 incorporates any such changes, and the current Schedule 1 and Form contained in this reprint are the operative text for the form and procedural notes.

No further amendment history in this text

• The compilation table in the supplied material lists only the original 1998 Regulations, the 2004 Amendment Regulations and the 2006 reprint. The Regulations as provided do not record any additional amendments, revocations or consequential changes beyond that.

Practical consequence for practitioners

• Because the Schedule 1 Form and notes were amended by instrument in 2004 and reprinted in 2006, practitioners must be sure to rely on the reprinted/last amended version for the current content of the Form and the procedural notes. The Regulations include the formal citation provision (r 1) and the reprint references which should be used when citing or referring to the operative version.

The amendment history in the supplied material is therefore brief and confined to a single formal amendment to Schedule 1 in 2004 and the subsequent reprint in 2006. The Regulations’ substantive framework , prescribed time, application form, the list of authorisations and triggering events, negotiation and Tribunal pathways , remains the structure reflected in the reprinted text.

The Regulations themselves, as supplied, do not contain or cite any reported litigation, decisions or caselaw. The text includes procedural pathways that anticipate adjudication (before the State Administrative Tribunal) but the supplied instrument contains no record of any Tribunal or court decisions applying or interpreting the Regulations.

Tribunal pathway present but no cases recorded here

• Schedule 1 note 2 provides a detailed procedural route for applicants to apply to the State Administrative Tribunal (SAT) for review of a Ministerial decision on entitlement or for a determination of the amount of compensation. The Regulations embed Tribunal access within the timeframes specified, but they do not supply Tribunal rules, decisions or precedent. There are no judicial or administrative decisions included in the Regulations’ compilation text.

Implication for research

• To locate litigation history or interpretive guidance, a practitioner will need to consult external sources: State Administrative Tribunal determinations, published decisions, or case law databases. The Regulations’ text alone does not supply precedents or examples of how the Tribunal has applied “fair compensation”, how it has interpreted the 30‑day, 60‑day and 21‑day windows, or how it has handled disputes about whether a management plan change renders renewal inconsistent. The Regulations set the process and time limits to get a matter before the Tribunal but do not define substantive valuation principles, which would typically arise in adjudicative decisions.

No statutory references to cases or precedents

• The Regulations do not reference any decisions or indicate interpretive direction by courts or tribunals. They are a procedural instrument; any interpretive or substantive gloss would come from subsequent Tribunal decisions or judicial review proceedings, none of which are reproduced in this text.

Practical note for litigators and advisers

• Practitioners should anticipate that the State Administrative Tribunal will be the forum where ambiguous terms such as “fair compensation” and the scope of “loss suffered” will be litigated, and where factual determinations about whether renewal of an authorisation would be “consistent with a management plan” will be made. The Regulations set the jurisdictional and procedural thresholds for getting a dispute before the Tribunal but provide no litigation history to guide outcome prediction; obtaining SAT decisions or other records will be necessary to understand how those thresholds have been applied in practice.

In short, the Regulations establish the procedural framework for Tribunal engagement but the supplied text contains no litigation history or case law; researchers must look to Tribunal and court databases to find decisions that interpret or apply the Regulations.

Several procedural and substantive features of the Regulations present traps for the unwary. These are not value judgments but concrete implementation and timing risks, discretion points and evidentiary expectations evident in the Regulations and Form notes.

Multiple and overlapping time limits

• Different 21‑day, 30‑day and 60‑day periods apply at different stages. The applicant must lodge within the period specified in the Minister’s published notice of the event (Schedule 1 note 1). Separately, the Minister has 30 days after receiving the application to decide and advise whether the applicant is entitled (note 2). If the Minister decides the applicant is not entitled, the applicant has 21 days from the day the advice is received to apply to the State Administrative Tribunal for review (note 2). If the Minister does not advise the applicant within the 30‑day decision period, the applicant may apply to the Tribunal but only within 21 days after the expiration of that decision period (note 2). For refusal by either party to agree on amount, the parties have a 60‑day negotiation window after advice of entitlement (or Tribunal determination) before either may apply to the Tribunal for determination of amount (note 2). Missing any one of these windows can foreclose an applicant’s procedural rights.

Ambiguity over which “period specified in the notice” applies

• Schedule 1 note 1 requires the application to be “made within the period specified in the notice of the event published by the Minister for Fisheries,” but it does not specify how long that notice period will be or what happens if the notice fails to specify a period. Practitioners must ensure they obtain the specific notice and determine the deadline stated in it. In the absence of that notice, other timeframes in the Regulations may interact with or supplant the deadline, but the Regulations themselves do not resolve such gaps.

Substantial compliance discretion

• Regulation 3(2) allows an application to be dealt with even if it is not substantially in the prescribed form. That creates a discretionary acceptance mechanism but also uncertainty. There is no definition in the Regulations of what “substantially in the prescribed form” means, which may cause contested decisions whether an application is receivable. Applicants should therefore aim for strict compliance, but may be able to rely on Ministerial discretion if technical errors occur.

“Fair compensation” undefined

• Schedule 1 note 5 states applicants are entitled to “fair compensation” for loss suffered, but the term is not defined and no valuation methodology is prescribed. The absence of a statutory valuation methodology means parties should expect valuation disputes and probably Tribunal determinations on what constitutes fair compensation in particular factual matrices.

Negotiation window and strategic timing

• The Regulations give a 60‑day window for negotiation of the amount after the Minister’s advice of entitlement or after Tribunal determination of entitlement (note 2). If an agreement is not reached within that 60‑day period, either party may apply to the Tribunal for determination of amount. Parties may use this window strategically: applicants may delay or accelerate negotiation, and the Minister’s office may do likewise. Those strategic considerations interact with the Tribunal’s caseload and with evidence-gathering and valuation preparation timelines.

Ministerial non‑action and remedies

• If the Minister fails to advise within 30 days, Schedule 1 note 2 allows the applicant to apply to the Tribunal to determine entitlement, but the applicant must do so within 21 days of the expiry of the decision period. Practically this means applicants must monitor the Minister’s 30‑day decision deadline and be ready to file quickly if no advice arrives. Failure to do so can forfeit Tribunal review rights.

Evidentiary expectation in the Form

• The Form requires the applicant to set out the “manner in which amount of compensation claimed was calculated.” While regulation 3(2) provides some breathing room for form defects, omission of a calculation method or supporting figures may weaken the applicant’s position in negotiation or Tribunal proceedings. Practitioners should ensure that the Form is supported by contemporaneous evidence and clear methodology.

Scope limited to listed authorisations and events

• The Regulations explicitly list the types of authorisations (note 3) and the events that give rise to claims (note 4). If an applicant’s authority or the triggering event falls outside those lists, the Regulations provide no pathway. There may be borderline situations (for example, modifications to authorisations or to management plans) where whether an authorisation qualifies or an event is included may be contested.

No payment funding mechanism specified

• While the Minister must enter into an agreement if an amount is agreed, the Regulations do not set out payment sources, timing or enforcement procedures for payment of compensation. Parties reaching agreement should therefore ensure the agreement addresses payment mechanisms, timing, offsetting, taxation consequences and enforcement.

Form amendments and version control

• Schedule 1 was amended in 2004 and the Regulations were reprinted in 2006. Practitioners must ensure they are using the current Form and the current text of the Notes. Filing the wrong version may create procedural disputes.

Operational bottlenecks in Minister’s office

• The Minister’s duty to decide within 30 days and to negotiate places administrative work on the Minister’s office. If the office is under-resourced or if multiple claims arise from the same event, delays in advising or negotiation could be frequent. The Regulations provide an applicant a Tribunal escape hatch if the Minister fails to advise in 30 days, but that escape hatch itself has tight filing deadlines.

Taken together, these “gotchas” are largely procedural. They turn on strict observance of the multiple and interlocking time limits, clear documentation of loss and calculation methodology, careful identification that the applicant and the event fall within the enumerated lists, and contingency planning in case the Minister fails to decide or negotiations stall.

The Regulations prescribe a concise set of steps and documentary expectations. The following compliance checklist is directly grounded in the Regulations and Form notes and focuses on actions that preserve rights, meet procedural deadlines and prepare a robust claim.

1. Confirm eligibility and triggering event

• Check that you hold one of the authorisations listed in Schedule 1 note 3 (aquaculture lease, aquaculture licence, commercial fishing licence, fishing boat licence, fish processor’s licence, managed fishery licence, interim managed fishery permit, farm lease, hatchery licence, hatchery permit, pearling licence or pearling permit).
• Verify that the event giving rise to the claim is one of those listed in Schedule 1 note 4: the specified section of the Acts Amendment (Marine Reserves) Act 1997, an order under s 13(1) of the Conservation and Land Management Act 1984 constituting or adding to a marine nature reserve or marine park, a management plan amendment or substitution under Division 1 of Part V of the Conservation and Land Management Act 1984 that makes renewal inconsistent, or a classification under s 62 of the Conservation and Land Management Act 1984 that declares a commercial activity incompatible with a conservation purpose.

2. Obtain and read the Minister’s published notice

• The Form notes require the application to be made “within the period specified in the notice of the event published by the Minister for Fisheries” (Schedule 1 note 1). Locate the published notice, read it carefully, and note the exact period specified in that notice for lodging applications. Do not rely on assumptions about the notice period.

3. Complete Form 1 fully and accurately

• Use Form 1 in Schedule 1 as the prescribed form (r 3(1)). Provide full identifying details, the details of the authorisation held, a clear statement of the event on which the claim is based, the dollar amount claimed and a clear, documented “manner in which amount of compensation claimed was calculated.” Even though r 3(2) allows discretion for forms not substantially in the prescribed form, strict compliance reduces risk of rejection or delay.

4. Assemble supporting evidence

• The Regulations require a statement of how the claim amount was calculated. Support that statement with contemporaneous financial records, licence documents, revenue and expense histories, valuation reports, expert reports (if used), and any correspondence or notices that show the causal link between the triggering event and the claimed loss. Retain copies of the Minister’s notice of the event and any relevant management plan or classification documents referred to in note 4.

5. Lodge the application and track receipt date

• Lodge the completed Form within the period specified in the Minister’s notice. Record the date the Minister receives the application (this triggers the Minister’s 30‑day decision obligation under Schedule 1 note 2). Use methods that give clear proof of receipt (registered post, recorded delivery, or official lodgement receipts).

6. Monitor the 30‑day decision period and be ready to act

• After the Minister receives the application, the Minister must decide within 30 days whether the applicant is entitled and advise in writing (Schedule 1 note 2). If the Minister does not advise within that 30‑day period, you have a 21‑day window from expiry to apply to the State Administrative Tribunal to determine entitlement. If the Minister advises that you are not entitled, you have 21 days from receipt of that advice to apply to the Tribunal for review. Prepare to file promptly if no advice is received, or if a negative decision is made.

7. Be prepared to negotiate

• If the Minister decides you are entitled, the Minister “must conduct negotiations with you with a view to settling the amount of the compensation” and, if agreed, must enter into an agreement (Schedule 1 note 2). Be prepared for negotiations and time your valuation evidence and expert reports so that they are available during the negotiation window. Ensure any agreement explicitly addresses payment timing, payment source, interest, tax treatment, release language and enforcement.

8. Prepare for Tribunal determination of amount if negotiations stall

• If an agreement on amount is not entered into within 60 days of advice that you are entitled (or of a Tribunal determination of entitlement), either you or the Minister may apply to the Tribunal for a determination of amount (Schedule 1 note 2). Prepare a Tribunal-ready case by collating valuation reports, financial evidence and legal submissions during the negotiation window so that an application can be filed immediately after the 60‑day negotiation period, if necessary.

9. Preserve records of all communications and timelines

• Keep meticulous records of dates, notices, communications, lodgement receipts, and any interim offers or negotiations. That documentation will support Tribunal applications and will be essential to demonstrate compliance with the Regulations’ time limits.

10. Use legal and valuation advice where appropriate

• The Regulations require a calculation method to be provided and they leave “fair compensation” undefined. Consider engaging legal counsel and valuation experts early in the process to prepare the methodology and evidence likely to support a fair compensation claim before negotiations or Tribunal proceedings begin.

11. Check version and amendments of Form 1

• The Schedule 1 Form was amended in 2004 and incorporated in the 2006 reprint. Ensure you use the current, reprinted form as included in the Regulations or as published by the Minister to avoid version disputes.

12. If the Minister exercises discretion about form or timing, preserve objections

• If the Minister declines to accept an application on the basis that it is not substantially in the prescribed form, or if the Minister purports to reject it for lateness despite contrary evidence, preserve contemporaneous objections in writing. Where the Minister’s conduct affects entitlement or the ability to apply to the Tribunal, the Tribunal review route in the Regulations will be the mechanism for resolution.

Following these steps aligns practice with the Regulations’ procedural framework: confirm eligibility, use the prescribed form, present a clear calculation and evidence, meet the multiple time limits, negotiate in the prescribed timeframes and be ready to seek Tribunal review or determination where the Minister either fails to decide, refuses entitlement, or negotiations fail within the 60‑day window.
