27 Scallop survey period

(1)  [Rule 27 Subrule (1) amended by S.R. 2025, No. 10, Applied:09 Apr 2025] [Rule 27 Subrule (1) amended by S.R. 2025, No. 10, Applied:09 Apr 2025] The Minister, by published notice, may determine any specified area of State waters to be open to the commercial scallop fishery for the conduct of a scallop survey for such period as is specified in the published notice.

(2)  [Rule 27 Subrule (2) amended by S.R. 2025, No. 10, Applied:09 Apr 2025] The Minister may make a determination under subrule (1) subject to such conditions as the Minister thinks fit and as are specified in the published notice.

(3)  [Rule 27 Subrule (3) amended by S.R. 2025, No. 10, Applied:09 Apr 2025] If the Minister makes a determination under subrule (1) , the holder of a fishing licence (scallop) may conduct a scallop survey in the area subject to any conditions specified in the published notice.

(4)  Subrule (3) does not apply to the holder of a fishing licence (scallop) while the fishing licence (scallop) is deactivated.

(5)  The holder of a fishing licence (scallop) must comply with any conditions of a determination under subrule (1) .

Penalty:  Grade 3 penalty.
