Fisheries Management (Vongole Fishery) Regulations 2021

Key definitional and structural concepts in these Regulations determine how the fishery operates on a daily and annual basis. The central commodity unit is the vongole unit. Unit entitlement is the number of vongole units allocated to a licence (reg 3 definition). Unit value is the Minister-determined number of kilograms that equals one vongole unit for each vongole fishing zone and quota period (reg 3 definition; reg 9(2)). Vongole quota entitlement (or quota entitlement) for a licence in respect of a vongole fishing zone and quota period is the maximum number of kilograms that may lawfully be taken under that licence in that zone during the quota period; mathematically, it is the unit entitlement multiplied by the unit value, subject to later variations (reg 3 definition).

Quota period is defined as a 12 month period commencing on 1 July (reg 3 definition). The Minister must determine unit value on or before the commencement of each quota period (reg 9(2)), making quota allocation operable on an annual cycle where kilograms permitted change as the Minister sets unit value. The Regulations preserve a link to prior Marine Scalefish Fishery allocations by treating unit entitlement, vongole fishing zone and vongole quota entitlement in relation to the MSF as those terms were defined in regulation 14(1) of the Marine Scalefish Fishery Regulations 2017 immediately before the new Regulations commenced (reg 3(4)).

Spatial concepts matter: three named vongole fishing zones are specified with precise geodetic coordinates referenced to the Geocentric Datum of Australia 2020 (GDA2020) (reg 3(3)(a); definitions for Coffin Bay, Port River and West Coast vongole fishing zones). The Regulations instruct that all lines in spatial descriptions are geodesics based on GDA2020, so the precise geodetic framing is binding for enforcement and mapping (reg 3(3)(a)).

Licence-related concepts set eligibility and use. The Minister may issue licences in respect of the fishery, but applications are strictly limited to a closed pool: those who immediately before 1 July 2021 held an MSF licence subject to a vongole quota entitlement condition, unless that condition was imposed after the commencement of MSF quota period 2020-2021 and applied only during that balance, or transferees of a licence under these Regulations who apply before expiry (reg 5(1)-(2)). Licences are transferable (reg 6(1)), but transfers require Ministerial consent and documentation (reg 6(2)), and the Minister may only consent if specified conditions are met, including payment of fees, licence not suspended, no pending proceedings against the holder, and fit and proper person tests for natural persons and company directors (reg 6(3)(a)-(e)).

Operational and enforcement concepts include Ministerial determinations and the use of registered fish processors. The Minister can make determinations for the purposes of a regulation (reg 17(1)-(2)), and these are to be published on the Department’s website (reg 17(3)). The Regulations require that all vongole taken under a licence be delivered or consigned to a registered fish processor (reg 14). Catch and disposal activities are subject to Ministerially-determined requirements for weighing, storing, sealing, tagging, transporting, and accompanying documentation (reg 13(1)(c)). There are also specific controls on shore-based agents: where registered boats are used (reg 11) or where licences operate without registered boats (reg 12), principals must themselves be shore-attending and remain within 700 metres of the agent, and no more than two shore agents may be engaged at the same time (regs 11(2)-(3), 12(2)-(3)).

Sanction concepts are explicit and quantified: many breaches attract a maximum penalty of $5,000 and specified expiation fees (eg regs 9(7), 10, 11-12, 13, 14, 15), while record-keeping obligations in reg 16 carry a lower maximum penalty ($2,500) and expiation fee ($210). The Regulations create criminal offences for failure to comply with Ministerial determinations connected to reporting, catch and disposal, and periodic returns (regs 10, 13, 15).

Taken together, the main concepts form an annualised, spatially-delimited, licence-based quota system with centralised control over the kilogram-value of quota through Ministerial determination, and with detailed downstream requirements for recording, processor delivery and limited labour models for shore-based agents.

The Regulations affect a narrowly defined population directly, and a broader set of market and administrative actors indirectly. Directly affected persons are current licence-holders in a narrow transition cohort: those who immediately before 1 July 2021 held a Marine Scalefish Fishery licence that was subject to a vongole quota entitlement condition, and persons who are transferees of such licences under these Regulations (reg 5(2)). The pool of prospective new entrants is effectively closed by this eligibility restriction (reg 5(2)), because applications for a Vongole Fishery licence are limited to that group and to transferees who apply in time (reg 5(2)(b)).

Licence-holders and masters of registered boats are secondarily affected by operational obligations: they must comply with reporting and record-keeping requirements as determined by the Minister (regs 10, 13, 15, 16). The holder of a licence or registered master is subject to several specified offences and penalties, for example for failing to comply with Ministerial information requirements (reg 10), failing to meet catch and disposal recording and handling requirements (reg 13), and failing to deliver to a registered fish processor (reg 14).

Companies that wish to hold a licence (or acquire one by transfer) are affected by corporate documentation and fit-and-proper tests. A transfer application must be accompanied by a current company extract from ASIC if the transferee is a company (reg 6(2)(c)), and the Minister must be satisfied that each director is a fit and proper person to be a director of a company that holds such a licence (reg 6(3)(e)). Natural person transferees must be at least 15 years of age and fit and proper (reg 6(3)(d)). Transfers will be refused if fees or other amounts payable under the Act have not been paid, if the licence is suspended, or if proceedings alleging offences against the Act are pending or likely to be commenced against the holder (reg 6(3)(a)-(c)).

Registered fish processors are directly affected by reg 14, which requires that all vongole taken under a licence be delivered or consigned to a registered fish processor. The Regulations therefore create processor-facing flows of product and documentation; they also likely increase the administrative role of registered processors, who must accept consignments and handle accompanying information as determined by the Minister (regs 13(1)(c), 14).

Shore-based labour and contractors who act as agents are affected via limits in regs 11-12: licence-holders and registered masters are restricted in how they may engage agents on the shore , the principal must be present on the shore and remain within 700 metres, and at most two agents may be engaged at any one time. That restricts labour models for harvesting activities in each zone.

Administrative actors in the Department are affected by the Minister’s obligations to publish determinations on the Department’s website and to notify affected persons of determinations (reg 17(3)-(4)). Fisheries officers are implicated as enforcement agents: records must be produced for inspection by a fisheries officer on request (reg 16(c)), and breaches of reporting, record-keeping and handling obligations attract fines and expiation fees enforced under the Act and these Regulations.

Indirectly affected parties include buyers and downstream seafood markets, who face the practical consequence that licensed catch must be delivered to registered fish processors (reg 14). This may concentrate transactions in a subset of processors and alter market access. Insurers, financiers and vessel owners who provide services to licence-holders may be affected by transfer restrictions and the need for up-to-date corporate extracts and fit-and-proper assessments (reg 6).

Finally, the Regulations close off certain forms of commercial activity unless a licence carries a quota condition: reg 9(7) explicitly makes it an offence to take vongole for a commercial purpose in a vongole fishing zone unless the licence is subject to a condition fixing a vongole quota entitlement, with a maximum penalty of $5,000 and expiation fee $315. This places commercial activity squarely in the hands of quota‑conditioned licence-holders.

The Regulations set out specific duties for licence-holders, masters of registered boats, and persons involved in processing and consigning vongole. They also create rights and discretions in the Minister to make determinations, to vary quota entitlements and to consent to transfers. Below are the key duties and material rights created by the instrument, itemised and linked to the relevant provisions.

Duties of licence-holders and masters

• Eligibility and possession: licences may only be issued to prescribed classes (reg 5). Licence-holders who take vongole commercially must ensure their licence is subject to a condition fixing a vongole quota entitlement for the relevant zone (reg 9(7)). Taking commercially without such a condition is an offence (reg 9(7)).
• Reporting and notification: fishing activities involving vongole must be notified to the Department as determined by the Minister (reg 10(1)). Failure to comply with such a determination is an offence (reg 10(2)).
• Catch recording, handling and disposal: licence-holders or registered masters must record information about catch and disposal as determined by the Minister; provide recorded information to the Department; and ensure vongole are weighed, stored, placed in containers, sealed, tagged and transported, delivered, consigned or otherwise disposed of, and accompanied by information, in accordance with Ministerial requirements (reg 13(1)(a)-(c)). Non-compliance is an offence (reg 13(2)). Records must be kept as determined by the Minister (reg 13(3)).
• Delivery requirement: all vongole taken under a licence must be delivered or consigned to a registered fish processor (reg 14).
• Periodic returns: provide the Department with returns in the manner, form and times determined by the Minister, and keep records of each return (reg 15(1)-(2)).
• Record particulars: maintain records in good condition, legible, readily accessible and produce them for inspection by a fisheries officer on request (reg 16).

Duties relating to agents and shore work

• If registered boats are used, the licence‑holder or registered master must not cause or permit a person to be engaged on the shore as an agent unless the licence‑holder or registered master is also on the shore and within 700 metres (reg 11(2)(a)-(b)). No more than two shore agents may be engaged at once (reg 11(3)).
• If licences are used without registered boats, the licence‑holder must themselves be on the shore while agents operate and remain within 700 metres, and no more than two agents may be used (reg 12(2)-(3)).

Transfer and registration duties

• Applications for transfer must be accompanied by the licence to be transferred, a return form completed up to date (reg 6(2)(a)-(b)) and, if transferee is a company, a current ASIC company extract (reg 6(2)(c)). The Minister may consent only if fees are paid, licence not suspended, no pending proceedings, and transferee or directors are fit and proper persons (reg 6(3)).

Ministerial rights and discretions

• The Minister may issue licences subject to the eligibility constraints (reg 5).
• The Minister must determine unit value for each quota period and zone on or before commencement of the quota period (reg 9(2)).
• The Minister may impose or vary licence conditions to fix quota entitlements, allow reallocations of units between licences (on joint application) and vary entitlements to account for under-catch or over‑catch according to specified formulas and caps (reg 9(3)(a), (c)-(g)). The Minister can also increase entitlements to recompense licence‑holders who assisted research (reg 9(3)(h)).
• The Minister may make determinations for the purposes of the Regulations, including the form of notifications, returns, and the particulars of weighing, storing, sealing and tagging, and must publish determinations on the Department’s website and give notice to affected persons in a manner the Minister considers adequate (reg 17(1)-(4)). Determinations may be varied or revoked by further determination (reg 17(5)). Notably, reg 17 does not apply to determinations made for the purposes of reg 9 (reg 17(6)).

Rights

• Transferability: licences are transferable with Ministerial consent, and transferees who meet the statutory tests can acquire unit entitlements (reg 6(1)-(3)).
• Adjustment and compensation rights: licence-holders have a right to apply for variation of unit entitlements in specified ways, including joint applications between two licence-holders to reallocate units (reg 9(3)(c)-(d)), and may receive increases for under-catch up to statutory limits or for research assistance at the Minister’s discretion (reg 9(3)(e), (f), (h)).
• Administrative transparency: determinations must be published on the Department’s website and notice given to persons bound by them (reg 17(3)-(4)),a procedural right to be informed.

Sanction regime

• Penalties and expiation fees for non-compliance are specified at multiple points (regs 9(7); 10(2); 11-13; 14; 15-16). For example, many breaches carry a maximum penalty of $5,000 and expiation fees that vary by offence (regs 9(7), 10(2), 13(2), 14, 15(1)).

In short, the duty structure places the operational compliance burden on licence-holders and masters, while the Minister retains calculative control over unit values, entitlement variations and the particulars of reporting and handling through determinations and licence-condition variations.

The Regulations specify a mixture of criminal penalties and expiation fees for non-compliance with reporting, quota, handling, transfer and record‑keeping obligations. Enforcement is framed as an administrative-criminal mix, and the Regulations reference fisheries officers as the inspecting authority for records (reg 16(c)).

Penalties and expiation fees specified in the text

• Quota condition requirement: taking vongole for a commercial purpose in a vongole fishing zone without a licence subject to a condition fixing a vongole quota entitlement is an offence with a maximum penalty of $5,000 and expiation fee $315 (reg 9(7)).
• Failure to comply with Ministerial determinations to notify the Department about fishing activities involving vongole is an offence, maximum penalty $5,000, expiation fee $500 (reg 10(2)).
• Agent rules: causing or permitting shore agents in contravention of regs 11 or 12 carries maximum penalties of $5,000 and expiation fees of $315 (regs 11(2)-(3), 12(2)-(3)).
• Catch and disposal determinations: failing to record, provide, weigh, store, seal, tag, transport, deliver or consign vongole in accordance with Ministerial requirements is an offence; maximum penalty $5,000 and expiation fee $500 for non-compliance with Ministerial determinations under reg 13(2). Keeping required records improperly (reg 13(3)) carries a maximum penalty $5,000 and expiation $315.
• Delivery to registered fish processor: failing to deliver or consign all vongole to a registered fish processor is an offence with maximum penalty $5,000 and expiation fee $315 (reg 14).
• Periodic returns: failing to provide the Department with periodic returns as determined by the Minister, or failing to keep a record of each return for the period determined, are offences with maximum penalties of $5,000 and expiation fees of $500 (reg 15(1)-(2)).
• Record keeping general duty: a person required to keep a record must ensure it is legible, maintained in good condition, readily accessible and produced for inspection by a fisheries officer on request. Maximum penalty is $2,500, expiation fee $210 (reg 16).

Mechanisms of enforcement

• Inspection powers: reg 16 explicitly requires records to be produced for inspection by a fisheries officer on request (reg 16(c)). That provision creates the on-the-ground inspection mechanism for verifying compliance with recording, weighing and tagging obligations.
• Expiation scheme: the expiation fees attached to many offences indicate an administrative enforcement track where an inspector or authorised officer may issue an expiation notice for contraventions, allowing respondents to pay rather than face criminal prosecution. The Regulations specify the fee amounts for various contraventions in each relevant provision (eg regs 9(7), 10(2), 13(2)).
• Ministerial publication and notification: reg 17 requires determinations to be published on the Department’s website and for notice to be given to persons bound by the determination in a manner and form the Minister considers will bring it to their attention (reg 17(3)-(4)). This sets out administrative procedural requirements for putting affected parties on notice before enforcement action proceeds, except that reg 17 does not apply to determinations made for the purposes of reg 9 (reg 17(6)).

Constraints and discretionary thresholds

• Where the Minister exercises discretion to reduce or increase quota entitlements under reg 9(3)(f)-(g), the Regulations provide formulaic caps (10% default) and an exceptional‑circumstances escape valve that permits the Minister, if satisfied, to allow greater carry-forward or greater reductions (reg 9(3)(f)(ii), (g)(ii)). The exercise of such discretion will determine the scale of sanctioned adjustments to future entitlements.
• Transfer consent is discretionary but constrained by statutory preconditions (reg 6(3)); transfers cannot proceed if fees unpaid, licence suspended, or if pending proceedings are likely (reg 6(3)(a)-(c)). The Minister must be satisfied that transferees or company directors are fit and proper persons (reg 6(3)(d)-(e)).

Evidence and compliance burden

• Enforcement will require physical and documentary evidence: weigh sheets, sealing and tagging information, transport and consignment documentation, periodic returns and other records as prescribed by Ministerial determination (regs 13, 15, 17). The obligation to maintain these records in legible condition and to produce them on request places an evidentiary burden on licence‑holders (reg 16).
• The mandatory delivery to registered processors (reg 14) creates an observable supply chain checkpoint, which law enforcement can use to verify that catch entered the permitted processing stream.

In sum, the Regulations combine criminal penalties for key operational breaches with an expiation system for administrative resolution, an inspection mechanism via fisheries officers, and Ministerial discretion over quotas that both creates compliance obligations and determines their magnitude. Those obligations will be enforced through record inspection, consignment inspections at processors, and the surrender or refusal of transfer consents where statutory preconditions are not met.

The Regulations sit as subordinate legislation under the Fisheries Management Act 2007 and explicitly reference Commonwealth corporate law and an earlier subordinate instrument. Key interaction points are set in the text and must be read together with the Act, the Corporations Act 2001 and the Marine Scalefish Fishery Regulations 2017 (as in force immediately before commencement).

Statutory hierarchy and cross-reference

• These Regulations are made under the Fisheries Management Act 2007 (reg 1 short title; heading indicates under the Act). Many enforcement and licence powers will therefore be exercised and supported by the Act itself; the Regulations create specific offences and procedural obligations within the Act’s framework.
• The Regulations borrow definitions from the Corporations Act: company, director, proprietary company and public company have the same meanings as in the Corporations Act (reg 3(2)). The transfer rules require a current company extract (ASIC extract) for transferees that are companies (reg 6(2)(c)), directly importing a corporate-documentation requirement from Commonwealth corporate regulation.

Relationship to Marine Scalefish Fishery (MSF) instruments

• The instrument is a partial spin-out of existing MSF quota allocations. It explicitly treats unit entitlement, vongole fishing zone and vongole quota entitlement in relation to the Marine Scalefish Fishery as those terms were defined in regulation 14(1) of the Marine Scalefish Fishery Regulations 2017 immediately before these Regulations commenced (reg 3(4)). The eligibility to apply for a vongole licence is restricted to persons who immediately before 1 July 2021 held an MSF licence with a vongole quota condition (reg 5(2)). That creates a transitional interaction: rights and entitlements under the MSF instrument are migrated into a distinct vongole fishery instrument, with the MSF definitions preserved for continuity.
• The Definitions note also clarifies that the MSF Regulations were immediately before change known as Fisheries Management (Marine Scalefish Fisheries) Regulations 2017, indicating name continuity (reg 3 Note).

Evidence, inspection and enforcement in the Act

• The Regulations require production of records to a fisheries officer on request (reg 16(c)). The Act sets out powers and procedures for fisheries officers; while those powers are not reproduced in the Regulations, enforcement and inspection under these provisions will rely on the Act’s enforcement framework and officer powers. The Regulations therefore must be read alongside the Act’s provisions on inspection, entry, seizure and prosecution.

Administrative publication, procedural fairness and determinations

• The Minister must publish determinations on the Department’s website and may also publish in the Gazette, and must give written notice to persons bound by them in a manner the Minister considers will bring them to attention (reg 17(3)-(4)). These publication and notification requirements create an administrative intersection with general public‑law expectations for legal notice and transparency. However, the Regulations also provide that reg 17 does not apply to determinations made for the purposes of reg 9 (reg 17(6)), which limits the procedural transparency for determinations that set unit value and quota‑related conditions; such determinations are governed by the specific provisions in reg 9 rather than the general determinations regime.

Other statutory and regulatory considerations

• Spatial coordinates and geodetic datum: the Regulations require that all spatial lines be geodesics based on GDA2020 (reg 3(3)(a)). This interacts with mapping and navigational statutes and standards, and with any enforcement or planning instruments that rely on geodetic coordinates.
• Nomenclature standard: the Regulations reference AS5300,2019 Australian Fish Names Standard for common and scientific fish names (reg 3(3)(b)). This is a standards interaction that affects species identification and may influence evidence in enforcement or research contexts.

In summary, operationalising these Regulations requires cross-referencing the Fisheries Management Act 2007 for enforcement powers and licence frameworks, the Corporations Act for company documentation and fit-and-proper assessments, the Marine Scalefish Fishery Regulations 2017 for legacy quota definitions, mapping standards for spatial boundaries (GDA2020) and naming standards (AS5300,2019). The Minister’s determinations and the exclusion of reg 9 from the general determinations publication regime create particular administrative interfaces that adjust how and when affected parties receive notice of quota-related decisions.

The Regulations were made in 2021 and first commenced on 1 July 2021, with subsequent variation in 2022. The legislative history included in the instrument provides the key dates and the specific changes recorded in the official variations schedule.

Principal instruments and commencement

• Principal regulations: Fisheries Management (Vongole Fishery) Regulations 2021, Gazette 24 June 2021 p2342, No. 90 (commencement: 1 July 2021; see legislative history entries). The text records r 2 being omitted under the Legislation Revision and Publication Act 2002 (commencement 1.7.2022).
• Variation instrument: Fisheries Management (Vongole Fishery) Regulations variation 2022, Gazette 16 June 2022 p1822, No. 40 (commencement: 1 July 2022; recorded under Legislative history).

Recorded variations in detail (as given)

• r 2 omitted under Legislation Revision and Publication Act 2002, with effect 1 July 2022 (legislative history notes).
• r 9 amendments: several changes were made by the 2022 instrument (No. 40). Specifically:
  • r 9(1): the phrase “following quota period” was inserted by 40/2022 r 3(1) (commencing 1 July 2022).
  • r 9(3)(b): deleted by 40/2022 r 3(2) (commencing 1 July 2022).
  • r 9(3) generally was amended by 40/2022 r 3(3) (commencing 1 July 2022). The principal text shows multiple subparagraphs in r 9(3) addressing the Minister’s powers to impose or vary licence conditions, with the entry in the legislative history noting deletion and amendment to r 9(3)(b) and other components.
  • r 9(4a)-(4c): these subregs were inserted by 40/2022 r 3(4) (commencing 1 July 2022). The new subregs limit counting certain increases when calculating carry-forwards and require that variations under subreg 3(f) or (g) be expressed to apply only for the quota period during which the variation is made (see r 9(4a)-(4c) in the text).
• The legislative history indicates that new entries appear in bold in the original official listing; here the relevant amendments from 2022 are recorded in the notes at the end of the instrument.

Consequential and interpretative notes in the instrument

• The instrument contains a note that the Fisheries Management (Marine Scalefish Fishery) Regulations 2017 were, immediately before the commencement of these Regulations, known as the Fisheries Management (Marine Scalefish Fisheries) Regulations 2017, which clarifies naming continuity and assists in tracing the MSF-era definitions referenced in reg 3(4).
• The amendments to r 9 in 2022 clarify and limit how carry-forwards and entitlement increases are to be treated, and insert procedural mechanics for when those increases may be disregarded for future calculations (r 9(4a)-(4c)). The insertion of “following quota period” into r 9(1) adjusts timing language for the definition of carry-forwards.

What is not in the legislative history

• The legislative history included here does not provide an explanatory memorandum or policy statements setting out the reasons for the 2022 changes. The entries record the statutory modifications and commencement dates only. There is no litigation history recorded as part of the amendment schedule.

Practical import of the amendments

• The 2022 amendments materially affect quota-accounting mechanics (reg 9), including carry-forward rules, the applicability of prior increases, and the temporal wording around quota periods. Those changes affect how licence-holders can rely on under-catch increases and how over-catch is offset, and they introduce restrictions on successive carry-forwards by disregarding certain increases when calculating entitlements for subsequent quota periods (reg 9(4a)-(4b)). They also require that any variation under subreg 3(f) or (g) be expressed to apply only for the quota period during which the variation is made (reg 9(4b)). These are substantive operational amendments to quota accounting.

Record-keeping recommendation

• Given that amendments affect entitlement calculations and may be time-limited (eg reg 9(4b)), licence-holders should maintain historical records of quota entitlements, Ministerial determinations and returns that span the 2019-2022 timeframe in order to reconcile any carry-forward or adjustment calculations and to evidence the position at the relevant assessment dates under reg 9.

The Regulations’ text and its appended legislative history do not identify any reported litigation or judicial consideration of these Regulations. The instrument lists the principal regulations, the variation (2022, No. 40) and the provisions varied, but contains no cases, proceedings, reported decisions or enforcement outcomes. The Regulations themselves create offences and reference fisheries officers as inspectors (reg 16(c)), but no prosecutions, appeals or judicial reviews are recorded in the provided material.

What the absence of litigation in the instrument means for practitioners

• The absence of a litigation record in the instrument is not the same as an absence of legal risk. The Regulations create a number of offences and discrete decision points where administrative action by the Minister is required (for example, determinations of unit value (reg 9(2)), consent to transfers (reg 6(3)), and decisions about varying quota entitlements (reg 9(3))). Those Ministerial decisions are potentially reviewable under administrative law principles in the Act or by judicial review if procedural fairness or statutory boundaries are breached, but no case law is cited in the Regulations to indicate how courts have interpreted these provisions.
• Practitioners should be alert that the Minister’s wide discretion over unit values, entitlement variations and consent to transfers could generate disputes about reasonableness, relevancy of considerations, or procedural fairness. Any such contention would be litigated under the Act and public law principles, but the Regulations include no guidance on process for merits review or appeal.

Enforcement and evidence

• The Regulations designate records and consignment practices as key sources of enforcement evidence (regs 13-16). If enforcement action were to occur, evidentiary disputes would likely centre on the adequacy and integrity of records, the correctness of weightings and tagging, compliance with consignment rules to registered processors (reg 14), and whether Ministerial determinations were lawfully made and communicated (reg 17). Again, no litigation history is available in the instrument to set precedent on these points.

Practical consequence

• In the absence of case law, licence-holders, processors and transferees should assume that statutory obligations will be enforced, and that administrative decisions by the Minister are susceptible to judicial review challenges on standard public law grounds. Where the Regulations create quantitative formulae (eg for carry-forward or over-catch), the numeric rules will be critical in enforcement and any future litigation will likely focus on the correct application of those formulas and the Minister’s exercise of exceptional-circumstance discretions.

The Regulations contain a number of practical pitfalls and non-obvious consequences that will affect licence-holders, transferees, processors and administrative staff. The following is a focused list of “gotchas” drawn from the text, with concrete citations and the mechanisms by which problems can arise.

1. Closed application pool for licences (reg 5(2))

• Only persons who held an MSF licence with a vongole quota condition immediately before 1 July 2021, or transferees under these Regulations, may apply for a licence. If a person does not meet that temporal eligibility test, they cannot obtain a Vongole Fishery licence. The transitional wording is strict and hinges on the exact timing and nature of the MSF licence condition. Practitioners should check the precise wording and timing of MSF licence conditions to determine eligibility.

2. Commercial activity requires quota condition (reg 9(7))

• It is an offence to take vongole for a commercial purpose in a vongole fishing zone unless the licence is subject to a condition fixing a vongole quota entitlement. Licences without that condition cannot be used for commercial harvesting. A licence-holder unintentionally operating without the condition would be exposed to a $5,000 maximum penalty and $315 expiation fee.

3. Minister determines unit value annually and reg 17 does not apply to reg 9 determinations (regs 9(2), 17(6))

• The Minister must set unit value on or before the start of each quota period, but reg 17’s general publication and notification procedures do not apply to determinations made for reg 9. That means quota‑defining determinations (unit value) may be governed by reg 9’s own processes rather than the general transparency requirements in reg 17. Licence-holders must therefore track communications closely for unit value announcements and cannot rely solely on the reg 17 publication route.

4. Carry-forward and over-catch mechanics are complex and time‑limited (reg 9(3)(e)-(g); 9(4a)-(4c))

• Carry-forward increases for under-catch are permitted but capped (10% default), and exceptional circumstances can alter this cap (reg 9(3)(f)). Over-catch triggers future entitlement reductions calculated at 1 kg per excess kg up to the 10% threshold, and 2 kg per excess kg where the excess exceeds the 10% threshold (reg 9(3)(g)). The 2022 amendments add rules excluding certain earlier increases from being counted when calculating carry-forward entitlement (reg 9(4a)), and require variations under subregs 3(f)/(g) to be expressed as applying only for the quota period during which they are made (reg 9(4b)). Licence-holders should maintain contemporaneous catch records to reconcile any carry-forward or over-catch adjustments and to ensure that entitlements are calculated correctly.

5. Transfer conditionality creates risk to marketable value (reg 6(3))

• The Minister can refuse consent to transfer on fit-and-proper grounds and if fees are unpaid, licence suspended or pending proceedings exist against the holder (reg 6(3)(a)-(c)). For company transferees, every director must be a fit and proper person (reg 6(3)(e)), and an ASIC extract must accompany the transfer application (reg 6(2)(c)). These conditions impose due diligence obligations on buyers and financiers; a proposed transfer can be blocked even if sale terms are agreed.

6. Mandatory delivery to registered processors may concentrate market access (reg 14)

• All vongole must be delivered or consigned to a registered fish processor (reg 14). If registered processors are few, remote fishers may face transport costs, timing constraints, or bottlenecks. The Regulations do not set processor capacity requirements; licence‑holders bear the logistical responsibility.

7. Strict agent proximity and numbers (regs 11-12)

• Whether using registered boats or not, the licence‑holder (or registered master) must be on the shore and remain within 700 metres of any shore agent, and no more than two shore agents may be engaged at once (regs 11(2)-(3), 12(2)-(3)). This constrains labour models, prevents remote supervision arrangements, and creates operational challenges on large beaches or in safety-critical circumstances.

8. Record-keeping format and accessibility obligations (regs 13, 15, 16)

• Records must be maintained in good condition, be legible and readily accessible, and produced for inspection by fisheries officers on request (reg 16). The Minister determines the manner, form and times for returns and record retention (regs 13(1)(a)-(b), 15(1)-(2)). Failure to maintain accessible, legible records could attract penalties and undermine defences in enforcement proceedings.

9. Fees and prescribed forms for variation applications (reg 9(6))

• Applications to vary unit entitlements must be in a Minister‑approved form, follow the form instructions, and be accompanied by the prescribed fee (reg 9(6)). Missing or incorrect forms, or payment issues, can invalidate an application and jeopardise entitlements arising from joint applications or reallocations.

10. Definitions and spatial precision (reg 3(3)(a))

• All coordinate lines are geodesics based on GDA2020 and coordinates are expressed in those terms (reg 3(3)(a)). Enforcement will use precise geodetic data. Operators relying on older datums or imprecise GPS readings may misidentify zone boundaries.

11. Transitional reliance on MSF definitions (reg 3(4))

• The migration of unit entitlement definitions from MSF regulation 14(1) as it was immediately before these Regulations commenced (reg 3(4)) means historical MSF records and decisions are relevant in entitlement calculations. Errors in historical data or misunderstandings about legacy definitions may produce disputes.

12. Ministerial discretion with limited published process exemption (reg 17(6))

• While reg 17 requires determinations to be published on the Department website and for affected persons to be notified (reg 17(3)-(4)), reg 17 does not apply to determinations made for reg 9 (unit-value and quota determination). That creates a potential gap in public notification procedure for key quota-setting decisions.

Practitioners should map these “gotchas” onto their clients’ operational models: licence eligibility, transfer timelines, processor capacity, record systems, and labour arrangements. Each operational decision has statutory hooks that can affect licence value, transferability and enforceability.

Compliance with these Regulations requires a combination of eligibility verification, annual administrative actions, operational controls, record-keeping systems and proactive monitoring of Ministerial determinations. Below is a practical, stepwise compliance checklist tied to specific regulatory provisions.

1. Confirm licence eligibility and status (reg 5)

• Verify whether you are in the closed class eligible to apply: did you (or the entity) hold a Marine Scalefish Fishery licence subject to a vongole quota entitlement immediately before 1 July 2021? If not, you cannot apply for a Vongole Fishery licence under reg 5(2). If you acquired the licence via transfer under these Regulations, ensure the transfer application complied with reg 6 procedural requirements and was approved.

2. Manage transfers properly (reg 6)

• If buying or selling a licence, prepare the transfer application with:
  • the licence document to be transferred (reg 6(2)(a));
  • a completed form of return as required by reg 15 up to the date of application (reg 6(2)(b)); and
  • a current ASIC company extract if transferee is a company (reg 6(2)(c)).
• Ensure fees and amounts under the Act are paid, the licence is not suspended and there are no pending or likely proceedings against the existing holder (reg 6(3)(a)-(c)). For company transferees, confirm all directors satisfy fit-and-proper criteria (reg 6(3)(e)).

3. Stay on top of annual unit value determinations (reg 9(2))

• The Minister must determine unit value on or before the commencement of each quota period. Allocate internal processes to monitor Department announcements and any direct notices. Because reg 17 does not apply to determinations for reg 9 (reg 17(6)), do not rely only on general determinations publication; monitor zone-specific communications and the Department’s website.

4. Maintain precise spatial knowledge (reg 3(3)(a))

• Use mapping systems that reference GDA2020 and ensure vessel GPS and charting correspond to the geodesic coordinates published. Train masters on the precise boundaries of Coffin Bay, Port River and West Coast zones.

5. Implement robust catch recording and handling systems (regs 13, 15, 16)

• Establish standard operating procedures to record catch and disposal information in the manner and form the Minister determines (reg 13(1)(a)).
• Ensure weigh, storage, containerisation, sealing, tagging and transport conform to Ministerial requirements (reg 13(1)(c)).
• Provide recorded information to the Department in the manner and times required (reg 13(1)(b)).
• Keep records as determined for form, location and retention period (reg 13(3), reg 15(2)). Maintain records in good condition, legible and readily accessible (reg 16).
• Implement backups and secure storage for records to satisfy production on request to a fisheries officer (reg 16(c)).

6. Deliver to a registered fish processor (reg 14)

• Identify and contract with registered fish processors that can accept consignments in your zone. Ensure transport and timing arrangements align with processor capacity and Minister-determined rules for consignments and accompanying information.

7. Comply with agent proximity and limits (regs 11-12)

• If using shore agents, ensure the licence-holder or registered master is on the shore concurrently and remains within 700 metres of the agent at all times when agents are engaged (regs 11(2)(b), 12(2)(b)). Do not engage more than two shore agents simultaneously (regs 11(3), 12(3)). Adjust operational plans and labour rosters accordingly.

8. Apply correctly for unit‑entitlement variations and joint reallocations (reg 9(3)(c)-(d), 9(6))

• Use Minister-approved application forms, follow instructions precisely and pay the prescribed fee when applying to vary unit entitlements (reg 9(6)).
• For joint reallocations between holders, ensure both parties make a joint application and understand the impact on unit entitlements and quota entitlements.

9. Monitor catch tallies against entitlement and plan for carry-forward mechanics (reg 9(3)(e)-(g))

• Reconcile catch by zone against quota entitlements regularly to anticipate under‑catch or over‑catch outcomes.
• For under-catch, understand the 10% default cap on carry-forward increases and the exceptional‑circumstances process for exceeding that cap (reg 9(3)(f)). Note reg 9(4a) that certain increases must be disregarded in calculating carry‑forwards.
• For over-catch, understand how future entitlements will be reduced (1 kg or 2 kg per excess kg depending on thresholds) and that variations must be expressed to apply only for the quota period during which made (reg 9(3)(g), 9(4b)).

10. Keep company governance documents current (reg 6(2)(c), 6(3)(e))

• If the licence is held by a company, ensure ASIC extracts and director particulars are up-to-date and that directors meet fit-and-proper expectations. Transferability can be blocked if the Minister is not satisfied on these points.

11. Observe penalties and expiation processes (regs 9(7), 10(2), 13, 14, 15, 16)

• Put compliance controls in place to avoid offences that carry $5,000 maximum penalties and expiation options. Implement pre-audit checks before consignments and before producing returns or records.

12. Track Ministerial determinations and Department publications (reg 17)

• Regularly check the Department’s website for determinations and any variations; ensure the business receives any direct written notices the Minister gives under reg 17(4). Remember that determinations for reg 9 are excluded from the reg 17 publication rule (reg 17(6)), so cross-check unit-value announcements and quota communications using multiple channels.

13. Prepare for inspections (reg 16)

• Ensure that records are immediately accessible and that masters and on-shore licence-holders understand inspection protocols. Have a designated compliance officer for handling fisheries officer requests.

14. Document research assistance and seek compensation where appropriate (reg 9(3)(h))

• If assisting in Department research under the Act, document the assistance carefully and, if seeking compensation via increased quota entitlements, apply for variation under the specific mechanics in reg 9(3)(h) supported by evidence of time spent and the Minister’s acknowledgment.

15. Keep historical records and reconcile MSF-era entitlements (reg 3(4))

• Maintain historical MSF licence records and MSF quota-period catch data (MSF quota periods 2019-20 and 2020-21 are referenced in reg 9 definitions) because these figures are used in transitional entitlement adjustments (reg 9(3)(e), reg 9(4)). Historical data will be essential in entitlement calculations and in any transfer due diligence.

Operational checklist summary

• Eligibility check, licence status verification, transfer due diligence.
