Fisheries Management (Sardine Fishery) Regulations 2021

The Regulations create a quota‑based, administratively governed fishery. Key legal concepts and how they operate are:

• Fishery constitution and species list: The Sardine Fishery is formally constituted by regulation 4(1)-(2) and limited to the aquatic resources listed in Schedule 1 (Australian Anchovy, Maray, Australian Sardine, Blue Sprat, Sandy Sprat).

• Sardine fishing zones: Spatial governance is central. The Regulations define three fishing zones (Gulf St. Vincent Zone, Spencer Gulf Zone, Outside Zone) by precise GDA2020 geodesic coordinates and lines (regulation 3(1)(Gulf St. Vincent Zone, Spencer Gulf Zone) and regulation 3(3)(a)-(c)). The 2024 amendments replaced an earlier "Gulfs Zone" definition with two discrete gulfs zones effective 1 January 2025 (Legislative history).

• Unit system and unit value: Each licence holds a unit entitlement (number of sardine units) in respect of a zone (regulation 3(1) definitions). The Minister determines the unit value (kilograms per unit) on or before the start of each quota period; the quota entitlement in kilograms is unit entitlement multiplied by unit value, subject to any intra‑period variations (regulation 3(1) definitions; regulation 9(2)). This makes the Minister’s unit value determination the immediate price in kilograms that converts statutory units into catch limits.

• Quota periods and temporal structure: A quota period is 1 July-31 December 2021 for the first transitional period and thereafter each 12 months commencing 1 January (regulation 3(1) definitions). The unit value must be set for each quota period (regulation 9(2)).

• Licence‑based individual catch quotas: The Minister can impose licence conditions fixing sardine quota entitlements (regulation 9(3)(a)). The Regulations contain mechanisms for proportional increases to entitlements (regulation 9(3)(d)), negotiated reallocations between two licence holders by joint application (regulation 9(3)(e)), carry‑forward increases where catch fell short (regulation 9(3)(f)), and reductions where catch exceeded quota (regulation 9(3)(g), as varied by the 2022 amendments and preserved in transition for certain years).

• Minimum fishing units: A licence cannot be used to take sardines if the total number of sardine units allocated to the licence is less than 100 units (regulation 9(6)). This is a de minimis threshold that prevents fishing on very small unit holdings.

• Ministerial determinations and administrative rule‑making: The Minister may make determinations to provide detail for multiple regulations (regulation 17(1)-(2)), must publish determinations on the Department website and notify affected persons (regulation 17(3)-(4)), and may vary or revoke determinations (regulation 17(5)). Notably, regulation 17(6) expressly excludes determinations for regulation 9 from regulation 17 procedural requirements (an important transparency and process distinction).

• Transfer and fit and proper test: Licences are transferable but only with Ministerial consent, supported by required documents and subject to checks that include outstanding fees, suspensions, pending prosecutions and fit and proper persons tests for transferees and company directors (regulation 6(1)-(3)).

• Operational and traceability obligations: Requirements include registration of boats and masters (regulations 7-8); notification when a boat is used under more than one licence (regulation 11); record‑keeping, weighing, sealing and tagging as set by Ministerial determination (regulation 12); consignment/delivery to registered fish processors (regulation 13); and restrictions on unloading onto other boats (regulation 14).

• Enforcement architecture: Offences carry maximum fines, and many offences have a specified expiation fee alternative (regulations 10, 11, 12, 13-16). Record access for fisheries officers is mandated (regulation 16).

These concepts produce a hybrid regime: quota entitlements resemble individual transferable quotas in structure but transfers and many operational details remain subject to administrative control and Ministerial discretion. The Regulations also make substantial use of Ministerial determinations to set the practical details of catch reporting, weighing, storage, sealing, tagging, transport and the form and timing of returns (regulation 12; regulation 17).

Primary affected parties are defined by the licensing and operational scope of the Regulations:

• Existing Marine Scalefish Fishery licence holders with sardine conditions or registered sardine nets as of 1 July 2021. Only those persons, or transferees of licences transferred under these Regulations, are eligible to apply for licences in the Sardine Fishery (regulation 5(2)(a)-(b)). The Minister may only grant if the applicant’s MSF licence has been varied to revoke the sardine quota condition or surrendered (regulation 5(3)). Thus the Regulations channel initial entitlements to persons with specific prior MSF relationships.

• Licence transferees and companies seeking transfers. Transfers require Ministerial consent and supporting documents including a completed return and, for company transferees, a current company extract from ASIC (regulation 6(2)). The Minister’s consent conditions attach to payment of fees, suspension status, pending prosecutions, and fitness checks for natural persons and company directors (regulation 6(3)(a)-(e)). Company directors are specifically subject to a fit and proper test (regulation 6(3)(e)).

• Registered owners and masters of boats used in the fishery. Registration and revocation of registration are required to use boats under licences (regulations 7-8). There are explicit offences for using a registered boat under more than one licence at the same time (regulation 10), and for failing to provide prescribed notifications where a boat is, or will be, used under multiple licences (regulation 11).

• Processors and persons in the supply chain. Licence holders must deliver or consign all sardines taken under the licence to a registered fish processor (regulation 13). Unloading onto other boats is restricted to boats listed on the processor’s certificate of registration (regulation 14). These obligations pull processors and the logistics chain into the compliance perimeter.

• Fisheries officers and the Department. The Department is the administrative unit charged with assisting a Minister in administration of the Act (regulation 3(1) definition). The Department will receive returns, records and notifications and enforces compliance; fisheries officers are authorised to request production of records (regulation 16).

• Company stakeholders. Where the transferee is a company, the regulation expressly requires a current company extract and subjects directors to fit and proper person consideration (regulation 6(2)(c); 6(3)(e)). This implicates corporate governance and due diligence obligations on prospective transferees.

• Persons associated with transhipment and storage. Obligations around weighing, sealing, tagging and transport, and the requirement to maintain records in a legible and accessible form for inspection, place compliance costs on anyone handling catch from the boat to the registered processor (regulations 12(1)(a)-(c); 16).

Secondary or wider impacts:

• Buyers and supply chain partners outside registered processors are indirectly affected because delivery to registered processors is mandatory (regulation 13). This constrains sales channels and may affect market arrangements.

• Potential purchasers of licences face administrative screening (regulation 6) and possible subjectivity through the "likely to be commenced" standard for pending proceedings (regulation 6(3)(c)). This can affect marketability and valuation of licence entitlements.

• The Minister and Department carry administrative burdens to make determinations, publish notices, assess transfers and manage quota calculations and variations (regulation 17; regulation 9).

The Regulations therefore concentrate immediate statutory rights in a defined set of incumbent MSF licence holders and prospective transferees; they place recurring compliance, record‑keeping and delivery obligations on licence holders, boat owners and processors, and allocate gate‑keeping discretion to the Minister in transfers, unit valuations, quota adjustments and many technical details.

The Regulations assign specific duties to licence holders, registered owners, registered masters, transferees and the Minister, and create enforceable rights and thresholds.

Key duties:

• Eligibility and application constraints: Only certain MSF licence holders (or transferees) may apply for Sardine Fishery licences (regulation 5(2)). The Minister may grant only where the applicant’s MSF licence has been varied to remove a sardine condition or surrendered (regulation 5(3)). This duty affects prospective applicants’ process for migrating harvesting rights.

• Transfer application content and preconditions: An application for consent to transfer must include the licence, a completed return up to date with the application and, for a corporate transferee, a current company extract (regulation 6(2)). The Minister’s consent is conditional on fees paid, licence not suspended, absence of pending or likely proceedings against the holder, and the transferee and company directors being fit and proper persons (regulation 6(3)(a)-(e)).

• Registration and revocation procedures: Applications to register boats/devices or masters must include prescribed documents (regulation 7). Applications to revoke registration must follow Minister‑approved forms and be accompanied by specified documentation (regulation 8(2)).

• Quota compliance and unit threshold: Licence holders subject to a condition fixing a sardine quota entitlement must not take sardines under the licence while total sardine units allocated to the licence are less than 100 units (regulation 9(6)).

• Catch, disposal and traceability obligations: Where sardines are taken from a registered boat, the licence holder or registered master must record catch and disposal information, provide that information to the Department, and ensure weighing, storage, sealing, tagging and transport/delivery are carried out in accordance with Ministerial requirements (regulation 12(1)(a)-(c)). Records must be kept in the form, place and for the period determined by the Minister (regulation 12(3)). The Regulations also require delivery or consignment of all sardines to a registered fish processor (regulation 13) and prohibit unloading onto other boats except those specified on the processor’s certificate (regulation 14).

• Returns and records: Licence holders must provide periodic returns in the form, manner and times determined by the Minister and retain copies as determined (regulation 15(1)-(2)). Records must be legible, accessible and produced for inspection on request (regulation 16).

• Notifications where boats used under multiple licences: Where a registered boat is or is to be used under more than one licence to take sardines, the Department must be notified in the manner and times determined by the Minister and of information specified by the Minister (regulation 11(1)); failure to comply is an offence (regulation 11(2)).

• Obey determinations: The Minister can determine forms, times, details and the Minister’s determinations generally must be published on the Department’s website and notified to affected persons (regulation 17(3)-(4)), though regulation 17(6) excludes determinations made under regulation 9 from regulation 17.

Key rights and administrative powers:

• Ministerial power to issue licences: The Minister may issue licences subject to the Regulations (regulation 5(1)).

• Transferability subject to consent: Licences are transferable, but only with the Minister’s consent and subject to the statutory preconditions in regulation 6 (regulation 6(1)-(3)). Transferability is a statutory right that is administratively gate‑kept.

• Quota entitlement as a statutory allocation: Licences may have conditions fixing sardine quota entitlements expressed in units and kilograms via the unit value. Licence holders have the right to take sardines up to their quota entitlement, subject to the unit minimum and any variations imposed by the Minister (regulation 3 definitions; regulation 9).

• Mechanisms to change entitlements: The Minister must, on or before each quota period, determine the unit value (regulation 9(2)). The Minister may increase quotas proportionately to all licences during a quota period (not more than twice) and vary licence conditions to reallocate units between two licences on joint application (regulation 9(3)(d)-(e)). The Minister also has power to increase entitlements for undercatch (regulation 9(3)(f)) or decrease entitlements for overcatch (regulation 9(3)(g)) following specified formulas.

• Determination publication and notification: For determinations other than those under regulation 9, the Minister must publish determinations on the Department website and notify affected persons in a manner that will bring the determination to their attention (regulation 17(3)-(4)).

Duties impose recurring administrative burdens: records, returns, weighing and tagging, delivery to registered processors and compliance with Ministerial determinations. Rights such as quota entitlements and transferability are present but qualified by administrative controls, fit and proper tests and Ministerial discretion. The Minister’s control over unit value (regulation 9(2)) centrally converts unit holdings to kilogram catch ceilings, placing revenue and catch volume uncertainty with licence holders.

Enforcement combines criminal offences with expiation (infringement) options and inspection powers. The Regulations specify maximum penalties and expiation fees, and require production of records to fisheries officers.

Offences and penalties (representative, not exhaustive):

• Transfer and registration related: If a registered boat is used to take sardines under more than one licence at once, the registered owner and registered master each commit an offence. Maximum penalty $5,000; expiation fee $315 (regulation 10).

• Notification failures: Failure to comply with Ministerial determination about notifying the Department where a registered boat is or will be used under more than one licence is an offence for registered owner and master. Maximum penalty $5,000; expiation fee $315 (regulation 11).

• Catch and disposal non‑compliance: Failure by licence holder or registered master to record catch/disposal information, provide it to the Department, or to follow the Minister’s requirements for weighing, sealing, tagging, transport and disposal is an offence. Maximum penalty $5,000; expiation fee $500 for failing to comply with determinations made under regulation 12(1)-(2). Failure to keep records as required by regulation 12(3) attracts a maximum penalty $5,000; expiation $315.

• Processor delivery breaches: Failure to ensure that all sardines taken under the licence are delivered or consigned to a registered fish processor is an offence with maximum penalty $5,000 and expiation $315 (regulation 13).

• Unloading onto other boats: Causing, suffering or permitting unloading of sardines onto another boat not specified on processor certificate attracts a maximum penalty $5,000 and expiation $315 (regulation 14).

• Periodic returns and record retention: Failing to provide returns or keep a record of returns as determined is an offence with a maximum penalty $5,000 and expiation fee $500 (regulation 15).

• General record keeping condition: Persons required to keep records must maintain them in good condition, legible, readily accessible and produce them for inspection by a fisheries officer on request. Maximum penalty $2,500; expiation fee $210 (regulation 16).

Enforcement mechanisms and administrative process:

• Expiation scheme: Many offences carry a specified expiation fee, allowing an alleged offender to pay an amount and avoid prosecution (regulations 10-16 list expiation fees). The structure provides a compliance pathway other than criminal proceedings.

• Inspection powers: Regulation 16 requires records to be produced to a fisheries officer on request. The broader powers of fisheries officers under the Act (not reproduced in these Regulations) are likely to be invoked; the Regulations require accessibility and legibility of records.

• Ministerial preconditions for administrative approvals: Transfer consent is conditional on there being no pending or likely proceedings alleging an offence against the Act against the licence holder (regulation 6(3)(c)); that can be enforced by denying transfer consent.

• Publication and notification obligations: The Minister must publish determinations (regulation 17(3)) and notify persons bound by a determination (regulation 17(4)). However regulation 17(6) excludes determinations made for the purposes of regulation 9 from the operation of regulation 17, creating a potential divergence in process and public visibility for quota‑related determinations.

• Penalty levels: Maximum penalties are predominantly $5,000 for operational offences, with lower penalties and smaller expiation fees for record maintenance (regulation 16). The monetary values are modest relative to the possible market value of quota entitlements; the Regulations therefore rely on administrative controls and process to shape behaviour rather than very large criminal sanctions.

Operational enforcement trade‑offs and practical effects:

• The combination of an expiation regime and administrative precondition can produce multiple compliance levers: payment of expiation fees as a practical route for minor breaches, and administrative controls (licence suspension, transfer refusals) for more serious or systemic non‑compliance (regulation 6(3), 10-16).

• The relatively low maximum fines (mostly $5,000) compared to the potential market or value of quota entitlements emphasises the importance of administrative restrictions (transfer consent, suspension) to enforce compliance and deter behaviour affecting quota accuracy and traceability.

• The Regulations foreground document and record inspection as the primary enforcement tool; accessibility and legibility of records are required and the Department is the repository and recipient of returns, increasing the role of information control in enforcement (regulations 12, 15, 16).

All enforcement tools and penalty figures are specified in the Regulations and must be applied by fisheries officers and the Department in accordance with the Act and the public administrative law framework.

The Regulations are subordinate legislation under the Fisheries Management Act 2007 and explicitly cross‑refer to several other statutory instruments and legal frameworks:

• Fisheries Management Act 2007: These Regulations are made under the Act (heading and context). Many enforcement powers and the administrative context (suspension, offences under the Act, fisheries officer powers) will operate within the parent Act’s framework. For example, transfers are conditioned on there being no pending or likely proceedings alleging an offence against the Act (regulation 6(3)(c)), linking transferability directly to the Act’s enforcement architecture.

• Fisheries Management (Marine Scalefish Fishery) Regulations 2017: The Sardine Fishery regulatory scheme is deliberately carved out from the Marine Scalefish Fishery (MSF) arrangements. The Regulations reference the MSF regulations and preserve continuity for definitions and unit entitlements allocated immediately before the transfer (regulation 3(4), regulation 5(2)-(3)). Transitional provisions in the legislative history preserve certain quota adjustment rules as between the principal regulations and the 2022/2024 amendments (Legislative history: Transitional provisions).

• Fisheries Management (General) Regulations 2017: The definition of “sardine net” is imported by reference from the General Regulations (regulation 3(1) definition), so technical definitions and device restrictions in the General Regulations continue to apply.

• Corporations Act 2001 (Commonwealth): Corporate definitions (company, director, proprietary company, public company) are adopted by reference (regulation 3(2)). Transfers to companies require a current company extract from ASIC (regulation 6(2)(c)), linking transfer documentation to federal corporate registers.

• National Measurement Act 1960 (and related determinations): Spatial descriptions are required to use GDA2020 geodesics as defined in a Commonwealth determination under section 8A of the National Measurement Act 1960 (regulation 3(3)(a)). This fixes the datum for spatial coordinates and ties the spatial limits to Commonwealth measurement standards.

• Administrative law and publication practices: Regulation 17 requires determinations to be published on the Department’s website and notified to affected persons. That interacts with broader administrative law requirements for procedural fairness and transparency; however regulation 17(6) excludes regulation 9 determinations, creating an explicit exception for quota determinations from the general determination publicity and notification requirements.

• Expiation and penalty regimes: The expiation mechanism interacts with the State’s broader expiation and enforcement systems under the Act and other subordinate instruments. Expiation amounts are set out within these Regulations and will be processed within the Departmental enforcement machinery.

Practical intersections and cross‑jurisdictional effects:

• Corporate due diligence: Buyers of licences who are companies must produce an ASIC current company extract, bringing federal corporate registries into the fisheries transfer process (regulation 6(2)(c)). Directors are subject to fit and proper person considerations (regulation 6(3)(e)).

• Continuity with MSF entitlements: Licence migration from MSF to Sardine Fishery is controlled by these Regulations; holders must vary or surrender MSF licence conditions before Sardine Fishery licences can be granted (regulation 5(3)).

• Spatial regulatory coherence: The use of GDA2020 and geodesics ensures spatial definitions are technically consistent with other coastal and offshore regulatory mapping exercises (regulation 3(3)(a)).

• Administrative discretion and judicial review: The Ministerial discretion over unit value, quota variations, transfer consent and other determinations will be exercisable subject to public law limits (e.g. reasonableness, absence of mala fides), although the Regulations do not themselves state procedural constraints for decisions under regulation 9 (and regulation 17(6) expressly excludes the operation of regulation 17 to regulation 9 determinations).

The Regulations thus operate in a network of federal and state instruments and administrative practices, with particular cross‑links to the MSF regulations, the General Regulations, the Corporations Act and national measurement standards.

The legislative history appended to the Regulations records three principal amendment events and related transitional provisions. The published variations show how the Regulations have moved from a single "Gulfs Zone" concept to discrete gulf zones, and how quota rules were adjusted in 2022 and 2024. Key amendments recorded in the legislative history:

• Principal regulations made 2021: Fisheries Management (Sardine Fishery) Regulations 2021, Gazette 24.6.2021, no. 89, commenced 1 July 2021 (Principal regulations entry).

• 2022 amendments , Fisheries Management (Sardine Fishery) (Quota) Amendment Regulations 2022 (No 73 of 2022): Commenced 1 January 2023 (Gazette 1.9.2022 p5812; Commencement 1.1.2023: regulation 2). These amendments substituted regulation 9(1), deleted some parts of regulation 9(3)(b),(c) and amended regulation 9(3) and related paragraphs. The 2022 instrument also inserted regulation 9(4) replacement and added new subregulations 9(4a)-(4c) (see Legislative history: Provisions varied and Transitional Schedule 1). The purpose of these changes in text was to adjust the mathematical treatment of quota increases/decreases, and to add detailed temporal application constraints (for example that certain variations be expressed to apply only for the balance of the quota period).

• 2024 amendments , Fisheries Management (Sardine Fishery) (Fishing Zones) Amendment Regulations 2024 (No 124 of 2024) and another 2024 instrument (No 121): Both came into effect 1 January 2025 (Gazette 12.12.2024 p4653 and p4662; Commencement 1.1.2025: r 2). Notable changes include:

  • Substituting the earlier "Gulfs Zone" definition and inserting distinct "Gulf St. Vincent Zone" and "Spencer Gulf Zone" definitions (Regulation 3 amendments; Legislative history: r 3 entries).
  • Amending regulation 4(2) to reflect the new zone definitions (Legislative history).
  • Substituting and amending parts of regulation 9 to provide transitional allocation of units at commencement of quota period 1 January 2025, ensuring units previously allocated to "Gulfs Zone" are allocated to both Spencer Gulf Zone and Gulf St. Vincent Zone in specified ways (regulation 9(3)(b) and related transitional provisions in the 2024 amending instrument’s Schedule). The transitional Schedule allows the Minister to vary entitlements so that increases or decreases that would have applied to the Gulfs Zone may instead apply to the Spencer Gulf Zone for the quota period commencing 1 January 2025 (Fisheries Management (Sardine Fishery) (Fishing Zones) Amendment Regulations 2024, Sch 1).

• Transitional provisions: The 2022 amendment included a transitional provision preserving regulation 9(3)(g) as in force immediately before the relevant day for certain licences where overcatch occurred in the 2022 quota period (Transitional provision in the 2022 instrument). The 2024 amendment’s Schedule includes specific transitional provisions for reassigning quota variations between the former Gulfs Zone and the new Spencer Gulf Zone for the 2025 quota period (Fisheries Management (Sardine Fishery) (Fishing Zones) Amendment Regulations 2024, Sch 1).

• Miscellaneous: Regulation 2 was omitted under the Legislation Revision and Publication Act 2002 effective 1 January 2023 (Legislative history: Provisions varied, r 2 omitted). Various small technical amendments to regulation 3 and regulation 9 are recorded in the variation table.

The legislative history in the statutory printout documents the variation items and dates that alter definitions and the operation of quota adjustments. Practitioners must consult the legislative history and transitional schedules when dealing with entitlements spanning amendment dates (notably the 1 January 2023 and 1 January 2025 cut‑offs). The transitional schedules explicitly preserve or reassign variation powers in respect of quota increases or decreases that arise as a result of catches in particular quota periods.

The text of the Regulations as provided does not record any court cases, appeals or administrative decisions concerning these Regulations. The Legislative history section sets out amendment instruments and commencement dates but contains no citations to judicial determinations or disciplinary decisions. Therefore, based solely on the provided material, there is no reported litigation history attached to these Regulations within the source text.

Users seeking case law or administrative review outcomes that interpret these Regulations must search public law and tribunal/court databases and the Department’s enforcement registers, as any judicial decisions or tribunal rulings would be external to the Regulations’ text and are not referenced in the statutory instrument’s legislative history provided here.

The Regulations contain several provisions that are easy to miss but which have material operational and legal impact:

• Restricted entry and required MSF licence variation: Only persons who immediately before 1 July 2021 held MSF licences with sardine quota conditions or registered sardine nets, or transferees of licences transferred under these Regulations, may apply for Sardine Fishery licences (regulation 5(2)). The Minister may only grant if the MSF licence has been varied to revoke a sardine quota condition or surrendered (regulation 5(3)). Practically, that limits entry and ties access to historical MSF status. This is not an open licensing regime.

• Unit value is a political/administrative lever: The Minister must determine the unit value in kilograms before each quota period (regulation 9(2)). Because quota entitlements in kilograms are the product of unit entitlement and unit value, licence holders’ effective catch ceiling can change entirely at the unit value determination. The Regulations do not prescribe formulae or constraints on the Minister’s unit value determination in regulation 9(2), and regulation 17(6) expressly excludes regulation 9 determinations from the publication/notification framework in regulation 17, creating a potential transparency gap (regulations 9(2) and 17(6)). Practitioners must therefore monitor how the unit value is communicated and whether additional departmental practice notes exist.

• Regulation 17(6) carve‑out: Most Ministerial determinations must be published on the Department’s website and notified to persons bound (regulation 17(3)-(4)), but regulation 17(6) says the regulation does not apply in relation to a determination made for the purposes of regulation 9. That means quota unit value determinations and perhaps other quota‑related adjustments may not be bound by the same publication and notification regime as other technical determinations, increasing uncertainty for licence holders reliant on timely public notice.

• Dealing with under‑ and over‑catch rules: The formulas for carry‑forward and penalty reductions are specific and have caps. Undercatch carry‑forward gives 1 kilogram additional entitlement for each kilogram shortfall up to 10% of the initial quota entitlement, unless the Minister sets a lower percentage or kilograms or is satisfied of exceptional circumstances and sets a higher percentage or kg (regulation 9(3)(f)). Overcatch rules (applicable to quota periods commencing on or after 1 January 2023) reduce future entitlements by 1 kg per kg over if excess is within 10%, or by 2 kg per kg over if excess exceeds 10% (regulation 9(3)(g)). Practitioners must apply the precise percentage thresholds and statutory caps rather than rely on general understandings of "carry‑over". Transitional provisions preserve certain applications of the earlier rules for catches in the 2022 quota period (Legislative history: Transitional provisions).

• Transferability is subject to fit and proper tests and pending prosecutions: Transfers require the Minister’s consent and are conditional on no pending or likely proceedings against the licence holder and on transferees/ company directors being fit and proper persons (regulation 6(3)(c)-(e)). The “likely to be commenced” standard is subjective and can materially affect marketability and timing of transfers.

• Minimum unit threshold to fish: The rule that a licence holder subject to a quota condition must not take sardines while their total units are less than 100 units (regulation 9(6)) can strand small unit holdings and render them non‑fishable unless aggregated with other units.

• Delivery to registered fish processors and transhipment constraints: Licence holders must ensure all sardines are delivered or consigned to registered fish processors (regulation 13). Unloading onto other boats is prohibited unless the other boat is specified on the processor’s certificate of registration (regulation 14). These rules constrain at‑sea transhipment and may impose logistical and contractual adjustments for harvesting operations that previously relied on alternative landing or aggregation points.

• Records and determinative detail driven by Minister: The Regulations delegate significant technical and operational detail to Ministerial determinations: form of returns, timing, record‑keeping periods, weighing, storage, sealing, tagging, transport, and notification requirements (regulations 12, 15, 17). Because those determinants can be changed by subsequent determinations (regulation 17(5)), licence holders have ongoing compliance monitoring obligations.

• Penalty quantum relative to quota value: Maximum penalties (mostly $5,000) and expiation fees may be modest relative to market value of quota holdings. Enforcement is likely to lean on administrative controls (transfer refusal, suspension, revocation) and record requests rather than rely solely on high pecuniary penalties.

• Transitional reallocation risks with 2025 zone split: The 2024 amendments split the Gulfs Zone into two discrete zones and made allocations at commencement of the quota period commencing 1 January 2025 (regulation 9(3)(b)). The transitional schedule allows the Minister to effect increases/decreases in the Spencer Gulf Zone in lieu of the old Gulfs Zone for certain quota adjustments (Fisheries Management (Sardine Fishery) (Fishing Zones) Amendment Regulations 2024, Sch 1). Rights and entitlements for catches spanning the changeover must be carefully reconciled under those transitional rules.

• Determinations for regulation 9 not subject to regulation 17: Because regulation 17(6) excludes regulation 9 determinations from the publication and notification obligations, practitioners should not assume that quota unit value determinations or quota redistribution decisions will be publicly announced in the same way as other determinations; proactive engagement with the Department is advisable to avoid being caught unawares.

These operational details and carve‑outs create legal and commercial risk points. They concentrate administrative discretion and make licence transferability and quota certainty dependent on Ministerial computation and departmental practice.

The Regulations require a combination of procedural steps, record discipline and proactive administrative engagement. Below is a practical compliance checklist tied to the Regulations’ text.

1. Verify eligibility and, if necessary, effect MSF licence variation or surrender before applying.

   • If you intend to apply for a Sardine Fishery licence, ensure you held, immediately before 1 July 2021, a Marine Scalefish Fishery licence with a sardine quota condition or a registered sardine net, or that you are a transferee of a licence transferred under these Regulations (regulation 5(2)).
   • The Minister can only grant a Sardine Fishery licence if your MSF licence has been varied to revoke the sardine quota condition or surrendered (regulation 5(3)). Coordinate with the Department and legal advisers to process the MSF variation/surrender to avoid timing gaps.

2. For licence transfers, prepare and lodge the required documents.

   • Include the licence to be transferred and a form of return as required by regulation 15 completed up to date to the date of application (regulation 6(2)(a)-(b)).
   • If the transferee is a company, obtain and attach a current company extract from ASIC showing directors and company details (regulation 6(2)(c)).
   • Be prepared to demonstrate payment of all fees and that the licence is not suspended; anticipate fit and proper person queries for natural persons and each company director (regulation 6(3)(a)-(e)).

3. Understand unit entitlements and quota conversions.

   • Maintain accurate records of your unit entitlements per zone (regulation 3(1) definitions). The Minister determines the unit value (kg per unit) on or before each quota period (regulation 9(2)). Calculate your kilogram entitlement as unit entitlement × unit value, and monitor Department communications for unit value announcements.

4. Maintain minimum unit holdings or do not fish.

   • Do not take sardines under a licence if the total number of units allocated to the licence is less than 100 units (regulation 9(6)). If your holdings approach this threshold, plan aggregation with other licence holders via joint application under regulation 9(3)(e), or apply to increase entitlements where authorised.

5. Register boats and masters and comply with registration formalities.

   • Apply to register boats/devices and masters using the Department’s approved form and include required documentary attachments (regulation 7). For revocation of registration, complete the Minister’s approved form and required documentation (regulation 8).

6. Implement catch recording, weighing, tagging and storage protocols.

   • Comply with the Minister’s determinations about the manner, form, place and times to record catch and disposal information and provide it to the Department (regulation 12(1)(a)-(b)). Ensure weighing, storage, sealing, tagging, transport and consignment meet the Minister’s specified requirements (regulation 12(1)(c)). Keep records in the manner, place and period determined by the Minister (regulation 12(3)).

7. Ensure delivery to registered fish processor and control transhipment risk.

   • All sardines taken must be delivered or consigned to a registered fish processor (regulation 13). Do not cause unloading onto other boats unless those boats are specified on the processor’s certificate (regulation 14).

8. Provide periodic returns and retain copies.

   • Submit returns in the form, manner and times determined by the Minister (regulation 15(1)). Retain copies in the manner and for the period specified (regulation 15(2)).

9. Maintain records to inspection standard.

   • Keep records legible, in good condition and readily accessible, and produce them for inspection by a fisheries officer on request (regulation 16). Implement secure but accessible storage systems and a retrieval protocol for inspections.

10. Monitor Ministerial determinations and Department website.

    • For many operational details, the Minister will make determinations (regulation 17). Keep an up to date watch on the Department’s website and any communications. Note that regulation 17(6) excludes regulation 9 determinations from regulation 17, so actively seek quota unit value information from the Department and, where necessary, request written confirmation.

11. Manage under‑ and over‑catch implications.

    • Track cumulative catches against quota entitlements each quota period. If catch is less than quota in a quota period commencing on or after 1 January 2022, the Minister may increase the subsequent period’s entitlement by 1 kg for each kg shortfall up to 10% of the entitlement or other limits determined by the Minister; exceptional circumstances may allow higher increases (regulation 9(3)(f)). If catch exceeded quota for quota periods commencing on or after 1 January 2023, expect reductions calculated per regulation 9(3)(g). Apply precise statutory formulas when forecasting future entitlements.

12. Prepare for transferability constraints.

    • Expect Ministerial scrutiny on transfers including the "fit and proper person" assessment for transferees and directors (regulation 6(3)(d)-(e)). Ensure outstanding returns and fee payments are settled prior to seeking transfer consent (regulation 6(2)-(3)).

13. Train staff and implement compliance systems.

    • Develop internal procedures for record keeping, weighing, tagging and returns; designate a compliance officer to monitor Department notices and unit value announcements. Ensure masters and owners understand notification requirements where boats are used under multiple licences (regulation 11).

14. Legal and administrative engagement.

    • Where decisions are discretionary (e.g. refusal of transfer, quota adjustment), consider early legal advice to understand decision grounds and appeal or review options under administrative law. Keep records of Departmental communications and determinations for any required review.

15. Factor penalties and expiation into compliance policy.

    • Understand the expiation fee options and maximum penalties set out in the Regulations (regulations 10-16). Use this knowledge to prioritise compliance tasks that would attract higher penalties or greater operational risk.

Following this checklist aligns operational practice with explicit regulatory prescriptions and helps manage administrative discretion risk. Given the Minister’s central role in quota valuation and variation, licence holders should maintain ongoing engagement with the Department and consider contractual provisions that allocate quota valuation risk in commercial agreements.
