40 Concession holder to ensure provision for observer and equipment

(1) If an observer is to be carried on a nominated boat for a particular trip, the holder of the fishing concession must ensure that: (a) the observer; and (b) the observer’s safety equipment; and (c) the observer’s monitoring equipment; are on board the boat when the boat commences the trip. (2) The holder of the fishing concession must ensure that an observer is provided with adequate food and accommodation while the observer is on board the boat during a trip. (3) The holder of the fishing concession must ensure that an observer is carried safely on the boat.
