Fisheries Management (Prawn Fisheries) Regulations 2017

Constitution of fisheries and scope: The regulations formally create three fisheries (r 4(1)). Each fishery is defined by (a) the taking of King Prawn (Merlicertus latisulcatus) within specified waters and (b) the taking of certain incidental aquatic resources listed in Schedule 1 when they are taken in the same net and at the same time (r 4(2)-(4); Schedule 1 Parts 1 and 2). This dual composition means the regulatory unit is the prawn-targeted trawl fishery plus its incidental bycatch as listed.

Licence cap and transferability: Regulation 5 freezes the maximum number of licences for each fishery at the number in force immediately before commencement. Licences are transferable (r 6(1)), but transfers require Ministerial consent and a package of documentary and substantive pre-conditions (r 6(2)-(3)). Transfer pre-conditions include clearance of fees, unsuspended licence status, absence of pending proceedings against the transferor, single transferee only, age and fit-and-proper tests for natural persons (at least 15 years old, r 6(3)(e)) and fit-and-proper director tests for corporate transferees (r 6(3)(f)). Where a boat registered under a licence is tied to other Commonwealth or other-law entitlements, transfer requires either a concurrent transfer or surrender of those entitlements, or Ministerial satisfaction and concurrence by the other granting body that separate transfer will not lead to over-exploitation (r 6(3)(g)(i)-(ii)(A)-(B)).

Boat and master registration: Applicants must use forms and supply documents required by the application form (r 7(1)). A boat may be registered only if it meets overall length and engine power caps (overall length ≤ 24 metres and continuous brake power rating ≤ 340 kw) and if no other boat is registered to the same licence (r 7(2)(a)-(c)). Revocation of registration is available on application and subject to form and documentary requirements (r 8).

Fishing nights entitlement scheme: The regulations create a quantitative access control in the Gulf St. Vincent Prawn Fishery based on “fishing nights” and “fishing night units” (r 9). Key elements are defined in r 9(1) , fishing season, prescribed periods, unit entitlement, unit value, amalgamated gear, and closed season. The Minister determines the total number of nights available to licence holders, the number of fishing-night units required per night (including separate rules for amalgamated gear), and may create classes of units that can apply to different prescribed periods (r 9(2)-(3)). The Minister may vary licence conditions in multiple specified ways, including allowing unit reallocation between two licences on joint application, carrying-forward shortfalls up to specified percentages, and reducing entitlements where overuse occurs with graduated reduction rules (r 9(4), (4a)-(4f)). Some adjustments are limited to 10% or otherwise capped unless exceptional circumstances are found by the Minister (r 9(4)(c)(ii)(A)-(B) and similar provisions).

Temporary restrictions and Ministerial flexibility: The Minister may impose temporary restrictions or prohibitions on specified classes of fishing activity by notice to each licence holder in a manner the Minister determines and may attach exceptions and conditions (r 10(1)-(2)). Failure to comply with a notice is an offence (r 10(3)); the Minister must publish the restriction in the Gazette as soon as practicable (r 10(4)).

Reporting, record keeping and catch handling: For Gulf St. Vincent specifically, the holder or registered master must record catch and disposal information in the manner, form, places and times determined by the Minister, provide those records to the Department, and ensure specified handling, weighing and tagging requirements are met as determined by the Minister (r 11(1)-(1)(c)). Non-compliance attracts penalties and expiation fees and the obligation to keep records for determined periods and in determined ways is imposed (r 11(2)-(3)). More generally, holders must provide periodic returns as the Minister determines (r 12). Records must be legible, accessible and produced for inspection on request by a fisheries officer (r 13).

Ministerial determinations and publication: The Minister may make determinations under the regulations, including those of general or limited application and that can differentiate by person or circumstance (r 14(1)-(2)). Generally, determinations are to be published on the Department’s website and notice given to affected persons (r 14(3)-(4)); determinations may be varied or revoked by further determination (r 14(5)). Notably, r 14(6) excludes determinations made for the purposes of regulation 9 (fishing nights) or regulation 10 (temporary restrictions) from the r 14 publication/notice regime: r 10 independently requires Gazette publication (r 10(4)).

Transitional constraints on new entrants: Schedule 2 Part 2 clause 2 restricts eligibility to apply under s 54 of the Act for a prawn fishery licence to persons who held licences immediately prior to the commencement of the transitional clause (Schedule 2 Pt 2 cl 2(1)-(3)). In other words, immediate pre-existing licence holders are the only eligible applicants under s 54 for those fisheries during the transitional period specified.

Enforcement architecture: The instrument creates offences and prescribes maximum fines and expiation fees for most infringements (r 9, r 10, r 11, r 12, r 13). Fisheries officers are empowered to request production of records (r 13(c)). The Minister retains broad powers to impose and vary conditions, to consent to transfers and to issue temporary restrictions.

Primary regulated persons

• Licence holders in the Gulf St. Vincent, Spencer Gulf and West Coast Prawn Fisheries. Licensing mechanics and many obligations (returns, record-keeping, registration, entitlement scheme) are directed at the holder (r 6-7, r 9, r 11-12).
• Registered masters of boats from which aquatic resources are taken under a prawn fishery licence, who share obligations to record and provide catch and disposal information and to comply with Ministerial determinations on handling (r 11).
• Transferees of licences: the rules for transfer require documentary evidence (the licence, completed return form, and where the transferee is a company a current ASIC company extract not older than one month) and substantive assessments (r 6(2)-(3)). Corporate transferees require fit-and-proper assessments of directors (r 6(3)(f)).

Associated industry and supply-chain persons

• Boat owners and operators: registration rules cap boat length (≤ 24 metres) and main engine continuous brake power (≤ 340 kw) for registered boats (r 7(2)(a)-(b)), and limit one registered boat per licence (r 7(2)(c)).
• Persons in the post-harvest chain (weighers, packers, transporters, processors, bulk buyers) may be affected by catch handling, tagging, sealing and consignment requirements if the Minister determines such requirements for Gulf St. Vincent (r 11(1)(c)). Those requirements may affect how catch is stored, transported and sold and what accompanying information must travel with it.
• Persons intending to use amalgamated gear (triple-rig trawls up to a specified headline length) in the Gulf St. Vincent fishery; use requires Ministerial approval (r 9(1), r 9(7)) and the unit cost and nightly unit rates for amalgamated gear are matters for Ministerial determination (r 9(2)(c)).

Government actors and decision-makers

• The Minister responsible for fisheries has broad discretionary powers under the regulations: to consent to licence transfers (r 6(3)), to register boats and masters (r 7), to determine fishing-night units and values and to vary licence conditions under the fishing nights scheme (r 9), to impose temporary restrictions (r 10), and to issue determinations for operational matters and their publication (r 14).
• The Department (the Minister’s administrative unit) receives returns and records, publishes determinations on its website (r 14(3)), and is the agency to which catch/disposal information must be supplied (r 11(1)(b), r 12(1)).
• Fisheries officers who are entitled to inspect records maintained under the regulations (r 13(c)).

Other legal regimes and their actors

• Corporations and company directors since corporate transferees must provide a current company extract and directors must be assessed as fit and proper persons (r 6(2)(c); r 6(3)(f)). The Corporations Act definitions are imported by reference (r 3(2)).
• Bodies that grant Commonwealth or other-law entitlements (for example, entitlements to use a boat under Commonwealth law): where a registered boat used under a licence is the subject of another entitlement, transfer must either be concurrent or have the concurrence of the other granting body, or the Minister must be satisfied that separate transfer will not cause over-exploitation (r 6(3)(g)).

Indirect or practical impacts

• New entrants are constrained by transitional rules in Schedule 2 Part 2 cl 2 which restrict the pool of persons eligible to apply under s 54 of the Act to those who already held licences immediately before the clause’s commencement, limiting fresh competition for some period (Schedule 2 Pt 2 cl 2).
• Buyers, processors and exporters will be affected by record-keeping and tagging/consignment obligations where the Minister makes determinations under r 11(1)(c); failure by licence holders to supply appropriate documentation or follow handling requirements may disrupt supply chains.

Population size and market scope

• The cap on maximum licences (r 5) anchors licence scarcity to the historical number of licences at commencement, thus preserving the existing licence count for each fishery and affecting market entry, licence prices and transfer market dynamics. The regulations do not themselves establish an open new-licence process for expanding numbers.

Who pays and who decides

• Licence holders pay the compliance costs: record keeping, returns, potential tagging/sealing/transport costs, any application fees for registration and variation (r 9(5)(c) requires a prescribed fee for unit entitlement variation), and costs associated with meeting equipment limits or making changes to vessel registration. The Minister decides on transfers, registrations, fishing nights entitlements and temporary restrictions, and makes determinations governing operational detail (r 6, r 7, r 9, r 10, r 14).

Key duties imposed by the regulations

• Licence holders must provide periodic returns in the manner, form and at the times determined by the Minister and must keep records of each return for a period determined by the Minister (r 12(1)-(2)). Failure carries a maximum penalty of $5,000 and expiation fees (r 12).
• For the Gulf St. Vincent Fishery, licence holders and registered masters must record catch and disposal information in the manner, form, places and times determined by the Minister, supply that information to the Department when required, and ensure aquatic resources are weighed, stored, sealed, tagged and transported in accordance with Ministerial requirements (r 11(1)(a)-(c)). Non-compliance is an offence with maximum penalties and expiation fees specified (r 11(2)-(3)).
• Records required to be kept under the regulations must be maintained in good condition, legible, accessible and produced for inspection by a fisheries officer on request (r 13). Failure attracts a maximum penalty of $2,500 and an expiation fee (r 13).
• Registration-related duties: applications to register boats/devices/masters must be accompanied by documents specified in the form and boats must comply with size and engine power limits and the one-boat-per-licence rule (r 7(1)-(2)). Revocation of registration follows application requirements (r 8).
• Under the Gulf St. Vincent fishing nights scheme, licence holders must not engage in fishing activity under a licence during daylight hours or during a closed season, and must not use amalgamated gear without Ministerial approval (r 9(6)-(7)). Both are offences with maximum penalties and expiation fees (r 9(6)-(7)).

Key rights and discretions preserved for licence holders

• Licences are transferable (r 6(1)) subject to Ministerial consent and the transfer pre-conditions set out in r 6(2)-(3). The transfer regime creates a right to apply for transfer and to provide the required supporting documents, but it is not an automatic right to transfer.
• Licence holders can apply to vary unit entitlements under the fishing nights scheme (r 9(5)), and the Minister may, on joint application by two holders, reallocate unit entitlements between licences (r 9(4)(a)). These are channels for licence holders to seek operational adjustments to entitlement allocation.
• Where holders have under-used their entitlements during certain periods, the Minister may increase entitlements for subsequent fishing seasons up to specified caps or subject to exceptional circumstances (r 9(4)(ab), (c), (d)). These provisions create the possibility of temporary increases to operational access for under-using holders.
• Licence holders have procedural entitlements in relation to determinations: the Minister must publish determinations on the Department’s website and give notice in writing to persons bound by a determination, except where r 14(6) excludes determinations under r 9 or r 10 (see r 14(3)-(4), (6)). For temporary restrictions under r 10, the Minister must publish in the Gazette (r 10(4)).

Ministerial powers and constraints

• The Minister has broad powers to determine fishing-night units, classes, unit values, total nights and to vary conditions of licences under many specified circumstances (r 9(2)-(4f)). The Minister must adhere to some explicit numeric ceilings in the scheme (for example, 10% carry-forward caps unless exceptional circumstances are found: r 9(4)(c)(ii)(A) and related provisions).
• The Minister may restrict or prohibit specified classes of fishing activity by notice to licence holders and may attach exceptions and conditions (r 10(1)-(2)). Notices must be gazetted (r 10(4)). The Minister also controls determinations about record-keeping and handling and the way those determinations are published generally (r 14).

Procedural and administrative duties

• Transfer applications must be accompanied by the licence to be transferred, a completed form of return (r 12) up to the date of application and, for company transferees, a current ASIC company extract (r 6(2)(a)-(c)).
• Applications to register or to revoke registration must use prescribed forms and supply the documents specified on the form (r 7(1); r 8(2)).
• Applications to vary unit entitlements must be made in a manner and form approved by the Minister, completed according to the form’s instructions and accompanied by the prescribed fee (r 9(5)(a)-(c)).

Compliance triggers and enforcement

• The obligations are enforceable by penalties and expiation fees set out in the regulations for particular contraventions (r 9, r 10, r 11, r 12, r 13). Fisheries officers can request production of records and the Minister can issue notices and vary licence conditions, suspend or refuse transfers where conditions are not met (r 6(3)(b) re suspended licence).

Statutory penalties and expiation fees

The regulations specify maximum penalties and expiation fees for a number of contraventions. The pattern is:

• Fishing under licence during daylight hours or during the closed season in the Gulf St. Vincent Prawn Fishery: maximum penalty $5,000; expiation fee $315 (r 9(6)).
• Using amalgamated gear without Ministerial approval in Gulf St. Vincent: maximum penalty $5,000; expiation fee $315 (r 9(7)).
• Contravening a Ministerial notice under r 10 (temporary restriction or prohibition): maximum penalty $5,000; expiation fee $315 (r 10(3)).
• Failure to comply with a Ministerial determination on catch and disposal for Gulf St. Vincent: maximum penalty $5,000; expiation fee $500 (r 11(2)).
• Failure to keep records required by r 11 in the manner, place and for the period determined by the Minister: maximum penalty $5,000; expiation fee $315 (r 11(3)).
• Failure to provide periodic returns or keep a record of returns under r 12: maximum penalty $5,000; expiation fee $500 (r 12(1)-(2)).
• Failure to maintain a required record in good condition, legible and accessible and produce it to a fisheries officer: maximum penalty $2,500; expiation fee $210 (r 13).

Enforcement actors and mechanisms

• Fisheries officers have the statutory power to request production of records maintained under the regulations (r 13(c)). Production on request is a specific obligation.
• Ministerial notices under r 10 are enforceable; contravention is an offence and the Minister must publish notices in the Gazette (r 10(3)-(4)).
• The Minister exercises administrative controls: consent to licence transfers (r 6), registration of boats and masters (r 7), and power to vary or revoke determinations (r 14(5)). These administrative controls are enforcement-adjacent because the Minister can deny transfers, refuse registrations or vary fishing-night entitlements depending on compliance or operational considerations.
• The Minister’s determinations about catch weighing, sealing, tagging and transport (r 11(1)(c)) create operational obligations that may be enforced as offences with penalties if the determination is not complied with (r 11(2)).

Modalities of sanction

• The regulations provide for both criminal penalties (maximum penalties) and civil-style expiation (infringement) fees. The presence of prescribed expiation fees indicates the regulator’s ability to resolve some breaches by monetary payment without court prosecution where the expiation mechanisms are invoked, but the text supplies no detailed procedure for expiation beyond listing the fee amounts; those procedures would typically sit in the enforcement machinery under the Act or administrative practice.
• The penalty scale is relatively uniform across many operational offences (commonly $5,000 maximum), with record condition offences attracting a lower maximum ($2,500), indicating legislative prioritisation of accurate recording and active enforcement potential.

Compliance triggers, evidential and administrative risks

• Many of the obligations are expressed to be “in the manner and form, at such places and at such times, as determined by the Minister” (r 11(1)(a)-(c); r 12(1)). That means the precise content of the offences may be elaborated in Ministerial determinations. Non-compliance with those determinations constitutes an offence (r 11(2)). Enforcement therefore depends on the clarity, availability and communication of Ministerial determinations and how they are operationalised.
• Publication requirements for determinations generally require publication on the Department’s website and notice in writing to persons bound by the determination (r 14(3)-(4)). However, r 14(6) excludes determinations made for r 9 (fishing nights) and r 10 (temporary restrictions) from the r 14 publication requirements, although r 10 separately requires Gazette publication (r 10(4)). This difference in publication routes affects visibility and could influence evidentiary questions in enforcement (for example, whether a licence holder had reasonable notice).

Procedural consequences for transfers and registration

• The Minister’s requirement to be satisfied that there are no pending or likely proceedings against the holder of the licence prior to consenting to a transfer (r 6(3)(c)) creates a procedural gate that links enforcement activity to transferability. That means regulatory actions and investigations can have immediate effect on the transferability and saleability of licences.
• Licence suspension is a condition to consenting to transfer (r 6(3)(b)); where a licence is suspended, a transfer would be blocked. The text does not itself set out suspension procedures but links transferability to licence status.

Integration with the Fisheries Management Act 2007

• These regulations are made under the Fisheries Management Act 2007 and operate as subordinate legislation implementing the Act’s objectives and licensing architecture. References to application under section 54 of the Act appear in Schedule 2 Part 2 cl 2, which limits who may apply under s 54 for a prawn fishery licence during the transitional phase (Schedule 2 Pt 2 cl 2(1)-(3)). The regulations therefore function as operational detail for licences created and regulated under the Act.

References to Commonwealth and other state laws

• The Corporations Act 2001 (Commonwealth) is incorporated by reference for definitions of company, director, proprietary company and public company (r 3(2)). This means the corporate fit-and-proper assessments, and the documentary requirement of a “current company extract” (r 6(2)(c)), rely on the Commonwealth corporate register and its classification rules.
• The definition of “surveyed length” for a registered boat is tied to the certificate of survey issued under the Harbors and Navigation Act 1993 (r 3(1) definition), so vessel-tracing and compliance with harbour survey standards operate via that maritime statute.
• GDA2020 is referenced for spatial coordinates and geodesic lines in the spatial descriptions (r 3(3)(a); r 3(1) inserts GDA2020 by reference). The National Measurement Act 1960 is invoked within the GDA2020 definition as the source for the recognised-value standard of measurement position.

Overlap and interlocking entitlements

• The transfer provisions explicitly address interlocking entitlements granted under Commonwealth or corresponding laws: where a registered boat is subject to another entitlement, transfer either must be concurrent, require surrender, or be individually assessed by the Minister with concurrence from the other grantor to avoid over-exploitation (r 6(3)(g)(i)-(ii)(A)-(B)). This creates a necessary coordination point between State and Commonwealth or other-law entitlement systems and caps unilateral transferability where multisystem entitlements exist.

Publication and administrative law connections

• The Minister’s determinations regime requires publishing determinations on the Department’s website and notice to affected persons (r 14(3)-(4)), which ties into administrative transparency obligations. Nevertheless, the regulations exclude certain determinations (those under r 9 and r 10) from the r 14 publication regime (r 14(6)), while r 10 separately requires Gazette publication (r 10(4)). The interaction of these publication regimes with administrative law (procedural fairness, legitimate expectations, reasoned decision-making) is not set out in the regulations but will affect how determinations can be challenged or relied on.

Transitional and historical interaction

• The regulations revoke the earlier Fisheries Management (Prawn Fisheries) Regulations 2006 (Legislative history). The transitional provisions in Schedule 2 restrict entry and eligibility immediately following commencement by tying new applications under s 54 of the Act to persons who already held licences prior to the transitional clause (Schedule 2 Pt 2 cl 2). That has the effect of temporarily insulating the existing licence base from new entrants as the regulations bed in.

Where the regulations are silent

• The instrument sets many operational details to be “determined by the Minister” (r 11(1), r 12(1), r 9(2)). Where the regulations are silent on procedure for those determinations, the Fisheries Management Act 2007 and general administrative law principles will provide the background framework for review, but the regulations themselves do not elaborate appeal or review mechanisms specific to each Ministerial determination. The Act would need to be consulted for statutory review or appeal rights.

Chronology and principal amendments recorded in the text

• The principal regulations were made in 2017 (No. 233; Gazette 8.8.2017 p3428; commenced 15.1.2018 r 2). The legislative history lists subsequent variations and commencement dates in 2020, 2021, 2022 and 2023. The instrument abolished earlier 2006 regulations on commencement.
• Notable amendment instruments and dates from the legislative history: 323/2020 (Gazette 17.12.2020; commenced 17.12.2020), 105/2021 (Gazette 1.7.2021; commenced 1.7.2021), 75/2022 (Gazette 1.9.2022; commenced 1.11.2022), and two instruments in 2023 (20/2023 and 70/2023 with commencement dates 1.5.2023 and 31.7.2023, respectively).

Substantive textual changes and their timing

• r 3: the insertions and substitutions in r 3 (definition section) reflect several adjustments. GDA2020 was inserted by 20/2023 r 3(1) (1.5.2023). Definitions of Gulf St. Vincent, Spencer Gulf and West Coast waters were substituted by 20/2023 r 3(2)-(4) (1.5.2023). Other amendments to r 3 were made by 105/2021 r 4 (1.7.2021) and later by 20/2023 (1.5.2023).
• r 7: r 7(2) was varied by 105/2021 r 5(1), (2) (1.7.2021), adjusting registration conditions , the text now expressly caps length and engine power and one boat per licence (r 7(2)(a)-(c)).
• r 9 (the fishing nights scheme) has been the focus of multiple amendments across 2020-2023:
  • Closed season, fishing season and prescribed periods were substituted or amended by 70/2023 r 3 (31.7.2023), updating the dates and arrangements for prescribed periods and closed seasons.
  • Prescribed period 2 (and year-specific versions for 2020, 2021 and 2022) were inserted by 323/2020 r 4(1) (17.12.2020), indicating transitional or year-specific adjustments in 2020-2022.
  • Unit value was amended by 75/2022 r 3(2) (1.11.2022).
  • r 9(3) was substituted by 75/2022 r 3(3) (1.11.2022).
  • r 9(4) had variations by 323/2020 r 4(2) (17.12.2020) and was further amended by 75/2022 r 3(4) (1.11.2022).
  • r 9(4a) was inserted by 323/2020 r 4(3) (17.12.2020).
  • r 9(4b)-(4f) were inserted by 75/2022 r 3(5) (1.11.2022).
• Schedule 2 Part 1 was omitted under the Legislation Revision and Publication Act 2002 on 17.12.2020.
• The legislative history records the dates of historical versions available for review: 17.12.2020; 1.7.2021; 1.11.2022; 1.5.2023. Those snapshots should be consulted where transitional rights, unit values, prescribed periods and other dynamically amended items are relevant to a specific period.

Practical implications of amendment history

• Frequent amendments to r 9 indicate active management and iterative changes to the fishing nights scheme, unit values and prescribed periods. Amendments across 2020-2023 introduced year-specific constructs (prescribed period 2 (2020/2021/2022)), carry-forward mechanics and caps (r 9(4)-(4f)), and changes to unit valuation methods (75/2022 r 3(2)). Practically, licence holders must track the precise version of r 9 that applied in a given fishing season because entitlements, carry-forward and reduction rules differ by year and may be subject to transitional adjustments.
• The insertion of GDA2020 and substitution of spatial definitions in 2023 (20/2023) modernises spatial coordinates and aligns spatial descriptions with contemporary geodetic standards; operators and compliance officers will need to use GDA2020 coordinates for boundary delineation and enforcement.
• The legislative history documents that the Minister’s discretion has been a focal point for regulatory change. The changes suggest a pattern of adjustments that respond to operational circumstances; that creates an implementation and compliance challenge for regulated parties who must stay current with departmental determinations and the version history of the regulations.

The text of the Fisheries Management (Prawn Fisheries) Regulations 2017 as provided contains no recorded cases, judicial decisions, or administrative appeals. The legislative history lists amendments and historical versions but does not report litigation or judicial interpretation of the regulations. There are therefore no cases named in the instrument that would illuminate statutory construction or enforcement practice.

Implications of the absence of reported litigation

• Because the regulations themselves do not cite any judicial decisions, practitioners will need to rely on the Fisheries Management Act 2007, administrative law principles and any relevant decisions about analogous fisheries instruments if a question of statutory interpretation, procedural fairness or judicial review arises. The regulations make heavy use of Ministerial discretion (r 6, r 7, r 9, r 10, r 14) and determinations that may affect operational rights; such discretion can give rise to administrative law challenges where procedural fairness, reasonableness, or jurisdictional error are alleged, but the regulations do not set out internal appeal processes.
• The absence of litigation history in the instrument means there is no statutory compilation of precedents interpreting the fishing nights scheme, the fit-and-proper tests, or the Minister’s power to refuse transfers on the ground of pending proceedings or licence suspension. Where disputes arise, primary sources for contestation will be the Act, the text of the relevant regulation version in force at the time, Ministerial determinations and record of administrative processes (for example, reasons given for refusal of transfer consent).

What to look for in external search or litigation research

• Administrative decisions refusing transfers, imposing temporary restrictions (r 10), or enforcing determinations under r 11 or r 12 could generate judicial review claims where procedural fairness or reasonableness are at issue. Practitioners should search for cases under the Fisheries Management Act 2007 and related regulations in South Australian courts and tribunals for any judicial consideration of similar powers.
• Given the linkage of transferability to licence suspension or pending proceedings (r 6(3)(b)-(c)), enforcement actions such as suspension, notices of proposed prosecution, or adverse administrative findings could produce litigation affecting the economic value of licences; any such cases would be a critical source of precedent for future transfers and valuation disputes.

1. Ministerial discretion and publication anomalies

• Many operational duties are specified to be “as determined by the Minister” (r 11(1), r 12(1), r 9(2)) and the general rule in r 14 requires determinations to be published on the Department’s website and notice given in writing (r 14(3)-(4)). However, r 14(6) excludes determinations made for the purposes of r 9 or r 10 from the r 14 publication/notice regime. Temporary restrictions under r 10 do require Gazette publication (r 10(4)), but r 9 determinations (fishing night units, unit values, classes) are thus not governed by r 14’s publication requirements. Practically, licence holders must actively monitor Department communications and likely direct notices to ensure they receive the relevant determinations that will bind them.

2. Transferability is conditional, not automatic

• Although licences are “transferable” in principle (r 6(1)), transfers require Ministerial consent and a set of pre-conditions (r 6(2)-(3)). A pending prosecution, licence suspension, unpaid fees, failing to supply a completed return or, for corporate transferees, an adverse director fitness assessment, can block a transfer (r 6(3)(a)-(f)). The transferee must be a single person only (r 6(3)(d)). These conditions have direct commercial effects on the saleability and marketability of licences.

3. Interlocking entitlements require concurrency or concurrence

• If a boat registered under a licence is also the subject of a Commonwealth or other-law entitlement, transfer requires either concurrent transfer or surrender, or Ministerial satisfaction and concurrence from the other granting body to prevent over-exploitation (r 6(3)(g)(i)-(ii)(A)-(B)). Failure to sort out these interlocking entitlements can stall or void transfers.

4. One-boat-per-licence and vessel limits

• r 7(2)(c) prohibits registering more than one boat for use under a licence. r 7(2)(a)-(b) set a maximum overall length (24 metres) and maximum continuous brake power (340 kw). Where a licence previously used larger or more powerful vessels, operators must adjust to the registration constraints. The surveyed length definition references the Harbors and Navigation Act certificate of survey (r 3(1)) so compliance requires alignment with maritime survey standards.

5. Complexity and time-sensitivity of the fishing nights scheme

• The fishing nights entitlement scheme (r 9) contains multiple year-specific elements (prescribed period 2 has year-specific variants for 2020, 2021 and 2022 inserted by earlier instruments) and carry-forward and reduction mechanics that vary by class of fishing-night unit and by whether units allow fishing in one or both prescribed periods (r 9(4)-(4f)). These rules impose an administrative complexity risk: miscalculating entitlements for a fishing season can lead to unexpected decreases or disallowed nights. Licence holders must track the version of r 9 and any Ministerial unit value determinations for the relevant season.

6. Use of amalgamated gear requires prior approval

• Use of triple-rig “amalgamated gear” in Gulf St. Vincent requires Ministerial approval (r 9(7)) and the Minister determines the number of units required when amalgamated gear is used (r 9(2)(c)). Operating without approval risks the prescribed maximum penalty and expiation.

7. Recordkeeping obligations can be operationally demanding

• Catch and disposal reporting, weighing, sealing, tagging and transport requirements are made subject to Ministerial determination (r 11(1)(a)-(c)). The regulations impose strict record condition and accessibility obligations (r 13). The penalty regime attaches significant fines and expiation fees to recordkeeping failures, so operational processes must be robust to withstand inspection by fisheries officers.

8. Transitional restrictions on licence applications

• Schedule 2 Pt 2 cl 2 restricts eligibility under s 54 of the Act to persons who already held licences immediately before commencement. This creates a barrier to entry and affects the market for spectral licence sales or new entrants during the transitional period.

9. Fit-and-proper tests and minimum age

• The transferee of a licence who is a natural person must be at least 15 years of age and be a fit and proper person (r 6(3)(e)). The minimum age requirement is relatively low in conventional commercial terms; however, the fit-and-proper assessment and the required ASIC company extract for corporate transferees (r 6(2)(c)) are practical gates.

10. Penalty and expiation asymmetries

• Some failures attract higher expiation fees (for example, failure to comply with a Ministerial determination on catch and disposal r 11(2) carries expiation $500) while record-keeping condition failures carry lower expiation fees (r 13 expiation $210). Misunderstanding which contravention attracts which expiation fee can create unnecessary exposure.

Practical compliance checklist

1. Understand licence status and transfer implications

• Maintain up-to-date status of the licence; outstanding fees, pending prosecutions and suspension will impede transfer consent (r 6(3)(a)-(c)). Before entering a purchase or sale, obtain a current company extract (if transferee is a company,r 6(2)(c)), ensure all returns (r 12) are completed up to the transfer application date (r 6(2)(b)), and check for any interlocking entitlements on the registered boat (r 6(3)(g)) that might require concurrent transfer or surrender.

2. Register boats and masters per form requirements

• Use the form and supply documents specified (r 7(1)). Confirm the vessel meets the maximum overall length and engine continuous brake power limits (r 7(2)(a)-(b)) and remember only one boat may be registered to a licence (r 7(2)(c)). If revoking registration, comply with the application form requirements and supply specified documents (r 8(2)).

3. Track Ministerial determinations and publication channels

• Monitor the Department’s website for determinations that the Minister is required to publish (r 14(3)). For temporary restrictions under r 10, monitor the Gazette for notices (r 10(4)). Note r 14(6) excludes r 9 and r 10 determinations from the r 14 regime, so verify how the Department communicates r 9 determinations (unit values, classes and total nights) to licence holders.

4. Follow the fishing nights rules closely

• For Gulf St. Vincent licence holders, determine the licence’s unit entitlement and the unit value set by the Minister for each prescribed period and fishing season (r 9(1)-(2)). Keep accurate nightly logs (night defined as sunset to sunrise; r 9(1)). If you intend to apply to vary unit entitlements or to transfer unit entitlements between licences, use the approved form and pay the prescribed fee (r 9(5)(a)-(c)). Avoid fishing during daylight hours or closed seasons (r 9(6)) unless otherwise permitted.

5. Seek approval before using amalgamated gear

• Do not use amalgamated gear in the Gulf St. Vincent fishery without prior Ministerial approval (r 9(7)). Even where permitted, amalgamated gear has a different unit requirement which will be determined by the Minister (r 9(2)(c)).

6. Implement record-keeping and reporting systems

• Ensure catch and disposal records for Gulf St. Vincent are recorded in the manner, form, places and times determined by the Minister and provided to the Department as required (r 11(1)(a)-(b)). Maintain records in good condition, legible and readily accessible, and be prepared to produce them to a fisheries officer on request (r 13). Keep records for the period determined by the Minister (r 11(3); r 12(2)).

7. Ensure post-harvest handling meets Ministerial requirements

• If the Minister determines specific weighing, storage, sealing, tagging and transport requirements for Gulf St. Vincent catch, ensure that all handling and conveyance of catch complies and that accompanying information travels with consignments (r 11(1)(c)). Update commercial arrangements with processors and transporters to secure compliance across the supply chain.

8. Prepare for inspections and enforcement

• Institutionalise an internal compliance audit that verifies returns are lodged as required (r 12), records are kept in accessible format (r 13) and any Ministerial determinations are implemented. Train masters and crew to be aware of night definitions, closed seasons and the prohibition on daylight fishing (r 9(6)). Keep documentary evidence of compliance to reduce risk in the event of inspection or dispute.

9. Use formal application processes for variations and transfers

• For unit entitlement variations, use the Minister-approved forms, follow form instructions precisely and pay the prescribed fee (r 9(5)). For transfers, lodge the licence, a completed return form up to the date of application and, if the transferee is a company, a current company extract from ASIC not older than one month (r 6(2)).

10. Factor transitional and historical variants into seasonal planning

• Be aware of year-specific prescribed periods and transitional carry-forward rules that have been introduced in 2020-2023 (r 9 amendments). Plan fishing schedules and quota utilisation with reference to the specific version of r 9 and any Ministerial determinations that applied in the season concerned.

Record-keeping and evidence best practice

• Maintain contemporaneous logs of fishing nights, gear used, catch weights and handling actions. Ensure logs show sunset and sunrise times if needed to evidence night fishing (r 9(1) definition of night). Retain copies of all returns submitted to the Department and maintain a file of Ministerial determinations and notices received or published relevant to the licence.
• For transfers, keep documented evidence demonstrating clearance of fees, absence of pending proceedings and proof of completed returns up to the application date (r 6(2)(a)-(b)).

Engagement and dispute avoidance

• Where interlocking entitlements exist (r 6(3)(g)), engage early with the other grantor of the entitlement to secure concurrence for separate transfer or to arrange a concurrent transfer or surrender.
• If the Minister imposes a temporary restriction under r 10, verify the Gazette notice and seek clarification on exceptions and conditions promptly; notice is required to be published as soon as practicable (r 10(4)).
• Where a Ministerial determination affecting your operations is made, obtain written clarification on its scope and operational steps for compliance. The Minister can vary or revoke determinations (r 14(5)), so maintain records of communications and any contemporaneous operational adjustments.

Summary operational checklist (short)

• Check licence status and fees before any transfer.
• Use required forms and obtain ASIC company extract for corporate transferees.
• Register boats only if they meet length and power caps and ensure only one boat per licence.
• Monitor Department website and the Gazette for determinations and notices.
• Maintain robust record-keeping for catch, disposal and returns; be prepared for fisheries officer inspection.
• Seek Ministerial approval before using amalgamated gear.
• Budget for possible costs from weigh/pack/tag/transport requirements if the Minister imposes them.

By attending to these steps and the specific regulation references cited above, licence holders and their advisers can align operational practices with the compliance architecture established by the Fisheries Management (Prawn Fisheries) Regulations 2017.
