Fisheries Management (Miscellaneous Fishery) Regulations 2015

Key definitional and structural concepts in these Regulations flow from a combination of statutory definitions and operational mechanisms.

• Fishery and scope. The fishery is the Miscellaneous Fishery (r 4). Schedule 1 prescribes its contents as all aquatic resources except Abalone (Haliotis spp), King Prawn (Melicertus latisulcatus) and Southern Rock Lobster (Jasus edwardsii). The definition thus creates a residual category for species not already subject to separate management in South Australia.

• Licence as primary entitlement. A licence in respect of the fishery is the central instrument of entitlement. The Minister issues licences (r 5), may impose conditions limiting the class of fishing activities (r 6), and licences are transferable subject to Ministerial consent (r 5A). Transfer applications must include the licence, returns to date, and a company extract for corporate transferees (r 5A(2)).

• Fit and proper tests and minimum age. The Minister must be satisfied as to fitness and propriety. For natural persons, a minimum age of 15 years is required (r 5(6)(a); r 5A(3)(d)). For companies the Minister must be satisfied each director is fit and proper (r 5(6)(b); r 5A(3)(e)). The Regulations adopt Corporations Act meanings (r 3(2)) and require a current company extract for transferee companies (r 3(1) definition; r 5A(2)(c)).

• Competitive tendering. The Regulations set an explicit competitive tender procedure for issuing licences (Sch 2). The procedure prescribes advertising, a minimum one‑month period from ad to close, a 10% ADI bank guarantee accompanying each tender, sealed tenders in a locked box, public opening with specified steps to preserve order and randomness, and rules to determine successful applicants and the clearing price (Sch 2 cl 1-14). The Schedule contains a penalty on successful tenderers who fail to apply for or accept a licence: forfeiture of the 10% guarantee (cl 15).

• Giant crab individual quota system. Separate quota regimes operate for the Northern Zone (r 9) and Southern Zone (r 9A). Each has a quota period (12 months commencing 1 November for Northern; 1 October for Southern after amendments) and distinguishes unit entitlement (number of giant crab units allocated to a licence) from unit value (kilograms per unit determined annually by the Minister). A quota entitlement is the product of unit entitlement and unit value (r 9(1)(a), r 9A(1)(a)). The Minister must determine unit value for each quota period on or before its commencement (r 9(3), 9A(3)). The Minister may vary unit entitlements on joint application or adjust quota entitlements between quota periods based on under‑ or over‑catch (r 9(4)-(5), 9A(4)-(5)). Adjustments upward are limited to 10% absent exceptional circumstances (r 9(4)(c)); downward adjustments for over‑catch may be by 1 kg per kg up to 10% or 2 kg per kg for greater excess (r 9(4)(d)). Variations for the following quota period are to be expressed as applying only for that period (r 9(4b), 9A(4b)), and increases previously applied by virtue of carry‑forward are to be disregarded when calculating subsequent adjustments (r 9(4a), 9A(4a)). Cross‑fishery unit transfers are contemplated between the Miscellaneous Fishery and specified rock lobster fisheries on joint application (r 9(4)(b), r 9A(4)(b)).

• Ministerial determination power. The Minister may make determinations necessary to give effect to the Regulations (r 13). Those determinations can be general or limited, vary by class of person or circumstance, must be published on the Department website (and may be published in the Gazette), and the Minister must give written notice to affected persons in a manner he or she believes will bring the determination to their attention (r 13(2)-(4)). Determinations for rr 9, 9A or Schedule 2 are excluded from r 13 (r 13(6)).

• Record keeping and returns. Licence holders must submit returns in the manner, form, timing and with content the Minister determines and must retain copies as determined by the Minister (r 11). Records kept under the Regulations must be legible, readily accessible and produced on request to a fisheries officer (r 12).

• On‑shore agents rule. The Regulations limit the use of agents on shore for fishing activities. A licence holder or registered master must not cause or permit a person to act as a shore agent unless the licence holder or master is also engaged on shore in the activity and within 700 metres of that person (r 10(1)). No more than two shore agents may be simultaneously engaged (r 10(2)). Both provisions carry maximum penalties and expiation fees.

These concepts create a scheme that combines property‑bundle features (licence, unit entitlements), administrative discretion (Ministerial powers to issue, vary and publish determinations) and procedural constraints (tendering, application documentation, company extracts), together with information obligations to the Department.

The Regulations affect a defined set of actors by name and function.

• Licence holders in respect of the Miscellaneous Fishery. Primary obligations and opportunities fall on persons who hold licences in respect of the fishery. They may apply for registration of boats and masters (r 7), must provide periodic returns and keep records (r 11, r 12), may apply to vary quota entitlements (r 9(5), 9A(5)), and can make joint applications to vary unit entitlements (r 9(4)(a), 9A(4)(a)). Licence holders are also the parties whose entitlements are transferable subject to Ministerial consent (r 5A). They face penalties and expiation fees for breaches specified in rr 10-12 and 12.

• Prospective licence applicants and tenderers. Persons or entities wanting new licences, or additional licences, are affected by r 5: the Minister may issue additional licences if not detrimental to aquatic resources, and may call a competitive tender procedure (r 5(2)-(3)). Schedule 2 governs tenderers: they must lodge sealed tenders, provide an ADI guarantee equal to 10% of the tender, and follow the strict submission and opening procedures (Sch 2 cl 1-9). Successful tenderers who refuse to apply or accept licences forfeit the 10% guarantee (Sch 2 cl 15).

• Transferees and transfer applicants. Transfers are permitted but require Ministerial consent (r 5A). Transferee companies must supply a current company extract and the Minister must be satisfied as to fit and propriety of directors (r 5A(2)(c), r 5A(3)(d)-(e)). The transferor must have paid fees and must not have the licence suspended; proceedings alleging offences against the Act must not be pending or likely against the holder (r 5A(3)(a)-(c)).

• Directors, company officers and corporates. The Regulations refer to the Corporations Act for meanings and require a current company extract for corporate transferees (r 3(2); r 5A(2)(c)). For corporate licence applicants and transferees, every director must satisfy fit‑and‑proper standards (r 5(6)(b), r 5A(3)(e)). Thus company governance, disclosed via ASIC extracts, becomes material to licensing outcomes.

• Registered masters and boat/device registrants. Holders of licences who register boats/devices and nominate masters (r 7) are affected by the registration and revocation rules (r 8). Registered masters are also separately implicated by the on‑shore agent restrictions (r 10).

• Agents engaged on shore. Persons engaged as agents on shore to conduct fishing activities are directly regulated by r 10. The rule conditions their engagement on proximity to the licence holder/registered master and caps simultaneous agents at two. Breaches attract penalties and expiation.

• The Minister and the Department. The Minister is the central decision maker: issuances (r 5), transfers (r 5A), imposing licence conditions (r 6), determining unit values and varying quota entitlements (rr 9, 9A), making and publishing determinations (r 13), and conducting tenders under Schedule 2. The Department provides administrative support and hosts online publication of determinations (r 13(3)(a)). The Regulations define Department as the Public Service administrative unit assisting the Minister (r 3(1) definition).

• Fisheries officers and enforcement authorities. The Regulations give fisheries officers the power to request production of records (r 12(c)). Penalty and expiation regimes interact with prosecution and administrative enforcement machinery established under the Act.

• Holders of entitlements under Commonwealth or other State laws. Transfers require attention if a boat registered for use under a licence is also the subject of a Commonwealth entitlement; the Minister must be satisfied that either the entitlement transfers with the licence or is surrendered, or that separate transfer will not result in over‑exploitation and that the granting body concurs (r 5A(3)(f)). This implicates third parties who hold corresponding Commonwealth licences or permits.

• Persons managing rock lobster fishery licences. The Regulations permit unit transfers between Miscellaneous Fishery licences and certain rock lobster fishery licences (r 9(4)(b), r 9A(4)(b)), thereby affecting holders in those rock lobster fisheries defined in the Rock Lobster Fisheries Regulations 2017.

Who pays and who decides. Licence holders and tenderers bear fees, ADI guarantees and compliance costs; the Minister decides on issuance, transfers, quota unit values, quota adjustments, and the content and publication of determinations (r 5, r 5A, rr 9, 9A, r 13). Fisheries officers decide on inspection actions tied to record access obligations (r 12(c)). Courts or the prosecuting authority would enforce criminal penalties and expiation schemes under the Act and these Regulations.

This section maps the principal positive obligations to acts or omissions established by the Regulations, and the rights or entitlements created or constrained.

Duties and procedural obligations:

• Apply for and hold a licence to lawfully take aquatic resources constituting the Miscellaneous Fishery (r 4, r 5). The Minister may issue licences when a licence lapses or issue additional licences when not detrimental to aquatic resources (r 5(1)-(2)).

• If licences are issued by tender, comply with Schedule 2 tender rules: lodge sealed tenders, provide ADI guarantee equal to 10% of the tender, and respect the tender closing timeline (Sch 2 cl 1-4). Successful tenderers must make application for the licence in a reasonable time and accept the licence if offered or forfeit the ADI guarantee (Sch 2 cl 15). Tender procedural breaches (e.g. interfering with locked box) carry a maximum penalty (Sch 2 cl 5).

• Meet the Minister’s fit and proper tests and minimum age thresholds. For natural persons, be at least 15 years old and fit and proper (r 5(6)(a)). For companies, ensure each director is fit and proper (r 5(6)(b); r 5A(3)(e)). Provide a current company extract for corporate transferees (r 5A(2)(c)).

• When seeking transfer consent, supply the licence, current returns up to date, and documentation required by the application form; pay outstanding fees and have no suspension or pending proceedings alleging an offence against the Act (r 5A(2)-(3)(a)-(c)).

• Register boats, devices and masters when using these under licences, providing the documents specified in the application form (r 7). Apply in the Minister’s approved form and manner for revocation of registration (r 8(2)).

• Provide returns to the Department in the form, manner, timing and content determined by the Minister and retain a record of each return for the period the Minister determines (r 11(1)-(2)). Keep records in good condition, legible, readily accessible and produce them for inspection by fisheries officers on request (r 12).

• For giant crab: comply with quota entitlements as expressed for the licence and quota period. The licence holder’s lawfully takeable amount is the quota entitlement: the product of unit entitlement and unit value determined by the Minister (r 9(1)(a), r 9A(1)(a), r 9(3), r 9A(3)). Application to vary unit entitlements or quota entitlements must be in a Minister‑approved form, with specified documents and prescribed fee (r 9(5), r 9A(5)).

• When using on‑shore agents, ensure the licence holder or registered master remains on‑shore engaged in the activity and within 700 metres of the agent; do not permit more than two agents simultaneously (r 10(1)-(2)). Non‑compliance carries specified penalties and expiation fees.

Rights and entitlements:

• Licence holders have a transferable entitlement in property‑bundle terms, subject to Ministerial consent (r 5A(1)). Transferability creates a procedural right to seek consent; the Minister’s criteria for consent are spelled out (r 5A(3)).

• Where a licence ceases to be held, the Minister may issue it to another person, and may issue additional licences if not detrimental to aquatic resources (r 5(1)-(2)). The Minister may, but is not required to, call for applications via competitive tender (r 5(3)); if a tender is run, the successful tenderer has an expectation the licence will be granted, except in circumstances contemplated by Sch 2 cl 15.

• Licence holders have the right to make joint applications with other licence holders to reallocate unit entitlements between licences or between specified rock lobster licences and Miscellaneous Fishery licences (r 9(4)(a)-(b), r 9A(4)(a)-(b)). Those joint applications, if accepted, allow transfer of unit entitlement between licences.

• Licence holders have predictable quota calculation methodology: unit value is determined by the Minister on or before the commencement of each quota period, and unit entitlements multiply by that unit value to create quota entitlement for the quota period (r 9(3), 9(1)(a); r 9A(3), 9A(1)(a)).

• The Minister may vary quota entitlements between quota periods to allow limited carry‑forward of undercatch (increase by up to 10% absent exceptional circumstances) or apply reductions for overcatch (1 kg or 2 kg per kg depending on percentage over) (r 9(4)(c)-(d); r 9A(4)(c)-(d)). Variations are to be expressed as applying only for the quota period in which they are made (r 9(4b), r 9A(4b)).

• The Minister may make determinations of general or limited application, published on the Department website and notified to persons bound by them, creating an administrative right to expect rules and forms to be publicly accessible (r 13(1)-(4)). But rr 9, 9A and Sch 2 determinations are excluded from r 13 (r 13(6)); those instruments may therefore have separate publication processes.

Constraints on rights:

• The Minister retains substantive discretion: to issue additional licences only if not detrimental to resources (r 5(2)); to refuse transfer consent on several grounds including pending proceedings; to impose licence conditions limiting classes of fishing activity (r 6); and to determine unit values and make adjustments (rr 9, 9A). Where a tender is conducted, the Minister is required to grant only to the successful applicant (r 5(4)).

• Variations to quota entitlements are time limited (apply only for the quota period) and previous carry‑forward increases must be disregarded for future calculations (r 9(4a)-(4b), r 9A(4a)-(4b)). That constrains cumulative accrual of advantage from undercatch.

In practice, licence holders must manage application and transfer paperwork, meet record‑keeping and return obligations, monitor quota determinations and unit values announced by the Minister, and monitor the Department website or written notices for determinations (r 13(3)-(4)).

The Regulations specify penalties and expiation fees for named breaches and establish administrative enforcement points.

Monetary expiations and maximum penalties:

• On‑shore agent offences (r 10). Two distinct offences:

  • Permitting a person to be engaged on shore as an agent unless the licence holder or registered master is also on shore in the same activity and within 700 metres: maximum penalty $5,000; expiation fee $315 (r 10(1)).
  • Permitting more than two persons to be engaged at the same time on shore as agents: maximum penalty $5,000; expiation fee $315 (r 10(2)).

• Periodic returns and record retention (r 11).

  • Failure to provide returns as determined by the Minister: maximum penalty $5,000; expiation fee $500 (r 11(1)).
  • Failure to keep a record of each return in accordance with the Minister’s determination: maximum penalty $5,000; expiation fee $500 (r 11(2)).

• Keeping of records (r 12). A person required to keep a record must ensure it is in good condition, legible, readily accessible and produced to a fisheries officer on request. Maximum penalty: $2,500; expiation fee $210.

• Tender interference (Sch 2 cl 5). A person must not interfere with or remove a tender from the locked box prior to the close of tenders. Maximum penalty: $1,250.

The Regulations list only these specified penalties and expiation fees; other offences and penalties established under the principal Act may also apply, though those are not reproduced here.

Enforcement mechanisms and actors:

• Fisheries officers. Regulation 12 requires production of records to a fisheries officer on request, implying fisheries officers have inspection powers under this and the Act.

• Expiation scheme. The Regulations list expiation fees for specific breaches, indicating an administrative enforcement pathway where specified breaches may be dealt with by payment of an expiation fee rather than criminal prosecution. The amounts are set in the Regulations (r 10, r 11, r 12).

• Ministerial discretion leading to licence consequences. While not framed as a penalty in the Regulations themselves, the Minister may refuse to consent to transfers (r 5A(3)), may suspend licences under the Act (referenced in r 5A(3)(b) as a bar to transfer), and may revoke registrations on application (r 8(1)). The regulatory scheme also contemplates that licence conditions may be varied, including reductions in quota entitlements (r 9(4)(d), r 9A(4)(d)), which has a punitive economic effect for over‑catch.

• Tender guarantee forfeiture. Schedule 2 implements an enforcement mechanism for successful tenderers who then fail to apply for or accept licences: the ADI guarantee equal to 10% of the tender is forfeited on demand (Sch 2 cl 15).

Operational enforcement risks and uncertainties:

• The Minister’s discretion shapes enforcement outcomes. For example, the Minister must be satisfied that transferees are fit and proper persons before consenting to transfers and may refuse transfers where offences are alleged (r 5A(3)(c)-(e)). The absence of elaborate procedural protections in the Regulations for contested ministerial decisions means affected parties may need to rely on administrative law review under the Act and general administrative law principles in other legislation or the common law (not set out in these Regulations).

• Record and return enforcement depends on the Minister’s determination of form, content and retention periods. The Regulations impose penalties for failing to comply with that determination, but the form and timing of required returns are not set out here and are left to Ministerial determination (r 11), creating compliance uncertainty until those determinations are published.

• Quota enforcement and carry‑forward. The Minister may adjust future quota entitlements upward for undercatch (subject to a cap) or downward for overcatch with different multipliers depending on the degree of overcatch (rr 9(4)(c)-(d), 9A(4)(c)-(d)). Enforcement outcomes for quota breaches will therefore depend on measurement of total catch and the Minister’s lodgement of variations. Because variations apply for a single quota period (r 9(4b), r 9A(4b)) and increases previously applied must be disregarded for subsequent calculations (r 9(4a), r 9A(4a)), licence holders cannot assume a multi‑period accrual of benefits.

Administration and public notice:

• Determinations must be published on the Department website and may appear in the Gazette; written notice must be given to persons bound by the determination in a manner the Minister considers will bring it to attention (r 13(3)-(4)). Enforcement actors therefore have a statutory route to communicate rules, but compliance depends on licence holders monitoring those channels.

In sum, enforcement under these Regulations mixes criminal and administrative penalties, with several enforcement outcomes embedded in administrative decisions by the Minister, the content and timing of which are central to compliance and prosecution risk.

The Regulations do not operate in isolation; they reference and interact with other statutory instruments and administrative frameworks.

• Fisheries Management Act 2007. These Regulations are made under and sit subordinate to the Fisheries Management Act 2007 (the Act). The Act supplies the parent statutory structure for licensing, enforcement powers, and broader fisheries management objectives. The Regulations repeatedly refer to “the Act” (r 3(1) definition) and to offences against the Act as a bar to licence transfer (r 5A(3)(c)). The Regulations therefore must be read and implemented consistent with the rights, obligations and enforcement mechanisms in the Act.

• Corporations Act 2001 (Commonwealth). The Regulations adopt Corporations Act meanings for company, director, proprietary company and public company (r 3(2)). They require a current company extract as defined , a document prepared by ASIC from its national database enumerating company details including directors and office address , for company transferees (r 3(1) definition and r 5A(2)(c)). Consequently, ASIC records and corporate governance under the Corporations Act have direct bearing on licence approvals and transfers.

• Fisheries Management (Rock Lobster Fisheries) Regulations 2017. The giant crab quota provisions expressly reference corresponding definitions and quota frameworks in the Rock Lobster Fisheries Regulations 2017. In the Northern Zone r 9(2) and r 9(1)(b) and in the Southern Zone r 9A(2) and r 9A(1)(b) cross‑refer to the Northern Zone Rock Lobster Fishery and Southern Zone Rock Lobster Fishery meanings and unit entitlement definitions in those rock lobster regulations. The Regulations also permit joint applications to transfer unit entitlement between Miscellaneous Fishery licences and certain Rock Lobster Fishery licences (r 9(4)(b), r 9A(4)(b)). In practice, holders of rock lobster licences and Miscellaneous Fishery licences may be subject to coordinated management actions as to unit allocations.

• Commonwealth or corresponding law entitlements. Regulation 5A(3)(f) contemplates boats that are subject to Commonwealth or corresponding law licences or entitlements. The Minister may consent to transfer only if the entitlement is transferred or surrendered or, alternatively, if separate transfer is not likely to result in over‑exploitation and the other granting authority concurs. This cross‑jurisdictional linkage means Commonwealth entitlements, for example under Commonwealth fisheries law or permits, can constrain State licence transfers.

• Gazette and Departmental publication regimes. The Regulations require determinations to be published on the Department’s website and optionally in the Gazette (r 13(3)). Schedule 2 requires advertising in a form determined by the Minister and further requires advertisements to be published in the Gazette and possibly on a Minister‑determined website or in a State‑wide newspaper (Sch 2 cl 1(1a)). Administrative publication practices under the Public Service and the Gazette interact directly with the Regulations’ notice and tender rules.

• Australian Fish Names Standard AS5300,2019. Regulation 3(3)(a) sets common and scientific fish names according to AS5300,2019 as in force from time to time. That reference ties species naming and classification in the Regulations to that external standard.

• Expiation and general enforcement frameworks under State law. The Regulations set expiation fees for particular offences. Those provisions operate within the expiation, prosecution and fine collection frameworks provided by South Australian law and the Act, although those broader mechanisms are not reproduced in these Regulations.

• Administrative law principles. The Minister’s exercise of discretion (issuance, transfer consent, unit value determination, quota variation, tender procedures) will be conducted in the context of administrative law obligations and review mechanisms under State law (not set out in the Regulations). The Regulations do not elaborate appeals or merits review processes; they instantiate decision points that may be subject to judicial review or other remedies under broader administrative law.

The Regulations therefore create junctions with Commonwealth company law, other state fisheries regulations (rock lobster), Commonwealth fisheries entitlements, and administrative publication and enforcement frameworks. Practitioners advising clients must map State licence obligations against corporate records, concurrent Commonwealth permits and the Rock Lobster regulatory framework to anticipate constraints or necessary consents.

The Regulations include a legislative history section summarising revocations, variations and commencement dates. The statutory record shows the principal instrument commenced in 2015 and has been amended multiple times. The legislative history in this text records the following mechanical timeline and notable variations.

• Principal instrument. Fisheries Management (Miscellaneous Fishery) Regulations 2015 (No. 193) gazetted 13 August 2015 and commenced 1 September 2015 (r 2).

• Amendments and entries recorded:

  • 2017, No. 231 (Gazette 8 August 2017 p3421), amendments commencing 15 January 2018. These amendments inserted/varied several provisions: defined “Department” (r 3(1) insertion), substituted r 3(3), varied r 5A insertion, varied r 8(2), varied definitions and provisions in r 9 including giant crab quota entitlement and unit entitlement, substituted parts of r 11, and inserted rr 12-13 and Schedule modifications (see “Provisions varied” in legislative history lines).
  • 2020, No. 322 (Gazette 17 December 2020 p5786), commenced 17 December 2020; substituted the quota period definition in r 9 (quota period timing changes for Northern or Southern zone elements, see r 9 substitution).
  • 2021, No. 106 (Gazette 1 July 2021 p2612), commenced 1 July 2021; inserted r 5A (transfer of licence) and other variations (r 3 varied).
  • 2022, No. 41 and No. 42 (Gazette 16 June 2022 p1825 and p1831). No. 41 commenced 1 July 2022 and No. 42 commenced 1 October 2022 except r 3 which commenced 1 November 2022. These instruments substituted r 9 and inserted r 9A, and made detailed amendments to quota variation mechanics, including insertion of “following quota period” definition, amendment of r 9(4) and insertion of rr 9(4a)-(4c), r 9A analogous amendments, and amendment to r 13(6) to clarify determinations excluded (see legislative history notes).

• Revocation of prior regulations. The 2015 Regulations revoked Fisheries Management (Miscellaneous Fishery) Regulations 2000.

• Schedule 2 changes. Sch 2 cl 1 was varied by the 2017 amendment (231/2017) which added publication requirements for advertisements in the Gazette and possible website or State newspaper publication (Sch 2 cl 1(1a)).

Notable substantive amendment themes:

• Quota system evolution. Significant amendment activity relates to the giant crab quota system, with substitutions and additions to r 9 and creation of r 9A for the Southern Zone. The legislative history records amendments across 2017, 2020, 2021 and 2022 developing the quota scheme (r 9 substitution by 41/2022, r 9A inserted by 41/2022) and adding temporal rules (following quota period, limits on percentage carry‑forward, and rules to disregard previous increases when calculating new adjustments).

• Transfer regime introduction. Transfer of licences (r 5A) was inserted by the 2021 amendment (106/2021), creating an explicit transfer framework and documentation requirements.

• Administrative and publication details. The 2017 amendment refined r 3 (definitions), inserted record keeping and Minister’s determination powers (rr 12-13), and updated Schedule 2 tender publication requirements.

The legislative history attached to the Regulations thus provides a transparent amendment trail showing progressive elaboration of quota mechanics, introduction of transfer processes, and clarification of administrative publication and recordkeeping provisions. The history also identifies commencement dates for each variation, which is vital when considering rights and duties applicable in a given period.

The textual source of the Regulations supplies no cases, judicial interpretations or litigation history. There are no decisions cited or referenced in the instrument. The legislative history lists only legislative instruments, commencement dates and variations; it does not list any judicial review, enforcement proceedings or published decisions related to the Regulations.

Consequently, the text provides no statutory commentary, no appellate or judicial elaboration of operative phrases such as “fit and proper person”, no precedent on how the Minister must exercise discretion, and no recorded disputes about the tender process, quota variations or transfer consent. Practitioners will therefore need to rely on primary statutory text, administrative law principles, the Fisheries Management Act 2007, and any relevant decisions not recorded in this instrument for legal argumentation or interpretation. The absence of litigation citations in the instrument means the Regulations themselves do not supply case law guidance on contested points.

This section identifies practical traps and implementation details that commonly give rise to compliance risk, transactional friction or ambiguity, grounded in the text.

• Ministerial discretion and evidentiary thresholds. Many key outcomes hinge on the Minister’s satisfaction: issuing additional licences (r 5(2)), finding applicants fit and proper (r 5(6), r 5A(3)(d)-(e)), consenting to transfers (r 5A(3)), determining unit values (rr 9(3), 9A(3)) and varying quota entitlements (rr 9(4), 9A(4)). The Regulations do not specify evidentiary standards or procedural steps for those determinations. Practitioners should not assume objective minimum criteria beyond those expressly listed; instead, administrative practice and possibly separate determinations will shape application outcomes.

• Transfer documentation: returns up to date. Transfer applications must include a form of return as required by r 11 completed by the holder up to the date of application (r 5A(2)(b)). Because r 11 delegates the content, manner and timing of returns to Ministerial determination, a transfer applicant must ensure returns historically required are provided up to application date. Failure to supply up‑to‑date returns is grounds for refusal (r 5A(3)(a) links fee payment but r 5A(2)(b) imposes the return requirement).

• Cross‑jurisdictional entitlements. If a registered boat under the licence is also subject to Commonwealth or other entitlements, the Minister will require either co‑transfer, surrender or concurrence from the other granting authority (r 5A(3)(f)). Practitioners must check for such overlapping entitlements and secure co‑operation or surrender mechanisms before attempting State licence transfers.

• Tender procedure technicalities. Schedule 2 is prescriptive. Tenders must be sealed, accompanied by an ADI guarantee for 10% of the tendered amount, and deposited in a locked box. The advertisement must run in the Gazette and also possibly on a Minister‑determined website or State newspaper (Sch 2 cl 1(1a)). Interfering with the locked box prior to close carries a penalty of $1,250. Successful tenderers who fail to apply for or accept the licence forfeit their ADI guarantee. These are strict procedural traps; failing to meet them can forfeit expensive guarantees.

• Timing of quota period and unit value determination. For Northern Zone the quota period is 12 months commencing 1 November; for Southern Zone 12 months commencing 1 October (rr 9(1) and 9A(1) as amended). The Minister must determine the unit value on or before each quota period’s commencement (rr 9(3), 9A(3)). Licence holders must therefore track the Minister’s determination timetable; late public notice or failure to monitor could leave holders uncertain of permitted catch in the coming period.

• Carry‑forward and disregard rules. Under‑catch increases may be carried forward to the next quota period up to 10% absent exceptional circumstances; over‑catch can lead to reductions with 1 kg or 2 kg multipliers depending on the degree of over‑catch (rr 9(4)(c)-(d), 9A(4)(c)-(d)). Important constraints: any increase made by the Minister under a prior carry‑forward must be disregarded for calculating further adjustments (r 9(4a), r 9A(4a)), and variations under rr 9(4)(c) or (d) apply only for the quota period in which they are made (r 9(4b), r 9A(4b)). Practically, licence holders cannot treat under‑catch increases as permanent asset accretion or rely on multi‑period compounding.

• Prohibition on certain reallocation applications. An application under subregulation (4)(a) or (b)(i) to reallocate unit entitlements may not be made in respect of giant crab units allocated to a licence under subregulation (4)(c) , i.e., units created by carry‑forward cannot be immediately reallocated (r 9(4c), r 9A(4c)). This constraint limits transactional flexibility soon after carry‑forward adjustments.

• Determinations outside r 13. Regulation 13 provides for determinations generally, requiring online publication and notice. But r 13(6) expressly excludes determinations made for the purposes of regulations 9, 9A or Schedule 2 from r 13. That means some decisions about quotas and tender procedures may follow different publication or notice practices; stakeholders must monitor the Department’s communications channels and gazette advertisements per Sch 2 to ensure they receive relevant notice.

• Minimum age is 15. The minimum age for a licence holder or transferee natural person is 15 years (r 5(6)(a), r 5A(3)(d)). This is a low threshold relative to commercial expectations; however fit and proper requirements remain and parents or guardians may need to be involved in transactions where minors are concerned.

• Expiation amounts and criminal risk. Some breaches have expiation fees (r 10, r 11, r 12). Choosing to rely on expiation payment may not be optional for some breaches if the Act provides for discretionary prosecution. The Regulations do not specify whether all breaches are expiable only; practitioners should consider that recalcitrant or systematic non‑compliance may be escalated to prosecution under the Act.

• Absence of appeal mechanics in the Regulations. The Regulations do not set out merits review or appeal pathways for disputed Ministerial decisions. Parties disputing fitness, transfer refusals or quota variations will need to consider general administrative law remedies and any appeal mechanisms under the Act or wider South Australian law; those are not detailed here.

These practical points show that administrative timing, documentary completeness (company extracts, returns), cross‑jurisdictional entitlement checking, and understanding the temporal limits on quota adjustments are recurring sources of compliance risk.

This section sets out a compliance checklist and recommended processes grounded in the Regulations’ prescriptions. It focuses on proactive steps licence holders, transferees, tenderers and their advisers should take.

1. Establish licence status and scope.

   • Confirm that the species to be taken fall within the Miscellaneous Fishery (Sch 1 excludes Abalone, King Prawn, Southern Rock Lobster). Ensure you hold the appropriate licence to take species in the fishery (r 4).

2. For applicants seeking a licence.

   • Determine whether the Minister will run a tender. If so, follow Schedule 2 requirements: prepare a sealed tender; arrange an ADI bank guarantee equal to 10% of the tendered amount; ensure tender submission meets the advertised close date (Sch 2 cl 1-4). Confirm advertisement details in Gazette and any Minister‑determined website or newspaper per Sch 2 cl 1(1a).
   • Keep records of tender documentation and bank guarantee instruments.

3. For successful tenderers.

   • Timely application: if successful, apply for the licence within a reasonable time and accept the licence to avoid forfeiture of the 10% ADI guarantee (Sch 2 cl 15).
   • Prepare to pay the clearing price if more than one licence is granted (Sch 2 cl 10, 14).

4. For licence transfers.

   • Complete transfer application with: the licence to be transferred; returns up to application date (a form of return as required by r 11) completed by the holder (r 5A(2)(a)-(b)); if transferee is a company, include a current company extract from ASIC (r 5A(2)(c)).
   • Ensure all fees and amounts payable in relation to the licence are paid (r 5A(3)(a)), the licence has not been suspended (r 5A(3)(b)), and there are no pending or likely proceedings alleging offences against the Act (r 5A(3)(c)).
   • For company transferees, ensure each director meets the fit and proper person test in the Minister’s view (r 5A(3)(e)). Provide any further documents the Minister requests.

5. Fit and proper preparedness.

   • Gather documentation evidencing competence, compliance history, and character for all natural person applicants or company directors. Have current company extracts ready for corporate applicants.

6. Registration of vessels and masters.

   • When registering a boat, device or master for use under the licence, provide the documents specified in the application form (r 7). Keep copies and ensure master nominations are accurate.

7. Record keeping and returns.

   • Monitor the Minister’s determinations for the form, manner, timing and content of returns and retention periods. Keep legible, well‑organised records accessible for immediate production to fisheries officers upon request (r 11, r 12).
   • Retain copies of each return as required by the Minister and ensure records are maintained in good condition and readily accessible (r 11(2); r 12).

8. Giant crab quota compliance.

   • Determine whether your licence has unit entitlement for the Northern or Southern Zone. Note quota period commencement dates: Northern Zone 1 November, Southern Zone 1 October (rr 9(1), 9A(1)).
   • Track the Minister’s determination of unit value and any quota entitlement variations on or before the quota period’s commencement (rr 9(3), 9A(3), r 13 notice mechanisms).
   • If seeking to reallocate unit entitlements or exchange units with rock lobster licence holders, prepare joint applications in approved form and be aware of the limitation disallowing reallocation of units that were created by prior carry‑forward (r 9(4c), r 9A(4c)).
   • Monitor catch relative to quota entitlement; undercatch may permit a limited carry‑forward to the following quota period but is capped at 10% absent exceptional circumstances (r 9(4)(c), r 9A(4)(c)). Overcatch will attract reductions for the next quota period with prescribed multipliers (r 9(4)(d), r 9A(4)(d)).

9. On‑shore agent compliance.

   • If using on‑shore agents, ensure the licence holder or registered master is physically onshore, engaged in the same class of fishing activity and remains within 700 metres of each agent while they are engaged (r 10(1)). Do not permit more than two agents at the same time (r 10(2)). Record who is acting as agent and maintain location and activity logs to evidence compliance in case of inspection.

10. Monitor determinations and publications.

    • Regularly review the Department’s website for Ministerial determinations (r 13(3)(a)) and the Gazette for advertisements (Sch 2 cl 1(1a)). Where determinations are to be given in writing to persons bound (r 13(4)), ensure contact details provided to the Department are current and appropriate methods of service are used.

11. Tender procedural compliance for issuing licences.

    • If participating in tenders, ensure envelope labelling, sealing and timing per Sch 2. Retain proof of deposit in the Minister’s locked box and be present or follow post‑opening published outcomes to confirm supply and whether you are a successful tenderer.

12. Fees and penalties.

    • Pay prescribed fees, including tender guarantees and any prescribed application fees for quota entitlement variations (r 9(5)(c), r 9A(5)(c)). Address expiation notices timely if issued and consult on the risk of prosecution where systematic non‑compliance exists.

13. Cross‑jurisdictional checks.

    • For vessels that may be the subject of Commonwealth entitlements or other State licences, coordinate with holders of those entitlements to secure concurrence or surrender where necessary to facilitate State licence transfer (r 5A(3)(f)).

14. Administrative rights and challenge.

    • If refused transfer consent or subject to a quota variation, seek detail from the Department on reasons and the Minister’s determination. Consider administrative law review avenues if statutory or procedural fairness issues arise, noting the Regulations do not set out internal appeal mechanisms.

This checklist reduces operational surprises by anchoring compliance to the statutory text: ensure returns are current for transfer applications, meet tender guarantees and procedural deposit protocols, track quota period commencement and unit value determinations, and maintain accessible, legible records for inspection.
