#### 41 Traps to be used only if endorsement holder’s quota has not been taken 41 Traps to be used only if endorsement holder’s quota has not been taken > > (1) An endorsement holder must not set or use a commercial lobster trap to take rock lobster for sale unless— > > > > > (a) the endorsement holder or, in the case of an endorsement holder who is a nominated fisher for a shareholder, the shareholder has been allocated a quota for the period concerned by the Minister or has acquired quota in respect of the period concerned by means of a transfer, and > > > > > (b) the whole of that quota has not been taken. > > > (2) An endorsement holder must remove from the water any commercial lobster trap set or used by the endorsement holder as soon as practicable after taking his or her quota of eastern rock lobster. > > > (3) A contravention of this clause is an endorsement holder offence.
