#### 53 Firearms 53 Firearms > > (1) A person must not take any fish in any waters by means of a firearm. > > > > Maximum penalty—50 penalty units. > > > (2) It is not an offence under this clause for a commercial fisher to use a firearm to kill or attempt to kill shark or other fish lawfully taken by means of fishing gear (other than a firearm). > > > (3) In this clause, firearm does not include a spear gun.
