#### 129 Eligibility for endorsements 129 Eligibility for endorsements > > (1) A person who, immediately before 1 September 2019, was eligible for an endorsement in the restricted fishery remains eligible for that endorsement, subject to this clause. > > > (2) If a fishing business owner transfers an endorsement that is a component of a fishing business to another person, in accordance with the fishing business transfer rules— > > > > > (a) the fishing business owner, or any nominated fisher of the fishing business owner, ceases to be eligible for that endorsement, and > > > > > (b) the person to whom the endorsement is transferred becomes eligible for an endorsement of the same kind. > > > (3) A person whose endorsement is cancelled by the Minister under this Division (otherwise than because the person has ceased to be eligible for an endorsement) is taken, on that cancellation, to cease to be eligible for the endorsement. > > Note. > > Historically, eligibility for an endorsement was determined on the basis of shareholdings in the abalone fishery (which previously formed part of the sea urchin and turban shell restricted fishery).
