Fisheries Management (Fish Processors) Regulations 2017

The regulations operationalise several core concepts that structure compliance and enforcement:

• Registered fish processor: the principal regulated actor. The regulations refer to “a registered fish processor” and impose duties on that person wherever the person purchases, obtains, is consigned or delivered aquatic resources (see regs 6, 7, 8 et seq., 16-18). Registration is controlled under the Act; the regulations specify certain exemptions (reg 4) and grounds for refusal (reg 5).

• Ministerial determinations as the central standard-setting device: almost every substantive obligation is qualified by the phrase “in the manner and form, at such places and at such times, as determined by the Minister” (for example, regs 8(1)(a)-(c), 9(1)(a)-(c), 14(1)(a)-(c), 17(1)(a)-(b), 17(2)(a)-(b)). The Minister may make general or limited determinations, differentiate by person, thing or circumstance, publish on the Department website and notify affected persons (reg 19). Determinations may be varied or revoked (reg 19(5)). That design separates strategic/threshold rules in the regulations from operational detail left to administrative determination.

• Species-specific processing regimes: the regulations list specific species (abalone, vongole, pipi, blue crab, giant crab, sardines, tuna, rock lobster, King George whiting, snapper, southern calamari, southern garfish) and for each require recording, reporting and operational controls (regs 8-15D). The structure of each species regulation is consistent: record specified information as determined by the Minister; provide that information to the Department (for tuna, Department or AFMA); and ensure accompanying information and handling (weighing, storage, containers, sealing, tagging, sale, transport, consignment or disposal) is in accordance with Ministerial requirements.

• Record-keeping and returns: regs 16-18 require periodic returns, records for premises/consignments, and preservation/production of documents. Reg 16 obliges registered fish processors to provide returns “in the manner and form, at such times and containing such information, as determined by the Minister” and to keep copies of returns. Reg 17 focuses on records for each premises/consignment and requires transmission of information to the Department. Reg 18 prescribes good condition, legibility, accessibility and production to a fisheries officer on request.

• Enforcement mechanics: offences are created by failure to comply with Ministerial determinations, failure to provide returns or keep records as determined, failure to check consignments for undersize fish and failure to keep documents in prescribed form. Maximum penalties are uniformly specified (typically $2,500) and many contraventions carry an expiation fee of $210. Reg 7 contains a rebuttable evidentiary presumption where undersize fish are found in the processor’s possession (reg 7(3)): then the processor is taken, absent proof to the contrary, to have failed to perform the duty to check (reg 7(1)).

• Interaction with Commonwealth AFMA for tuna: the tuna regulation (reg 14) requires provision of recorded information to the Department or AFMA, introducing an inter-jurisdictional reporting mechanism for that species.

• Exemptions and carve-outs: reg 4 removes registration obligations for two specified classes; reg 16(3) and reg 17(5) limit the application of reg 16 and reg 17 respectively to holders of fishery authority or aquaculture licence in certain contexts (they are only required to comply in relation to aquatic resources sold or delivered to an unregistered fish processor (reg 16(3)); and reg 17(5) exempts fishery authority/aquaculture licence holders from reg 17 in relation to aquatic resources taken or farmed under their authority or licence).

These concepts combine a low-level offence/penalty structure with broad administrative discretion for the Minister to set operational detail via determinations. The instrument thus delegates day-to-day compliance specifications while maintaining statutory teeth in the form of penalties, presumptions and inspection rights.

The regulations directly affect several discrete actor groups and indirectly affect others through reporting and inspection chains:

• Registered fish processors: primary addressee of the regulations. They must register and comply with duties across reg 6 (adding premises/boats/vehicles), reg 7 (checking consignments for undersize fish), regs 8-15D (species-specific recording, handling and reporting), reg 16 (periodic returns) and reg 17 (records for premises and consignments). They must also keep and produce documents per reg 18. Registered processors carry the compliance costs and exposure to penalties.

• Unregistered persons who take physical possession of aquatic resources: unless exempted, persons who take physical possession and process, store, transport or otherwise deal with aquatic resources will fall within the ambit of registration requirements and all duties that attach to registered processors. The instrument does not list an exhaustive register of who must register; it prescribes exemptions and leaves the Act to define registration triggers (reg 4 interacts with the Act).

• Persons who buy and sell without taking physical possession: reg 4(a) expressly exempts persons who buy and sell aquatic resources without ever taking physical possession from registration as fish processors for the purposes of s 62(2)(c) of the Act. These actors are therefore outside the registration obligations in these regulations, though their upstream suppliers or logistic operators may be caught.

• Sellers operating under a permit in the Miscellaneous Broodstock and Seedstock Fishery: reg 4(b) exempts persons who sell aquatic resources taken pursuant to a permit in that particular fishery from registering as fish processors. The exemption is narrow and tied to a defined fishery.

• Holders of fishery authorities or aquaculture licences: partial carve-outs apply. Reg 16(3) limits the obligation to provide returns to those holders only in relation to aquatic resources sold or delivered to an unregistered fish processor. Reg 17(5) states holders of fishery authorities or aquaculture licences are not required to comply with the record-keeping requirements in reg 17 in relation to aquatic resources taken or farmed under their authority or licence. Thus licence-holders remain affected in some scenarios (notably where they sell to unregistered processors) but are exempt for their own catches/farming operations regarding the specified records.

• The Department and Minister: the Department is the recipient of required information and returns (see regs 8-15D, 16, 17). The Minister is the decision-maker who sets the content, manner, times, places and forms via determinations and exercises refusal powers for registration on environmental/disease risk grounds (reg 5). The Minister also publishes determinations on the Department website and issues notices to affected persons (reg 19).

• AFMA (Australian Fisheries Management Authority): named only in reg 3 and reg 14. For tuna processors, reg 14(1)(b) requires provision of recorded information either to the Department or to AFMA, so AFMA may be a direct recipient of operational data about Southern Bluefin Tuna processing activities.

• Fisheries officers: empowered to request production of documents kept under these regulations (reg 18(c)); processors must keep documents produced on request. Fisheries officers are enforcers and inspectors in the compliance chain.

• Transport and logistic operators: because the regulations condition weighing, containerisation, sealing and tagging, as “as determined by the Minister” for a range of species (e.g. regs 8(1)(c), 15(1)(c)), operators involved in movement and storage will be affected operationally, even if not the primary regulated party. Liability and compliance obligations sit with the registered fish processor, but practical operational changes will affect service providers.

Who pays: registered processors bear administrative costs (record-keeping, tagging, sealing, weighing, storage arrangements), fees for additional premises registration (reg 6(2)(c) prescribes a fee, though the amount is not stated in the regulations), potential expiation fees ($210 for many contraventions) and exposure to a maximum penalty of $2,500 for non-compliance. The Department and Minister bear the administrative cost of making and publishing determinations and processing registrations, acceptance of returns and inspections.

Duties

• Duty to register and to add premises before use: a registered fish processor must apply to have any additional premises, place, boat or vehicle specified in the processor’s certificate of registration before using it for processing, storage, transport or dealing with aquatic resources (reg 6(1)). The application must be in a Minister-approved form, completed according to instructions and accompanied by the prescribed fee (reg 6(2)(a)-(c)).

• Duty to check for undersize fish: reg 7(1) requires a registered fish processor to, as soon as possible after a consignment is delivered, take all reasonable steps to check for undersize fish. If undersize fish are found, reg 7(2) requires immediate rendering of those fish unsuitable for sale or consumption and their disposal as waste. Both subregs attract a maximum penalty of $2,500 and reg 7 contains an evidentiary presumption: if undersize fish are found in the processor’s possession, the processor is taken, unless they prove otherwise, to have failed to comply with reg 7(1) (reg 7(3)).

• Species-specific recording and handling duties: for each listed species (regs 8-15D) a registered fish processor must: (a) record information in the manner/form/places/times determined by the Minister (e.g. reg 8(1)(a)); (b) provide that recorded information to the Department, or for tuna, the Department or AFMA, in the manner/form/times determined by the Minister (e.g. reg 14(1)(b)); and (c) ensure that the aquatic resources are accompanied by the required information and are handled (weighed, stored, placed in containers, sealed, tagged, and sold/transported/delivered/consigned or otherwise dealt with) at such places and times as the Minister determines (e.g. reg 15(1)(c)). Non-compliance with a relevant Ministerial determination is an offence carrying the prescribed penalty and, in many cases, an expiation fee (see, for example, reg 8(2)-(3)).

• Periodic returns: reg 16(1) requires registered fish processors to provide returns in manner/form/times/with information as the Minister determines. Processors must retain a copy of each return in the manner and for the period as determined (reg 16(2)). Contraventions attract a maximum penalty of $2,500 and an expiation fee of $210 (reg 16(4)). Note the partial exception in reg 16(3) that a holder of a fishery authority or aquaculture licence is only required to comply with reg 16 in relation to aquatic resources sold or delivered to an unregistered fish processor.

• Records for premises and consignments: reg 17 obliges fish processors to record specified information about premises, places, boats or vehicles used by the fish processor (reg 17(1)) and for each consignment or batch received (reg 17(2)), providing the recorded information to the Department as determined by the Minister. Non-compliance attracts the usual penalties and expiation fees (reg 17(3)-(4)). Reg 17(5) exempts holders of fishery authority or aquaculture licence from compliance in relation to aquatic resources taken or farmed under those authorities or licences.

• Document condition and production: reg 18 requires that any document required to be kept under the regulations be maintained in good condition, legible and in a readily accessible place, and produced for inspection by a fisheries officer on request. Non-compliance attracts a maximum penalty of $2,500 and an expiation fee of $210.

Rights, procedural protections and ministerial powers

• Minister’s discretion on registration and refusals: the Minister may refuse to grant registration where satisfied that registration would create a risk of harm, including disease, to aquatic resources or the local ecological environment (reg 5). This is an express statutory ground tied to environmental and biosecurity risk.

• Ministerial determination power: the Minister may make determinations for the purposes of any regulation; determinations may be general or limited, may differentiate between persons and circumstances, must be published on the Department’s website and persons bound notified in writing as soon as practicable, and may be varied or revoked (reg 19(1)-(5)). The publication and notification requirements create a procedural avenue for processors to be informed of expectations.

• Rebuttable evidentiary presumption: reg 7(3) creates a legal presumption against a registered processor found in possession of undersize fish , the presumption is that the processor failed to take reasonable steps to check consignments unless they prove otherwise. This shifts an initial evidentiary burden onto the processor.

• Exemptions: reg 4 carves out two classes of persons from the requirement to be registered (buyers/sellers without physical possession; sellers under certain permits in a named fishery). This is a statutory right/privilege to operate outside the registration regime in those narrow circumstances.

• Access to AFMA for tuna information: reg 14(1)(b) permits the Minister to require that information about tuna processing be provided to AFMA as an alternative to the Department, institutionalising a data-sharing/right of access route to Commonwealth management for that species.

• Right to notice: reg 19(3)-(4) requires publication and specific notice to persons bound by a Ministerial determination. The phrases “must be published on the Department’s website” and “as soon as practicable after a determination ... a notice in writing... must be given to the persons bound by the determination” create enforceable procedural steps for promulgation of requirements.

These duties allocate compliance responsibilities largely to registered fish processors and create administrative rights and channels for the Minister and Department to issue, alter and enforce operational detail. The design produces routine compliance obligations but relies on administrative instruments for specification, with statutory penalties and a shifted evidentiary burden in one key area (undersize fish).

Penalty structure

• Maximum monetary penalty: across the regulations most offences for failure to comply with a Ministerial determination or record-keeping/return obligations are subject to a maximum penalty of $2,500. Examples include reg 7(1) and (2) (duty to check and render undersize fish unsuitable), reg 8(2) (failure to comply with a Ministerial determination for abalone), reg 16(4) (failure to comply with period returns), reg 17(3)-(4) (failure to comply with reg 17), and reg 18 (documents not maintained/produced).

• Expiation fees: many contraventions are associated with an expiation fee of $210. These are explicitly listed as expiation fees in the species provisions (e.g. regs 8(2)-(3), 9(2)-(3), 10(2)-(3), up to reg 15D(3)), reg 16(4), reg 17(3)-(4), and reg 18. That creates a consistent administrative penalty level for summary resolution of typical regulatory breaches.

• Presumptive evidentiary consequences: reg 7(3) sets a specific evidentiary mechanism: if undersize fish are found in the possession of a registered fish processor, the processor will be taken, in the absence of proof to the contrary, to have failed to comply with the duty to check (reg 7(1)). This is not a separate penalty but an evidentiary tool that reduces prosecutorial burden and raises the compliance cost for processors by requiring them to establish they carried out the required checking.

Enforcement actors and powers

• Fisheries officers: reg 18(c) requires that documents be produced for inspection by a fisheries officer on request; that implies that fisheries officers have inspection powers and act as primary enforcers. The regulations do not specify search/seizure powers beyond production on request, but production obligation and penalties create procedural leverage for inspectors.

• Department and AFMA as recipients: compliance enforcement includes submission of records/returns to the Department and, for tuna, possibly to AFMA (reg 14(1)(b)). Receipt and analysis of returns create administrative monitoring capacity and expose processors to audits or follow-up enforcement.

• Ministerial determinations: because most obligations require compliance with the Minister’s determinations (reg 19), breaches are often framed as non-compliance with those determinations; enforcement therefore hinges on publication and notice (reg 19(3)-(4)), and the existence and content of determinations will determine the precise legal obligation. Enforcement requires the Department to maintain public and targeted notice to processors.

Operational characteristics of enforcement

• Low monetary ceiling, high granularity: the maximum penalty of $2,500 is modest relative to potentially significant economic stakes in processing operations. The statutory design suggests enforcement will be largely administrative and regulatory rather than criminal-penal in scale. The availability of an expiation fee ($210) for many contraventions indicates an expectation of administrative resolution.

• Reliance on record-keeping and detection: enforcement mechanisms centre on inspection of records and physical inspection of consignments. Reg 7 places an inspection duty at receipt and creates a rebuttable presumption to facilitate prosecution of undersize fish incidents. Reg 18 mandates production of documents to fisheries officers; regs 16-17 require retention and transmission of returns and records.

• Inter-agency cooperation for tuna: reg 14 allows sharing of data with AFMA. That creates enforcement integration for tuna between state and Commonwealth agencies.

• Administrative discretion and notice dependencies: because substantive operational detail is delegated to Ministerial determinations, enforcement depends on the Minister making, publishing and notifying determinations in accordance with reg 19(3)-(4). Failure to publish or notify a determination (or failure to do so “as soon as practicable”) could complicate enforcement of obligations based on that determination, although the regulations impose the publication and notification duty.

• Evidentiary and compliance risk: the presumption in reg 7(3) imposes practical risk for processors: discovery of undersize fish can create a legal inference of non-compliance absent demonstrable contemporaneous checking, shifting the evidentiary burden to the processor to show reasonableness of steps taken.

In short, enforcement is designed to be administratively routinised (returns, records, expiation fees) and facilitated by an inspection-presumption regime for undersize fish, with the Minister and Department playing central roles in operational specification, receipt and enforcement of compliance. The low penalty ceiling and standardised expiation fee suggest an emphasis on routine regulatory compliance rather than large fines.

The regulations are expressly made under the Fisheries Management Act 2007 and are constructed to operate alongside other regulations and Commonwealth arrangements referenced within the instrument. The text names specific cross-references and inter-operational points:

• Fisheries Management Act 2007: the regulations are subordinate to the Act. They explicitly refer to sections of the Act when prescribing exemptions and grounds for refusal: reg 4 is “for the purposes of section 62(2)(c) of the Act” and reg 5 is “for the purposes of section 64(3)(b) of the Act”. That indicates the regulations implement and fill detail for statutory registration and refusal processes created by the Act.

• Fisheries Management (General) Regulations 2017: reg 3 defines “undersize fish” to have the same meaning as in the Fisheries Management (General) Regulations 2017. The undersize fish duty in reg 7 therefore interacts with definitions and potentially measurement or size standards contained in that general regulation.

• Other species-specific regulations: reg 3 cross-references the Fisheries Management (Blue Crab Fishery) Regulations 2013 and the Fisheries Management (Miscellaneous Broodstock and Seedstock Fishery) Regulations 2013 for definitions/meanings of “blue crab” and the named fishery respectively. Reg 4(b) provides an exemption relating to permits in the Miscellaneous Broodstock and Seedstock Fishery; compliance obligations for those activities may be governed by the separate Regulations to which reg 4 refers.

• AFMA and Commonwealth law: reg 3 defines AFMA as the Australian Fisheries Management Authority established by the Fisheries Administration Act 1991 (Commonwealth). Reg 14(1)(b) allows recorded information in respect of tuna to be provided to “the Department or AFMA” in the manner/form/times determined by the Minister. That creates an explicit data-sharing or reporting interaction between state-level processing regulation and Commonwealth management, presumably reflecting the inter-jurisdictional management regime for Southern Bluefin Tuna. The regulations do not purport to alter Commonwealth jurisdiction, but they create a pathway for information flow.

• Registration and licensing regimes: reg 6 requires registered fish processors to lodge applications to add premises, boats or vehicles to a certificate of registration, linking to the Act’s registration framework. Reg 16(3) and reg 17(5) carve out some obligations for holders of fishery authorities or aquaculture licences in relation to their own catches/farming operations, indicating that the regulations are intended to coexist with licence-based obligations under the Act or related subordinate instruments.

• Administrative law and delegated instrument rules: reg 19 allows determinations that are published on the Department website and may be published in the Gazette. The Minister’s determinations vary or revoke operational detail. This delegation raises typical administrative law interactions: determination content and the process for promulgation could become relevant to judicial review or legal challenges (the regulations themselves do not include procedural constraints beyond publication and notice). The instrument also references publication obligations that intersect with transparency and procedural fairness norms.

• Evidence and prosecution rules: reg 7(3) creates a statutory evidentiary presumption that interacts with criminal/prosecutorial procedures under the Act and the regulations. The presumption will be invoked in relevant proceedings, placing an evidentiary burden on the processor.

• Record retention and access: reg 18 requires documents to be maintained and produced to fisheries officers; that may interact with broader privacy, confidentiality or commercial-in-confidence frameworks (not addressed in the regulations). The regulations specify production on request; they do not provide express limits on use or disclosure of the produced material beyond the normal administrative operation.

In sum, the regulations are tightly linked to the Act and to a set of other fisheries regulations and Commonwealth arrangements. Practical compliance requires processors to understand definitions and obligations in other subordinate instruments (e.g. general regs for undersize fish) and to expect data-sharing with AFMA for tuna. Many enforceable specifics are deferred to Ministerial determinations, heightening the importance of monitoring determinations and their publication as part of the broader legal landscape.

The instrument provides a concise legislative history and records revocations and insertions since its commencement:

• Original instrument and commencement: Fisheries Management (Fish Processors) Regulations 2017 (No 225) were published in the Gazette on 8 August 2017 and commenced on 15 January 2018 (Gazette reference in the legislative history).

• Variation in 2021: Regulation variation No 93 of 2021 (Gazette 24 June 2021 p2370) commenced on 1 July 2021. The 2021 instrument inserted new species provisions: King George whiting, snapper, southern calamari and southern garfish (regs 15A-15D). The variation note records that rr 15A-15D were inserted by the 93/2021 instrument commencing 1 July 2021.

• Omissions under Legislation Revision and Publication Regulations 2002: the history records that reg 2 and Sch 1 were omitted under the Legislation Revision and Publication Regulations 2002 as of 1 July 2021. The specific content of the omitted provisions is not present in the text provided.

• Revocation of prior instrument: the 2017 regulations revoked the Fisheries Management (Fish Processors) Regulations 2007. The instrument’s legislative history includes that revocation.

• Notation of “New entries appear in bold”: the legislative history describes the entries that were varied and when. For example, r 3 remains noted as varied and r 4 had species inserted by the 2021 amendment: King George whiting (inserted by 93/2021 r 4(1)), snapper, southern calamari, and southern garfish (inserted by 93/2021 r 4(2)).

• Commencement sequencing: amendments in 2021 commenced on 1 July 2021. The principal regulations originally commenced on 15 January 2018 after Gazette notice on 8 August 2017.

The legislative history provided in the instrument is focused on the statutory amendments to the regulations themselves and does not list any regulatory determinations made by the Minister under reg 19, nor does it include any note of subordinate determinations or policy instruments that implement the “manner and form” details. It also does not list any subsequent variations beyond the 2021 amendments nor any revocations other than the 2007 instrument. Where the regulations themselves refer to determinations (reg 19), the history does not supply a register of what determinations have been made; those are to be found on the Department website per the publication requirement in reg 19(3).

Users needing a complete compliance timeline should therefore check the Department’s website for all Ministerial determinations and any administrative instruments promulgated under reg 19, and check government Gazette notices for any later amendments not recorded in the legislative history section of the instrument provided here.

The text of the regulations does not record any judicial decisions, appeals or litigation relating to the instrument. There are no named cases, no references to court judgments, and no summaries of legal challenges in the legislative text provided. The instrument’s legislative history records only statutory amendments and revocations of prior subordinate legislation (the 2007 regulations were revoked), but it does not include any litigation narrative.

Consequently, based solely on the supplied instrument, there is no litigation history to summarise: no cases are identified in the regulation text, and no judicial interpretation of the provisions is cited. For any litigation that might have arisen in practice , for example, disputes about the validity or content of Ministerial determinations under reg 19, challenges to registration refusals under reg 5, prosecutions for failure to check consignments under reg 7, or evidentiary disputes over the presumption in reg 7(3) , one would need to search South Australian Court and Tribunal databases, administrative law judgments, or Attorney-General/Government legal advice records. The instrument itself contains no such material.

Readers requiring an authoritative litigation history should therefore consult case law databases, South Australian criminal and administrative court records, and the Department’s enforcement reports, since the instrument does not supply judicial developments or precedent.

The regulations are compact but contain a number of operational traps and areas that create legal and compliance risk if not carefully managed. Below are concrete points to watch, with direct citations to the relevant regulation provisions.

• Heavy delegation to Ministerial determinations creates regulatory uncertainty (reg 8(1)(a)-(c); reg 19): most substantive obligations (what to record, how to tag/seal, where to weigh, how long to keep records, timing of returns) are left to determinations. Until a processor has concrete determinations, the obligations lack operational specificity. Compliance therefore depends not only on reading the regulations but on monitoring Department publications and written notices from the Minister (reg 19(3)-(4)).

• Publication and notice timing: reg 19(3) requires determinations to be published on the Department’s website, and reg 19(4) requires the Minister to give a notice in writing “as soon as practicable” to persons bound. The phrase “as soon as practicable” is flexible; processors exposed to changes should not assume immediate notification. Failure to monitor the Department website could leave a processor unaware of new or varied determinations that form the legal basis of offences.

• Rebuttable presumption for undersize fish (reg 7(3)): if undersize fish are later found in a processor’s possession, the processor is taken, absent proof to the contrary, to have failed to take all reasonable steps to check upon delivery. This places an onus on processors to retain contemporaneous evidence of checks (timing, who checked, method) to rebut the presumption. General record-keeping obligations must be tailored to produce that evidence.

• Exemption scope is narrow and operationally specific (reg 4): reg 4(a) exempts persons who buy/sell without ever taking physical possession. That exemption may be narrower than some market participants assume: any taking of physical possession will likely remove the exemption and bring registration obligations. Reg 4(b) exempts sellers under a permit in a named fishery only , a narrowly-defined circumstance.

• Registration of additional premises before use (reg 6(1)): processors who begin using a new premises, place, boat or vehicle for processing without lodging the required application risk contravening the regulation. The application must be in a Minister-approved form, completed per instructions, and accompanied by the prescribed fee (reg 6(2)). The regulation does not state a grace period or transitional allowance.

• Exemptions for licence-holders are contextual (regs 16(3) and 17(5)): holders of a fishery authority or aquaculture licence are exempt from certain obligations only in precise circumstances (e.g. reg 16(3) applies only in relation to aquatic resources sold or delivered to an unregistered fish processor). Misreading these carve-outs could cause compliance gaps when licence-holders deal with registered processors or with third parties.

• Multiple recipients and data-sharing for tuna (reg 14(1)(b)): processors of Southern Bluefin Tuna must be prepared to provide information either to the Department or AFMA. That may create additional reporting lines or duplicative requests; processors should obtain clarity on which body they must submit to in practice. The regulation does not specify which of the two will be the default recipient in any given case.

• Uniform penalty ceiling: the maximum penalty for non-compliance is $2,500 and the common expiation fee is $210. For high-volume or repeated non-compliance episodes, these sums may be small compared with commercial value, creating potential regulatory economics where administrative fines are tolerable relative to the cost of operational change. Regulators may respond by escalating enforcement frequency or seeking alternative sanctioning approaches, but the regulations themselves cap penalties.

• Record condition, accessibility and production obligations (reg 18): documents must be kept legible, in good condition and in a readily accessible place and be produced to a fisheries officer on request. Processors using off-site/archive storage, or relying on informal records, risk contravening these requirements. Electronic records are not expressly discussed; processors should confirm whether electronically-stored records meet the “readily accessible” requirement.

• Lack of detailed transitional rules for amended species list: regs 15A-15D inserting additional species came into force on 1 July 2021. The regulations do not specify transitional compliance arrangements for processors who dealt with those species before that date; practitioners should check Ministerial determinations and Department notices for transitional directives.

• No express confidentiality/data-use limitation: while regs require provision of information to the Department (and AFMA for tuna), the regulations do not specify confidentiality protections for commercially sensitive data. Processors should anticipate potential disclosure or internal data-sharing practices and seek clarification from the Department about handling of commercially sensitive information.

• Prescribed fees unspecified in the regulations: reg 6(2)(c) requires that applications to add premises be “accompanied by the prescribed fee” but the regulations do not specify the fee quantum. Processors must consult fee schedules or Department guidance to budget correctly.

These “gotchas” are operational rather than doctrinal: they concern timing, evidentiary burden, administrative discretion, narrow exemptions and information flows. Each creates a specific behavioural adjustment for processors, and the text of the regulations (as cited above) is the primary source for identifying these obligations and risks.

To meet the duties established by these regulations and manage the risks identified above, registered fish processors should implement a compliance plan aligned to the regulatory text and to the Ministerial determinations likely to be issued under reg 19. The steps below are practical, concrete and traceable to the relevant regulations.

1. Confirm registration status and scope

• Verify whether your activity constitutes processing, storage, transport or dealing that requires registration under the Act. If you buy and sell but never take physical possession, reg 4(a) exempts you from registration for the purposes of s 62(2)(c); document the basis of any reliance on that exemption. If you operate under a permit in the Miscellaneous Broodstock and Seedstock Fishery, check reg 4(b).
• Maintain an up-to-date copy of your certificate of registration and list of specified premises, places, boats and vehicles. Before using any additional premises/place/boat/vehicle for regulated activities, lodge an application with the Minister to have it specified on your certificate (reg 6(1)). Use the Minister-approved form and include the prescribed fee (reg 6(2)(a)-(c)). Record submission dates and receipts.

2. Monitor Ministerial determinations and Department publications

• Subscribe to the Department’s website notifications and retain records of all Ministerial determinations published under reg 19(3). The determinations will set the operative “manner and form, places and times” for recording, tagging, sealing, weighing, storage and returns.
• Maintain a register of determinations that affect your facility and workflows. Track variation and revocation notices (reg 19(5)) and ensure operations respond promptly to changes. Keep written evidence of when and how determinations were implemented operationally.

3. Build chain-of-custody and intake-check procedures focused on undersize fish

• Implement a standard intake checklist to be completed “as soon as possible” upon delivery (reg 7(1)). The checklist should record time/date of delivery, consignor, description of goods, species, batch identifiers, who performed the check and the method used (e.g. sample counts, measurements).
• If undersize fish are found, follow an established procedure to render them unsuitable for sale or consumption immediately and to dispose of them as waste in a traceable manner (reg 7(2)). Keep photographic evidence, waste disposal receipts and witness statements to rebut the presumption in reg 7(3) if needed.
• Retain intake records in a readily accessible, legible format so they can be produced promptly on inspection (reg 18).

4. Prepare and retain species-specific records and handling processes

• For any species you handle that appears in regs 8-15D, map the Ministerial requirements (once determined) to standard operating procedures: what information must be recorded (reg 8(1)(a) etc.), how and when it must be provided to the Department or AFMA (e.g. reg 14(1)(b) for tuna), and specific requirements for weighing, storage, containers, sealing and tagging (reg 8(1)(c), reg 15(1)(c) etc.).
• Standardise batch identifiers, container labels, seals and tags so that they meet whatever format the Minister prescribes; keep spare tagged seals and ensure staff are trained on correct application and record-keeping.

5. Implement record and return retention systems

• Implement an electronic document management system (EDMS) or paper file system that preserves records in good condition and legible form, stored in a readily accessible location (reg 18(a)-(b)). Index files by date, batch and species. Ensure backups for electronic records and retention policies aligned to periods specified by Ministerial determinations (reg 8(3), reg 17(4), reg 16(2)).
• Create templates for periodic returns required under reg 16 and maintain copies of each return in the manner and for the period determined by the Minister (reg 16(1)-(2)). Record proof of transmission to the Department or AFMA and acknowledgement receipts.

6. Prepare for inspections and evidence preservation

• Designate a compliance officer responsible for production of documents to fisheries officers on request (reg 18(c)). Maintain a checklist for documents that must be produced and a log of inspections and requests received.
• Preserve contemporaneous evidence of compliance steps (intake checks, weighing logs, container sealing logs, return submissions) to rebut allegations and the s 7(3) presumption if undersize fish are found.

7. Clarify interactions with AFMA and other regulators

• If processing tuna (Southern Bluefin Tuna), confirm whether the Department or AFMA will be the recipient of returns/records in practice (reg 14(1)(b)). Engage with the Department to obtain procedural guidance and avoid duplicative reporting.
• Review any other fishery-specific regulations referenced (Blue Crab Fishery regs, Miscellaneous Broodstock regs) to ensure consistent compliance across instruments.

8. Address employee training and operational controls

• Train staff on intake checking, sealing/tagging, weighing, record completion and document accessibility. Make sure responsibilities are allocated and documented.
• Create incident-response procedures for discovery of undersize fish and for any rejected consignments or defects.

9. Budget for fees and potential compliance costs

• Identify the prescribed fee for additional premises applications (reg 6(2)(c)) from Department fee schedules and budget accordingly. Budget also for administrative costs (tagging, weighing equipment, additional storage/containers), possible expiation fees ($210), and the administrative cost of responding to inspections and information requests.

10. Manage commercial confidentiality and data flows

• Seek clarity from the Department about how commercially sensitive information will be handled, stored and disclosed once provided under the regs. If necessary, document the case for confidentiality when supplying returns, and keep internal records of what is supplied and when.

11. Legal and audit readiness

• Maintain a compliance file that documents registration certificates, Ministerial determinations, submitted returns, inspection logs, and disposal receipts. This will assist in audits, prosecutions, or administrative reviews.
• If a registration application is refused under reg 5 on environmental or disease-risk grounds, preserve decision notices and seek internal review or legal advice consistent with the Act’s administrative review mechanisms.

12. Special attention to licence-holders

• If you hold a fishery authority or aquaculture licence, map where regs 16(3) and 17(5) apply and where they do not. Do not assume blanket exemption; confirm obligations for transactions involving unregistered processors or other third parties.

Following these steps aligns operations with the regulations’ text and their delegation structure. Critical practical priorities are: maintain contemporaneous intake checks and records to rebut reg 7(3); monitor Ministerial determinations (reg 19); ensure documents are legible and accessible for inspection (reg 18); and implement species-specific handling and reporting per the Minister’s guidance (regs 8-15D and reg 14’s AFMA interface for tuna).
