Fisheries Management (Blue Crab Fishery) Regulations 2013

Definitions and zones. The regulations begin with detailed definitions (reg 3). The fishery covers taking aquatic resources in the two defined blue crab fishing zones (Gulf St. Vincent and Spencer Gulf), each spatially described by geodesic lines using GDA94 coordinates (reg 3(1) and 3(3)(a); reg 4(2)). "Blue crab" is defined as Blue Swimmer Crab (Portunus armatus) (reg 3(1)). Schedule 1 Part 1 lists the crustaceans that may be taken in the fishery, including Blue Swimmer Crab and several other crab species, while Part 2 lists other aquatic resources permitted for bait or as incidental take (Schedule 1 Parts 1 and 2).

Quota units and quotas. Central to the instrument is an individual blue crab catch quota system (reg 10). The conceptual building blocks are unit entitlement (a number of blue crab units allocated to a licence), unit value (kilograms per unit determined by the Minister for each quota period), and quota entitlement (kilograms, being unit entitlement times unit value, subject to any variation) (reg 3 definitions; reg 10(1)). A quota period is a 12‑month period commencing 1 July (reg 3). The Minister must determine the unit value for each blue crab fishing zone and each quota period on or before the start of the period (reg 10(1)).

Pot entitlements. The regulations link the quota system to pot entitlements (reg 9). A blue crab pot entitlement is the maximum number of crab pots a licence holder may lawfully use at any one time (reg 3 definition). The Minister must determine a conversion value each quota period for a zone (reg 9(1)), and must impose or vary a licence condition fixing a blue crab pot entitlement when a licence is issued or when a blue crab quota entitlement is varied (reg 9(2)). Reg 9(3) provides the formulaic relationship between unit entitlement and conversion value, and prescribes rounding rules (fractions of half or more rounded up), although the literal mathematical formula is presented in the regulation text; the variables A, B and C are defined there: A (pot entitlement), B (unit entitlement), C (conversion value) (reg 9(3)).

Variation and movement of units. The Minister may vary unit entitlements across licences on joint application in several specific ways (reg 10(2)(b)-(d)), including transferring units between two Blue Crab Fishery licences, between a Blue Crab and a Marine Scalefish licence, or allocating units to a Marine Scalefish licence that previously lacked a blue crab quota condition. The regulations also allow limited carry‑forward and carry‑back style adjustments across quota periods: if actual catch is below the quota, the Minister may increase the licence’s quota for the following quota period by up to 10% of the first period’s quota, or a lower percentage chosen by the Minister, or a larger percentage if the Minister is satisfied exceptional circumstances exist (reg 10(2)(e)); conversely, if catch exceeds quota, the Minister may reduce the following quota period’s entitlement by rates of 1kg per surplus kg up to 10% or 2kg per surplus kg for amounts greater than 10%, subject to the Minister determining lower or different thresholds (reg 10(2)(f)). Variations under (e) or (f) are expressed to apply only for the quota period during which the variation is made (reg 10(4)).

Entry and transfer mechanics. Entry is restrictive: an application for a Blue Crab Fishery licence may only be made by a person who holds a Marine Scalefish Fishery licence with a condition fixing a blue crab quota entitlement (reg 5(2)). The Minister may only grant a Blue Crab licence if the applicant surrenders the Marine Scalefish licence and any Commonwealth or corresponding entitlement attached to the boat is surrendered (reg 5(3)). Licences are transferable (reg 6(1)) but transfers require Ministerial consent and supporting documentation, including the licence itself, completed returns (reg 12) up to the application date, and for companies, a current ASIC company extract (reg 6(2)). The Minister must be satisfied about payment of fees, suspension status, absence of pending enforcement proceedings, and the transferee’s fitness and propriety (reg 6(3)).

Ministerial determinations and publication. The Minister has express power to make determinations for the purposes of the regulations, including those that are of general or limited application and that may treat persons or circumstances differently (reg 14(1)-(2)). For most determinations, the Minister must publish the determination on the Department’s website and may publish in the Gazette, and must give written notice to persons bound by it (reg 14(3)-(4)). The Minister may vary or revoke determinations (reg 14(5)). Notably, reg 14(6) excludes the application of reg 14 to determinations made for the purposes of reg 9 or 10, so the special publication/notification procedure in reg 14 does not apply to determinations of conversion values or unit values, or other determinations made specifically for reg 9 or 10 purposes.

Compliance architecture. The instrument sets out detailed record keeping and return duties and attaches maximum penalties and expiation fees to failures to comply. The holder or registered master must record catch and disposal information as determined by the Minister, provide those records to the Department, and ensure blue crab are handled in accordance with Minister-determined requirements (reg 11(1)). Non‑compliance with a Ministerial determination under reg 11 is an offence for both the licence holder and the registered master, with a maximum penalty of $5,000 and an expiation fee of $500 (reg 11(2)). Periodic returns and record keeping are also penalised (reg 12, reg 13). These provisions create an administrative compliance regime enforced by civil penalties and expiation options.

Licence holders and registered masters. The primary regulated parties are holders of licences in respect of the Blue Crab Fishery and the registered masters of registered boats used under those licences. Those persons carry the operational duties: recording catch and disposal information, providing returns to the Department, and complying with Minister-determined requirements for weighing, storage, tagging and transport of blue crab (reg 11). Both the licence holder and the registered master are liable for offences under reg 11(2).

Potential entrants. Prospective entrants are affected by the eligibility constraints in reg 5. An application for a Blue Crab Fishery licence may only be made by a person who holds a Marine Scalefish Fishery licence subject to a condition fixing a blue crab quota entitlement (reg 5(2)). The Minister may only grant a Blue Crab Fishery licence if the applicant surrenders that Marine Scalefish licence and any related Commonwealth (or corresponding law) entitlement attached to a boat (reg 5(3)). Those mechanics impose a structured entry path and require applicants to swap or abandon certain existing entitlements held under other regimes.

Corporate entities and directors. Transfers to companies require the transferee company to produce a current company extract from ASIC issued within one month of application (reg 6(2)(c)). The Minister must be satisfied that each director of a transferee company is a fit and proper person to be a director of a company that holds the licence (reg 6(3)(e)). Therefore corporate structures, company officers and their backgrounds are relevant to transfer approvals.

Fish processors, dealers and transporters. The regulations’ requirements that blue crab be weighed, stored, sealed, tagged, transported, delivered, consigned or otherwise disposed of in accordance with Ministerial requirements (reg 11(1)(c)) affects persons further down the supply chain who accept consigned fish, because those consignments must carry the information the Minister determines; buyers and transporters will need to ensure chain‑of‑custody and compliance with tagging and documentation requirements.

Marine Scalefish Fishery licence holders. The regulations explicitly interlock with the Marine Scalefish Fishery. A person with a Marine Scalefish licence may have been subject to a condition fixing a blue crab quota entitlement; such units can be the basis for a new Blue Crab Fishery licence on surrender of that Marine Scalefish licence (reg 10(2)(a)). The regulations also permit unit transfers between Blue Crab and Marine Scalefish licences on joint application (reg 10(2)(c) and (d)). Consequently, holders of Marine Scalefish licences with blue crab unit conditions are materially affected, since their units can be moved, reduced or used to create Blue Crab licences.

Minister and Department. The Minister and the Department exercise central administrative and enforcement functions. The Minister determines unit values, conversion values, the content and manner of returns and records, and may impose licence conditions about pot carriage and quotas (regs 9, 10, 11, 14). The Department receives returns and is the administrative body responsible for publishing determinations on its website (reg 14(3)(a)).

Fisheries officers and enforcement bodies. The record‑keeping rules specify that records must be produced for inspection by fisheries officers on request (reg 13(c)), and the Act under which these regulations sit provides enforcement powers that fisheries officers exercise. The existence of specified maximum penalties and expiation fees (regs 11-13) establishes the enforcement contours available to officers and prosecuting authorities.

Indirectly affected stakeholders. Seafood markets, wholesalers, retailers and consumers are indirectly affected by the quota and pot entitlement system. While the regulations do not set market prices, the conversion between units and kilograms, the pot entitlements, and seasonal quota variations will affect the quantity of legal supply in each quota period. The regulations also specify species that may be taken as bait or incidentally (Schedule 1 Part 2), which affects bycatch management and supply dynamics for those species.

Who decides. Practical access, transfers and operational deployment of fishing effort are controlled by decisions of the Minister under the regulations, notably: issuance and grant conditions (reg 5), consent to transfers with fitness and document checks (reg 6), determinations of unit and conversion values each quota period (reg 9(1); reg 10(1)), and determinations about the content and timing of records and returns and handling requirements (reg 11; reg 12; reg 14). The Minister’s discretion is central to the allocation and annual adjustment mechanics.

Rights established by the regulations

• Right to take specified aquatic resources in the blue crab fishing zones, subject to licence conditions and species lists in Schedule 1 (reg 4(2); Schedule 1).
• A licence holder has the right to a blue crab quota entitlement measured in kilograms, derived from the licence’s unit entitlement and the Minister‑determined unit value for a zone and quota period (reg 3 definitions; reg 10(1)).
• A licence holder has the right to a blue crab pot entitlement, calculated under reg 9(3) using unit entitlement and the Minister‑determined conversion value for the quota period and zone (reg 9(1)-(3)).
• Licences are transferable, subject to Ministerial consent and the statutory conditions for transfer (reg 6(1)-(3)).

Operational duties

• Recording and reporting: The holder or registered master must record such catch and disposal information as determined by the Minister, and provide that information to the Department in the manner, form and at times the Minister determines (reg 11(1)(a)-(b)). The holder must keep records in accordance with Ministerial determinations (reg 11(3)).
• Handling and chain of custody: The holder or registered master must ensure blue crab are weighed, stored, placed in containers, sealed, tagged, transported and otherwise disposed of in accordance with any Minister‑determined requirements, and that consignments are accompanied by the required information (reg 11(1)(c)).
• Periodic returns: The licence holder must provide the Department with returns in the form, manner and at times determined by the Minister, and retain a record of each return as determined (reg 12(1)-(2)).
• Record keeping standards: Records must be maintained in good condition, legible, readily accessible, and produced for inspection by fisheries officers upon request (reg 13(a)-(c)).

Administrative duties related to licence transactions

• Applications for transfer must be accompanied by the licence, completed returns up to application date, and for companies a current company extract not more than one month old (reg 6(2)).
• Applications to vary unit entitlements must follow a Minister‑approved form and instructions and be accompanied by a prescribed fee (reg 10(6)).
• Registration of boats, devices and masters for use under a licence requires the documents specified in the application form (reg 7).

Ministerial administrative duties and powers

• Determination of conversion values and unit values for each quota period and zone must be made on or before the start of each quota period (reg 9(1); reg 10(1)).
• The Minister may impose and vary licence conditions fixing pot entitlements, limiting carriage of crab pots on boats, and otherwise regulating carrying of crab pots (reg 9(2), (4)).
• The Minister may, on joint application, vary unit entitlements across licences in specified ways (reg 10(2)(b)-(d)).
• The Minister may increase or decrease quota entitlements for the following quota period based on under‑catch or over‑catch within prescribed bounds and exceptional circumstances rules (reg 10(2)(e)-(f); reg 10(3)-(4)).
• The Minister may make determinations for the purposes of any regulation, typically publish them on the Department’s website and notify affected persons, and may vary or revoke determinations (reg 14(1)-(5)). Determinations for regs 9 or 10 however are excluded from reg 14’s publication and notification processes (reg 14(6)).

Enforceable obligations and penalties

• Failure to comply with a Minister’s determination under reg 11 is an offence for both the holder and the registered master, with maximum penalty $5,000 and expiation fee $500 (reg 11(2)).
• A licence holder’s failure to comply with periodic return obligations is a maximum $5,000 penalty with $500 expiation fee (reg 12).
• Record retention failures under reg 12(2) attract the same maximum penalties and expiation fees (reg 12(2)).
• Record quality, accessibility and production obligations under reg 13 carry a maximum penalty of $2,500 and an expiation fee of $210 (reg 13).
• The regulations define expiation fee levels and maximum penalties for the principal administrative obligations (regs 11-13).

Constraints on rights

• Entry constraint: applications for a Blue Crab licence can only be made by persons already holding a Marine Scalefish Fishery licence with a blue crab quota condition, and grant of a new Blue Crab licence requires surrender of that Marine Scalefish licence and surrender of any Commonwealth or corresponding entitlement attached to the boat (reg 5(2)-(3)).
• Transfer consent is constrained by the Minister’s satisfaction about fees, suspensions, pending proceedings, transferee fitness, and, if a boat has a Commonwealth entitlement, either concurrent transfer or surrender of that entitlement or concurrence from the grantor of that entitlement (reg 6(3)(a), (b), (c), (f)).
• Pot entitlements must not be varied except as provided by reg 9 (reg 9(2)(c)), which ties pot entitlement changes to quota entitlement changes and to the Minister’s determinations.
• Variations to quota entitlements arising from carryforward or overcatch adjustments are temporary, applying only for the quota period during which the variation is made (reg 10(4)).

Rights to administrative review or appeal. The regulations do not set out internal review or merits appeal processes for Ministerial decisions. They set conditions and information publication requirements for determinations generally (reg 14) but exclude determinations under regs 9 and 10 from those publication rules (reg 14(6)). Any review or appeal routes are therefore matters outside this instrument, for example, court or tribunal review under general administrative law principles, or other statutory mechanisms available under the Fisheries Management Act 2007; those external routes are not specified in the text of these regulations.

Penalties specified. The regulations attach specific maximum penalties and expiation fees to statutory offences relating to record keeping, returns and compliance with Ministerial determinations.

• Catch/disposal determinations: non‑compliance with a Ministerial determination made under reg 11 (recording, providing information, handling, weighing, storage, sealing, tagging and transport as determined) makes both the licence holder and the registered master guilty of an offence with maximum penalty $5,000 and an expiation fee of $500 (reg 11(2)).
• Record keeping retention: a licence holder must keep records made under reg 11 in the manner, at the place and for the period determined by the Minister; failure carries a maximum penalty of $5,000 and an expiation fee of $315 (reg 11(3)).
• Periodic returns: failing to provide returns as determined by the Minister under reg 12 attracts a maximum penalty of $5,000 and an expiation fee of $500 (reg 12(1)); failing to keep a record of each return as determined attracts the same maxima (reg 12(2)).
• Record condition and production standards: persons required to keep records must ensure they are in good condition, legible, readily accessible and produced on request by a fisheries officer; failure is a maximum penalty of $2,500 and expiation fee of $210 (reg 13).

Who enforces. The regulations are enforced within the statutory enforcement architecture of the Fisheries Management Act 2007 (the Act is the enabling instrument cited in reg 3). The text explicitly references production to "a fisheries officer" (reg 13(c)), implying enforcement through fisheries officers who exercise powers under the Act. The Department is the administrative unit responsible for assisting the Minister (reg 3 definition of Department), and the Minister makes determinations about reporting, records and handling requirements (reg 14).

Expiation scheme and criminality. The presence of specified expiation fees for particular contraventions creates a civil scheme by which alleged offences may be dealt with by payment of the set expiation fee instead of prosecution. The regulations set expiation fees for each offence category (regs 11-13). The availability of expiation fees implies enforcement can proceed either by prosecution (seeking the maximum penalty) or by expiation, depending on prosecutorial discretion and procedural rules in the Act and associated policy.

Suspension and transfer consequences. Regulation 6(3)(b) requires the Minister to be satisfied that "the licence to be transferred has not been suspended" before consenting to its transfer. Suspension under the Act therefore has immediate consequences for transferability; an unsatisfied suspension presents a bar to transfer.

Ministerial determinations excluded from reg 14 regime. Reg 14 sets publication and notification obligations for determinations made under the regulations. However reg 14(6) states this regulation does not apply to determinations made for the purposes of reg 9 or 10. That means determinations of conversion values and unit values and likely other technical determinations directly implementing quotas and pot conversion may not be subject to the publication, Gazette and written-notice formalities set out in reg 14(3)-(4). Operationally, this changes how those determinations may be communicated and potentially how enforceable notice is given; the regulations nonetheless require the Minister to determine unit and conversion values on or before the quota period start (reg 9(1); reg 10(1)).

Administrative compliance risk. The compliance architecture concentrates on documentary and procedural duties: approved forms, specific content for returns and records, and retention/production standards (regs 7, 10(6), 11-13). Non‑compliance attracts set penalties and expiation fees. The regime therefore depends on both administrative capability (the Department to specify forms and receive returns) and enforcement capacity (fisheries officers to inspect and to apply expiation or prosecute).

Limited criminal offences. The regulations create primarily administrative offences with monetary penalties and expiation options; there are no imprisonment penalties specified in the text. Maximum fines are relatively modest (up to $5,000) and expiation fees are lower figures for quick disposition.

Fisheries Management Act 2007. These regulations are made under the Fisheries Management Act 2007 (the Act) and operate within its broader regulatory and enforcement framework. The regulations refer repeatedly to licence issues, licensing conditions, suspensions and offences "under the Act" (e.g. reg 6(3)(a) references fees or amounts payable under the Act or the repealed Act). Enforcement, suspension and transfer powers contemplated in the regulations are implemented against the backcloth of the Act’s powers; the regulations do not replicate broader enforcement powers such as arrest, seizure or search powers that may be set out in the Act.

Marine Scalefish Fishery regulations. The instrument explicitly links to the Marine Scalefish Fishery. The definitions and transfer mechanics refer to licences in respect of the Marine Scalefish Fishery, and the regulations allow the allocation and reallocation of blue crab units between a Blue Crab Fishery licence and a Marine Scalefish Fishery licence on joint application (reg 10(2)(a), (c), (d)). This creates an administrative interface between the two regulatory instruments; entitlements and unit allocations may shift between the two fisheries subject to the mechanics here.

Corporations Act. The regulations adopt the Corporations Act 2001 definitions for company, director, proprietary company and public company (reg 3(2)). Regulation 6(2)(c) requires a current company extract prepared by the Australian Securities and Investments Commission under the Corporations Act to accompany a transfer application when the transferee is a company. The Corporations Act hence supplies corporate identity and officer information used to assess transferee fitness.

Commonwealth or corresponding laws. Regulation 5(3)(b) and regulation 6(3)(f) reference licences, permits or other entitlements to take aquatic resources granted under a law of the Commonwealth or a corresponding law. The Minister may only grant a Blue Crab Fishery licence if any Commonwealth entitlement attached to the boat is surrendered (reg 5(3)(b)). On transfers, if a boat is subject to such an entitlement, the entitlement must either be transferred with the licence, surrendered, or the grantor must concur with a separate transfer (reg 6(3)(f)(i)-(ii)). Those provisions ensure coordination between State licences and Commonwealth fisheries entitlements or other jurisdictions’ regimes.

AS5300 Australian Fish Names Standard. Regulation 3(3)(b) instructs that common and scientific names of fish are given according to AS5300,2019 Australian Fish Names Standard published by the Fisheries Research & Development Corporation, as in force from time to time. That cross‑reference ties species identification and labeling to an external standard, which affects how Schedule 1 species are to be read and applied.

Legislation Revision and Publication Act 2002 and Gazette publication. The legislative history and notes show that reg 2 was omitted under the Legislation Revision and Publication Act 2002 (Legislative history). Regulation 14(3)(b) allows determinations to be published in the Gazette, and reg 14(3)(a) requires publication on the Department’s website. The regulations therefore use the Department website and optionally the Gazette as publication platforms. However, determinations for regs 9 and 10 are excluded from the reg 14 regime (reg 14(6)), meaning those determinations may be subject to different publication or notification procedures elsewhere or not be required to be published under reg 14.

Relevance to other enforcement and administrative law. The regulations do not set out appeal or merits review processes, but Ministerial decisions under these regulations remain subject to the broader administrative law framework, judicial review, and any appeal processes prescribed in the Act or other legislation. The instrument itself is silent on internal review procedures, leaving interaction with other statutes and common law administrative remedies relevant but external to these regulations.

Interplay with revoked instruments. The regulations replaced earlier Blue Crab Fishery regulations from 1998 (Legislative history: “revoked the following: Fisheries Management (Blue Crab Fishery) Regulations 1998”). Where the new regulation varies terms and references, transitional effects or existing entitlements may be governed by the Act or by saving provisions in amendment instruments; details are not reproduced in the regulation text here, but the legislative history tabulates subsequent amendment instruments and commencement dates.

Principal instrument and major variations. The Fisheries Management (Blue Crab Fishery) Regulations 2013 were made eventually as Gazette No. 214 dated 29 August 2013 and commenced 1 September 2013 (Legislative history: 2013 No 214). Subsequent instruments altered various provisions. The legislative history lists significant variation instruments and effective dates:

• 2017 (No 221), Gazette 8 August 2017, commencement 15 January 2018: multiple amendments including substitution of regs 11 and 12, insertion of regs 13 and 14, variation of definitions (crab pot), departure of the "Department" definition, and variations to Schedule 1 Part 2 (see the Provisions varied table: r 3(3), r 8(2), r 10(3), r 11 substituted by 221/2017 r 7, r 12 substituted by 221/2017 r 8, rr 13 and 14 inserted by 221/2017 r 8, Sch 1 Pt 2 varied by 221/2017 r 9(1)-(4)). The commenced date is 15.1.2018.

• 2020 (No 261), Gazette 27 August 2020, commencement 27 August 2020: variation to r 10(2) (varied by 261/2020 r 4(1)) and insertion of r 10(4) (by 261/2020 r 4(2)).

• 2021 (No 92), Gazette 24 June 2021, commencement 1 July 2021: further variations including to definitions of blue crab quota entitlement, unit entitlement, and Marine Scalefish Fishery terminology (r 3 variations by 92/2021 r 4(1),(4); r 10 varied by 92/2021 r 5). The legislative history notes deletion and insertion entries and shows that some provisions were adjusted to redefine unit entitlement and quota entitlement relationships starting 1 July 2021.

• 2022 (No 36), Gazette 16 June 2022, commencement 1 July 2022: substitution of r 10(3) and (4) and insertion of r 10(5),(7) by 36/2022 r 3(2); deletion of some subparagraphs in r10(2) noted as (da), (g) deleted by 36/2022 r 3(1). Commencement 1.7.2022.

Provisions varied entries and effects. The legislative history lists the provisions that were varied, the amending regulation instrument and commencement date. Specific entries of interest:

• r 3: multiple definition changes across instruments, including changing the definition of crab pot (221/2017), substituting Department (221/2017), varying Marine Scalefish Fishery references (221/2017; 92/2021), and varying unit entitlement and quota entitlement definitions (92/2021).

• r 10: underwent several changes (221/2017 r 6(1), (2) varied r 10(3); 261/2020 r 4(1) and r 4(2) added and substituted subregs; 92/2021 r 5 varied r 10(2)). 36/2022 r 3 substantially substituted reg 10(3) and r 10(4) and inserted r 10(5)-(7), changing the rules for carryovers and limits and adding further constraints and definitions.

• r 11 was substituted by 221/2017 r 7, altering catch and disposal requirements and penalties.

• r 12 was substituted by 221/2017 r 8, altering periodic returns provisions.

• rr 13 and 14 were inserted by 221/2017 r 8, adding record keeping standards and Ministerial determinations procedures.

• Sch 1 Part 2 was varied by 221/2017 r 9(1)-(4), updating the list of species prescribed for the fishery.

Omitted and historical notes. The legislative history notes that r 2 was omitted under the Legislation Revision and Publication Act 2002 (commenced 15.1.2018). Sch 2 was omitted under the same Act as part of the 2018 consolidation. The historical versions are listed with their dates: 15.1.2018, 27.8.2020, and 1.7.2021, indicating points at which consolidated historical versions are available.

Implication of amendments. The history shows the framework has been actively updated, notably in 2017 and in 2020-2022, with substantive changes to quota mechanics (reg 10) and the Minister’s determination, notification and record keeping regimes (rr 11-14). The successive amendments inserted detailed administrative and compliance provisions in 2018 (substituting reg 11 and reg 12 and adding regs 13 and 14), and further refined quota carryover and adjustment rules in later instruments (2020, 2021, 2022).

Care point: the legislative history entries identify which provisions were varied, by which regulation and on what date; any user relying on the regime should consult the consolidated instrument effective at their relevant date, because the definition of unit entitlement, quota calculations, and the Minister's powers were modified in those later instruments.

The source contains no cases, litigation summaries, or precedents. The regulation text and legislative history do not list any judicial decisions, appeals, or administrative tribunal determinations relating to the Blue Crab Fishery Regulations. The "Legislative history" section in the instrument records amendment instruments and commencement dates only; it does not record litigation outcomes or references to case law. Therefore, from this source alone there is no recorded litigation history to summarise.

If parties contest Ministerial determinations, transfer decisions, quota adjustments or enforcement actions under these regulations, such disputes would proceed under the Act’s enforcement and review mechanisms and general administrative law principles, but no examples or cases are provided in the regulation text or legislative history included here.

Ministerial discretion and publication carve‑out. The Minister must determine conversion values and unit values each quota period (reg 9(1); reg 10(1)), but reg 14(6) explicitly states that reg 14 (the provisions about Ministerial determinations, including publication on the Department website, possible Gazette publication, and notice to persons bound by the determination) does not apply in relation to determinations made for the purposes of reg 9 or 10. Practically, that means unit and conversion value determinations, while required to be made on or before the quota period start, are not covered by the standard publication and notification obligations in reg 14. Users should not assume the same public notice regime applies to these primary technical determinations; check the Department’s website or specific departmental communications for how these determinations are promulgated in practice (reg 9(1); reg 10(1); reg 14(3)-(6)).

Formula presentation and reliance on Ministerial numbers. Reg 9(3) sets out a formula in which variables A (pot entitlement), B (unit entitlement) and C (conversion value) are defined, and it prescribes rounding for fractions of half or more. The conversion value and unit value are both Minister‑determined each quota period (reg 9(1); reg 10(1)). Licence holders therefore cannot compute kilograms or pot entitlements without those Ministerial determinations. The text provided here shows the variables and rounding rule, but practitioners must locate the current conversion and unit values before assessing entitlements for a quota period.

Entry constraints and licence surrender. An application for a Blue Crab licence may only be made by a person holding a Marine Scalefish licence subject to a blue crab quota condition (reg 5(2)). The Minister may only grant the application if the applicant surrenders the Marine Scalefish licence and any Commonwealth entitlement attached to the boat (reg 5(3)). Therefore, acquiring a Blue Crab Fishery licence requires surrender of other State or Commonwealth entitlements; applicants should plan for the administrative and economic implications of surrendering entitlements before applying.

Transfers: fit and proper and concurrent Commonwealth entitlements. Transfers require the Minister’s consent and documentation including returns to the application date and, for companies, an ASIC company extract not older than one month (reg 6(2)). The Minister must be satisfied that fees are paid, the licence is not suspended, no proceedings are pending, transferees are fit and proper persons, and, where a boat is subject to a Commonwealth entitlement, either the entitlement accompanies the transfer or is surrendered, or the grantor concurs to separate transfers (reg 6(3)). Transfers of licences that are linked to separate Commonwealth entitlements can be blocked or conditioned, so buyers and sellers must coordinate with Commonwealth entitlement holders.

Carryover and penalisation mechanics. The rules for increases after under‑catch and decreases after over‑catch are detailed and have percentage and per‑kilogram rates that can change across amendment instruments (reg 10(2)(e)-(f); reg 10(3)-(4)). Key practical points:

• Increase for under‑catch is capped at 10% of the quota entitlement for the first quota period, unless the Minister determines a lower percentage or is satisfied exceptional circumstances apply and determines a higher percentage (reg 10(2)(e)(i)-(ii)).
• Decrease for over‑catch may be 1kg reduction per excess kg up to 10% threshold, and 2kg per excess kg for amounts greater than 10%, subject to Ministerial adjustment (reg 10(2)(f)(i)-(ii)).
• Any increase applied under subregulation (e)(i) or (ii) must be disregarded when calculating future adjustments under the relevant subregs (reg 10(3)).
• Variations under (e) or (f) are expressed to apply only for the quota period during which the variation is made (reg 10(4)).

These mechanics can have counterintuitive consequences: an over‑catch can reduce future entitlement at a multiplicative rate (particularly above the 10% threshold), and increases from under‑catch are time-limited. Operators should calculate both immediate and subsequent period impacts and verify current percentages the Minister has determined for the quota period.

Form and fee compliance. Applications to vary unit entitlements require approved forms, completion in accordance with instructions, and payment of a prescribed fee (reg 10(6)). The regulations do not state the quantum of the fee; practitioners must check the Department’s fee schedule. Failure to use the approved form or to pay the fee may render an application invalid.

Record keeping and expiation fees. The regulations prescribe maximum penalties and expiation fees for failures to comply with determinations, returns and records (regs 11-13). Note the different expiation fee levels: $500 for catch/disposal and periodic return failures (regs 11(2); 12(1)), $315 for failure to keep records per reg 11(3), and $210 for record condition/production failures under reg 13. Ensure record formats and retention periods required by the Minister are followed precisely to avoid enforcement action.

Limited publication of determinations. While reg 14 requires most determinations to be published on the Department’s website and persons bound to be notified in writing, reg 14(6) excludes determinations for reg 9 or 10. Relying solely on reg 14 publication obligations to ensure awareness of changes to conversion values or unit values would be risky; confirm the Department’s practice for announcing those numbers.

Species scope. Schedule 1 lists the aquatic resources that may be taken and those permitted for bait. The inclusion of many scalefish and molluscs in Part 2 indicates the fishery’s permitted incidental species and bait list, and operators should ensure harvesting activities stay within Schedule 1 species and the applicable licence conditions (reg 4(2); Schedule 1).

Interaction with Commonwealth entitlements. Transfers and licence grants can be constrained by Commonwealth or corresponding law entitlements attached to boats (reg 5(3)(b); reg 6(3)(f)). Parties planning transfers must confirm whether boats are subject to such entitlements and secure the needed concurrence or surrender before expecting Ministerial consent.

Pre‑application checks and eligibility

• Confirm eligibility to apply for a Blue Crab Fishery licence: you must currently hold a Marine Scalefish Fishery licence that is subject to a condition fixing a blue crab quota entitlement (reg 5(2)). If not, you cannot apply.
• If eligible and planning to apply, prepare to surrender the Marine Scalefish licence and any Commonwealth or corresponding entitlement linked to the boat at the time the Minister would grant the Blue Crab licence (reg 5(3)(a)-(b)). Plan for the economic implications of surrendering those entitlements.

Documentation for licensing and transfers

• For transfer applications, assemble the original licence to be transferred, a completed form of return as required by reg 12 showing catch and disposals up to the application date, and if the transferee is a company, a current ASIC company extract issued within one month of application (reg 6(2)). Incomplete documentation risks refusal of transfer consent.
• Ensure there are no unpaid fees or other amounts in relation to the licence under the Act or the repealed Act, and that the licence is not suspended before applying for transfer, as these are preconditions for Ministerial consent (reg 6(3)(a)-(b)).
• For corporate transferees, verify each director’s suitability, because the Minister must be satisfied that each director is a fit and proper person to be a director of a company holding such a licence (reg 6(3)(e)). Consider pre‑application checks on director records and any relevant litigation or regulatory history.

Administrative compliance for operations

• Before each quota period (quota periods commence 1 July), check the Department’s communications for the Minister’s determination of unit value for the relevant blue crab fishing zone and the conversion value used to calculate pot entitlements (reg 9(1); reg 10(1)). These numbers determine kilogram quota entitlements and pot entitlements for the period.
• Maintain up‑to‑date records of unit entitlements allocated to the licence, and reconcile those with the Minister’s unit and conversion value determinations to compute the current quota entitlement and pot entitlement (reg 3 definitions; reg 9(2)-(3); reg 10).
• For operational handling and chain of custody, implement procedures to ensure blue crab are weighed, stored, placed in containers, sealed, tagged, transported and consigned in the manner and with the information required by the Minister. Confirm the precise Ministerial requirements and apply them consistently (reg 11(1)(c)).

Returns and record keeping

• Use the approved forms and follow the Minister’s prescribed manner and times for periodic returns under reg 12. Keep a duplicate record of each return as prescribed (reg 12(2)). Failure to provide returns or keep return records attracts specified penalties (reg 12).
• Keep all records in good condition, legible, readily accessible, and produce them for inspection upon request by fisheries officers (reg 13). Ensure retention periods and storage locations match any Ministerial determinations about the place and time records must be kept (reg 11(3); reg 12(2)).
• Implement a records management system that produces the required documents in Minister‑prescribed formats and accommodates inspections, including remote or on‑site audits by fisheries officers.

Managing quotas, pots and unit movements

• For any planned unit entitlement variation, use the Minister‑approved form, follow instructions precisely, and pay the prescribed fee (reg 10(6)). Confirm what the prescribed fee is with the Department before lodgement, and ensure the form is completed per instructions to avoid rejection.
• Where units are to be reallocated between licences, use the joint application mechanisms permitted by reg 10(2)(b)-(d). Ensure all affected licence holders agree and that the application demonstrates a corresponding increase and decrease of unit entitlements as required by the regulation.
• Monitor catch relative to quota carefully. If catch is below quota and you plan to rely on the potential increase for the following quota period, check the Minister’s determination for the percentage or kilogram cap that will apply; increases are capped at 10% unless the Minister determines otherwise for exceptional circumstances (reg 10(2)(e)). If catch exceeds quota, be aware that subsequent quota entitlement may be reduced by 1kg per excess kg up to the 10% threshold and by 2kg per excess kg above that threshold, subject to the Minister’s pre‑determined thresholds (reg 10(2)(f)). Because any variation under (e) or (f) applies only for the following quota period (reg 10(4)), operators should budget for temporary entitlement changes.

Boat carriage and pot limits

• Ensure the number of crab pots used at any one time does not exceed the licence’s blue crab pot entitlement (the "maximum number ... may lawfully use at any one time") and that the number of pots carried on boats complies with any licence condition limiting carriage under reg 9(4). If your licence conditions change following a quota variation, adjust your pot usage and carriage accordingly to remain within the new entitlement.

Communications and public notices

• Do not rely solely on the reg 14 publication pathway for unit and conversion value determinations; reg 14(6) excludes determinations made for reg 9 and reg 10 from the general determinations publication regime (reg 14(6)). Instead, proactively seek the Minister’s determinations for unit and conversion values from the Department ahead of quota period commencement.

Enforcement readiness

• Implement internal compliance checks and audit trails for returns and record‑keeping to ensure quick production of documents for fisheries officers. The record production requirement (reg 13(c)) is coupled with a maximum penalty and an expiation fee.
• Train registered masters and crew on the shared liabilities: reg 11(2) makes both the licence holder and the registered master guilty of an offence for failure to comply with a Ministerial determination about catch and disposal. Allocate responsibilities clearly and document delegation decisions.

Coordinating transfers involving Commonwealth entitlements

• If a boat intended to be used under the licence is subject to any Commonwealth or corresponding law entitlement, coordinate with the relevant Commonwealth authority well in advance of any State licence transfer or grant, because the Minister may require the Commonwealth entitlement either to be transferred with the licence or to be surrendered, or to secure the grantor’s concurrence for separate transfers (reg 5(3)(b); reg 6(3)(f)).

Review procedures and legal advice

• Because the regulations do not specify internal merits review processes for Ministerial decisions, consider pursuing administrative law advice early if a Ministerial decision on grant, transfer or unit entitlements is adverse. Judicial review or other remedies under the Act may be available; seek legal advice appropriate to the circumstances.

Practical checklist summary

• Confirm eligibility and plan surrender of existing State or Commonwealth entitlements if applying for a new Blue Crab Fishery licence (reg 5).
• Before quota period start, obtain unit and conversion values from the Department and compute your kilogram quota and pot entitlement for the period (reg 9(1); reg 10(1)).
• Maintain and produce statutory records, use approved forms for returns and unit variation applications, and pay prescribed fees (regs 10(6), 11-13).
• Coordinate transfers carefully, supply current company extracts for corporate transferees, and address any Commonwealth entitlements attached to boats prior to transfer (reg 6(2)-(3); reg 5(3)(b)).
• Monitor catch against quota to manage the carryover and over‑catch adjustment effects for subsequent quota periods (reg 10(2)(e)-(f); reg 10(4)).
• Keep up with Department communications and confirm how the Minister’s determinations are being published or otherwise communicated in practice, especially for unit and conversion values that are excluded from reg 14 publication provisions (reg 14(6)).
