#### 40P Definitions 40P Definitions > In this Division— > > commercial fishing authority holder means— > > > (a) a shareholder in a share management fishery, or > > > (b) an owner of a fishing business the components of which include an endorsement in a restricted fishery, or > > > (c) any other person, or class of persons, declared by the regulations to be a commercial fishing authority holder. > > commercial fishing determination means a fishing determination that relates to— > > > (a) commercial fishing authority holders, or > > > (b) the taking of fish for sale, or > > > (c) a share management fishery or restricted fishery, or > > > (d) a method that is used to take fish for sale, or > > > (e) any other commercial fishing activity for which a licence or authority is required under this Act. > > **ss 40P–40T:** Ins 2015 No 59, Sch 1 \[21\].
