269 Forfeiture of boats and motor vehicles by order of court
> > (1) A court may order forfeiture of a boat or motor vehicle that has been seized under this Part in connection with a fisheries offence if the court—
> >
> > > (a) convicts a person of the offence, or
> >
> > > (b) (Repealed)
> >
> > > (c) makes an order under section 10 of the [Crimes (Sentencing Procedure) Act 1999](/view/html/inforce/current/act-1999-092) in respect of the offence.

> > (2) The Local Court must not order any such forfeiture if it is satisfied that the value of the boat or motor vehicle exceeds the jurisdictional limit of the Local Court sitting in its General Division within the meaning of the [Local Court Act 2007](/view/html/inforce/current/act-2007-093).
>
> > (3) To avoid doubt, a forfeiture order is not a monetary penalty for the purposes of any provision of this Act that provides for the maximum monetary penalty that may be imposed by the Local Court in proceedings for an offence under this Act or the regulations.
