#### 221ZX Significant effect on environment requiring EIS includes significant effect on threatened species, populations and ecological communities for purposes of Part 5 of Planning Act 221ZX Significant effect on environment requiring EIS includes significant effect on threatened species, populations and ecological communities for purposes of Part 5 of Planning Act > > (1) For the purposes of Part 5 of the Planning Act, an activity is to be regarded as an activity likely to significantly affect the environment if it is likely to significantly affect threatened species, populations or ecological communities. > > > (2) In that case, an environmental impact statement prepared under Part 5 of the Planning Act is to include or be accompanied by a species impact statement. > > > (3) If the likely significant effect on threatened species, populations or ecological communities is the only likely significant effect on the environment, a species impact statement may be obtained under Part 5 of the Planning Act instead of an environmental impact statement and that Part applies as if references to an environmental impact statement were references to a species impact statement. > > **s 221ZX:** Ins 2016 No 63, Sch 11.2 \[15\].
