#### 190 Special provisions relating to oysters on public water or other land 190 Special provisions relating to oysters on public water or other land > > (1) All oysters on public water land, or on any area from which the taking of oysters is prohibited under this Act, and all oysters taken from any such land or area without lawful authority, are the property of the Crown. > > > (2) A person who, without lawful authority, takes oysters from any public water land is guilty of an offence. > > > > Maximum penalty—50 penalty units. > > > (3) A person has lawful authority to take oysters from public water land for personal consumption. However, this subsection is subject to any other prohibition or restriction imposed by or under this Act on the taking of oysters.
