Fisheries Management (Abalone Fisheries) Regulations 2017

The regulations are built around a small set of recurring technical concepts. Defining and tracking these is central to compliance.

• Abalone fishery and zones (reg 5 and reg 3 definitions). The instrument expressly constitutes three fisheries: Central Zone, Southern Zone and Western Zone. Each fishery is defined by geographic coordinate‑based zone boundaries (see reg 3(1) definitions of Central Zone, Southern Zone and Western Zone). The term abalone fishery, when used, refers to one of these three fisheries.

• Whole, meat and conversion value (reg 3 definitions and reg 4). "Whole" means the whole abalone including meat, viscera and shell; "meat" is all muscular foot after viscera removal. The weight of abalone meat before removal from the shell is calculated by multiplying whole weight by the conversion value determined by the Minister (reg 4). The Minister may determine and later vary conversion values for each fishery and class of abalone (regs 10(2)(a)(ii), 11(2)(a)(ii), 12(2)(a)(ii)).

• Classes of abalone (reg 3(4)). A "class of abalone" is a class determined by the Minister having regard to species, sex, size, weight or other characteristics. The quota and unit systems operate by class.

• Unit entitlement, unit value and abalone quota entitlement (regs 10-12 definitions). For each licence and class of abalone:

  • Unit entitlement is the number of abalone units allocated to a licence for a class.
  • Unit value is the number of kilograms of abalone meat the Minister determines an abalone unit represents for a fishery/class/quota period.
  • Abalone quota entitlement (or quota entitlement) is the maximum kilograms of meat lawfully takeable in a quota period by multiplying unit entitlement by unit value, subject to any subsequent variation.

• Quota period (regs 10(1), 11(1), 12(1)). Each zone has defined quota periods: Central and Western are 12 months commencing 1 January; Southern initially had a transitional period starting 1 October 2022 to 31 August 2023 then annual periods starting 1 September (see reg 11). Specific named quota periods (quota period 2020 etc) are inserted for transitional calculations (various amendments listed).

• Minister's determinations and discretion (reg 19 and regs 10-12). The Minister must determine unit values and conversion values (regs 10(2), 11(2), 12(2)) and may vary conversion values. The Minister may vary licence conditions that fix unit entitlements and quota entitlements under a range of factual triggers set out in each zone's regulation; these include catch shortfalls (carry‑forward increases), overcatch (reductions in subsequent entitlement), joint applications to shift units between licences, compensation for assisting with research, and particular transitional carry‑forward rules (regs 10(3), 11(3), 12(3)). The Minister’s general power to make determinations for the purposes of a regulation is in reg 19.

• Registration of boats, devices and masters (regs 8-9). An application to register a boat, device or master must be accompanied by the documents specified in the application form (reg 8). The Minister may revoke a registration on application by the licence holder, subject to form and documentation requirements (reg 9).

• Reporting, record keeping and inspection (regs 16-18). The holder or registered master must record catch and disposal information in the manner, form, places and times determined by the Minister; provide those records to the Department; and ensure weighing, storage, tagging and transportation comply with requirements set by the Minister (reg 16). The Minister determines the format and timing of periodic returns (reg 17). Records must be maintained in good condition, legible, readily accessible and produced on request to a fisheries officer (reg 18).

• Minimum unit entitlement thresholds (regs 10(6), 11(6), 12(6)). Each zone specifies a minimum number of units a licence must carry for specified classes before commercial taking is permitted. The Southern Zone has markedly different thresholds (Blacklip 100 units; Greenlip 5 units) compared with Central and Western thresholds, which reflect the regulation's zone‑specific design.

These concepts are the building blocks of the regulatory obligations: the Minister sets conversion and unit values, licence holders hold unit entitlements and must respect quota periods and any Ministerial variations, and reporting and registration rules operationalise enforcement. The regulations also cross‑reference external legal frameworks for definitions (eg Corporations Act meanings at reg 3(2)).

The regulations directly affect several categories of persons and entities, and indirectly affect others in the commercial supply chain.

Directly affected persons and entities

• Licence holders in each of the three constituted fisheries (Central, Southern and Western). The maximum number of licences is frozen at the pre‑commencement number (reg 6). Licence holders are subject to quota units, reporting and operational restrictions (regs 6, 10-12, 16-18).
• Registered masters and boats used under licences. Registration is required for boats/devices and persons as masters (reg 8). Only one registered boat may be used at any one time under a licence (reg 13). Rules govern how many registered masters may fish on the same day, trainee diver exceptions, and supervision requirements (reg 14).
• Transferees and applicants to whom licences and unit entitlements may be transferred. Transfers are permitted but subject to Ministerial consent and documentary and fitness conditions (reg 7). Company transferees must provide a current company extract issued within one month of application (reg 7(2)(c)), and company directors must be fit and proper persons (reg 7(3)(e)). Natural person transferees must be at least 15 years and be fit and proper (reg 7(3)(d)).
• Companies that hold licences (or seek to) because corporate governance checks under the Corporations Act definitions apply and a current company extract is required in transfers (regs 3(2), 7(2)(c)).

Indirectly affected persons and entities

• Buyers, processors and transporters of abalone. The holder or registered master must ensure abalone are weighed, stored, sealed, tagged and transported in accordance with Minister requirements (reg 16(1)(c)). Those downstream are likely to be bound by chain‑of‑custody tagging and transport obligations imposed on the licence holder.
• Employers and crew. The restrictions on number of registered masters and trainee diver rules affect crew planning (reg 14).
• Entities holding Commonwealth or other statutory entitlements in respect of a boat that is registered for use under a licence. A licence transfer that involves a boat subject to another entitlement under Commonwealth law must either transfer the entitlement together or see it surrendered, or else the Minister must be satisfied that separate transfer will not risk over‑exploitation and that the other granting body concurs with the separate transfer (reg 7(3)(f)).
• The Department administering the Act, which receives returns and implements Ministerial determinations and may inspect records under reg 18.

Who pays

• Licence holders pay prescribed fees associated with applications to vary unit entitlements (reg 10(5), 11(5), 12(5)) and any other prescribed fees under the Act that must be paid before transfer consent (reg 7(3)(a)). They also bear compliance costs for record keeping, reporting, tagging and storage as determined by the Minister (regs 16-18).
• Transferees (companies and individuals) bear the administrative cost of supplying company extracts and proving fitness and good character (reg 7(2)(c), 7(3)(d)-(e)).

Who decides

• The Minister has recurring operational decision‑making power: determination of unit values and conversion values (regs 10-12), power to vary licence conditions including unit entitlements under specified triggers (regs 10-12), general power to make determinations for purposes of regulations (reg 19), discretion to consent to licence transfers subject to statutory criteria (reg 7).
• The Department receives returns and implements determinations; fisheries officers inspect records (reg 18).

Behavioural change required

• Licence holders must manage quota unit entitlements and alter fishing activity to respect quota entitlements and minimum unit thresholds (regs 10-12).
• They must comply with registration and operational constraints that affect vessel use and crew deployment (regs 8, 13-15).
• They must operate record systems and processes that satisfy Ministerial specifications for catch and disposal and periodic returns, and keep records accessible for inspection (regs 16-18).

The regulations therefore influence who can fish, how much they can fish, how quota entitlements are counted and altered, and what administrative systems and operational practices licence holders must maintain. The source furnishes the precise statutory text governing these actors and responsibilities; the contours of compliance and costs are set by the statutory criteria and the Minister’s subsequent determinations.

This section organises the principal duties imposed on regulated entities and the rights or procedural avenues the instrument affords them.

Principal duties

• Observe quota entitlements. Licence holders must not take more than their abalone quota entitlement for a quota period, which is the product of unit entitlement and unit value subject to Minister variations (regs 10-12 definitions). The holder must also not take commercially if their unit entitlement for certain classes falls below the prescribed minimum threshold for that fishery (regs 10(6), 11(6), 12(6)).
• Comply with catch and disposal requirements. The holder or registered master must record catch and disposal information in the manner, form, at the places and times determined by the Minister; provide that information to the Department; and ensure abalone are weighed, stored, tagged and transported according to requirements determined by the Minister (reg 16(1)). Failure to comply with a Ministerial determination under reg 16(1) is an offence (reg 16(2)).
• Keep periodic returns. Licence holders must provide returns in the manner, form and times determined by the Minister and keep copies of returns as required (reg 17).
• Maintain records. Persons required to keep records must ensure records are legible, kept in good condition, readily accessible and produced for inspection by a fisheries officer on request (reg 18).
• Registration rules. Holders must register boats and devices for use under a licence and register masters as required, using forms and documents specified for applications (reg 8) and may apply for revocation of registration following approved forms and requirements (reg 9).
• Operational limits. Holders must not use more than one registered boat at any one time to take abalone under a licence (reg 13), must allow no more than one registered master to engage in fishing activities under the licence on the same day subject to limited Southern Zone and trainee exceptions (reg 14), and must not permit registered boats to be transported or towed to fishing locations (reg 15).

Rights, procedural avenues and discretions affecting regulated persons

• Right to transfer licences subject to Ministerial consent. Licences are transferable (reg 7(1)) but transfer requires an application with the licence, a completed periodic return up to application date and, for company transferees, a current company extract (reg 7(2)). The Minister may consent to transfer only if conditions in reg 7(3) are satisfied, including payment of fees, no suspension, no pending relevant proceedings, and fitness of transferee or directors (reg 7(3)(a)-(e)). Where boats are subject to other entitlements the transfer must either include that entitlement or be approved by the other granting body (reg 7(3)(f)).
• Right to apply to vary unit entitlements. On joint application by two licence holders, the Minister may vary unit entitlements by transferring units from one licence to another (regs 10(3)(a), 11(3)(a), 12(3)(a)). Applications must be made in a manner and form approved by the Minister, in accordance with instructions and accompanied by the prescribed fee (regs 10(5), 11(5), 12(5)).
• Ministerial compensation/reward mechanism. The Minister may increase quota entitlements to compensate licence holders who assist in research activities under the Act if the Minister considers it appropriate (regs 10(3)(e), 11(3)(e), 12(3)(e)).
• Ministerial power to vary quota entitlements after overcatch or undercatch. For each fishery the Minister may increase or decrease licence quota entitlements in specified circumstances tied to prior period catches including mechanisms to carry forward shortfalls or to penalise overcatch in a subsequent period. These vary between zones (regs 10(3)(aa), (b), (c), 11(3)(b)-(d), 12(3)(b)-(d)). For example, in the Central Zone the Minister may increase future unit entitlements across several years where total catch in 2020 fell short and some licence holder(s) individually fell short by more than 50 kg (reg 10(3)(aa)). In the Southern Zone overcatch triggers possible reductions and undercatch allows increases up to specified caps (reg 11(3)(b), (d)).
• Determination process. The Minister may make determinations for the purposes of a regulation and those determinations must be published on the Department’s website and notice given to persons bound by the determination in a manner the Minister considers will bring it to their attention; however, reg 19(6) excludes determinations made for the purposes of regulations 10, 11 or 12 from the operation of reg 19 (reg 19).

Constraints and procedural checks on Ministerial decisions found in the text

• Statutory limits on some variations: several variations to quota entitlements are expressly time‑limited to the quota period during which they are made (see regs 10(3)(f), 11(3)(f), 12(3)(f)). Some increases derived from one mechanism are disregarded for the purposes of later carry‑forward calculations (regs 10(4), 11(4), 12(4)), which affects how cumulative increases operate.
• Transfer constraints related to external entitlements: where boats are subject to Commonwealth or other entitlements reg 7(3)(f) requires transfer together or surrender, or Ministerial satisfaction and concurrence by the other granting body for separate transfer (reg 7(3)(f)(i)-(ii)).

These duties and rights allocate operational responsibilities to licence holders and procedural control to the Minister and Department. Several of the Minister’s powers are mandatory (must determine unit values) while many are discretionary (may vary conversion values; may vary quota entitlements under specified triggers).

The regulations specify a set of criminal penalties and statutory expiation fees for non‑compliance with particular provisions. The enforcement model combines monetary penalties, expiation options and inspection powers.

Specified penalties and expiation fees

• Minimum unit entitlement offences (Central Zone): Holding a licence and taking abalone for a commercial purpose when unit entitlement falls below the prescribed minimum for Blacklip or Greenlip attracts maximum penalty $5 000 and expiation fee $500 (reg 10(6)).
• Minimum unit entitlement offences (Southern Zone): Same maximum penalty $5 000 and expiation fee $500 for falling below Southern Zone thresholds: Blacklip 100 units; Greenlip 5 units (reg 11(6)).
• Minimum unit entitlement offences (Western Zone): Same maximum penalty $5 000 and expiation fee $500 where unit entitlement falls below prescribed figures (reg 12(6)).
• Use of more than 1 registered boat at a time (reg 13): Maximum penalty $5 000; expiation fee $315.
• Use of registered masters (reg 14): Maximum penalty $5 000; expiation fee $315 for causing or permitting more than one registered master on the same day except for limited exceptions.
• Transporting or towing a registered boat to fishing location (reg 15): Maximum penalty $5 000. (No expiation fee specified in the text for reg 15.)
• Catch and disposal determination non‑compliance (reg 16(2)): If a Ministerial determination on catch/disposal is not complied with, both the holder and the registered master are guilty of an offence; maximum penalty $5 000; expiation fee $500 stated in reg 16(2).
• Record keeping location and retention failure (reg 16(3)): Holder must keep records as determined by the Minister; maximum penalty $5 000; expiation fee $315.
• Periodic returns (reg 17): Failure to provide returns as determined by the Minister or to keep records of returns attracts maximum penalty $5 000; expiation fee $500 for both providing and keeping.
• Record condition and accessibility (reg 18): False or poor maintenance of required records or failing to produce for inspection draws maximum penalty $2 500; expiation fee $210.

Enforcement mechanisms

• Inspection. Records kept under these regulations must be produced for inspection by a fisheries officer on request (reg 18(c)). That provides on‑site inspection and document production as an enforcement tool.
• Expiation. The instrument sets expiation fees for many offences, which provides an administrative alternative to prosecution for certain contraventions (see expiation fees listed alongside maximum penalties).
• Ministerial determinations and licence condition variations. The Minister has power to vary licence conditions, including decreasing unit entitlements following overcatch and increasing entitlements following undercatch in some circumstances. Decreases in entitlement may be applied to subsequent quota periods (regs 10-12). This can operate as both a regulatory correction and an enforcement response to prior behaviour. For example, reg 11(3)(c) allows the Minister to reduce quota entitlements for three quota periods where a holder is convicted of an offence involving taking more than 100 kg in excess of entitlement.

Operational enforcement implications drawn from the text

• Dual liability for catch/disposal determinations. Both the licence holder and the registered master can be guilty of the offence when a Ministerial determination under reg 16(1) is not complied with (reg 16(2)). This creates overlapping responsibility between owner/operators and masters.
• Varied expiation fees. The difference in expiation fees across offences can shape enforcement practice; for some operational breaches the expiation fee is modest (eg $210 for reg 18) while for others it is higher (eg $500 in several quota/return/reg 16 contexts).
• Administrative sanctions via condition variation. The Minister’s ability to vary quota entitlements after overcatch or undercatch operates as an administrative sanction beyond criminal penalties and may reduce future allowable catches.

What the regulations do not specify in detail

• The text does not set out the procedural process for enforcement actions beyond production on request and the listing of offences, eg it does not detail notice or review rights for administrative variations to licence conditions beyond the statutory text; nor does it specify an internal review mechanism for Ministerial determinations (although determinations must be published under reg 19 for many, see next section on interaction with other laws).
• Reg 19(6) excludes determinations made for regs 10-12 from publication/notice rules in reg 19; those quota‑related determinations are therefore not covered by reg 19’s publication and notice obligations, which has enforcement and transparency implications.

In combination, the regulations provide a mix of monetary penalties, expiation schemes and administrative licence adjustments as enforcement tools. The statutory text places detailed responsibilities on licence holders and registered masters and allocates primary operational discretion to the Minister and the Department for monitoring and corrective action.

The regulations are made under the Fisheries Management Act 2007 and explicitly cross‑reference a small set of external legal instruments and standards. The source text contains limited but important points of interaction.

Primary enabling legislation and subordinate status

• These regulations are subordinate legislation under the Fisheries Management Act 2007 (header). They operate within the powers delegated by the Act and must be read and applied in that statutory context. The regulations use terms and mechanisms that are designed to implement the Act’s framework for licences, permit conditions, quota management and enforcement.

Corporations Act definitions

• Reg 3(2) adopts the Corporations Act 2001 (Commonwealth) meanings for company, director, proprietary company and public company. Reg 7(2)(c) requires a transferee company to provide a current company extract from the Australian Securities and Investments Commission database, and reg 7(3)(e) requires that each director of a transferee company be a fit and proper person to be a director of a company that holds an abalone licence. These references import corporate identity and governance checks administered under Commonwealth law into the licensing process.

Geodesic and measurement standards

• Reg 3(3)(a) specifies that spatial descriptions use geodesics based on the Geocentric Datum of Australia 2020 (GDA2020) as defined under a Commonwealth National Measurement Act determination. That imports a Commonwealth measurement standard for defining zone boundaries and coordinates.

Interplay with Commonwealth entitlements

• Reg 7(3)(f) deals directly with instances where a boat registered for use under a licence is the subject of a licence, permit, authority or other entitlement under Commonwealth law or a corresponding law. If such an entitlement exists, the entitlement must either be transferred with the licence or surrendered before transfer, or the Minister must be satisfied that separate transfer will not cause over‑exploitation and the other granting body must concur. This clause requires coordination between State licensing and Commonwealth maritime/fisheries entitlements where both apply to the same vessel.

Publication and administrative law cross‑references

• Reg 19(3)(a) requires publication of Ministerial determinations on the Department’s website and permits Gazette publication (reg 19(3)(b)). Reg 19(4) requires written notice as soon as practicable to persons bound by a determination, in a manner and form that the Minister considers will bring it to their attention. These procedural rules are administrative practice points that interact with administrative law concepts such as reasonable notice and communication, although the regulations themselves do not specify appeal or merits review paths.

Limits on publication for quota determinations

• Significantly, reg 19(6) provides that reg 19 does not apply in relation to determinations made for the purposes of regs 10, 11 or 12. That means determinations underpinning the unit value, conversion value and many quota‑related variations are not subject to the publication and notice regime in reg 19. That exclusion can affect transparency and creates an interaction between the statute’s notice requirements and the Minister’s discretion to make quota adjustments.

Interaction with the Fisheries Management Act 2007 enforcement and licensing regime

• The regulations impose offences with penalties and expiation fees; the Act will provide the broader enforcement architecture, including who has powers of investigation, what procedural steps govern revocation or suspension of licences, and how appeals and prosecutions proceed. The regulations refer to obligations such as payments of fees "under the Act" as a precondition to transfer consent (reg 7(3)(a)), tying the subsidiary regulatory operation directly to the principal Act’s fiscal and licensing provisions.

Transitional restrictions on eligibility to apply for a licence

• Schedule 2 Part 2 restricts who may apply under section 54 of the Act for a licence in respect of each of the three fisheries to those already holding such a licence immediately before the commencement of the clause (Schedule 2 cl 2). This establishes an interaction between the transitional regulation and the Act’s licence application processes.

What the text does not change or specify

• The regulations do not repeal other parts of the Fisheries Management Act and other subordinate instruments; they operate alongside them. The document notes that earlier versions of regulations are listed in the legislative history and that references to other legislation or instruments in the text may be obsolete if those instruments have been updated (legislative history notes). Users must therefore consult the principal Act and any other relevant subordinate instruments for the complete legal picture.

In short, the regulations import Commonwealth corporate and measurement standards, require coordination with Commonwealth entitlements affecting vessels, rely on the Fisheries Management Act 2007 for the broader licensing and enforcement framework, and create a tension between the Minister’s discretionary quota determinations and the general publication and notice regime by expressly excluding quota determinations from reg 19 notice obligations.

The source provides a concise legislative history and a schedule of amendments and variations. The instrument was made in 2017 and has been varied several times. The legislative history and variation table are the authoritative record provided in the source; below is a synthesis of the changes recorded there.

Key instruments and dates

• Principal instrument: Fisheries Management (Abalone Fisheries) Regulations 2017 (No 220), Gazette 8.8.2017; commencement noted 15.1.2018 for r 2 (the short title provision appears to have internal commencement notation).
• 2020 variation: Fisheries Management (Abalone Fisheries) (No 320) , Gazette 17.12.2020, r 2 commenced 17.12.2020. This amendment inserted multiple quota period definitions (quota period 2020 through quota period 2025) and varied provisions in regs 10, 11 and 12 (see the variation table entries for r 10, r 11 and r 12 with insertion of specific quota periods and additional subregulations such as 11(3a) and 12(3a)).
• 2022 variation: Fisheries Management (Abalone Fisheries) (Quota) Amendment Regulations 2022 (No 74 of 2022) , Gazette 1.9.2022; commencement for most of the variation 1.10.2022, with rr 3, 5 and Sch 1 commencing 1.1.2023 as noted in the commencement column. This instrument inserted the term "following quota period" definitions into regs 10(1) and 12(1), substituted and deleted particular subparagraphs in reg 10(3), replaced reg 10(4), inserted reg 10(4a), and made multiple other substitutions and insertions in regs 11 and 12, including insertion of reg 12(3a) and substitution of reg 12(4). The regulation also produced transitional provisions (Transitional etc provisions associated with regulations or variations) dealing with carry‑forward applications for overcatch incidents in 2022.
• 2023 variation: Gazette entry 20.4.2023, No 18; commencement 1.5.2023 for r 3. This amended r 3(3) and deleted Schedule 1. The variation table notes r 3(3) amended by 18/2023 r 3.

Selected substantive changes recorded in the variation table

• Quota period insertions and definitions were added by the 2020 instrument (No 320) across regs 10, 11 and 12 to create named quota periods for transitional carry‑forwards and calculations (e.g. "quota period 2020", "quota period 2021", etc).
• Reg 10(3): varied by 320/2020 (Dec 2020) and then amended by 74/2022 (Jan 2023 commencement for some parts). The 74/2022 instrument deleted subparagraph (d) of reg 10(3) and substituted reg 10(4). It also inserted reg 10(4a), which restricted applications under reg 10(3)(a) in respect of abalone units allocated under reg 10(3)(b).
• Reg 11: initially amended by 320/2020 to add provisions dealing with quota period transitions (adding reg 11(3a)), and later amended by 74/2022 for quota period changes effective 1.10.2022.
• Reg 12: similarly subject to the 2020 and 2022 amendments, including insertion of "following quota period", and updates to the carry‑forward and overcatch logic.
• Sch 1 was deleted by 18/2023; Pt 1 of Sch 2 was omitted under the Legislation Revision and Publication Act 2002 on 17.12.2020.

Transitional provisions associated with the 2022 amendments

• The 2022 variation included an accompanying schedule stating that certain overcatch events that occurred in the quota period commencing 1 January 2022 would still be processed under the pre‑amendment version of the relevant reg 10(3)(b) or reg 12(3)(b) as they stood immediately before the relevant day, ensuring those licences could be varied under the pre‑existing rules for the quota period commencing 1 January 2023. These are transitional clauses tailored to tidy the legal effect of amendment on ongoing quota calculations.

Notes on legislative revision housekeeping

• The legislative history includes a standard note that references in the legislation to other legislation or instrument titles may be obsolete and earlier versions are listed. It records the exact instruments and dates of commencement relevant to each variation, which practitioners should consult when working off a particular date or version.

What the legislative history records do not include

• The historical versions listed (17.12.2020, 1.10.2022, 1.1.2023) are noted but the source does not include text of prior versions beyond what is captured in the variation notes. The provided table identifies which provisions were inserted, substituted, varied, or deleted and the commencement dates for those changes; practitioners should consult the consolidated and historical versions on the official legislation site for line‑by‑line text comparisons.

In sum, the instrument has been actively varied since 2017 with substantive quota‑mechanism reforms added in 2020 and a quota‑amendment package in 2022 that took effect during 2022-2023, plus technical revisions in 2023. The legislative history supplied in the source should be consulted directly when determining the text applicable to a specified historical date.

The legislative text supplied does not name, summarise or list any litigation or judicial decisions concerning these regulations. The legislative history portion in the source documents variations, commencements and revocations, but it does not include any cases or reported decisions applying, interpreting or challenging these specific regulations.

What is recorded in the source

• The instrument contains a legislative history of amendments and commencement dates (see the "Legislative history" portion), but it contains no references to court cases, tribunal decisions or any proceedings under the regulations. There are no named cases in the text provided and no description of contested enforcement actions.

Implications for litigation risk and likely legal issues (statutory text as basis)

• Because the regulations vest substantial administrative discretion in the Minister , notably the mandatory and discretionary powers to set unit values and conversion values for quota periods (regs 10(2), 11(2), 12(2)) and the broad power to vary licence conditions in response to catch records (regs 10-12) , potential legal issues that could arise in future litigation include:
  • Procedural fairness challenges to administrative decisions where interested parties claim insufficient notice or lack of opportunity to be heard. The regulations set a notice regime for Ministerial determinations in reg 19 but expressly exclude determinations for regs 10-12 from reg 19(3)-(5) (reg 19(6)), which may be a locus for dispute about notice and reasons in individual cases.
  • Challenges to the rationality or reasonableness of unit values or conversion values where those determinations materially affect quota entitlements and therefore economic interests. The text requires that the Minister determine unit values and conversion values but does not prescribe a statutory methodology or consultation process in the operative clauses themselves.
  • Disputes over transfer consent where reg 7(3)(f) requires concurrence or satisfaction regarding separate transfers of Commonwealth entitlements in relation to a boat. That cross‑jurisdictional aspect could generate procedural or jurisdictional litigation.
  • Enforcement disputes concerning the application of penalties and the scope of offences in regs 13-18, including whether particular operational practices fall within Ministerial determinations relating to weighing, storage and tagging under reg 16(1)(c).
  • Judicial review claims directed at the lawfulness of quota entitlement variations that reduce an operator’s future ability to fish, particularly where the Secretary/Minister is exercising the power under the regs to reduce entitlements after an overcatch or following criminal conviction (see reg 11(3)(c)).

What the regulations themselves create

• The instrument establishes statutory offences and penalty schemes, but does not include a stand‑alone internal merits review mechanism for administrative decisions under the regulations; typical avenues for challenge would therefore be administrative law review (eg judicial review on public law grounds) and any relief available under the Fisheries Management Act 2007. The source text does not catalogue those review routes.

Conclusion for litigation history

• As of the text provided, there is no litigation record. Practitioners concerned with potential challenges should focus on the textually explicit discretionary powers (regs 10-12 and reg 19) and on how determinations are published and notified, because those are likely flashpoints for dispute given the material economic effects of quota‑related determinations.

This section collates practical pitfalls and non‑intuitive features of the regulations that can produce compliance failure, surprise fiscal effects or operational disruption. Each item is grounded in the statutory text.

1. Conversion value centralised and variable (regs 4, 10(2), 11(2), 12(2))

• The conversion from whole abalone weight to meat weight is not fixed in the regulations; it is determined by the Minister and may be varied from time to time (reg 4; regs 10(2)(a)(ii), 11(2)(a)(ii), 12(2)(a)(ii)). Licence holders whose quota entitlements are denominated by unit value and who rely on whole weight measurements should monitor Ministerial determinations closely because changes in conversion value alter the effective kilograms of meat attributable to whole weight.

2. Quota determinations may not be subject to standard publication/notice rules (reg 19(6))

• Reg 19 sets out publication and written notice requirements for Ministerial determinations, but reg 19(6) excludes determinations made for the purposes of regs 10, 11 or 12. That means the determinations that set unit values and conversion values and many variations to quota entitlements may not be published under reg 19 and Ministers need not provide the same written notice mechanisms in reg 19(3)-(5) for quota determinations. Practically, this reduces guaranteed transparency for the most economically significant determinations.

3. Minimum unit entitlement thresholds differ markedly between zones (regs 10(6), 11(6), 12(6))

• The Southern Zone sets Blacklip minimum unit entitlement at 100 units and Greenlip at 5 units (reg 11(6)); Central and Western Zones have much lower thresholds (eg 25 units for Blacklip in Central, 25 units in Western; Greenlip 25 in Central, 27.5 in Western). Licence holders moving between zones, changing business models, or attempting to downsize may be prevented from commercially taking abalone in a zone if unit entitlement falls below the relevant minimum. The significance varies by zone and class.

4. Certain increases in quota entitlements are expressly non‑transferable (reg 11(3)(d)(ii))

• In the Southern Zone, a Ministerial increase under reg 11(3)(d)(i) can be accompanied by a prohibition on transferring any additional abalone units allocated to the licence as a result of that increase (reg 11(3)(d)(ii)). Practitioners must check licence variation notices to see if newly allocated units are ring‑fenced and non‑transferable.

5. Some unit reallocation applications are restricted (reg 10(4a), 12(4a))

• Applications under joint transfer provisions cannot be made in respect of units allocated under certain prior variation provisions (eg reg 10(4a) states an application under reg 10(3)(a) may not be made in respect of units allocated under reg 10(3)(b)). This prevents immediate secondary trading of some administratively allocated units and can affect liquidity and restructuring plans.

6. One‑boat and towing prohibitions affect operational logistics and costs (regs 13, 15)

• Reg 13 prohibits using more than one registered boat at once under a licence, which constrains multi‑vessel operations. Reg 15 forbids transporting or towing a registered boat to the place where it will be used to take abalone, which restricts certain staging strategies and could increase time at sea and fuel costs because vessels cannot be carried or towed to favourable dive locations.

7. Master and trainee restrictions narrow labour flexibility (reg 14)

• The holder must not permit more than one registered master to engage in fishing activities on the same day (reg 14(1)), with limited exceptions for the Southern Zone and trainee divers. Trainees are capped at 10 days of commercial diving per quota period and must be directly supervised (reg 14(2)(b)). That constrains training throughput and may increase short‑term crew costs.

8. Dual liability for catch/disposal breaches (reg 16(2))

• If a Ministerial determination on catch and disposal is not complied with, both the licence holder and the registered master are each guilty of an offence (reg 16(2)). This creates shared exposure and potential employer‑employee liability conflicts if a master acts outside of or contrary to holder instructions.

9. Documentary and fitness requirements for transfers (reg 7)

• Licence transfer requires a completed periodic return up to the date of application, the licence document, and a company extract for company transferees (reg 7(2)). The Minister may refuse consent where fees are unpaid, the licence is suspended, proceedings are pending or likely, or transferees/directors are not fit and proper persons (reg 7(3)(a)-(e)). This makes transfers contingent on compliance, litigation exposure and personal/board vetting.

10. Varied caps and carry‑forward rules differ across zones and quota periods (regs 10-12; legislative history)

• The central mechanics that increase or decrease entitlements after undercatch or overcatch differ substantially by zone and by quota period, and the 2020 and 2022 amendments added multiple temporal rules for 2020-2025 quota periods (see regs 10(3)(aa), 11(3)(d)(iii), 12(3)(b)). Practitioners must apply the correct version of the regulation for the relevant quota period; failing to do so can miscalculate entitlements.

11. Prescribed form, manner and times for returns are delegated to the Minister (regs 16-17)

• Many operational requirements (what to record, timing, how to tag, where to store) are left entirely to Ministerial determinations without statutory content in the regulations. This creates compliance uncertainty until determinations are issued or amended and raises operational risk if determinations change with limited published notice (remembering the reg 19(6) exception for quota‑related determinations).

12. Transitional eligibility restrictions may block new entrants (Schedule 2 cl 2)

• Schedule 2 Part 2 restricts initial eligibility to apply for a licence under section 54 of the Act to persons who were already licence holders immediately before commencement (Schedule 2 cl 2). That can lock the current licence population and limit entry opportunities for new participants during the transitional period.

Practitioners should therefore track Ministerial determinations and legislative amendments, preserve complete contemporaneous records to defend against enforcement actions, model the financial effect of changes in conversion/unit values, and consider the liquidity and transferability constraints on unit entitlements when planning business activity.

This section provides a practical compliance checklist, organised around recurring obligations in the regulations. Each step is grounded in the statutory text and indicates documentation and process expectations.

1. Review licence status and transfer constraints (reg 6, reg 7)

• Confirm the licence is in force and that the total number of licences has not been exceeded (reg 6).
• Before attempting a transfer, ensure all fees and other amounts payable under the Act are paid in full, the licence is not suspended, and no relevant proceedings are pending or likely (reg 7(3)(a)-(c)). If transferee is a company, obtain a current ASIC company extract dated within one month of application (reg 7(2)(c)). For individuals ensure age and fit and proper status (reg 7(3)(d)-(e)). If the licenceed vessel is subject to Commonwealth entitlements, plan for concurrent transfer, surrender, or secure concurrence from the other granting body (reg 7(3)(f)).

2. Register boats, devices and masters properly (regs 8-9)

• Complete the application forms in the manner and with the supporting documents specified in the forms when registering a boat or device or when registering a person as a master (reg 8). Maintain a record of registration and apply for revocation using the approved form if needed (reg 9). Keep forms and supporting documents readily accessible for inspection.

3. Track unit entitlements, unit values and conversion values (regs 10-12, reg 4)

• Maintain an account ledger showing unit entitlement allocations by class, current unit values determined by the Minister for each quota period, the conversion value for whole to meat weight, and resulting abalone quota entitlements per quota period (regs 10-12 definitions, reg 4). Update models each time the Minister issues a new determination for unit value or conversion value (regs 10(2), 11(2), 12(2)). Because the Minister may vary conversion values, you must be ready to recalculate quotas and adjust operations.

4. Observe minimum unit entitlement thresholds (regs 10(6), 11(6), 12(6))

• Do not take abalone commercially if the unit entitlement for the relevant class falls below the prescribed minimum for that zone. Check the exact figure for the fishery and class (Blacklip, Greenlip) and ensure unit entitlements are not depleted below those thresholds through transfers or administrative reductions.

5. Make formal applications for unit transfers and variations (regs 10(5), 11(5), 12(5), 10(3)(a), 11(3)(a), 12(3)(a))

• Use the Minister‑approved forms and pay the prescribed fee for applications to vary unit entitlements. Joint applications for transfer of units between two licence holders are permitted subject to constraints (for example reg 10(4a) restricts applications in respect of certain administratively allocated units). Document consent and ensure both applicants comply with form and fee requirements.

6. Keep accurate and ministerially compliant catch, disposal and returns records (regs 16-18)

• Implement and maintain recording procedures that capture the information determined by the Minister for catch and disposal (reg 16(1)(a)). Set up electronic or hardcopy systems that allow data provision to the Department in the manner and at the times specified by Ministerial determinations (reg 16(1)(b)) and keep copies of each periodic return as required (reg 17(2)). Ensure records are maintained in good condition, legible, and readily accessible and that personnel can produce records to a fisheries officer on request (reg 18). Because the Minister determines the manner, place and times for submission and for storage periods, update processes as new determinations are published.

7. Comply with Ministerial requirements for weighing, sealing, tagging and transport (reg 16(1)(c))

• Put in place chain‑of‑custody procedures to guarantee compliance with any Ministerial requirements on weighing, storage, sealing, tagging and transport. Ensure that all containers, seals and tags are applied and accompanying documentation is completed as required by the Minister.

8. Limit vessel and master usage to statutory limits (regs 13-15)

• Operationally ensure only one registered boat is used at any one time to take abalone under a licence (reg 13). Confirm that only the permitted number of registered masters engage in fishing activities on any one day; the general rule allows only one registered master, with limited Southern Zone and trainee diver exceptions (reg 14). Do not transport or tow registered boats to the fishing site (reg 15).

9. Train and supervise trainee divers within statutory limits (reg 14(2)(b))

• Keep records of trainee divers’ days of commercial diving (cap 10 days per quota period for a trainee) and ensure trainees are under direct supervision of the registered master at all times while engaged in fishing activities (reg 14(2)(b)(i)-(ii)).

10. Retain documentary evidence for inspections and potential disputes

• Maintain a compliance binder including licence documents, registration certificates, copies of periodic returns, catch/disposal records, unit entitlement ledgers, determinations relied upon (unit value, conversion value and any quota variations), ASIC extracts for corporate transferees, and proof of payment of prescribed fees and charges. Ensure these are readily accessible and legible for fisheries officer inspection under reg 18.

11. Monitor the Department’s website and Gazette for determinations (reg 19(3))

• For determinations other than those for regs 10-12, publication is required on the Department’s website and may be in the Gazette (reg 19(3)). Regularly check the Department’s official channels for updates. For quota‑related determinations (regs 10-12), note reg 19(6) excludes them from reg 19’s publication/notice obligations; consequently, maintain direct contact with the Department or request written confirmation of unit values and conversion values that affect your licence.

12. Prepare for Ministerial licence condition variations after overcatch or undercatch (regs 10-12)

• Keep historical catch records for relevant prior quota periods because the Minister may vary future quota entitlements based on past overcatch or undercatch, subject to caps and disregards set out in the regulations. Where overcatch could lead to reductions, plan for forced reductions in future quota periods; where undercatch might allow increases, be aware that some increases can be non‑transferable or subject to caps.

13. Comply with criminal and administrative obligations and understand penalties (regs 13-18)

• Given the set of maximum penalties and expiation fees across several operational provisions, embed compliance checks and internal controls to detect breaches early, document corrective actions, and where appropriate, use expiation payment options to manage minor procedural infringements.

14. Engage legal or regulatory advisers when in doubt

• For transfers of licences involving corporate entities, cross‑jurisdictional vessel entitlements, or where Ministerial determinations materially change quota entitlements, seek legal advice to clarify fit and proper tests for directors, the operation of cross‑entitlement transfers (reg 7(3)(f)), and administrative review or appeal options under the Fisheries Management Act 2007.

This checklist operationalises the statutory obligations in the regulations. Because many procedural details (forms, exact data fields for returns, tagging specifications) are left to Ministerial determination, licence holders should create an internal process of continuous monitoring of Department publications, provide a nominated compliance contact to receive statutory notices, and maintain an auditable trail tying each operational action to the specific determination or licence condition that required it.
