What it does
These Regulations impose and quantify a fixed levy that attaches to the allocation and to the renewal of a defined class of fishing capacity units linked to the South East Trawl Fishery. The instrument was made under the Fisheries Levy Act 1984, and it operates by (a) designating which units of fishing capacity are "prescribed" for the purposes of specified paragraphs of that Act, and (b) setting the dollar amount payable when those levy-triggering events occur. The Regulations themselves are short and procedural: reg 3 prescribes the relevant units of fishing capacity by reference to the South East Trawl Fishery Preliminary Management Plan, and reg 4 fixes the levy amount at $27.90 for both the allocation and the renewal of a prescribed unit of fishing capacity (regs 3; 4(1)-(2)). The instrument also contains a short citation provision and an interpretation clause that defines "plan of management" and "the Act" for the Regulations (regs 1; 2).
Mechanically, the Regulations do not create new levy-triggering events outside the Fisheries Levy Act 1984. Instead they specify that, for the purposes of paragraphs 5 (bc) and 5 (bd) of the Act, a "prescribed unit of fishing capacity" is an allocation made in accordance with the South East Trawl Fishery Preliminary Management Plan (reg 3), and they set a monetary charge that applies to two distinct statutory levy events: the initial allocation of such a unit and the renewal of its allocation, each at $27.90 (reg 4(1)-(2)). The Regulations do not set procedural rules for collection, payment timing, exemptions, enforcement or variation of the levy amount. Those operational matters remain within the Fisheries Levy Act 1984 and any administrative practice established under that Act.
The Regulations also tie the identity of prescribed units to a specific management plan determined by the Minister on 27 January 1988 and published in the Gazette on 5 February 1988, with the regulation language adopting the plan "as that plan is in force from time to time" (reg 2). Accordingly, the scope of the levy is not fixed by the Regulations alone but is linked to the content and ongoing force of that management plan.
