sec.29 Activities authorised under authority
This section states particular matters about what an authority authorises under section 52 of the Act . An authority authorises the carrying out of an activity stated— in the authority; or in a provision of this chapter or the Fisheries (Commercial Fisheries) Regulation 2019 . The authorisation is subject to the conditions— stated in the authority; or prescribed for the authority under this chapter or the Fisheries (Commercial Fisheries) Regulation 2019 . Also, the authorisation, including the conditions to which it is subject under subsection (3) , is subject to any provision of the Fisheries Declaration 2019 that— prohibits the carrying out of the activity; or prohibits the carrying out of the activity in particular circumstances; or otherwise imposes a restriction on how the activity may be carried out. (sec.29-ssec.1) This section states particular matters about what an authority authorises under section 52 of the Act . (sec.29-ssec.2) An authority authorises the carrying out of an activity stated— in the authority; or in a provision of this chapter or the Fisheries (Commercial Fisheries) Regulation 2019 . (sec.29-ssec.3) The authorisation is subject to the conditions— stated in the authority; or prescribed for the authority under this chapter or the Fisheries (Commercial Fisheries) Regulation 2019 . (sec.29-ssec.4) Also, the authorisation, including the conditions to which it is subject under subsection (3) , is subject to any provision of the Fisheries Declaration 2019 that— prohibits the carrying out of the activity; or prohibits the carrying out of the activity in particular circumstances; or otherwise imposes a restriction on how the activity may be carried out.
- (a) in the authority; or
- (b) in a provision of this chapter or the Fisheries (Commercial Fisheries) Regulation 2019 .
- (a) stated in the authority; or
- (b) prescribed for the authority under this chapter or the Fisheries (Commercial Fisheries) Regulation 2019 .
- (a) prohibits the carrying out of the activity; or
- (b) prohibits the carrying out of the activity in particular circumstances; or
- (c) otherwise imposes a restriction on how the activity may be carried out.
