sec.131 Matters about seizure of fisheries resources— Act , s 154
For section 154 of the Act — fish of a species of regulated fish are declared to be fisheries resources to which the section applies; and the offences against sections 77 and 78 of the Act are declared to be offences to which the section applies; and the percentage prescribed for fish that are declared fisheries resources is— if the Fisheries Declaration 2019 , schedule 2 prescribes a threshold percentage for the species of fish—that threshold percentage; or otherwise—5%.
- (a) fish of a species of regulated fish are declared to be fisheries resources to which the section applies; and
- (b) the offences against sections 77 and 78 of the Act are declared to be offences to which the section applies; and
- (c) the percentage prescribed for fish that are declared fisheries resources is— (i) if the Fisheries Declaration 2019 , schedule 2 prescribes a threshold percentage for the species of fish—that threshold percentage; or (ii) otherwise—5%.
