Fisheries (Fees, Royalties and Levies) Regulations 2017

Fee unit pricing and indexing: The Regulations use fee units as the unit of account for all fees, levies and many royalties (Endnotes, Explanatory details). The Monetary Units Act 2004 determines the dollar value of a fee unit each year; the Regulations do not set dollar amounts directly. Practically, this means the monetary burden changes with the Treasurer's annual determination and is not fixed in the Regulations themselves (Endnotes).

Differentiation by class and purpose: Levies are routinely split by class of licence or individual quota unit and by purpose. Schedules 3, 5 and 6 list separate levy components: management services, compliance services, research services, administration services, and (for some quota units) a levy for grants under s 151(5) of the Fisheries Act (regulations 19(2), 21(2), 22(2); Schedules 3, 5, 6, 7). This structure makes explicit cost allocation by function.

Fixed fees vs variable, formula-driven levies: Some fees are fixed per transaction or licence, for example application and transfer fees in Schedule 2 and the standard annual licence fee in regulation 9 (2.6 fee units). Other charges are variable and calculated by reference to historical catch, production or economic value measures. The abalone royalty (regulation 17) and the Fisheries Research and Development Corporation (FRDC) research levy formulas (regulation 23) use measures such as average weighted beach price per kilogram, average annual landed weight, and counts of licences or quota units (definitions in regulation 17 and regulation 23(2)). The text of the instrument supplied contains placeholders for the arithmetic formula images in regulation 17 and regulation 23; the Regulations nevertheless define the variables used in those formulas (see regulation 17 variables GVPr, FS, FRDC; regulation 23 definitions A, B, C, D, GVPf).

Small‑scale cap: For access licences and aquaculture licences the Regulations cap total levy payable if the average annual catch or production over the prior three financial years is less than 500 kilograms. In those circumstances the total levy per licence must not exceed 38.9 fee units (regulation 19(3) and regulation 21(3)). That cap creates a lower bound on annual cost for very small operations.

Payment mechanics, notice and enforcement: Annual payment dates are not hard‑coded; the Victorian Fisheries Authority specifies the date and must give at least 14 days written notice to licence or quota holders (regulations 10(1)-(2), 18(2), 25(1)-(2)). Failure to pay fees or levies within 14 days of due date exposes licence holders to administrative action under s 58 of the Fisheries Act, including a requirement to show cause for non-payment and potential suspension or cancellation (notes to regulations 10 and 25). For individual abalone quota units, s 66Q consequences are highlighted: non-payment within 14 days may lead to suspension and failure to pay within 12 months will result in cancellation (note to regulation 18 and note to regulation 25(2)).

Discretionary relief mechanisms: The Minister has a defined power to reduce or waive levies in whole or in part for particular classes where the level of the relevant services was materially less than the level on which the prior levy was based, or will be materially less in the licensing year in which the levy is payable (regulation 26). The VFA has a separate limited power to waive some permit application fees where special circumstances apply (regulations 30(4)-(5), 31(3)). The Minister can also refund grants levies where proceeds have not been granted by year end (regulation 27).

Itemised schedules and amendment history: The Regulations are highly detailed, with several Schedules listing amounts by licence class and purpose (Schedules 2, 3, 5, 6, 7). The instrument records multiple amendments (Endnotes Table of Amendments) and specific Schedule substitutions and revocations across 2019-2021, indicating the schedules are intended to be updated periodically by statutory rule (Endnotes, Table of Amendments; see Sch. 3, Sch. 6 amendments).

Legal basis and sunset: The Regulations operate under the Fisheries Act 1995 (regulation 2) and, as subordinate legislation, will sunset ten years from making under the Subordinate Legislation Act 1994 (Endnotes).

Licence and quota holders: The primary financial burden falls on holders of commercial access licences, aquaculture licences, fish receiver licences and individual quota units identified in Schedules 2, 3, 5 and 6 (see regulation 19(1), 21(1), 22(1), Schedule 2, Schedules 3, 5, 6). For example, abalone access licence holders in Central, Eastern and Western Zones appear as classes in Schedule 3 with specific levy components (Schedule 3, items 1-3). Individual abalone quota unit holders are subject to royalty (regulation 17) and levy components in Schedule 6 (regulation 22(2), Schedule 6).

Applicants and transferees: Applicants for licences pay application fees (regulation 6, Schedule 2), and persons seeking to transfer licences or quota units pay transfer fees (regulation 7, Schedule 2; regulations 11-12). Where a person applies for multiple aquaculture licences covering the same specified area, regulation 6(2) limits the applicant to a single application fee, being the highest applicable fee.

Recreational licence holders: Recreational fishery group licence applicants and holders pay application fees and duration‑based levies (regulations 28-29). The Regulations also allow online applications to attract a lower levy for the 1‑year and 3‑year licence durations (regulation 29(3)).

Permit applicants: Applicants for general permits and protected aquatic biota permits pay fixed application fees (regulations 30 and 31). The VFA may waive those fees in writing where special circumstances exist (regulations 30(4) and 31(3)).

Boat owners engaged in regulated commercial fishing: Those required to register boats under Part 5 of the Fisheries Regulations 2019 must pay registration application, renewal and transfer fees stated at 2.6 fee units each (regulations 32-34). The Regulations note that carrying out specified commercial fishing from an unregistered boat is prohibited under s 114 of the Fisheries Act 1995 (note to regulation 34).

Government and agencies: The Victorian Fisheries Authority (VFA) administers collection and is responsible for setting the annual dates for payment and giving written notice (regulations 10(1)-(2), 18(2), 25(1)-(2)). The Minister retains discretion to reduce or waive levies (regulation 26) and to refund grant levies where proceeds are unused (regulation 27). The Fisheries Research and Development Corporation (FRDC) is a beneficiary identified in the research levy design (definition in regulation 5 and regulation 23).

Who decides: The VFA sets payment dates and administers notices; the Minister decides on reductions, waivers and refunds; the Treasurer fixes the fee unit dollar value annually (regulation 25(2); regulation 10(2); regulation 18(2); Endnotes).

Flow of money and incidence: Levies are payable to the VFA (regulations 10(1), 18(1), 25(1)). For research levies that fund the FRDC, regulation 23 prescribes formulas that allocate the research levy across licence classes and quota units. Schedule 7 sets levies intended for grants under s 151(5). The Regulations therefore channel funds from licence and quota holders to administration, compliance, management, research and grant-making purposes as specified.

Compliance and enforcement exposure: Licence and quota holders who fail to pay levies or royalties risk administrative action. The instrument explicitly references s 58 (power to require a licence holder to show cause about cancellation/suspension for unpaid fees) and s 66Q (suspension/cancellation for non-payment of individual abalone quota unit royalties) of the Fisheries Act 1995 (notes to regulations 10, 18, 25). Thus, non-payment directly affects entitlement to fish or hold quota.

Duties to pay specified fees, levies and royalties: The Regulations impose duties to pay application fees, transfer fees, licence fees, levies and royalties as applicable to the licence or quota class. Examples:

• Annual licence fee for a commercial fishery licence: 2.6 fee units (regulation 9), payable annually by the date the VFA specifies (regulation 10(1)).
• Application and transfer fees for classes listed in Schedule 2 (regulations 6-7, Schedule 2).
• Fee for transfer of individual abalone quota units: 15.3 fee units (regulation 11).
• Fee for transfer of other individual quota units: 2.6 fee units (regulation 12).
• Levies per class and purpose set out in Schedules 3, 5, 6 and 7 (regulations 19(2), 21(2), 22(2), 24).

Duty to provide notice and timing for payment: The VFA must give written notice at least 14 days before the specified payment date for renewal fees and levies (regulations 10(2), 18(2), 25(2)). The specified date is determined by the VFA (regulations 10(1), 18(1), 25(1)).

Duty to notify VFA for specific abalone quota actions: The fee for a notification under s 66J(1) of the Act of nomination of a holder of an abalone fishery access licence is 2.6 fee units (regulation 15). There is also an application fee to obtain an abalone quota unit holding statement under section 66H(2): 2.6 fee units (regulation 14).

Payment-related administrative consequences: If fees or levies are not paid when due, the VFA can exercise powers under the Fisheries Act 1995 to require the holder to show cause why the licence should not be cancelled or suspended (note to regulations 10 and 25). For individual abalone quota unit royalties and levies, non-payment risks suspension after 14 days and cancellation after 12 months (notes to regulations 18 and 25). These are rights and duties grounded in the Act but linked to the Regulations' payment mechanics.

Ministerial discretion: The Minister may reduce or waive levies in whole or in part if satisfied the level of the relevant service was materially less, or will be materially less, than the level on which the levy was based (regulation 26). The Minister may refund grants levies where proceeds are not granted by the end of the licensing year (regulation 27). The Regulations also permit waiver of certain permit application fees by the VFA where special circumstances exist (regulations 30(4), 31(3)) and allow the Minister to waive recreational fishery licence application fees in special circumstances (regulation 28(2)).

Calculation and record‑keeping triggers: Several levies and the abalone royalty depend on prior years’ catch, production or price data. Regulation 17 defines GVPr as the average weighted beach price per kilogram of abalone for the financial year preceding the licensing year multiplied by the weight allocated to the quota unit. Regulation 23 defines GVPf and licence/quota counts (A, B, C, D) as inputs to research levies. These provisions create a duty on the administering agency to compile and make available the underlying data and on holders to maintain records to justify eligibility for caps (for example the <500 kg cap in regulations 19(3) and 21(3)).

Recreational licence duties: Applicants for recreational fishery licences must pay levies before a licence will be issued (regulation 29(4)). The Minister may exempt persons or classes from these levies where special circumstances apply (regulation 29(5)).

Rights to notice and procedural protections: Licence holders have a right to at least 14 days’ written notice of any payment date set by the VFA (regulations 10(2), 18(2), 25(2)). Rights to seek waivers or reductions are available to applicants and holders via the VFA (permit fee waivers) or the Minister (levy reductions/waivers and refunds) under the stated criteria (regulations 26, 27, 30(4), 31(3)).

Administrative enforcement under the Fisheries Act: The Regulations themselves set monetary obligations but rely on the enforcement powers of the Fisheries Act 1995. The instrument repeatedly notes the link to administrative enforcement:

• Section 58 of the Act is referenced in notes to regulation 10 and 25 as the mechanism by which the VFA may require a licence holder to show cause about cancellation or suspension when fees or levies remain unpaid 14 days after they were due (notes to regulations 10 and 25).
• Section 66Q of the Act is referenced in the note to regulation 18 (and to regulation 25(2)) in relation to non-payment of royalties and levies for individual abalone quota units, identifying the specific consequence rules: suspension after 14 days and cancellation after 12 months (note to regulation 18 and note to regulation 25(2)).

No criminal penalties are specified directly in the Regulations; the enforcement mechanisms signalled are administrative, suspension or cancellation of licences or quota entitlements. The Regulations also incorporate prohibitions by reference: the note to regulation 34 points to section 114 of the Act, under which carrying out certain commercial fishing activities from an unregistered boat is prohibited.

Timing and notice as compliance enablers: The VFA must give at least 14 days’ written notice of specified payment dates (regulations 10(2), 18(2), 25(2)). This notice requirement is both an administrative duty on the regulator and an intended procedural protection for licence holders; lack of notice could be a ground for contesting enforcement steps in practice, although such procedures are governed by the Act and general administrative law.

Discretionary relief reduces enforcement rigidity: The Minister’s power to reduce or waive levies (regulation 26) and to refund grants levies (regulation 27), together with the VFA’s power to waive certain permit fees (regulations 30(4) and 31(3)) introduce administrative flexibility. They are also potential focal points for disputes, including requests for relief and possible challenge if relief is denied. The Regulations specify the factual bases on which the Minister may act in regulation 26(2): namely, material reductions in the level of services compared with the level on which the levy was based.

Practical enforcement posture: The design privileges administrative remedies tied to licence status (suspension, cancellation) rather than direct statutory fines in the Regulations. This means the most immediate and salient enforcement lever is loss of entitlement to fish or transfer quota rather than a separate monetary penalty imposed in Court.

Record‑evidence exposure: Several levies and caps depend on historical catch, production or price data (regulations 17, 19(3), 21(3), 23). Incorrect reporting by licence or quota holders, or disagreements over the data used by the VFA to calculate levies (for example the average weighted beach price), could result in disputes that, if contested, would be resolved under the Act’s dispute and review mechanisms or by administrative review.

Primary statutory link to the Fisheries Act 1995: The Regulations are expressly made under ss 150, 151, 151A and 153 of the Fisheries Act 1995 (regulation 2). They operationalise those sections by prescribing the dollar (fee unit) amounts and the formulas for levies and royalties, and by specifying payment mechanisms and administrative procedures that link back to the compliance and enforcement provisions of the Act (notes to regulations citing s 58 and s 66Q).

Monetary Units Act 2004 and fee units: All monetary obligations in the Regulations are expressed in fee units rather than fixed dollar amounts (Endnotes, Explanatory details). The Monetary Units Act 2004 determines the annual dollar value of a fee unit in each financial year and prescribes publication requirements for the Treasurer’s determination. Therefore the Regulations interact operationally with the Monetary Units Act: a licence holder must convert fee units to dollars using the Treasurer’s announced fee unit value (Endnotes).

Fisheries Regulations 2019 and class definitions: The Regulations refer to licence classes as defined in the Fisheries Regulations 2019 (regulation 5(2)). The definitions and the classes of licence (for example access licences, aquaculture licences) are therefore anchored in the Fisheries Regulations 2019, and any reclassification or renaming in that instrument affects the scope and application of fee and levy entries here.

Primary Industries Research and Development Act 1989 and FRDC: The Fisheries Research and Development Corporation is the body established under s 8 of the Primary Industries Research and Development Act 1989; the Regulations assign research levies in part for work carried out on behalf of the FRDC (definitions and regulation 23). This links levy design and collection under the Fisheries Act machinery to the FRDC’s remit under Commonwealth law.

Administrative law and procedural protections: Because the Regulations place duties and discretionary powers on administrative actors (VFA and Minister), standard administrative law principles and judicial review under the common law and the Victorian Charter may apply to decisions such as fee waivers, levy reductions or licence suspension or cancellation. The Regulations themselves do not specify appeals or merits review processes, so these interactions will be governed by the Fisheries Act and broader Victorian administrative law.

Statutory rule amendment process and sunset: The Regulations have been amended several times by statutory rules (Endnotes Table of Amendments). As subordinate legislation, they are subject to the Subordinate Legislation Act 1994 which provides for sunsetting; the endnotes state that these Regulations will sunset ten years after making, on 22 November 2027. That statutory backdrop affects how permanent the rates are in practice and signals a window for parliamentary review.

Other offence and safety laws: The Regulations reference prohibitions tied to vessel registration (note to regulation 34 citing s 114 of the Act). In practical terms, compliance with these Regulations will be interdependent with compliance with other regulatory regimes governing maritime safety, biosecurity, planning and environmental approvals, which may impose their own fees and administrative costs.

The Regulations include explicit records of amendment activity in the instrument and in the Endnotes, and the Schedules show various substitutions and updates. The Endnotes include a Table of Amendments that lists statutory rules effecting change:

• Fisheries and Fisheries (Fees, Royalties and Levies) Amendment Regulations 2019, S.R. No. 11/2019, made 26 February 2019; commencement: reg 5 on 1 April 2019 (Endnotes).
• Fisheries (Fees, Royalties and Levies) Amendment Regulations 2019, S.R. No. 164/2019, made 23 December 2019; commencement 1 February 2020 (Endnotes).
• Fisheries (Fees, Royalties and Levies) Amendment Regulations 2020, S.R. No. 19/2020, made 17 March 2020; commencement 1 April 2020 (Endnotes).
• Fisheries (Fees, Royalties and Levies) Amendment Regulations 2021, S.R. No. 163/2021, made 14 December 2021; commencement 16 December 2021 (Endnotes).

Schedule-specific amendments and substitutions are recorded in the body of the instrument:

• Schedule 2 was amended by S.R. Nos 164/2019 reg. 11 and 163/2021 reg. 5.
• Schedule 3 (Levies for access licences) was substituted by S.R. No. 11/2019 reg. 5, amended by S.R. No. 164/2019 reg. 12, substituted by S.R. No. 19/2020 reg. 7, and amended by S.R. No. 163/2021 reg. 6 (see footnote to Schedule 3).
• Schedule 4 was substituted and later revoked; Schedule 5 (levies for aquaculture licences) was substituted by S.R. Nos 11/2019 reg. 5 and 19/2020 reg. 8.
• Schedule 6 (levies for individual quota units) was substituted by S.R. No. 11/2019 reg. 5 and amended by S.R. No. 164/2019 reg. 14, and substituted by S.R. No. 19/2020 reg. 8.
• Schedule 7 was amended by S.R. Nos 164/2019 reg. 15 and 163/2021 reg. 7.

Regulation-specific amendments are noted inline, for example:

• Regulation 12 (fee for transfer of quota units other than abalone) was substituted by S.R. No. 164/2019 reg. 6.
• Regulation 20 (levies on fish receiver licences) was substituted by S.R. No. 164/2019 reg. 8 and subsequently amended by S.R. No. 19/2020 reg. 4 (amending levy components).
• Several definitions and the scope of access licence classes were altered by S.R. No. 164/2019 (see amendment notes to regulation 5 and to regulation 19(1) items).

Revocations: The Regulations explicitly revoke earlier Fisheries (Fees, Royalties and Levies) subordinate instruments listed in Schedule 1, the table of prior S.R. Nos dating back to the 2008 instrument and a string of amending instruments to 2017 (Schedule 1).

Sunset date: The Endnotes record the statutory sunsetting regime and note the ten‑year sunset date from the day of making (22 November 2027). This is relevant to legislative planning and to the expectation that the schedules will be revisited and renewed or replaced before that date.

Interpretive and drafting notes: The Endnotes also record that style changes under the Interpretation of Legislation Act 1984 have been applied, and that punctuation, headings and notes are treated as part of the instrument as appropriate. The Explanatory details explain the use of fee units and the mechanism for converting fee units to dollar amounts each financial year.

Institutional practice: The amendment history shows frequent updating of rate schedules and occasional structural changes to how levies are allocated (for example changes to research levy formulas and to which licence classes attract particular levy components). Practitioners should therefore assume the schedules are dynamic and check the latest statutory rule history when advising clients.

The text of the Regulations and the Endnotes do not record any litigation arising under these Regulations. The instrument contains no conclusive list of cases or legal challenges and names no judicial decisions; therefore there is no litigation history included in this statutory text.

Potential sources of litigation or review (administrative law exposure): While the instrument itself contains no litigation record, the rights and discretions it establishes create plausible avenues for litigation or administrative review under broader law. Those avenues include:

• Challenges to administrative decisions under the Fisheries Act 1995, for example decisions to suspend or cancel licences for non-payment, or to refuse waivers or refunds where a party claims the decision was unreasonable or procedurally unfair. The Regulations direct particular procedural steps (eg, 14‑day notice) which could be material in an administrative law review.
• Disputes about the correct calculation of formula-driven levies and royalties. Regulation 17 and regulation 23 define variables like GVPf, GVPr, and licence/quota counts (A, B, C, D) that feed into levy and royalty calculations. Disagreements over the underlying data or method could give rise to review or challenge.
• Disputes about the application of caps and exemptions (for example the 38.9 fee unit cap for small catch or production in regulations 19(3) and 21(3)).
• Procedural disputes around notice: The Regulations require at least 14 days’ written notice for payment dates (regulations 10(2), 18(2), 25(2)). Failure to provide adequate notice before enforcement may be a ground for contesting enforcement choices.

No named cases in the instrument: Because the legislative text does not cite any case law or include references to judicial decisions, practitioners must look outside the Regulations to determine prior judicial treatment of similar levy, fee or royalty disputes under the Fisheries Act or of administrative decisions about licence cancellation and suspension. Those cases are not present in this statutory text.

Practical implication for advising clients: In the absence of litigation recorded here, risk assessment should focus on administrative decision points set out in the Act and the Regulations: calculation and notice of levies and royalties, payment mechanics, the Minister’s discretion under regulation 26, and any data or record-keeping that supports entitlement to reduced levies or caps. If clients anticipate a high‑value dispute, for example, about a royalty calculation for abalone quotas, advise them to preserve records and to seek internal review and, where appropriate, administrative or judicial review under the applicable processes in the Fisheries Act and general Victorian administrative law.

Fee units, not dollars: All amounts are expressed in fee units (see Endnotes, Explanatory details). The dollar cost therefore depends on the Treasurer’s determination of the fee unit for the relevant financial year. The instrument itself gives a 2021 example ($15.03 per fee unit for 2021-22) but that value changes each year. Practitioners must convert fee units to dollars using the current Treasurer’s determination before advising on precise cash obligations (Endnotes).

Hidden variability and missing formula images in the supplied text: The Regulations rely on formulae for the abalone royalty (regulation 17) and the FRDC research levy (regulation 23). In the provided text the visual formula objects appear as placeholders (image markers). The Regulations still define the variables used in those formulas (for example GVPr, FS, FRDC in regulation 17; A, B, C, D, GVPf in regulation 23), but any precise arithmetic or operator (for example whether the royalty is GVPr minus FS, or some other relationship) is not visible in the reproduced text available here. Before computing a royalty liability or advising clients, obtain the authoritative version (including the formulas) from the Victorian legislation database to ensure the correct arithmetic is applied (regulation 17 and regulation 23 read together with Schedules 3 and 6).

Caps for small operations have a precise trigger: The total levy cap of 38.9 fee units applies where averaged annual catch (access licences) or production (aquaculture) over the three financial years immediately preceding the licensing year is less than 500 kilograms (regulations 19(3) and 21(3)). The cap is not automatic across all classes; it applies only to licence classes subject to the defined levies and only where the three-year average meets the strict <500 kg threshold. Practitioners should check the exact averaging window and calculations; incorrect averaging could lead to an unexpected bill.

Timing and notice: The VFA sets the payment date and must provide 14 days’ written notice (regulations 10(2), 18(2), 25(2)). If the VFA sets a short compliance window or a date that creates cashflow pressure, operators can request a waiver or relief but administrative discretion applies. Failure to receive notice does not necessarily immunise a holder from enforcement under the Act, so keep records of any written notices received and of communications with the VFA.

Different charges for similar transactions: Transfer fees vary by licence class. For abalone quota transfers the application fee is 15.3 fee units (regulation 11), while other quota transfers attract 2.6 fee units (regulation 12). Schedule 2 shows that most licence classes have application fees of 20.4 fee units but Scallop Dive (Port Phillip Bay) has a Nil application fee while still attracting a transfer fee of 15.3 fee units (Schedule 2, item 18). These asymmetries matter in structuring transactions and in advising on the comparative cost of entry, exit and consolidation.

Levies split by purpose (and some Nil entries): Schedules 3, 5 and 6 itemise levies by management, compliance, research and administration services, and some items are Nil in particular columns. For example the Abalone Fishery (Central Zone) access licence shows a management levy of 15.3 fee units and Nil for compliance, research and administration in Schedule 3 (item 1). Understanding which components are Nil matters for bargaining or for challenging allocations. Check the Schedules carefully when modelling total levy exposure.

Ministerial discretion is fact‑specific and limited: The Minister can reduce or waive levies if satisfied certain material service reductions occurred or will occur (regulation 26(2)). The statutory test is service-level-oriented rather than hardship-oriented. Operators seeking relief should frame applications with factual evidence about service levels used to justify levy calculations.

Grants levy refund tied to grant use: Regulation 27 allows refund of grant levies if proceeds of the levy are not granted by the end of the licensing year. That refund is to "the person who at the date of the refund is the holder of the licence, individual quota unit or permit in respect of which the levy was paid." Practically, that creates a potential timing mismatch and administrative complexity about how to return funds and to whom, especially if ownership of licence/quota has changed in the interim.

Online discount is limited to recreational licences: Regulation 29(3) prescribes a lower levy for recreational licences applied for online for 1‑ and 3‑year licences. Other online application channels are not specified to receive discounts. Do not assume online discount applies to commercial licences.

Interplay with other instruments: Class definitions refer to the Fisheries Regulations 2019 (regulation 5(2)). If the Fisheries Regulations 2019 change licence class names, counts or delineations, that will affect levy incidence and calculation. Always cross-check class definitions in the Fisheries Regulations 2019 when applying a Schedule entry.

Record‑keeping/data dependence: Calculation of research levies and abalone royalties depends on counts (A, B, C, D) and GVP measures (regulation 23). Errors or disagreements in those data sources can materially change levy or royalty obligations. VFA is the practical data source; operators should seek written confirmation of the data used if levy amounts appear inconsistent with commercial experience.

Transfer timing and hierarchy rules: Where an applicant applies for more than one aquaculture licence to conduct aquaculture at the same specified area, only one application fee is payable, being the highest fee otherwise payable for those licences (regulation 6(2)). Also, specific exemptions exist for certain Yabbies licences if the applicant already holds another current Yabbies licence specifying the same area (regulation 6(3)). These rules affect transaction structuring for multi‑licence operations.

Sunset and regulatory churn: The Regulations will legally sunset ten years after making (Endnotes). The amendment history shows frequent schedule updates. Businesses should plan for regulatory change and keep monitoring for statutory rule updates.

Map licence and quota exposures first: Identify every licence, permit, quota unit and boat registration that your client holds or requires. Use the classes listed in regulation 5 and cross-check with Fisheries Regulations 2019 to ensure you are applying the correct Schedule entry (regulation 5(2), Schedules 2, 3, 5, 6, 7). For each item, note whether it attracts application fees, transfer fees, annual licence fees (regulation 9), levies (Schedules 3, 5, 6) or royalties (regulation 17 for abalone quotas).

Convert fee units to dollars: Before preparing a cash flow or invoice, convert all fee-unit amounts into dollar amounts using the Treasurer’s fee unit value for the relevant financial year (Endnotes, Explanatory details). The Regulations allow rounding to the nearest 10 cents. Keep a dated record of the fee unit value used for each calculation and cite the Treasurer’s Gazette notice.

Manage timing and notices: The VFA specifies the annual payment date; ensure your client is on the VFA’s mailing or electronic list to receive the written notice at least 14 days before the due date (regulations 10(2), 18(2), 25(2)). Do not rely on informal reminders. Maintain records of notices, invoices and payment confirmations to evidence compliance if the VFA later alleges late payment.

Calculate levies and royalties using authoritative data: For formula-driven levies and royalties (regulations 17 and 23), obtain the authoritative version of the Regulations with the full formula images and confirm the data sources and methodology the VFA will use for variables such as average weighted beach price (GVPr), GVPf and licence/quota counts (regulation 17, regulation 23). Where a levy depends on three-year averages, assemble and retain the three-year data set that you expect the VFA to use so you can verify calculations and support any request for correction. If the operator believes the data are incorrect, engage early with the VFA to seek correction.

Check eligibility for small‑operation caps and discounts: If averaged catch or production in the relevant three-year period is likely to be below 500 kilograms, calculate whether the operation qualifies for the cap that limits total levy to 38.9 fee units (regulation 19(3) and 21(3)). For recreational licences, if applications are submitted online, apply the online discounted levies for the 1‑ and 3‑year licenses (regulation 29(3)). For multi‑licence aquaculture applications covering the same area, charge only the highest application fee rather than multiple application fees (regulation 6(2)).

Use the waiver and reduction mechanisms where appropriate: If service levels materially decline (for example a planned reduction in compliance activities or a demonstrated drop in management activity), consider applying to the Minister under regulation 26 for a reduction or waiver of the relevant levy component. The statutory test is framed in terms of material change in service level, so document the factual basis for any application: what services were provided in the prior licensing year, what was the service baseline used to set the levy, and how will the services materially differ in the licensing year in issue (regulation 26). For permit application fees and certain licence application fees, the VFA may waive fees in special circumstances (regulations 30(4), 31(3), 28(2) for group recreational licence fees). Keep contemporaneous evidence in support of any “special circumstances” claim.

Pay on time and keep proof of payment: Because s 58 and s 66Q consequences flow from non‑payment, and because the VFA’s power to require show cause or to suspend/cancel entitlements is time dependent, prioritise timely payment and retain bank or transaction records. If cashflow issues arise, engage the VFA before the due date to seek an arrangement or to lodge an application for relief; unsolicited late payment may foreclose administrative relief.

When transferring licences or quota, budget for transfer fees and procedural steps: Transfers attract the fees set in Schedule 2 and specific transfer fees for quota transfers (regulations 7, 11, 12, Schedule 2). For abalone quota transfers in particular plan for the higher transfer fee (15.3 fee units, regulation 11). Check requirements for abalone quota notifications and holding statements: application fee for abalone quota holding statement is 2.6 fee units (regulation 14) and notification fee for nomination under s 66J(1) is 2.6 fee units (regulation 15).

Document records for audit and dispute resolution: Because levies and royalties are tied to historical data, retain catch records, sales invoices, beach price evidence, production logs, and any records of licence or quota holdings as at 1 January or as of the relevant reference dates required by the formulas (see regulation 23(2) definitions for A, B, C, D). If the operator is relying on the small-catch cap, preserve records for the three-year averaging window.

Monitor amendments: Given the recorded amendment history and the practical likelihood of future statutory rule updates, subscribe to the Victorian legislation updates for Fisheries instruments. Schedules may be substituted or amended by statutory rule, and new licence classes or changed levy components can change the bill materially (Endnotes, Table of Amendments; footnotes to Schedules).

If in doubt, seek confirmation from the VFA: For complex computations such as the FRDC levy shares or the abalone royalty, request a VFA calculation and ask for the working used. Where the formula application may change a client’s commercial position, consider seeking written confirmation of the VFA’s methodology and the data sources to reduce the risk of later dispute.

Plan commercial strategy around levy structure: When advising on entry, exit or consolidation consider the differences in application and transfer fees across licence classes (Schedule 2), the annual licence fee (regulation 9), and the per-unit levies in Schedules 3, 5 and 6. For multi-licence operations, use regulation 6(2) to limit application fee exposure for co-located aquaculture licences. For quota trading, account for transfer fees and any different royalty incidence (regulation 11 vs regulation 12).

Record evidence for any Ministerial relief application: If seeking reduction or waiver under regulation 26, prepare a succinct factual dossier showing how and why the level of services was or will be materially less than the level on which the prior levy was based. Include operational metrics (eg staff hours, compliance patrol hours, research projects undertaken) that match the levy purpose components (management, compliance, research, administration).

Keep governance around licence ownership: Regulation 27 ties refunds of grants levies to the current holder at the date of refund. Where licences or quotas are expected to be sold, maintain clear transfer records and consider the timing of refund claims when ownership changes.

By following the mapping, data verification, timely payment, record keeping and proactive engagement steps above, licence holders and applicants can reduce exposure to enforcement action and minimise surprises from formula-driven calculations and annual fee‑unit valuation changes.
