sec.72 Chief executive to give usage notice
This section applies if the chief executive becomes aware that the total entitlement under all the effort units for a trawl region for a particular effort year— has been used; or is likely to be used in the next month. The chief executive must immediately give each holder of a trawl licence a written notice (a usage notice ) stating— if the total entitlement has been used— the day the total entitlement was used; and the day the regulated period starts under the Fisheries Declaration 2019 , section 92 (3) ; or if the total entitlement is likely to be used in the next month—that the total entitlement is likely to be used in the next month. s 72 amd 2020 SL No. 236 s 136 (sec.72-ssec.1) This section applies if the chief executive becomes aware that the total entitlement under all the effort units for a trawl region for a particular effort year— has been used; or is likely to be used in the next month. (sec.72-ssec.2) The chief executive must immediately give each holder of a trawl licence a written notice (a usage notice ) stating— if the total entitlement has been used— the day the total entitlement was used; and the day the regulated period starts under the Fisheries Declaration 2019 , section 92 (3) ; or if the total entitlement is likely to be used in the next month—that the total entitlement is likely to be used in the next month.
- (a) has been used; or
- (b) is likely to be used in the next month.
- (a) if the total entitlement has been used— (i) the day the total entitlement was used; and (ii) the day the regulated period starts under the Fisheries Declaration 2019 , section 92 (3) ; or
- (i) the day the total entitlement was used; and
- (ii) the day the regulated period starts under the Fisheries Declaration 2019 , section 92 (3) ; or
- (b) if the total entitlement is likely to be used in the next month—that the total entitlement is likely to be used in the next month.
- (i) the day the total entitlement was used; and
