86A Offence—use prohibited gear (a) the person uses fishing gear in waters; and (b) the gear is prohibited fishing gear. (i) in or beside waters; and (ii) in possession of fishing gear; and (b) the gear is prohibited fishing gear. (3) An offence against subsection (2) is a strict liability offence.
