34A Movement of fish without proper documents prohibited (1) A relevant person commits an offence if the relevant person: (a) moves, from one place to another place, fish or aquatic life of a class prescribed for this section; and (b) does not, at the time the fish or aquatic life are moved, have possession of a document in the approved form specifying: (i) the species of fish or aquatic life being moved; and (ii) the place where the fish or aquatic life was caught, taken or harvested. (2) A relevant person commits an offence if the relevant person: (a) receives from another person fish or aquatic life of a class prescribed for this section; and (b) does not, at the time the fish or aquatic life are received, receive from that other person a document in the approved form specifying: (i) the species of fish or aquatic life being received; and (ii) the place where the fish or aquatic life was caught, taken or harvested. (3) An offence against subsection (1) or (2) is an offence of strict liability. (4) The Director may, by Gazette notice, prescribe a class of fish or aquatic life for this section.
