What it does
The Fisheries (Abalone) Amendment Rules 2019 (SR 2019‑063) is a subordinate legislative instrument that amends the Fisheries (Abalone) Rules 2017 (the Principal Rules). It is structured in three Parts. Part 1 is preliminary and contains the short title and commencement provisions. The instrument took effect on notification in the Gazette on 2 October 2019, except for Part 2 which commences on 1 November 2019 and Part 3 which commences on 1 January 2020. Part 2 (rules 4‑20) and Part 3 (rules 21‑26) each declare that the amendments effected by their respective rules have been incorporated into the authorised version of the Principal Rules. This means that the instrument does not reproduce the text of the amendments. Instead, it states that the amendments are already reflected in an officially maintained consolidated copy of the Principal Rules. The instrument is administered by the Department of Primary Industries, Parks, Water and Environment and was made under the enabling powers that govern the original Rules. Mechanically, the Amendment Rules operate as a conduit: they authorise changes to the existing abalone fishery regulatory framework, but a reader cannot determine the specific content of those changes from the face of this instrument alone. The only way to identify what has been altered is to consult the authorised version of the Principal Rules as amended from time to time. This drafting technique places a burden on users to ensure they are referencing the correct consolidated text, rather than a standalone statutory instrument. The two‑stage commencement also creates a phased transition for any obligations altered by Part 2 and Part 3 respectively.
