What it does
These Regulations (First Nations Voice Regulations 2023) set procedural, geographic and membership details that operationalise specified provisions of the First Nations Voice Act 2023 (the Act). Mechanically, the Regulations:
- fix the commencement trigger: they commence on the day section 9 of the Act comes into operation (r 2);
- define the geographic regions used by the Act by reference to a registered plan, and give each region a name (r 4(1)-(2));
- prescribe the size of each Local First Nations Voice (r 5);
- prescribe a list of native title bodies corporate that are relevant for a particular Act cross‑reference (r 6);
- fix a monetary amount to be used as a security for costs under a cross‑referenced provision of the Act (r 7);
- set short, concrete transitional timeframes and procedural rules for initial consultations, first meetings, and meeting-frequency exceptions in the initial year after the first post‑commencement elections (rr 8-10).
The Regulations are implementing and descriptive rather than policy‑heavy: they do not include an explanatory memorandum or express the policy rationale inside the instrument. They repeatedly refer to and operate by reference to specific provisions of the Act (for example, section 9, section 11, section 16(2), section 22(1), section 29(2), section 43(1), section 45(1), section 46(1), Schedule 1 cl 21(1)(f) and Schedule 2 cl 3 of the Act). Where the Act leaves matters to subordinate legislation,for example the delineation of regions, the number of members of Local First Nations Voices, which native title bodies count for a given Act provision, and a prescribed monetary figure,these Regulations supply those specifics.
The instrument therefore converts high‑level Act provisions into working rules: who is a Local First Nations Voice member in terms of headcount (r 5), where regions start and finish by pointing to GRO Plan No 15/2023 (r 4(1)), which incorporated native title bodies are considered prescribed for the Act’s s 33(2) purpose (r 6), the security for costs amount to be used under Schedule 1 cl 21(1)(f) of the Act ($200) (r 7), and short timelines and procedural arrangements for the first election cycle and first meetings after the relevant Schedule 2 clause comes into force (rr 8-10). The Regulations therefore change the Act’s operational contours by specifying concrete detail necessary for implementation.
