##### 5 Person not intending to reside in dwelling Where a person is a prescribed person in relation to a dwelling, and the Secretary is satisfied that the person has not resided in the dwelling as his or her principal place of residence and does not intend so to reside within a reasonable time, the Secretary shall direct that, for the purposes of this Act, the person is to be deemed not to be a prescribed person in relation to the dwelling.
