First Home Owner Grant Regulations 2000

The regulations embed several recurring legal and administrative concepts that operationalise the grant scheme. Each is defined or demonstrated in distinct provisions.

• Relevant interest and interested person: Regulation 3 cross‑refers "interested person" to section 16 of the Act; regulation 4 and regulation 5 prescribe when an occupier or builder who does not own the land may nevertheless be taken to hold a "relevant interest" for s 6(1)(h) purposes (reg 3; reg 4(1); reg 5(1)). Regulation 7 then specifies who is excluded from operation of s 16(1), and contains detailed sub‑categories (reg 7).

• Commissioner satisfaction tests: Multiple regulations put the Commissioner in the position of forming subjective or objective administrative satisfactions as preconditions to statutory effects. Examples include being satisfied that a person is eligible for specified financial assistance administered by the Housing department (reg 4(1)(b)(i)), satisfied the land is used for a primary production business (reg 5(1)(b)(i)), and satisfied that strata registration will occur as soon as practicable (reg 7(2a)(a)-(b)). These "satisfaction" hooks are an explicit mechanism to vest evaluative discretion in the Commissioner.

• Deeming and qualification: Regulation 4(2) contains a deeming rule: a person who is not eligible for the named disability assistance scheme is to be taken to be eligible for the purpose of the regulation where the Commissioner is satisfied the only reason for formal ineligibility is the person’s financial circumstances. This creates an exception to formal eligibility rules, narrowing legal risk for certain applicants but creating a fact‑intensive gateway assessed by the Commissioner.

• Recordkeeping and auditability: Regulation 9 imposes statutory recordkeeping obligations on delegates taking part in administration agreements. Delegates must maintain records, provide them to the Commissioner on demand, allow inspection with reasonable notice, and retain records for five years after payment (reg 9(2)(a)-(c), (4)). The definition of records is broad and includes application forms, documents notified by the Commissioner, and any document given to or created by the delegate that relates to the application (reg 9(4)).

• Financial handling of grant funds: Regulation 9(3) explicitly permits delegates to retain interest that accrues on funds received from the Commissioner for grant payments if the funds are held in a specified account. That provision operationally divides the income stream arising from grant funds between the Commissioner and the delegate.

• Information sharing and confidentiality: Regulation 11 sets the scope of authorised receipt and permitted disclosures of "confidential information" as defined by s 65(7) of the Act. It lists Commonwealth and State entities, Ministers and departmental officers, delegates, applicant agents with apparent authority, and users of a protected web site as authorised recipients (reg 11(1)-(2)). The regulation defines "protected web site" and "relevant scheme" to calibrate permitted disclosures (reg 11(3)).

• Deemed service times: Regulation 10A fixes the legal date of service for mailed and other non‑personal deliveries, a simple but legally significant concept because many statutory time limits run from date of service (reg 10A).

• Specificity of exceptions: Regulation 7 contains narrow carve‑outs. For example, it excludes from s 16(1) operation a person who only appears as an interested person because a financial institution required a guarantee from the co‑owner (reg 7(2D)). It also provides an exclusion where strata titles registration is anticipated and the owner will not become the owner of the home after registration (reg 7(2a)). These are tailored interventions that affect entitlement assessments.

Each of these concepts is expressed as an operational rule rather than as policy argument. The regulations therefore translate broad statutory entitlements and prohibitions in the Act into concrete administrative triggers, evidentiary standards and data flows. The repeated use of Commissioner satisfaction thresholds and delegate record obligations shows the instrument’s emphasis on administrative discretion plus auditability.

The regulations create obligations and entitlements that touch distinct stakeholder groups. Below is a focused description of who is affected and how, based solely on the text.

• Applicants and prospective first home owners: Individuals who apply for the first home owner grant are the primary subjects. The regulations affect their eligibility where they build on land they do not own (regs 4 and 5), where they are subject to examinations under s 41 (reg 10), and where their confidential information may be disclosed under reg 11. Applicants who are disabled and eligible for specified assistance, or who are building on land used principally for primary production, may be treated as having a relevant interest in the land for s 6(1)(h) purposes if conditions are met (reg 4(1); reg 5(1)).

• Landowners who permit occupation: Owners who give written permission for occupation of a home built on land they own are affected because giving that permission triggers a specific exclusion from the operation of s 16(1) of the Act in some circumstances (reg 7(1)). Owners whose land will become subject to a strata titles scheme at the commencement of the eligible transaction may also be excluded from s 16(1) if certain strata registration timings and outcomes are satisfied (reg 7(2a)).

• Co‑owners and guarantors: Persons who are co‑owners but are only included as interested persons because a financial institution requires a guarantee are excluded from the operation of s 16(1) in respect of the application (reg 7(2D)). Guardians holding interests as trustees for persons under legal disability are likewise excluded (reg 7(2C)). The State Housing Commission and a specified corporate entity engaged in the Yawuru Home Ownership Project are expressly excluded (reg 7(3); reg 7(4A)).

• Financial institutions and other delegates: Entities that enter administration agreements with the Commissioner are directly affected. Regulation 9 requires them to maintain specified records, allow access and inspection on reasonable notice, retain records for five years after payment, and they are permitted to retain interest on Commissioner funds if the funds are held in an approved account (reg 9(2)-(3), (4)). Administration agreements must include the conditions set out in reg 9 (reg 9(1)).

• The Commissioner and departmental officers: The Commissioner is central to implementation, with statutory powers to form satisfactions under regs 4, 5 and 7, to require inspection and records under reg 9, to set witness fees under reg 10, and to authorise disclosures under reg 11 (reg 4(1)(b); reg 5(1)(b); reg 7(2a)(b); reg 9(2); reg 10(1); reg 11). Departmental officers in the Public Service principally assisting the Minister and the Treasurer are recipients of permitted disclosures (reg 11(2)(i)-(j)).

• Agents and authorised representatives: An applicant’s agent with apparent authority may receive confidential information in respect of the application (reg 11(2)(g)). The regulations also contemplate access through a protected web site by persons authorised to do so (reg 11(2)(h)).

• Ministers and other public administrators: The Minister is a permitted recipient of confidential information for purposes of scheme administration and for responding to parliamentary correspondence carried out on behalf of a person (reg 11(2)(a)-(b)). Officers of departments that administer schemes providing financial assistance in relation to home ownership may receive information for administration and policy formulation (reg 11(2)(c)-(d), (da)).

• External Commonwealth agencies named in the regulations: The Australian Crime Commission is expressly authorised to receive confidential information under the Act (reg 11(1)). The Commissioner of Taxation of the Commonwealth is listed as a permitted recipient in relation to the First Home Saver Accounts Act 2008 (Commonwealth) (reg 11(2)(f)), a cross‑jurisdictional disclosure path that the compilation notes indicate may be subject to change (see Other notes).

Practically, the regulations influence the behaviour of financial institutions, owners and builders because of the record, access and disclosure requirements, and because they create legal routes for non‑owners to be treated as having relevant interests. The Commissioner’s satisfactions, including the deeming in reg 4(2), determine whether statutory benefits attach. Delegates who receive Commissioner funds acquire the specific right to retain interest arising on those funds when held in an account used solely for grant payments (reg 9(3)), which is a direct financial effect on institutions administering the scheme.

The regulations distribute duties and rights among the Commissioner, delegates, applicants, owners and other recipients of confidential information. Below are the principal obligations and entitlements spelled out in the text.

Duties placed on the Commissioner and the administration

• Form satisfactions and make determinations: The Commissioner must form satisfactions under regs 4, 5 and 7 to trigger treatment of non‑owners as having relevant interests or to exclude certain persons from s 16(1) (reg 4(1)(b); reg 5(1)(b); reg 7(2a)). Those satisfactions are preconditions for statutory effects and thus are functional duties of the Commissioner.

• Determine witness fees and travel reimbursement: Under reg 10(1)(a) the Commissioner determines the fee payable to a witness for an examination, according to the time taken and by reference to an "appropriate publication" such as ABS average weekly earnings (reg 10(1)(a), (3)). The Commissioner also determines reasonable travel reimbursement up to the amount actually paid when travel exceeds 7 kilometres (reg 10(1)(b)).

• Set administration agreement conditions: Section 37(2) of the Act is implemented by regulation 9, which requires the Commissioner to ensure administration agreements include conditions for recordkeeping, inspection and retention (reg 9(1)-(2), (4)). The Commissioner can also specify which documents are "records" for these purposes (reg 9(4)(b)).

Duties placed on delegates and financial institutions

• Maintain, produce and retain records: Delegates must maintain records relating to applications they administer, provide those records or copies to the Commissioner on request, allow the Commissioner to access and inspect the records with reasonable notice at a reasonable time, and retain the records for five years after the payment of the relevant grant (reg 9(2)(a)-(c); reg 9(4)). "Records" is defined broadly to include application forms, Commissioner‑notified documents and any document created by or given to the delegate that relates to the application (reg 9(4)).

• Account segregation and interest handling: Delegates are entitled to retain interest that accrues on amounts received from the Commissioner for grant payments if the amounts are held in an account used solely for the purpose of receiving those amounts and other amounts approved by the Commissioner (reg 9(3)). This confers a specific right in respect of interest earnings on Commissioner funds.

Duties and rights of witnesses and applicants

• Attend examinations: Persons summoned under s 41 to give examination are entitled to be paid a fee and travel reimbursement as set out in reg 10, except that applicants and their spouse or de facto partner are excluded from entitlement in relation to examinations arising from their own application (reg 10(1)-(2)). The fee quantum is set by the Commissioner and referenced to average weekly earnings (reg 10(1)(a), (3)).

• Service and notice: Parties who must serve notices or documents outside personal service must account for the deemed service times in reg 10A when calculating response or appeal timeframes (reg 10A).

Information disclosure rights and constraints

• Authorised receipt and permitted disclosure of confidential information: Regulation 11(1) authorises the Australian Crime Commission to receive confidential information. Regulation 11(2) lists other permitted disclosures to Ministers, departmental officers administering related schemes, delegates, the Commonwealth Commissioner of Taxation for a Commonwealth Act, applicant agents with apparent authority, protected web site users, and specified departmental officers (reg 11(1)-(2)). The regulation defines "confidential information" by reference to s 65(7) of the Act and defines "protected web site" and "relevant scheme" to limit permitted recipients (reg 11(3)).

Owner and co‑owner entitlements and exclusions

• Exclusions from s 16(1): Regulation 7 makes clear that certain owners and persons are to be treated as excluded from the statutory operation of s 16(1) for applications. This includes landowners who give written permission for occupation as contemplated by regs 4 and 5 (reg 7(1)), guardians holding interests in trust (reg 7(2C)), co‑owners who are guarantors required by financial institutions (reg 7(2D)), the State Housing Commission (reg 7(3)), and Nyamba Buru Yawuru Ltd in relation to the Yawuru Home Ownership Project (reg 7(4A)). For non‑strata home units the regulation excludes a person who will not be lawfully entitled to exclusive occupancy on completion of the transaction (reg 7(2)).

These duties and rights create a structure where the Commissioner exercises evaluative oversight, delegates have granular recordkeeping and limited income rights from interest, witnesses have conditioned entitlements, and confidential information can flow to specified recipients. The compliance obligations on delegates are concrete and time‑bounded, while the Commissioner’s role is both discretionary and supervisory.

The regulations are largely procedural and prescriptive rather than punitive. The text provides a framework for administrative enforcement through obligations, records and disclosure, rather than specifying novel criminal penalties. Points relevant to enforcement and compliance follow from the regulations’ provisions and cross‑references to the Act.

• Administrative enforcement via Commissioner powers: The Commissioner’s power to require production and inspection of records from delegates (reg 9(2)(b)) is an enforcement mechanism. The power to demand records and to inspect them, coupled with the statutory requirement that delegates retain records for five years (reg 9(2)(c)), enables audits and retrospective enquiries into compliance with program rules.

• Financial consequences mediated by the Act: Regulation 8 prescribes interest rates for specified sections of the Act (reg 8(1)-(3)). Those rates will be applied where the Act imposes interest consequences, for example under provisions that relate to repayments, recovery of overpayments, or other monetary adjustments referred to in the Act (reg 8). The regulations therefore influence the financial penalties or charges applied under the Act, although the precise circumstances in which interest is payable are contained in the Act itself.

• Examination and testimonial powers with witness entitlements: The regulations provide for the summoning and payment of witnesses under s 41, with regulated fee entitlements (reg 10). The ability to compel attendance and to award fees is an enforcement tool that supports investigative or verification processes.

• Confidential information disclosures to law enforcement and agencies: Regulation 11(1) authorises the Australian Crime Commission to receive confidential information and allows other disclosures to Ministers, Commonwealth officials and departmental officers for specified administrative purposes (reg 11(1)-(2)). The permitted disclosure channels support cross‑agency enforcement and investigation, including potentially for fraud detection or recovery action, subject to the scope of the listed recipients and the definition of "confidential information" in s 65(7) of the Act.

• No new statutory offences in the regulations: The regulations do not themselves create new criminal offences or specify penalties such as fines or imprisonment. Any punitive measures for non‑compliance with substantive grant rules would be derived from the Act; the regulations mainly operationalise procedures that enable enforcement under the Act.

• Enforcement risks and practical constraints: Because key determinations rest on the Commissioner’s satisfaction (regs 4(1)(b), 5(1)(b), 7(2a)), enforcement frequently takes the form of administrative review, reconsideration or internal audit rather than immediate criminal sanction. The regulations provide mechanisms for discovery and audit via delegate record obligations, but they do not create express statutory recovery mechanisms in the text provided; those would be in the Act.

In short, enforcement under the scheme operated by these regulations is predominantly administrative: powers to inspect and require records, to share confidential information with specified agencies, to apply prescribed interest rates under Act provisions, and to compel witness attendance with fee rules. The regulations give the Commissioner tools to administer, audit and investigate, while any penalties for wrongdoing are to be sought through the Act’s substantive provisions and existing criminal or civil law channels referenced therein.

The regulations expressly cross‑refer to and interact with several pieces of State and Commonwealth legislation, and with particular statutory concepts. These interactions create cross‑jurisdictional data flows, definitional alignments and conditional effects that practitioners must notice.

• First Home Owner Grant Act 2000 (WA): The regulations implement and qualify multiple provisions of the Act, including s 6(1)(h) (relevant interest), s 16(1) (interested persons), s 30, s 32 and s 52 (interest provisions), s 37(2) (administration agreements), s 41 (examination), s 62(3) (service), and s 65(3) (confidential information). The regs are subordinate instruments that set operational details required by those Act sections (see reg 3; regs 4, 5, 7, 8, 9, 10, 10A, 11).

• Housing Act 1980 (WA): Regulation 4(1)(b)(i) refers to financial assistance schemes administered by the department of the Public Service principally assisting the Minister in administration of the Housing Act 1980. That reference places the identification of eligible disability assistance schemes within the domain of the housing administration apparatus, anchoring eligibility assessments to departmental schemes under the Housing Act architecture (reg 4(1)(b)(i)).

• Strata Titles Act 1985 (WA): Regulation 7(2a) deals with proposed strata titles schemes under the Strata Titles Act 1985. The regulation excludes certain owners from s 16(1) where, at the commencement date of the eligible transaction, it is proposed that the land will be subject to a strata titles scheme and that registration will occur "as soon as practicable" after completion (reg 7(2a)(a)-(b)). This cross‑reference creates a timing and outcome dependency where strata scheme registration under the Strata Titles Act interacts with first home owner grant eligibility.

• Transfer of Land Act 1893 (WA): The definition of "non‑strata home unit" in reg 7(4) refers to the registered proprietor under the Transfer of Land Act 1893 of undivided shares in the land. The property law definition of a proprietor under the Transfer of Land Act is used to determine whether a person is lawfully entitled to exclusive occupation of a part of a building, with ownership and occupancy entitlements defined by the Torrens system (reg 7(4)(b)(i)).

• Australian Crime Commission Act 2002 (Commonwealth): Regulation 11(1) expressly authorises the Australian Crime Commission to receive confidential information under s 65(3)(a) of the Act. That is an express cross‑jurisdictional data sharing link with a Commonwealth investigatory agency (reg 11(1)).

• First Home Saver Accounts Act 2008 (Commonwealth): Regulation 11(2)(f) permits disclosure to the Commissioner of Taxation for the purposes of administering the First Home Saver Accounts Act 2008 (Commonwealth) (reg 11(2)(f)). The compilation notes include a footnote indicating that the referenced Commonwealth Act was later repealed by a named federal enactment (Other notes, footnote 1). That indicates a potential legislative mismatch between the regulation text and current Commonwealth law, and requires practitioners to check current Commonwealth instruments before relying on that disclosure path.

• Administrative publication and statistics sources: Regulation 10(3) contemplates the use of "appropriate publication" for calculating witness fees and lists material published by the Australian Bureau of Statistics as an example. That ties fee calculation to a national statistical source (reg 10(3)).

• Finance/treasury instruments via interest rate amendments: Regulation 8’s interest percentages have been altered by subsequent Finance Regulations Amendment instruments over time (compilation table entries for 2015, 2019, 2020, 2023, 2024). Those amendments reflect interactions between the grants regime and Government finance instruments that regularly update prescribed interest rates.

• Interdepartmental disclosure for related schemes: Regulation 11(2)(c), (d) and (da) permit disclosure to officers and ministers of departments administering schemes that provide financial assistance in relation to home ownership, where disclosure is for administration or policy formulation. This creates an interface with other State schemes and administrative programmes.

In practice, the regulations rely on definitions and administrative processes established in other statutes to determine eligibility, occupancy rights, data sharing and strata registration consequences. That means lawyers and administrators must read the regulations in tandem with the Act and the cross‑referenced legislation to determine outcomes in borderline cases. The compilation table also documents a history of amendments effected through other written laws and Finance Regulations, underscoring the interdependence with broader regulatory and fiscal instruments.

The regulations have been amended repeatedly since their original commencement on 1 July 2000. The compilation table in the instrument lists the statutory history, showing how the instrument has evolved. Key points from the amendment record follow.

• Commencement: The regulations commenced 1 July 2000 (r 2).

• Early amendments and additions: Amendments were made in 2001, 2002 and 2003, followed by further revisions at multiple points. The 2001 Amendment Regulations are listed with a commencement date of 24 July 2001.

• Periodic adjustments to administrative details: Amendments in 2007, 2008 and 2009 updated administrative content. The 2008 and 2009 amendments had staggered commencements for some clauses (see compilation table entries for 2008 and 2009).

• Interest rate updates: Regulation 8, prescribing interest rates for various sections of the Act, has been updated several times. The entry "Regulation 8 inserted: Gazette 26 Jun 2015 p. 2278; amended Gazette 11 Dec 2015 p. 4961; 29 Dec 2017 p. 6085; 28 Jun 2019 p. 2493; SL 2020/71 r. 4; SL 2023/70 r. 4; SL 2024/82 r. 4" documents a sequence of interest rate adjustments in 2015, 2017, 2019, 2020, 2023 and 2024. The reprinting history confirms periodic updates of the core regulations to reflect those changes.

• Deletions and insertions: Regulation 6 was deleted (Gazette 29 Dec 2017 p. 6083). Regulation 10A (prescribed service times) was inserted by Gazette 29 Dec 2017 p. 6086. Regulation 11 (disclosure of confidential information) has been amended multiple times, most recently by SL 2024/151 r. 4 (Gazette 24 Jul 2024), indicating an ongoing refinement of permitted disclosure pathways.

• Compilation reprints: The regulations were reprinted at least three times, with reprint dates noted at 4 Feb 2005, 23 Oct 2009 and 3 Mar 2017. Each reprint incorporates amendments up to that date.

• Specific targeted amendments: Regulation 7 was amended at various dates (22 Oct 2002; 11 Aug 2015; 29 Dec 2017; SL 2020/206 r. 11) to refine exclusions from s 16(1). For example, subregulations 2a through 2D and related definitions likely reflect evolving policy needs linked to strata development, guardianship situations, and co‑owner guarantee arrangements. The inclusion of a named corporate entity for the Yawuru Home Ownership Project (reg 7(4A)) reflects a discrete project‑based amendment (Gazette 10 Apr 2015 agreement referenced in the definition).

• Cross‑statutory alignment updates: The regulations have been amended to reflect changing Commonwealth and State institutional arrangements. For instance, the authorisation for the Australian Crime Commission to receive confidential information (reg 11(1)) references the Australian Crime Commission Act 2002 (Commonwealth) and was affected by amendments listed in the compilation table (e.g. Australian Crime Commission (Western Australia) Act 2004 s. 70 assented 8 Dec 2004).

• Recent amendments on disclosure: The schedule indicates amendments to reg 11 as recently as July 2024 (SL 2024/151 r. 4). Those amendments changed the list and conditions for permitted disclosures, indicating a continuing focus on data sharing and confidentiality rules.

The compilation table provides a concise timeline: from the original 2000 regulations through multiple amendments, reprints and targeted adjustments. Practitioners should consult the latest published reprint or the Western Australian legislation website for current text because the instrument has been updated repeatedly on technical points such as interest rates, service times and permitted disclosures.

The text supplied contains no case law, judicial decisions, disputes or litigation records. The regulations themselves do not record or cite any cases. The compilation table and notes do not list judicial challenges or reported litigation outcomes. Accordingly, there is no litigation history contained within this instrument to summarise or analyse.

Practitioners seeking litigation history must therefore consult court databases, reported judgments and case law repositories for decisions that interpret the First Home Owner Grant Act 2000 or these regulations. The regulations set administrative duties, discretionary satisfactions and recordkeeping obligations that are the kind of matters likely to be subject to judicial review or appeal in disputes about eligibility, disclosure and administrative decision making, but any such cases are not included in the regulation text or compilation materials provided.

The regulations are compact but contain several technical and operational features that can produce traps for the unwary. These "gotchas" are concrete mechanics or legal interactions to watch for.

• Commissioner satisfaction hooks create uncertainty at the margins: The operation of regs 4 and 5 depends on the Commissioner being "satisfied" about eligibility for a disability assistance scheme or about land being used solely or principally for primary production (reg 4(1)(b); reg 5(1)(b)). Those thresholds are fact‑intensive and not self‑executing. Applicants and owners cannot assume automatic treatment; documentary evidence and administrative processes are required to secure the Commissioner’s satisfaction.

• Deeming provision in reg 4(2): A person who is not eligible for the named financial assistance scheme is "taken to be eligible" for the purposes of reg 4 if the Commissioner is satisfied the only reason for ineligibility is financial circumstances (reg 4(2)). This rule can be helpful to applicants but requires the Commissioner’s assessment of causation between financial circumstances and formal ineligibility, which may be contested.

• Delegates may retain interest on Commissioner funds: Regulation 9(3) permits delegates to retain interest on amounts received from the Commissioner when held in an account used solely for grant payments and other approved amounts. This can be overlooked by applicants and by public finance officers. The regulation effectively grants a revenue stream to delegates for holding Commissioner funds. Delegates must ensure segregation of accounts to exercise this right.

• Record retention and inspection obligations are strict and time‑limited: Delegates must keep records for five years after payment of the grant and must provide access to records on Commissioner request (reg 9(2)(c); reg 9(2)(b)). Failure to retain or produce records could impair an entity’s ability to demonstrate compliance. The definition of "records" is broad (reg 9(4)), including any document created by or given to the delegate that relates to the application.

• Exclusions from s 16(1) may change who is considered an "interested person": Regulation 7 contains multiple narrowly drafted exclusions that can affect entitlement and standing in application assessment (reg 7(1)-(4A)). For example, co‑owners who are only guarantors are excluded (reg 7(2D)), and strata timing can exclude an owner who will not become the owner of the home after registration (reg 7(2a)). These carve‑outs require early factual analysis of ownership structures and financing arrangements before reliance on a grant.

• Non‑strata home unit definition uses Transfer of Land concepts: The regulation’s definition of "non‑strata home unit" ties entitlement to registered proprietorship and exclusive occupation rights under property law constructs (reg 7(4)-(5)). Practitioners must check underlying title documents and any agreements between co‑owners to determine lawful entitlement to exclusive occupation (reg 7(5)(a)-(b)).

• Service times for mail are prescribed and differ by destination: Regulation 10A sets distinct deemed service dates depending on whether mail is sent within the State, elsewhere in Australia, or overseas (reg 10A(a)-(c)). These are legal fictions that affect limitation and response periods. Miscounting can lead to missed deadlines.

• Disclosure regime includes a protected web site mechanism with access controls: Regulation 11(2)(h) permits disclosure to persons who access information through a "protected web site" provided by the Commissioner (reg 11(2)(h); reg 11(3) definition). The security and authentication mechanisms for such a site become practical compliance points. The regulation also permits disclosure to applicant agents with "apparent authority" (reg 11(2)(g)), which can raise questions of proxy authority and fraud risk.

• Reference to a repealed Commonwealth Act may be obsolete: Regulation 11(2)(f) refers to disclosure to the Commissioner of Taxation for the First Home Saver Accounts Act 2008 (Commonwealth). The "Other notes" state that this Commonwealth Act was repealed by a named federal enactment (Other notes, footnote 1). That creates potential obsolescence or mismatch in the regulation language and means practitioners must verify whether the disclosure path is still viable or requires statutory amendment.

• Specific corporate carve‑outs are narrow and project‑based: The inclusion of Nyamba Buru Yawuru Ltd and the Yawuru Home Ownership Project (reg 7(4A)) is an example of a regulation amending list tied to a specific project. Such entries may be overlooked and create project‑specific rules that are non‑transferable to other arrangements.

• Witness fee calculation is discretionary but tied to ABS data: The Commissioner decides witness fees by reference to the time taken and an "appropriate publication", with the Australian Bureau of Statistics cited as an example (reg 10(1)(a); reg 10(3)). The lack of a fixed scale means practical uncertainty in budgeting for examinations or in advising witnesses on expected payment.

These are operational "gotchas" that will commonly arise in practice when advising applicants, owners, financial institutions, delegates and departmental officers. Each points to an evidentiary, timing or institutional procedural issue that should be addressed in application documentation, administration agreements and internal compliance checklists.

Compliance under the regulations combines documentary proof, administrative processes, account controls and timely record management. The following practical measures map directly to the regulatory text.

For applicants and builders (including owner builders) building on land they do not own

• Establish documentary evidence of owner permission: Where eligibility depends on written permission to occupy (reg 4(1)(b)(ii); reg 5(1)(b)(ii)), obtain a written, signed permission from the owner that specifies the occupation right upon completion. Keep original and certified copies as part of the application file.

• If claiming a disability‑based relevant interest, gather documentation of financial assistance eligibility: Regulation 4 requires the Commissioner to be satisfied the person is eligible for the relevant disability assistance scheme (reg 4(1)(b)(i)). Where formal ineligibility is due only to financial circumstances, prepare evidence of financial position and documents showing why that is the sole ground of ineligibility for use under reg 4(2). Anticipate requests for departmental confirmation of scheme rules under the Housing Act 1980 framework.

• Where primary production land is involved, document land use: For reg 5, obtain and present evidence that the land is used solely or principally for a primary production business; examples include business registrations, agricultural activity records, rates notices, or statutory declarations addressing land use (reg 5(1)(b)(i); reg 5(2) definition).

For owners, co‑owners and guardians

• If granting written permission, be clear about the consequences: Owners who give permission for occupation may be excluded from s 16(1) for the application (reg 7(1)). Ensure the permission is in writing and preserves any intended legal or commercial rights. Keep contemporaneous documentation to evidence the permission and its terms.

• For co‑owners who act as guarantors only, confirm status and evidence: Where a co‑owner is included only because a financial institution requires a guarantee, the co‑owner is excluded from s 16(1) if the conditions are met (reg 7(2D)). Prepare documentation from the lender showing the guarantee requirement and the limited nature of the co‑owner’s involvement.

• Where strata registration is anticipated, collate proof of strata scheme timing: To rely on the reg 7(2a) exclusion, ensure there are contemporaneous strata scheme proposals, evidence that registration will occur as soon as practicable after completion, and proof the person will not become owner of the home post‑registration (reg 7(2a)(a)-(c)).

For delegates and financial institutions entering administration agreements

• Include the prescribed conditions in administration agreements: Administration agreements must contain the conditions in reg 9(2) and (3). Ensure the agreement imposes obligations to maintain records, provide records to the Commissioner on request, allow inspection subject to reasonable notice, and to retain records for five years after grant payment (reg 9(1)-(3)).

• Establish recordkeeping systems that meet the broad "records" definition: Because "records" includes the application form, Commissioner‑notified documents and any related document created by or given to the delegate, design filing and electronic systems to capture and index these materials, and maintain an audit trail covering communications and transactions (reg 9(4)).

• Segregate accounts to retain interest lawfully: If the delegate will retain interest earned on Commissioner funds, hold those amounts in an account used solely for the purpose of receiving the Commissioner’s amounts and any other amounts approved by the Commissioner, and document approvals. Maintain reconciliations to demonstrate that the account meets the reg 9(3) conditions and record interest accruals and retention as part of financial reporting.

• Prepare for Commissioner inspection: Develop internal procedures to respond to Commissioner requests with reasonable notice and to facilitate inspection at a reasonable time. Maintain searchable indexes to produce documents quickly.

For departmental officers and the Commissioner

• Document satisfactions and decision rationales: When exercising satisfactions under regs 4, 5 and 7, prepare written decisions or file notes that articulate the evidence relied on. This reduces legal risk and facilitates internal review.

• Administer the protected web site with authentication controls: Regulation 11(3) contemplates a "protected web site" through which persons may access application information (reg 11(2)(h); reg 11(3)). Implement secure authentication, logging and role‑based access to ensure disclosures are limited to authorised individuals.

• Review cross‑statutory references for obsolescence: The mention of the First Home Saver Accounts Act 2008 in reg 11(2)(f) is flagged in the compilation notes as having been repealed in federal law (Other notes). Verify whether this disclosure path remains lawful and whether any internal procedures referencing it require update.

For service of documents

• Apply reg 10A deemed service times when calculating time limits: Use the specified deemed service days for posted documents and next business day for other sent or left communications. Make recalculation templates part of office procedure to avoid missed deadlines (reg 10A(a)-(d)).

For witnesses called under s 41

• Provide guidance on fee expectations: Witnesses (other than applicant and spouse/de facto partner) are entitled to a fee set by the Commissioner tied to examination time and average weekly earnings, plus travel reimbursement if travel exceeds 7 km (reg 10(1)(a)-(b), (3)). Maintain communication about likely fee quantum and the method of calculation, referencing ABS materials where applicable.

For confidentiality and disclosure

• Implement consent and authority checks for agents: Where disclosure to an agent is contemplated under reg 11(2)(g), verify apparent authority through client instructions, signed authorisations, power of attorney documents, or evidence of ongoing representation.

• Log disclosures and retain records for audit: Keep an auditable trail of all disclosures of confidential information, recording recipient, purpose, statutory basis under reg 11, and any approvals. This supports compliance review and protects against unlawful disclosure claims.

General compliance hygiene

• Keep retention and destruction schedules aligned with reg 9(2)(c): Ensure record retention policies preserve application records for five years after payment as a minimum.

• Train staff on the narrow exclusions in reg 7: Ownership, guarantee roles, guardianship and strata timing are all potentially decisive facts. Train staff to capture these facts early in the application process.

• Maintain cross‑reference checklists to the Act and other statutes: Because many effects are tied to statutory definitions and other Acts (Housing Act 1980, Strata Titles Act 1985, Transfer of Land Act 1893), maintain a cross‑reference checklist so that eligibility, title and strata issues are considered with the relevant legislative context.

Following these steps will align operational processes with the regulations’ explicit requirements on recordkeeping, account segregation and interest retention, evidence for Commissioner satisfactions, permitted disclosures, and service times. Regular audits and procedural reviews are sensible given the Commissioner’s inspection power and the potential for future regulatory amendments.
