First Home Owner Grant Regulation 2008

The regulation turns on a small set of concepts stated within its single operative section. These concepts establish the eligibility criteria for the exclusion.

• Shared equity partner. The regulation uses the phrase "shared equity partner" to identify the person to whom the exclusion may apply, but it does not create a standalone definition or glossary entry. Instead it defines the status by reference to two factual conditions that must both be satisfied (s 3). Practically, "shared equity partner" in the regulation is any person who either has, or will have on completion of the transfer, an interest in the land on which the relevant home is built that is not more than 50 per cent, and who falls into one of the two entity categories specified.

• Interest threshold. The exclusion is conditional on the shared equity partner having "not more than a 50% interest" in the relevant land (s 3(a)). The phrasing expressly covers the equality point: a 50% interest falls within the exclusion. The interest test applies at the time of the facts or "on the completion of the transfer" that gives effect to the relevant home’s ownership arrangements. The regulation therefore requires a temporal assessment of ownership shares as they will stand once the transfer is complete.

• Entity categories. There are two entity categories that, when combined with the interest threshold, trigger the exclusion: (i) a financial institution; and (ii) an entity declared as a provider of community housing under the Duties Act 1999, section 73A (s 3(b)(i)-(ii)). The regulation does not define "financial institution", nor does it reproduce the Duties Act declaration. It therefore relies on the ordinary legal meanings or on definitions in other instruments or Acts to determine whether an entity falls within either category.

• Relation to Act s 15. The regulation’s operation is expressly to exclude persons from the application of the Act, section 15 (s 3). The text does not restate s 15, nor does it expand or modify other sections of the Act. It therefore performs a delimited function: to alter the set of persons who must join in an application by creating an exception to s 15.

• Formal republication features. The endnotes provide further technical concepts relevant to interpretation and administration: commencement dates, amendment instruments, editorial amendment power under the Legislation Act 2001 (and the republication’s handling of editorial changes), the notation conventions for uncommenced provisions or current modifications, and the values of penalty units at the republication date.

Together these concepts confine the regulation’s subject-matter tightly. It does not create a grant, a new eligibility test for the grant itself, financial thresholds for the grant, or procedural requirements for application forms. Rather it removes an application-party requirement in a specific set of shared-equity ownership arrangements where the partner is either a lender or a declared community housing provider and the partner’s interest is 50% or less (s 3).

The regulation affects a narrow and identifiable group of actors, plus a broader set of stakeholders who interact with them in the context of a first home owner grant application under the Act.

Directly affected persons

• Shared equity partners meeting the dual condition. Any person who, at the time of transfer completion, will have an interest of not more than 50% in the land on which the relevant home is built and who is either (a) a financial institution, or (b) an entity declared as a provider of community housing under the Duties Act 1999, s 73A, is specifically excluded from the operation of Act s 15 (s 3). For these persons the exclusion means they do not fall within the class of persons who must join in the application under the Act’s s 15 requirement.

Indirectly affected persons

• Primary applicants for the first home owner grant. Those applying for the grant who would otherwise have needed to secure the participation of co-owners or shared equity partners for the purposes of the application may find their administrative obligations reduced if a shared equity partner meets the regulation’s exclusion criteria. The regulation does not create a direct entitlement for applicants; its mechanical effect is on who must join in the application.

• Financial institutions and declared community housing providers. Entities in these categories that hold or will hold an interest of not more than 50% in the land on which a qualifying home is built are affected because the regulation removes the statutory requirement that they join an application; operational procedures for lenders and provider entities may be adjusted accordingly.

• Conveyancers, solicitors and lenders. Professionals managing transfers and settlement have to assess ownership shares and entity status to determine whether the exclusion applies. The timing of the interest test ("on the completion of the transfer") implicates conveyancing practice and settlement documentation.

• Administrators and decision-makers. The public official(s) responsible for administering the First Home Owner Grant Act will apply this exclusion when assessing whether an application complies with s 15; they must verify the ownership shares and whether a counterparty is a financial institution or declared community housing provider (s 3).

• Third parties whose contractual or regulatory rights depend on co-ownership. The exclusion alters which co-owners are required to join in the application; that can change documentation practices and contractual risk allocation among owners, lenders and applicants.

Who is not affected

• Persons with more than a 50% interest in the land are not covered by the exclusion and therefore remain subject to Act s 15’s requirement to join in the application unless another statutory exclusion applies.

• Entities that are neither financial institutions nor declared providers under Duties Act s 73A, even if their ownership interest is 50% or less, are not excluded.

The regulation therefore reshapes participation in the grant application process by reducing the statutory burden on two specific categories of shared-equity partners (financial institutions and declared community housing providers) where their ownership interest is 50% or less (s 3). That change modifies the legal status of those particular parties in the application process but does not change the underlying grant criteria that are set out in the Act itself.

The regulation creates a right of exclusion and thereby alters who has a statutory duty to join in a first home owner grant application as provided by the Act, s 15. It does not, however, create new duties, procedural obligations, or substantive grant entitlements beyond that limited exclusion.

Right of exclusion

• The regulation confers on a specified class of shared equity partners the right not to be included in the application requirement under Act s 15. The text is framed as an exclusion from the application of s 15: "A person (shared equity partner) is excluded from the application of the Act, section 15" if the two conditions are satisfied (s 3). That is the central legal right the regulation creates.

Duties that remain or arise by implication

• Duty to assess ownership share. Applicants, conveyancers, lenders and administrators will have an implied duty to determine whether the shared equity partner’s interest is "not more than a 50% interest", and whether that position will be the case "on the completion of the transfer" (s 3(a)). The regulation makes the timing explicit, so parties must assess projected ownership shares at settlement/completion, not only at an earlier point.

• Duty to verify entity category. Parties must verify whether a shared equity partner is a "financial institution" or an entity declared as a provider of community housing under Duties Act s 73A (s 3(b)). The regulation does not prescribe the evidentiary standard for that verification, but the administrator applying the Act will require documentation or legal proof in order to give effect to the exclusion.

• Duty to comply with other aspects of the Act. The exclusion is limited to s 15. Any duties that Act confers elsewhere remain in force; the regulation does not purport to modify other sections of the Act.

Preserved rights of the grant applicant

• The regulation does not expand or reduce an applicant’s substantive entitlements under the Act. It neither creates a new grant nor alters the Act’s eligibility criteria except insofar as the identity of persons who must join in the application is affected. Applicants who benefit from co-owners being excluded from joining an application gain procedural convenience, but their substantive rights remain governed by the Act.

Administrative discretion and evidentiary considerations

• The regulation delegates no new discretionary powers to administrators; it only prescribes a categorical exclusion. Nevertheless, because the regulation requires assessments of future ownership shares and the legal status of entity categories, administrators will have to exercise judgement in determining whether documentary proof supplied meets the exclusion criteria. The regulation leaves the process of verification to administrative practice rather than prescribing a specific evidentiary checklist.

Limitations on the exclusion

• The exclusion applies only where both conditions are satisfied: the ownership threshold and the entity category (s 3). Failure to satisfy either condition means the person remains within the operation of Act s 15, and thus duties to join in an application continue to apply.

In sum, the regulation creates a discrete right for particular shared equity partners to be excluded from a statutory application requirement while imposing indirect duties on applicants, administrators and conveyancers to verify that the exclusion properly applies in any given transaction (s 3).

The regulation contains no new offences, monetary penalties or enforcement mechanisms within its operative text. It achieves its substantive effect by excluding certain persons from the operation of a specified provision of the Act (s 3) rather than by imposing sanctions or compliance obligations that attract penalties. Therefore, readers must look to the First Home Owner Grant Act 2000 and general enforcement frameworks for information on remedies, compliance notices or penalties, none of which are supplied in the regulation itself.

Penalty unit information in the republication

• The republication’s prefatory material notes that "At the republication date, the value of a penalty unit for an offence against this law is $150 for an individual and $750 for a corporation (see Legislation Act 2001, s 133)". That statement is a note about the monetary value of a penalty unit applying to the republished law at that date; it does not create an offence or indicate that the regulation itself contains sanctioned offences. It merely records the applicable unit values for any offences that might exist elsewhere in the statutory scheme (prefatory note).

Enforcement implications stemming from the exclusion

• The practical effect of the exclusion is to change who must join in an application under Act s 15. Where a person is excluded by the regulation, administrators should not require that person’s formal participation in the application process. Conversely, if a party is incorrectly treated as excluded when they do not meet both criteria in s 3, a misapplication might give rise to procedural defect in the grant application. The regulation does not state the sanction for such a procedural defect or specify corrective steps; those would fall to the Act’s general administrative and judicial review frameworks or to any specific provisions in the Act addressing invalid or defective applications.

Verification and record-keeping as compliance mechanisms

• Because the regulation depends on fact-based conditions , percentage interest at completion, and entity status , the practical enforcement environment will rely on documentary verification. Conveyancers, lenders and applicants will need to retain transfer documentation and entity status evidence to support a claim that a shared equity partner falls within the exclusion. The regulation does not prescribe the documentary standard; thus enforcement will ultimately be administered by the relevant decision-maker under the Act.

Legislation Act procedural marks affecting legal status

• The endnotes record the republication status and include notations about uncommenced provisions (U) and modifications (M). Those procedural markers affect legal certainty about which provisions are in force, and enforcement bodies must consult the legislation register and the endnotes to ascertain the current legal position (endnotes 1 and 3).

In short, the regulation does not add penal measures; enforcement will be through correct administrative application of the Act and normal legal remedies for administrative error where applicable. The only monetary reference within the republication concerns the value of penalty units, which is a general legislative fact rather than an enforcement mechanism created by this regulation.

The regulation is expressed as an instrument subordinate to the First Home Owner Grant Act 2000 and interacts directly with that Act and indirectly with the Duties Act 1999 and the Legislation Act 2001. The republished document also records amendment instruments that interact with the regulation.

Direct interaction with the First Home Owner Grant Act 2000

• The regulation operates by excluding certain persons from the application of Act s 15 (s 3). It therefore modifies, by exception, who the Act requires to join in a first home owner grant application. The regulation does not purport to amend the substance of the Act beyond that exclusion; it relies on the Act’s powers to be varied by subordinate legislation.

Interaction with the Duties Act 1999

• The regulation’s second category of entities relies on a declaration under the Duties Act 1999, s 73A (s 3(b)(ii)). That cross-reference means that whether a particular entity is excluded depends on whether it has been declared a provider of community housing under that Duties Act section. Determination of that status therefore requires reference to the Duties Act’s declaration mechanism and to any register or instrument under which entities are declared.

Interaction with Legislation Act 2001

• The republication contains multiple references to the Legislation Act 2001. The discussion of authorised republications, editorial amendments and the Parliamentary Counsel’s power to make editorial changes points to procedural interaction. The republished instrument expressly refers to the Legislation Act’s provisions regulating editorial amendments (part 11.3) and to the value of penalty units under s 133 (prefatory note, endnotes 1 and 2). The republication also notes that editorial changes made under part 11.3 do not alter the effect of the law, but that this particular republication "does not include amendments made under part 11.3" (endnote 1). Users should therefore consult the legislation register for the authoritative and current text, including any modifications.

Interaction with subordinate instruments and amendment Acts

• The legislation history lists subordinate instruments (SL2009-16, SL2009-33) and Acts (A2009-29, A2018-2) that have amended the regulation (endnote 3). Those instruments altered the timing and content of various insertions and omissions in the regulation. Practitioners must consult those amending instruments to understand prior iterations and to trace when specific provisions inserted or removed became effective.

No interaction with substantive grant eligibility in the regulation text

• The regulation is narrowly focused and does not address other aspects of grant eligibility, such as residency tests, age limits, prior ownership disqualifiers or dwelling-type limitations. Any interplay with those substantive tests remains governed by the Act itself and any other subordinate instruments that deal expressly with grant eligibility.

Practical cross-checks required

• In practice, to apply the exclusion correctly an administrator or applicant will need to cross-check three legal sources: (1) the factual ownership interest and how that will stand at transfer, determined by conveyancing documents and the transfer instrument; (2) the entity’s legal character (is it a "financial institution" under whatever legal definition applies, and is it declared under Duties Act s 73A); and (3) the First Home Owner Grant Act s 15 itself to understand the duty that is being excepted.

The regulation therefore functions as a narrow point of cross-legislation interaction, connecting property-transfer facts, entity status under the Duties Act and the statutory application requirement under the First Home Owner Grant Act, all within the procedural context established by the Legislation Act for subordinate instruments and republications.

The republication's endnotes provide a concise chronology of the regulation’s legislative history, showing initial notification and subsequent amendments by subordinate instruments and Acts. That history is the authoritative source within the republished document for tracing the regulation’s changes up to the republication effective date of 1 March 2018 (endnote 3).

Key dates and instruments

• Initial notification and commencement. The First Home Owner Grant Regulation 2008 (SL2008-4) was notified on the legislation register on 11 March 2008. Sections 1 and 2 commenced on 11 March 2008, with the remainder commencing on 12 March 2008 (Legislation Act provisions cited in the history) (endnote 3).

• Amendments by subordinate instruments in 2009. Two subordinate instruments amended the regulation in 2009: First Home Owner Grant Amendment Regulation 2009 (No 1) (SL2009-16), notified 30 April 2009 with parts commencing 1 July 2009; and First Home Owner Grant Amendment Regulation 2009 (No 2) (SL2009-33), notified 29 June 2009 with its remainder commencing 1 July 2009 (endnote 3 and amendment history).

• Amendment by Act 2009. The First Home Owner Grant Amendment Act 2009 (No 2) (A2009-29) also made amendments, notified 23 September 2009, with particular provision s 9 commencing 24 September 2009 (endnote 3).

• Revenue Legislation Amendment Act 2018. More recently, the Revenue Legislation Amendment Act 2018 (A2018-2) affected the regulation; the Act was notified on 28 February 2018, with sch 1 pt 1.3 of the Act commencing on 1 March 2018 (endnote 3).

Specific insertions and omissions recorded

• The amendment history (endnote 4) records particular insertions and omissions in earlier republications: for example, s 2 was omitted in R1 under the Legislation Act, s 89(4). Section 3A and 3B were inserted by SL2009-33 s 4 and later omitted by A2009-29 s 9. A provision concerning protected information, disclosure to commissioner of taxation,Act s 50(3)(f) (s 4) was inserted by SL2009-16 s 4 and later omitted by A2018-2 amendment 1.11. That history demonstrates both the piecemeal nature of the regulation’s amendments and the fact that some earlier insertions were subsequently removed.

Republication sequence

• The endnotes also list earlier republications and the ranges of dates for which those republications were effective (endnote 5). Notably, Republication R1 was effective from 12 March 2008 to 30 June 2009; R2 from 1 July 2009 to 23 September 2009; and R3 from 24 September 2009 to 28 February 2018. Republication R4 is the one effective as at 1 March 2018 and incorporates the historical changes up to that date.

Editorial amendments and part 11.3

• The republication materials explain the Parliamentary Counsel’s power to make editorial amendments under the Legislation Act 2001, part 11.3; they also state that this republication does not include amendments made under part 11.3 (endnote 1). That procedural point is relevant to practitioners tracing textual changes for drafting practice rather than substantive amendments.

Practical consequence of the history

• The amendment history shows that the regulation has been the subject of targeted, limited changes rather than wholesale redrafting. The presence of both subordinate instrument amendments and Act-level amendments means that anyone advising on the regulation must consult the detailed legislative history and the legislation register to confirm which provisions were in force at a given date, particularly because some inserted provisions were later omitted.

The republished regulation does not record any cases, judicial decisions or tribunal rulings that interpret this regulation. The body of the document contains no citations to judicial authorities, and the endnotes do not list any litigation-based annotations. Therefore, within the republication up to 1 March 2018, there is no litigation history recorded in the instrument itself.

What that absence means in practice

• The absence of recorded litigation in the regulation’s endnotes does not mean that no disputes have ever arisen under the First Home Owner Grant Act 2000 or under the regulation in relation to its application. The republication simply does not include case references. To establish whether courts or tribunals have interpreted the exclusion in s 3 or the Act’s s 15, practitioners must search court and tribunal databases, published judgments and administrative review decisions outside the republished regulation document.

Implications for legal certainty and interpretation

• Where a statutory instrument has no recorded litigation history in its republication, decision-makers and lawyers must rely instead on textual interpretation, the statute’s legislative history (including the amendment instruments listed in the republished document), and any available administrative guidance or practice notes issued by the administering agency. The regulation’s limited textual content (a single operative exclusion) reduces the scope for complex interpretive disputes, but potential issues remain, for example: the meaning of "financial institution"; the timing and calculation of "not more than a 50% interest" at completion; and the identification of entities declared under Duties Act s 73A. Each of those points could be the subject of litigation, but none is recorded in the republication.

Recommended steps where litigation risk exists

• If a client anticipates dispute about the application of the exclusion, the practitioner should (i) check the legislation register for any subsequent amendments or notations after 1 March 2018; (ii) search court and tribunal databases for judicial treatment of First Home Owner Grant Act s 15 and the regulation’s s 3; and (iii) review any administrative guidance from the agency responsible for grants. The republication itself does not supply those materials.

In sum, the regulation’s republication contains no internal litigation history; interpretive questions must therefore be addressed by reference to the text, the amendment history recorded in the endnotes and external jurisprudential sources.

The regulation is short, but several potential pitfalls can cause procedural error or downstream disputes. These are matters that practitioners, conveyancers, applicants and lenders should check before proceeding with or relying on the exclusion.

1. The interest threshold includes 50%

• The regulation excludes a shared equity partner who "has, or on the completion of the transfer will have, not more than a 50% interest in land" (s 3(a)). The phrase "not more than a 50% interest" explicitly covers the 50 per cent case. A common drafting pitfall is to assume "less than 50%" was intended; the regulation is explicit. Practitioners should therefore include 50% in their calculations.

2. Timing is critical: "on the completion of the transfer"

• The interest test is not frozen at an earlier date; it applies to the position "on the completion of the transfer". That means restructured ownership arrangements or intended post-settlement share adjustments can alter whether the exclusion applies. Parties must therefore confirm the anticipated allocation of interests at completion and document it.

3. Entity category questions are unresolved in the regulation

• The regulation relies on "financial institution" and a Duties Act declaration for community housing providers (s 3(b)). The regulation does not define "financial institution", nor does it reproduce Duties Act s 73A. Practitioners must refer to primary sources to determine whether an entity falls within either category. Misclassification risks incorrect exclusion claims.

4. Evidence and administrative practice are unspecified

• The regulation does not set out how to prove a shared equity partner’s status or interest percentage. Administrators may require particular documents. Failure to supply adequate evidence could cause an application to be treated as non-compliant, but the regulation provides no safe-harbour list of acceptable documents.

5. The exclusion applies only to Act s 15

• The regulation does not exempt excluded persons from any other statutory requirements or from contractual obligations. Parties should not assume a broadly framed immunity from involvement in the grant process; the exclusion is narrowly confined to the s 15 requirement.

6. Amended and omitted provisions complicate historical positions

• The amendment history shows that earlier insertions such as ss 3A and 3B were later omitted (endnote 4). If advising about transactions that occurred when those insertions were in force, practitioners must trace the exact text in force at the relevant time. The republication’s history makes that trace possible but requires careful cross-referencing.

7. Reliance on external declarations (Duties Act s 73A)

• The exclusion’s second limb depends on a declaration under another Act. That external dependency can create timing problems: if the declaration status of an entity under the Duties Act changes, the entity’s entitlement to exclusion may equally change. Advisers should verify the declaration status at the relevant time.

8. No direct guidance on concurrent interests or aggregated holdings

• The regulation is silent on how to treat situations where multiple entities have complex interest structures (for example, tiers of ownership or trust arrangements). Determining a 50% interest in such cases may require legal analysis beyond the regulation itself.

9. Administrative discretion not articulated

• While the regulation creates a categorical exclusion, it does not prescribe how administrative officers should handle borderline or contested cases, leaving room for case-by-case judgement which can introduce unpredictability in practice.

10. Republication and editorial amendments caveat

• The republication materials indicate editorial powers under the Legislation Act exist but state that this republication "does not include amendments made under part 11.3" (endnote 1). Practitioners should confirm the final, in-force wording on the legislation register to avoid reliance on an out-of-date or editorially altered text.

Mapping these "gotchas" onto transaction workflows and client instructions will reduce the risk of incorrect exclusion claims and of grant applications being returned or rejected for procedural non-compliance.

Compliance with the regulation is largely procedural and fact-driven. The regulation creates an exclusion that can be invoked only when two criteria are met. The practical compliance steps are therefore concrete: verify ownership shares at completion, verify entity status, document the basis for exclusion, and ensure that the remaining application requirements under the Act are met.

Step-by-step compliance checklist

1. Identify all persons with an ownership interest in the land on which the relevant home is built. Record current registered interests and any instruments that will alter those interests at completion.

2. Calculate the share that each shared equity partner will have "on the completion of the transfer". The regulation’s text requires this forward-looking assessment (s 3(a)). Ensure the calculation includes a 50% share as within the exclusion.

3. Determine the entity category of the shared equity partner:

   • Is the partner a "financial institution"? The regulation refers to this category but does not define it. Use statutory definitions, company constitutions, licensing, regulator registers (where relevant) or legal advice to establish the entity’s character.
   • Alternatively, is the partner an entity declared as a provider of community housing under the Duties Act 1999, s 73A? Obtain the relevant declaration instrument or authoritative register entry under the Duties Act to verify the status.

4. Assemble documentary proof that demonstrates both the percentage interest at completion and the entity status. Evidence may include transfer instruments, settlement statements, financing agreements, certificates from regulators, or a copy of a Duties Act declaration.

5. Present the documentation with the first home owner grant application or, if administrative practice requires, at the application assessment stage. Where the administering body has a published checklist or guidance note, follow its directions for supporting evidence.

6. Retain files. Keep records proving why a shared equity partner was excluded; they may be needed if the application is audited, reviewed, or challenged.

7. Do not assume exclusion applies across the board. Check whether other persons with different ownership interests or different entity types remain subject to the Act’s s 15 requirement and ensure they join the application where required.

8. Check the in-force text and amendment history on the legislation register. Use the endnotes to confirm the date-specific version of the regulation that applies to the transaction (endnotes 3-5).

9. Where ownership structures are complex (trusts, nominee arrangements, layered corporate ownership), obtain legal advice to determine the effective interest for the purpose of the regulation’s 50% threshold.

10. If in doubt, consult the administering authority. The regulation does not prescribe an evidentiary standard; clarifying the authority’s documentation expectations before lodging an application will reduce the risk of delay.

Compliance costs and burdens

• The regulation reduces the burden of requiring particular shared equity partners to join in an application, which may simplify applicants’ administrative processes. That said, the compliance burden shifts to ascertainment and documentation of ownership percentage at completion and entity status. Verification may require searches, regulator checks, or legal opinions, particularly where the meaning of "financial institution" is disputed or the Duties Act declaration is not straightforward.

Record-keeping and risk management

• Maintain clear records that explain the decision to not include a shared equity partner in the application. If later challenged, those records will be the primary evidence that the exclusion was properly applied. Consider obtaining a solicitor’s opinion in complex cases, especially where significant value or multi-party financing arrangements are involved.

Timing and settlement coordination

• Because the relevant test is the ownership position at "completion of the transfer", coordinate settlements and grant lodgement timing to ensure the factual position claimed in the application correlates with what is recorded at completion. Conveyancers and settlement agents should be involved early in the process to provide the necessary certifications or confirmations.

In sum, compliance involves a small set of precise checks and documentation tasks. The regulation’s narrow scope means that, with disciplined evidentiary practice and attention to the timing of transfers, applicants and advisers can reliably determine whether the exclusion in s 3 applies and proceed accordingly.
