sec.87 Applications made before commencement that relate to relevant eligible transactions
This section applies if— an application under section 16 was made before the commencement of this section; and the eligible transaction to which the application relates— is a relevant eligible transaction under section 25EA (1) ; and has a commencement date on or after 20 November 2023 and before the commencement of this section. To remove any doubt, it is declared that— the rights and liabilities of all persons in relation to the application are, and have always been, the same as if part 3 , division 7 had been in force from 20 November 2023; and anything done in relation to the application has the same effect, and is taken to have always had the same effect, as it would have had if part 3 , division 7 had been in force from 20 November 2023. s 87 ins 2024 No. 35 s 13 (sec.87-ssec.1) This section applies if— an application under section 16 was made before the commencement of this section; and the eligible transaction to which the application relates— is a relevant eligible transaction under section 25EA (1) ; and has a commencement date on or after 20 November 2023 and before the commencement of this section. (sec.87-ssec.2) To remove any doubt, it is declared that— the rights and liabilities of all persons in relation to the application are, and have always been, the same as if part 3 , division 7 had been in force from 20 November 2023; and anything done in relation to the application has the same effect, and is taken to have always had the same effect, as it would have had if part 3 , division 7 had been in force from 20 November 2023.
- (a) an application under section 16 was made before the commencement of this section; and
- (b) the eligible transaction to which the application relates— (i) is a relevant eligible transaction under section 25EA (1) ; and (ii) has a commencement date on or after 20 November 2023 and before the commencement of this section.
- (i) is a relevant eligible transaction under section 25EA (1) ; and
- (ii) has a commencement date on or after 20 November 2023 and before the commencement of this section.
- (i) is a relevant eligible transaction under section 25EA (1) ; and
- (ii) has a commencement date on or after 20 November 2023 and before the commencement of this section.
- (a) the rights and liabilities of all persons in relation to the application are, and have always been, the same as if part 3 , division 7 had been in force from 20 November 2023; and
- (b) anything done in relation to the application has the same effect, and is taken to have always had the same effect, as it would have had if part 3 , division 7 had been in force from 20 November 2023.
