First Home Owner Grant and Home Buyer Schemes Regulations 2021

The Regulations operate by defining and conferring the legal status "relevant interest in land" for specific factual and contractual relationships; by carving out an owner‑joining requirement; by prescribing an administrative time limit for VCAT review where an objector fails to appear; and by authorising a targeted cross‑border disclosure of protected information.

Relevant interest in land (regulation 5)

• The central substantive concept for eligibility is "relevant interest in land" as used in section 5(4) of the Act. Regulation 5 sets out five discrete bases on which that interest exists for a person who does not own the land: (a) entry into a comprehensive home building contract for construction of a home on the land; (b) commencement of building by an owner‑builder; (c) acquisition of a share in, or entry into a sale agreement with, a housing co‑operative that owns the land; (d) acquisition under a home buyer scheme within the meaning of section 34A of the Act; and (e) acquisition under a Help to Buy arrangement (reg 5(1)-(3)). The regulation ties each non‑owning participant to the owner by requiring that the landowner has granted a licence or right of exclusive occupancy in respect of the home (reg 5(1)(b)).

Exclusive occupancy and self‑contained dwelling

• Regulation 5 requires that the person be granted a licence or right of exclusive occupancy by the landowner, and that the home contains or will contain its own kitchen, bathroom and sanitary facilities (reg 5(1)(b)-(c)). The requirement for those facilities is an objective criterion intended to distinguish dwellings from non‑residential or shared‑facilities arrangements.

Housing co‑operatives and statutory cross‑references

• "Housing co‑operative" is defined by reference to registration under the Co‑operatives National Law (Victoria) (reg 4). For acquisition under a home buyer scheme the regulation points users back to section 34A of the Act (reg 5(2)). Regulation 5(3) as inserted by S.R. No. 58/2025 adds Help to Buy arrangements as another explicit basis.

Exemption from joining (regulation 6)

• Where regulation 5(1) applies, the owner identified in regulation 5(1)(b) is excluded from the application of section 15 of the Act; the instrument notes the effect that such owners are not required to join in a first home owner grant application.

VCAT timeframe (regulation 7)

• The Regulations prescribe a six‑week period for purposes of section 33(2) of the Act, being the period that begins on the day VCAT confirms a decision. This is a procedural limitation on VCAT's ability to re‑open and review when an objector is in default of appearance.

Authorised disclosure to New Zealand police (regulation 8)

• Regulation 8 authorises disclosure of protected information to a narrowly defined class of New Zealand police members, specifically those employed at the New Zealand Police National Intelligence Centre, but only where disclosure is "in connection with an investigation or prosecution carried out in the course of the member's duty" (reg 8). The term "member of the New Zealand police force" is defined by reference to the Policing Act 2008 of New Zealand (reg 4).

Interpretive and temporal settings

• The Regulations are made under s 54 of the Act (reg 2) and revoke an earlier instrument (reg 3). Endnotes record the date of making and commencement, and note that the instrument will sunset ten years after the day of making under the Subordinate Legislation Act 1994 (endnote 1). The endnotes also record interpretation provisions derived from the Interpretation of Legislation Act 1984, including that headings, examples and punctuation form part of the Statutory Rule as relevant (endnote 1).

Primary affected parties

• Applicants for the First Home Owner Grant and participants in Home Buyer Schemes under the Act: The Regulations directly affect who is treated as having a "relevant interest in land" for grant eligibility by adding specific factual scenarios and contractual relationships (reg 5). Persons in those categories may become eligible without being landowners.

• Owners of land where the dwelling is built: The owner whose land is subject to the arrangements recognised by regulation 5(1)(b) is explicitly removed from the obligation to join a first home owner grant application under section 15 of the Act (reg 6). In practical terms the owner will be asked to grant an exclusive‑occupancy licence or right but will not be required to be an applicant.

• Housing co‑operatives and their participants: A housing co‑operative registered under the Co‑operatives National Law (Victoria) is the vehicle through which a person may acquire a share or enter a sale agreement and thereby have a relevant interest in land, subject to the other conditions in regulation 5(1) (reg 4; reg 5(1)(iii)).

• Builders, owner‑builders and contracted purchasers: Persons who enter into a comprehensive home building contract, or who commence building as owner‑builders, are recognised as having relevant interests if the other conditions in regulation 5(1) are met (reg 5(1)(i)-(ii)). That changes the eligibility posture for builders who, by contract, will occupy a completed dwelling.

• Participants in statutory schemes: Persons who have acquired land under a "home buyer scheme" within the meaning of s 34A of the Act, and persons acquiring land under a Help to Buy arrangement (added by S.R. No. 58/2025), are treated as having a relevant interest (reg 5(2)-(3)). The Regulations therefore affect those who participate in such statutory or government‑assisted purchase arrangements.

• Victorian administrative and quasi‑judicial bodies: VCAT users and decision‑makers are affected by the six‑week period prescribed for re‑opening and review under section 33(2) of the Act (reg 7). Objectors in VCAT proceedings and the parties opposing them must account for that timeframe.

• New Zealand Police personnel and information custodians: The Regulations authorise disclosure of protected information to specified New Zealand police officers, which affects (a) custodians of protected information under the Act, and (b) members of the New Zealand police force who are employed at the New Zealand Police National Intelligence Centre and are engaged in investigations or prosecutions (reg 8). The definition of "member of the New Zealand police force" points to the Policing Act 2008 (NZ) (reg 4).

Secondary, indirect and administrative actors

• Advice and compliance professionals: Lawyers, conveyancers, builders, cooperative managers, and grant administrators will face changes to documentation requirements, proof of exclusive occupancy licences and evidence of self‑contained dwelling features (reg 5(1)(b)-(c)).

• Information governance and privacy officers: Because regulation 8 authorises disclosure of "protected information" to a defined NZ police class under s 50(4)(d) of the Act, agencies holding protected information must decide on compliance with that exception and keep records documenting the basis for disclosure (reg 8).

• Regulators and legislators: The Governor in Council made the Regulations under s 54 of the Act (reg 2) and revoked an earlier instrument (reg 3). The endnotes show the statutory sunset point, which may influence policy renewal and review processes (endnote 1).

Who does not become eligible automatically

• The Regulations do not treat mere occupancy without an exclusive licence or right as giving a relevant interest; nor do they contemplate arrangements lacking the requirement that the dwelling contain its own kitchen, bathroom and sanitary facilities (reg 5(1)(b)-(c)). The owner is excluded from being required to join only where the interest is recognised under regulation 5(1) (reg 6).

Duties created or clarified by the Regulations

• Duty to assess and recognise eligible arrangements: Administrators who determine eligibility under the Act must apply regulation 5 to decide whether a person who is not the landowner nonetheless has a "relevant interest in land" (reg 5). The duty is to verify the specific factual conditions: existence of a comprehensive home building contract, owner‑builder commencement, a housing co‑operative share or sale agreement, acquisition under a home buyer scheme, or acquisition under a Help to Buy arrangement (reg 5(1)-(3)).

• Duty to verify a licence or right of exclusive occupancy: For each of the relevant interest categories in regulation 5(1), the administrator must be satisfied the landowner has granted a licence of exclusive occupancy of the home or a right of exclusive occupancy (reg 5(1)(b)). That is a documentary and factual requirement the regulator will check when assessing an applicant.

• Duty to ensure the dwelling is self‑contained (or will be): Administrators must confirm that the home contains, or on completion will contain, its own kitchen, bathroom and sanitary facilities (reg 5(1)(c)). This is an objective threshold upon which eligibility may turn.

• Duty to respect prescribed VCAT timeframe: Where section 33(2) of the Act applies and an objector is in default, VCAT may re‑open and review a matter only within the six‑week period prescribed by regulation 7. That duty constrains decision‑makers and parties who might seek to reopen or challenge VCAT decisions.

• Duty to control disclosure of protected information: Custodians of protected information must treat the regulation 8 exception narrowly, disclosing only to persons who meet the composite definition (member of NZ police force and employed at the NZ Police National Intelligence Centre) and where the disclosure is in connection with an investigation or prosecution carried out in the course of that member's duty (reg 8). The underlying duty under section 50 of the Act to protect information remains; regulation 8 provides one narrow authorised exception.

Rights created or clarified by the Regulations

• Right to be treated as having a relevant interest: Individuals who meet the conditions in regulation 5 gain the legal consequence tied to "relevant interest in land" under section 5(4) of the Act. That legal status is a right attaching to their factual or contractual relationship, enabling them to proceed with a grant application without being the registered owner.

• Right of landowners not to be required to join: Where the conditions of regulation 5(1) are satisfied, the owner referred to in regulation 5(1)(b) is excluded from the application of section 15 of the Act (reg 6). The right is negative: owners in that category are not required to be applicants on grant forms.

• Procedural rights before VCAT: The six‑week prescription for re‑opening a matter under section 33(2) creates a time‑limited right for parties to seek re‑opening. For parties seeking to preserve challenges, the timeframe is an express boundary that privileges timely procedural action (reg 7).

Interaction with statutory duties in the Act and other instruments

• The Regulations frequently invoke sections of the Act (s 5(4), s 15, s 33(2), s 50(4)(d), s 34A and s 54) and the Policing Act 2008 (NZ) for definitions. The duties and rights created by the Regulations are therefore derivative: they operate within the legal architecture established by the Act and by referenced statutes such as the Co‑operatives National Law and the Policing Act 2008 (NZ) (reg 4).

Practical documentation duties

• For eligibility and compliance purposes the Regulations impose practical evidentiary duties: proof of the comprehensive home building contract, proof of owner‑builder commencement, documentation of a housing co‑operative share or sale agreement, documentary evidence of acquisition under a home buyer scheme or Help to Buy arrangement, and a licence or right of exclusive occupancy and proof of self‑contained facilities (reg 5(1)-(3)). Agencies will need to identify what evidentiary standard they will accept.

Express penalties

• The Regulations themselves do not specify new criminal or civil penalties or fines. The instrument does not insert penalty provisions into the Act nor attach fines or offences to compliance failures in these Regulations. Enforcement therefore relies on the enforcement mechanisms and penalties already provided for in the First Home Owner Grant and Home Buyer Schemes Act 2000 and any associated enforcement framework in the Act.

Enforcement mechanisms implied by the Act

• The Regulations operate by amending eligibility and procedure within the Act's framework. For enforcement and penalties, users must look back to the Act for the applicable mechanisms, including qualifications for grants, recovery of improperly obtained grants, administrative penalties or other remedies that the Act provides. The Regulations refer to specific Act sections,s 5(4), s 15, s 33(2), s 50(4)(d) and s 34A,so enforcement of the Rules in practice will be through application of those sections and any sanctions contained in the Act.

VCAT re‑opening and review

• Regulation 7 prescribes a six‑week period for VCAT to re‑open and review under section 33(2) of the Act. Enforcement here is procedural: parties seeking to re‑open must do so within that period. If an attempt is made outside the prescribed period, VCAT will be constrained from doing so by the regulation as prescribed for the purposes of s 33(2) (reg 7).

Information disclosure and authorised exceptions

• Regulation 8 authorises a limited disclosure of protected information to defined New Zealand police personnel under section 50(4)(d) of the Act. The Act's privacy and protected‑information rules will determine the consequences of improper disclosures outside the authorised exception. The Regulations narrow the authorised recipient class; custodians who disclose outside that class may face enforcement or remedial measures under the Act.

Administrative accountability and record keeping

• Because the Regulations create specific documentary thresholds (exclusive occupancy licences, self‑contained facilities, contractual documentation, acquisition under schemes), administrative enforcement will consist largely of refusal, recovery, or administrative correction where eligibility is misrepresented or improperly certified. Agencies will be required to maintain records proving compliance with the conditions in regulation 5 and to record any disclosures under regulation 8 to the specified NZ police members.

Sunset and legislative review as an enforcement control

• The instrument will sunset 10 years after making (endnote 1). This temporal limit creates an implicit enforcement and review checkpoint: persistent issues arising under these Regulations will need to be addressed in the course of any renewal or replacement prior to the sunset date.

Direct cross‑references to the Act

• The Regulations are made under section 54 of the First Home Owner Grant and Home Buyer Schemes Act 2000 (reg 2). They expressly operate to clarify the meaning and application of parts of the Act by reference to sections within it: notably s 5(4) (definition/recognition of relevant interest), s 15 (who must join in an application), s 33(2) (VCAT re‑opening and review), s 50(4)(d) (protected information disclosure), and s 34A (home buyer scheme) (reg 5; reg 6; reg 7; reg 8; reg 5(2)). The Regulations should therefore be read alongside the Act.

Co‑operatives National Law (Victoria)

• Regulation 4 defines "housing co‑operative" to mean a non‑distributing co‑operative registered as a co‑operative under the Co‑operatives National Law (Victoria). That means the legal form and regulatory status conferred by the Co‑operatives National Law determine whether a co‑operative qualifies under regulation 5(1)(iii). The interaction requires practitioners to check registration status and compliance under the Co‑operatives National Law before relying on regulation 5 for grant eligibility.

Policing Act 2008 (New Zealand)

• The defined term "member of the New Zealand police force" in regulation 4 is taken from the Policing Act 2008 (NZ). Regulation 8 authorises disclosure to such members employed at the New Zealand Police National Intelligence Centre. The effect is that the scope of permissible disclosure turns on the NZ statutory definition and the employment status within the NZ Police National Intelligence Centre, hence cross‑jurisdictional administrative coordination is required when invoking regulation 8.

Subordinate Legislation Act 1994 and Interpretation of Legislation Act 1984

• Endnotes record that the Regulations will sunset ten years after the day of making under section 5 of the Subordinate Legislation Act 1994 (endnote 1). The endnotes also refer to interpretation rules under the Interpretation of Legislation Act 1984 (ILA), including section 36 (headings, examples, punctuation, etc.) and section 39B (insertion effects on numbering). These interpretive provisions affect how the Regulations are read and therefore how they interact with other subordinate instruments.

Procedural interaction with VCAT and administrative law

• Regulation 7 prescribes a six‑week period for VCAT to re‑open and review a matter under section 33(2) of the Act (reg 7). That procedural limit interacts with VCAT's rules of practice and the administrative law principles that regulate reopening and review. Parties must factor the prescribed period into any strategy for challenge, review or enforcement.

Information privacy and disclosure regimes

• Regulation 8 authorises disclosure of protected information to specified NZ police members for investigations or prosecutions. That exception interacts with the Act's own protections for "protected information" under s 50 and with broader information‑sharing or privacy laws. While the Regulations authorise a specific cross‑border disclosure, custodians must reconcile that with any other legal constraints, such as the Act's protected‑information framework and any applicable privacy obligations.

Statutory definitions and evidentiary interaction

• The Regulations introduce terms and thresholds (exclusive occupancy licence, self‑contained dwelling facilities) which must be interpreted in light of other relevant statutory definitions and property law concepts when documenting and evidencing eligibility. Where the Act refers to "home buyer scheme" (s 34A) the Regulations adopt that cross‑reference, requiring users to consult the Act for the scheme’s definition and any conditions.

Revocation of earlier regulations

• Regulation 3 revokes the First Home Owner Grant Regulations 2021. Practitioners must therefore compare the text of prior instruments and the current Regulations to reconcile transitional arrangements and to confirm whether prior guidance or forms remain applicable.

Original making and commencement

• The Regulations were made on 21 December 2021 by the Governor in Council under section 54 of the First Home Owner Grant and Home Buyer Schemes Act 2000, and came into operation on 21 December 2021, as recorded in the endnotes (endnote 1).

Revocation of predecessor

• Regulation 3 revokes the First Home Owner Grant Regulations 2021. The instrument therefore replaced or consolidated earlier subordinate instruments dealing with the same topic (reg 3).

Amendment recorded in this publication

• The version provided incorporates amendments up to 25 June 2025. The Table of Amendments identifies at least one consequential or substantive amendment: the First Home Owner Grant and Home Buyer Schemes Amendment Regulations 2025, S.R. No. 58/2025, made on 17 June 2025 and commencing 25 June 2025 (Table of Amendments). That amendment inserted regulation 5(3), which treats a person as having a relevant interest in land if they have acquired land under a Help to Buy arrangement (reg 5(3) inserted by S.R. No. 58/2025 reg 4).

Sunset provision

• The endnotes state the Regulations will sunset 10 years after the day of making on 21 December 2031 pursuant to section 5 of the Subordinate Legislation Act 1994 (endnote 1). That temporal limit means the Regulations will require affirmative legislative action for continuation beyond that date.

Interpretative amendments and stylistic changes

• The endnotes also draw attention to interpretation provisions from the Interpretation of Legislation Act 1984 that affect how the Regulations are read, such as the legal status of headings, notes, examples and punctuation (endnote 1). Those are not substantive policy amendments but affect textual interpretation.

Recorded amending instrument details

• The Table of Amendments records the amending instrument S.R. No. 58/2025 with its date of making (17.6.25) and date of commencement (25.6.25) and cites the specific regulation inserted (reg 3: S.R. No. 31/2021 appears in explanatory details but the table identifies S.R. No. 58/2025 as the 2025 amending rule). Users should consult the recorded S.R. numbers and dates when tracking the chronological changes.

What the amendment changed

• The key substantive change documented in the Table of Amendments is insertion of reg 5(3) by S.R. No. 58/2025 reg 4, which adds acquisition under a Help to Buy arrangement to the list of circumstances giving a person a relevant interest in land for the purposes of s 5(4) of the Act (reg 5(3)).

Practical consequence of amendment

• The 2025 amendment expands the class of persons who may be treated as having a relevant interest, thereby affecting eligibility assessments, documentary requirements and the population of potential applicants under the Act. Practitioners should check whether the Help to Buy arrangements referenced are defined elsewhere or in other instruments.

Transitional provisions

• The Regulations as printed do not set out transitional provisions for earlier applications or actions taken under the revoked earlier instrument. Users must therefore examine the Act, the revocation instrument and any amending instrument for transitional rules that govern in‑flight applications and administrative decisions made before the amending commencement dates.

How to monitor further amendments

• The endnotes advise that current versions and up‑to‑date legislative information are available at legislation.vic.gov.au (endnote 1). Given the sunset date and the recorded 2025 amendment, practitioners should monitor subordinate legislation updates, particularly near the sunset date and following any policy changes to home buyer support schemes.

Absence of cases or judicial interpretation in the instrument

• The Regulations themselves do not record any litigation history. They do not name or cite any cases, and the endnotes contain no references to judicial decisions. The text therefore presents an unlitigated statutory specification as at the version dated 25 June 2025.

Implications for precedent and uncertainty

• Because the instrument is silent on any judicial interpretations, there is no precedent embedded within the Regulations for how courts or VCAT should construe the new concepts. For example, regulation 5 introduces objective requirements such as "licence of exclusive occupancy" and "its own kitchen, bathroom and sanitary facilities" without providing interpretive examples or definitions; absent case law, administrative decision‑makers and practitioners will be the first to interpret those phrases in practice.

Areas likely to generate disputes

• The Regulations create factual and documentary thresholds that may lead to contested questions requiring adjudication. Potentially litigable areas include:
  • Whether a contractual arrangement qualifies as a "comprehensive home building contract" for the purposes of reg 5(1)(i);
  • The scope and legal effect of a "licence of exclusive occupancy" or a "right of exclusive occupancy" and whether certain licence forms satisfy the requirement in reg 5(1)(b);
  • Whether an existing dwelling "contains, or on completion will contain, its own kitchen, bathroom and sanitary facilities" for reg 5(1)(c), particularly for modular, shared, or staged developments;
  • The interpretation of "acquired the land under a home buyer scheme within the meaning of section 34A of the Act" and the content of "Help to Buy arrangement" as added by reg 5(3), if those terms are ambiguous or defined elsewhere; and
  • The lawful scope of disclosure under reg 8 when the recipient’s duties or employment status at the New Zealand Police National Intelligence Centre are disputed.

VCAT procedural disputes

• Regulation 7 prescribes a six‑week period for VCAT to re‑open and review under s 33(2) of the Act. Disputes may arise about the calculation of the six‑week period, the point at which a decision is "confirmed" by VCAT, or equitable relief where parties miss the timeframe.

No recorded judicial clarifications

• As the instrument does not list any judicial authorities or prior litigation, stakeholders should not expect pre‑existing judicial guidance on these specific regulations. Early administrative decisions and any reported VCAT or court decisions will therefore be important to monitor.

Practical litigation readiness

• Practitioners advising clients on contentious eligibility or disclosure issues should document the factual basis for reliance on the Regulations, gather contemporaneous evidence of exclusive‑occupancy licences and contractual terms, and be prepared to place that material before VCAT or a court if the decision is challenged.

Narrow factual predicates with evidence burdens

• Regulation 5 ties eligibility to specific factual predicates, for example the existence of a licence or right of exclusive occupancy and self‑contained facilities in the dwelling (reg 5(1)(b)-(c)). Applicants who rely on informal arrangements, oral agreements, or licences that do not confer exclusive occupancy in clear legal form may find applications refused. Practitioners should note the evidentiary burden: an unsigned or ambiguous occupancy arrangement may not satisfy the regulation.

Exclusive occupancy versus mere permission

• The distinction between an exclusive occupancy licence or right and mere permission to occupy is material. The Regulations require an owner to have "granted to the person a licence of exclusive occupancy of the home or right of exclusive occupancy of the home" (reg 5(1)(b)). Documents that create shared rights, floating licences, or time‑limited permissions that do not confer exclusivity may not meet this test.

Self‑contained dwelling requirement

• The regulation requires the home "contains, or on completion will contain, its own kitchen, bathroom and sanitary facilities" (reg 5(1)(c)). This may exclude bedsit or shared facilities arrangements, rooming houses, or dwellings staged to be completed over time unless there is clear evidence of completion on a date relevant to the grant. Where construction is incomplete, administrators will need evidence of contractual obligation and reliable completion timelines.

Housing co‑operative technicalities

• The definition of "housing co‑operative" depends on registration under the Co‑operatives National Law (Victoria) (reg 4). A co‑operative incorporated or registered under another regime or a non‑distributing association that calls itself a co‑operative may not qualify. Practitioners must confirm registration status and that the co‑operative is "non‑distributing" as required.

Unclear statutory references requiring cross‑checking

• Regulation 5(2) and (3) adopt cross‑references to a "home buyer scheme within the meaning of section 34A of the Act" and to a "Help to Buy arrangement" (reg 5(2)-(3)). The Regulations do not define Help to Buy within the instrument; reg 5(3) was inserted in 2025. Users must cross‑check the Act and any other instruments for the precise definitions and conditions of such schemes before relying on them.

VCAT timing traps

• The six‑week window for VCAT to re‑open and review under section 33(2) begins on "the day on which the decision is confirmed by VCAT" (reg 7). Confirmation may be a technical step; parties who miscalculate the starting point or the six‑week period risk losing the ability to have a matter re‑opened.

Disclosure limited to narrow NZ Police class

• Regulation 8 authorises disclosure of protected information only to members of the New Zealand police force who are employed at the New Zealand Police National Intelligence Centre and only in connection with investigations or prosecutions carried out in the course of duty (reg 8). Requests coming from other NZ Police personnel, international law enforcement, or private investigators do not fall within the authorisation. Custodians must verify both the NZ policing status and the employment at the National Intelligence Centre before disclosing.

Cross‑jurisdictional verification

• Because regulation 8 depends on the NZ Policing Act for the definition of "member", Australian custodians may need to obtain proof of the recipient’s status under NZ law or seek official confirmation via diplomatic or police liaison channels to be assured the authorised exception is engaged.

No penalties or transitional guidance in the Regulations

• The Regulations do not set new penalties nor include transitional provisions for prior applications affected by the revocation in reg 3. Applicants and administrators should not assume automatic grandfathering or that prior forms remain valid; the absence of transitional provisions can produce administrative uncertainty.

Sunset deadline

• The Regulations will sunset on 21 December 2031 (endnote 1). Any long‑term advice or contracts premised on the Regulations should consider the sunset and the possibility that the regime may be altered or not renewed.

Document the occupancy right and dwelling facilities

• To rely on regulation 5(1), applicants should obtain and retain a clear, written and legally effective licence or instrument that grants exclusive occupancy or a right of exclusive occupancy from the landowner. The instrument should specifically describe the premises and the exclusive nature of the occupation. Evidence that the dwelling contains or will contain its own kitchen, bathroom and sanitary facilities is required; where construction is incomplete, contemporaneous building contracts, completion schedules and progress certificates should be preserved (reg 5(1)(b)-(c)).

Collect contractual and transactional evidence

• If relying on a comprehensive home building contract or owner‑builder commencement, retain the full building contract, certificates of commencement, builder’s statutory declarations, council approvals, and any home warranty or insurance documents. For housing co‑operative cases, retain the co‑operative’s registration proof under the Co‑operatives National Law (Victoria) and the share or sale agreement showing acquisition (reg 5(1)(i)-(iii); reg 4).

Verify scheme and Help to Buy status

• For acquisition under a home buyer scheme or a Help to Buy arrangement (reg 5(2)-(3)), obtain the scheme documents that show the person has "acquired the land" under the statutory scheme within the meaning of section 34A of the Act or under the Help to Buy scheme. Because the Regulations cross‑reference those schemes without giving fuller definitions, obtain the underlying statutory or scheme documentation, and record the transaction details demonstrating that acquisition occurred under the scheme.

Record ownership and the effect of exemption

• Where regulation 5(1) is relied upon, the owner identified in reg 5(1)(b) is excluded from the application of section 15 and is not required to join in the grant application (reg 6). Practically, obtain a written acknowledgement from the owner that they have granted the occupancy licence or right and that they agree not to be a joined applicant where appropriate. Keep documentary proof to forestall later disputes about whether the owner was required to join.

Prepare for VCAT procedural timelines

• For parties contemplating re‑opening or review under section 33(2) of the Act, diarise the VCAT decision confirmation date carefully. Regulation 7 prescribes a six‑week period commencing on the day of confirmation by VCAT (reg 7). Ensure any application to re‑open is filed within that six‑week window and that the precise date of confirmation is recorded and proven.

Handle protected information disclosures cautiously

• Custodians of "protected information" should establish a disclosure protocol that checks: (a) whether the recipient is a member of the New Zealand police force as defined in the Policing Act 2008 (NZ); (b) whether the recipient is employed at the New Zealand Police National Intelligence Centre; and (c) whether the disclosed material is needed "in connection with an investigation or prosecution carried out in the course of the member's duty" (reg 8). Keep written records of the request, the recipient’s status, the legal basis for disclosure, the material disclosed, and any internal approvals. If in doubt, seek legal advice and where appropriate request official certification from NZ Police offices.

Cross‑check definitions and statutory references

• Because the Regulations rely on the Act and other statutes for key concepts, practitioners must cross‑check the applicable definitions in the Act (e.g., s 34A) and in the Co‑operatives National Law and the Policing Act 2008 (NZ) for compatibility with the facts of each case. Do not assume the Regulations' wording is exhaustive.

Retain contemporaneous evidence of eligibility decisions

• Administrators should keep records showing why each applicant met the requirements of regulation 5 at the time of application, including copies of occupancy licences, contracts, building approvals, progress certificates, and any co‑operative registration. This documentation is the primary defence to later recovery actions or disputes.

Monitor amendments and the sunset date

• The Regulations have a recorded amendment adding reg 5(3) in 2025 and will sunset in December 2031 (Table of Amendments; endnote 1). Ensure internal compliance processes track legislative updates and monitor the Victorian legislation portal for any further amending instruments before the sunset date.

Seek early advice for novel or marginal cases

• When arrangements are novel, for example complex co‑operative structures, staged occupancy during construction, modular or prefabricated dwellings, or cross‑jurisdictional receipt of protected information, seek legal advice early. Document the legal basis used to treat a person as having a relevant interest and ensure all statutory cross‑references are satisfied.

Use forms and declarations that match the regulatory thresholds

• Where agencies provide forms for grant applications, ensure the forms require the applicant to declare and upload evidence of the specific elements in regulation 5 (contract, licence, proof of self‑contained facilities, scheme acquisition documents). Require the owner’s written acknowledgement where the owner is excluded from joining in the application under regulation 6 to avoid disputes about whether the owner had to be joined.

Keep chain‑of‑custody and disclosure logs for protected information

• When disclosing protected information under reg 8, maintain a disclosure log that records the recipient’s identity, the statutory basis for disclosure, the investigation or prosecution to which the disclosure relates, and any cross‑border data‑sharing protocols followed. This will help demonstrate compliance if a disclosure is later questioned.
