237 Offence—disposal of firearms by unauthorised holders
generally
(a) the person has possession of a firearm; and
(b) the person is not authorised by a licence or permit to possess the
(c) either—
(i) the person fails to surrender the firearm to a police officer;
or
(ii) if the person has possession of the firearm because of the
death of the individual authorised to possess it—the person
fails to—
(A) give the firearm to a licensed firearm dealer to
temporarily store the firearm; and
(B) give the registrar written notice of the death and the
name of the licensed firearms dealer storing the
(2) Subsection (1) does not apply to a person who inherits a firearm.
Note The defendant has an evidential burden in relation to the matters
mentioned in s (2) (see Criminal Code, s 58).
if the defendant proves that the defendant is authorised to possess the
firearm under 1 or more of the following sections:
s (3) (see Criminal Code, s 59).
