sec.146W Provisions applying for particular proceedings

This section applies for sections 146L , 146M , 146O , 146Q and 146R (each the section ). A person causes something mentioned in the section if the person’s act or omission is a substantial or significant cause of the thing or substantially contributes to the thing. The section applies despite the Criminal Code , sections 23 (1) and 24 . It is a defence in a proceeding against a person for a contravention of the section for the person to prove the person took reasonable precautions and exercised proper diligence to prevent the contravention.
