### 65A Fire permit officers determine applications for permits

> > (1) An application for a permit under [section 66](#GS66@EN) in respect of a Fire Management Area is to be determined by –
> >
> > > > (a) in the case of State forest within that area – a fire permit officer appointed under [section 65](#GS65@EN) [(1)](#GS65@Gs1@EN) [(a)](#GS65@Gs1@Hpa@EN) ; and
> > >
> > > > (b) [*\[Section 65A Subsection (1) amended by No. 55 of 2000, Sched. 1, Applied:14 Jul 2000\]*](/view/html/inforce/2000-07-14/act-2000-055#JS1@Ja5@GC5@EN) [*\[Section 65A Subsection (1) amended by No. 64 of 2002, Sched. 1, Applied:31 Dec 2002\]*](/view/html/inforce/2002-12-31/act-2002-064#JS1@Ja8@GC4@EN) in the case of any reserved land as defined in the [Nature Conservation Act 2002](/view/html/inforce/2026-04-12/act-2002-063) within that area – a fire permit officer appointed under [section 65](#GS65@EN) [(1)](#GS65@Gs1@EN) [(b)](#GS65@Gs1@Hpb@EN) ; and

> > > > > > (i) a fire permit officer appointed under [section 65](#GS65@EN) [(1)](#GS65@Gs1@EN) [(c)](#GS65@Gs1@Hpc@EN) ; or

> > > > > > (ii) a member of the Fire Service who is authorised by the Commission to determine such applications for that area.

> > (2) In determining applications for permits, a fire permit officer or member of the Fire Service authorised under [subsection (1)](#GS65A@Gs1@EN) [(c)](#GS65A@Gs1@Hpc@EN) [(ii)](#GS65A@Gs1@Hpc@Hqii@EN) is to have regard to such advice, recommendations and reports as he or she is given by the Commission or the relevant Committee.

> > (3) A fire permit officer appointed under [section 65](#GS65@EN) [(1)](#GS65@Gs1@EN) [(c)](#GS65@Gs1@Hpc@EN) is entitled to be reimbursed by the Commission for expenses that he or she incurs in the execution of his or her duties.
