### 14 State Fire Management Council

> > (1) A State Fire Management Council is established.
>
> > (2) The Council consists of –
> >
> > > > (a) a person nominated by the Minister; and
> > >
> > > > (b) the Chief Officer; and
> > >
> > > > (c) the person for the time being holding, in the Fire Service, an office or position determined by the Chief Officer; and
> > >
> > > > (d) the chief executive officer of the Forestry corporation; and
> > >
> > > > (e) a person nominated by the chief executive officer of the Forestry corporation; and
> > >
> > > > (f) the Director of National Parks and Wildlife; and
> > >
> > > > (g) a person nominated by the Director of National Parks and Wildlife; and
> > >
> > > > (h) a person nominated by the Tasmanian Farmers' and Graziers' Association; and
> > >

> > (3) The member of the Council referred to in [subsection (2)](#GS14@Gs2@EN) [(a)](#GS14@Gs2@Hpa@EN) is chairperson of the Council.
>
> > (4) The members of the Council referred to in [paragraphs (a)](#GS14@Gs2@Hpa@EN) , [(e)](#GS14@Gs2@Hpe@EN) , [(g)](#GS14@Gs2@Hpg@EN) , [(h)](#GS14@Gs2@Hph@EN) , [(i)](#GS14@Gs2@Hpi@EN) and [(j)](#GS14@Gs2@Hpj@EN) of [subsection (2)](#GS14@Gs2@EN) are appointed by the Governor.
>
> > (5) The Minister may require a body referred to in [paragraph (h)](#GS14@Gs2@Hph@EN) , [(i)](#GS14@Gs2@Hpi@EN) or [(j)](#GS14@Gs2@Hpj@EN) of [subsection (2)](#GS14@Gs2@EN) to submit a list of names within a specified period, being a period of not less than 30 days.
>
> > (6) If a body referred to in [paragraph (h)](#GS14@Gs2@Hph@EN) , [(i)](#GS14@Gs2@Hpi@EN) or [(j)](#GS14@Gs2@Hpj@EN) of [subsection (2)](#GS14@Gs2@EN) fails to comply with [subsection (5)](#GS14@Gs5@EN) , the Minister may nominate a person for the purposes of that paragraph.
>
> > (7) If a body referred to in [paragraph (h)](#GS14@Gs2@Hph@EN) , [(i)](#GS14@Gs2@Hpi@EN) or [(j)](#GS14@Gs2@Hpj@EN) of [subsection (2)](#GS14@Gs2@EN) changes its name, the Governor may, by order, amend that paragraph by substituting the body's new name.
>
> > (8) If a body referred to in [paragraph (h)](#GS14@Gs2@Hph@EN) , [(i)](#GS14@Gs2@Hpi@EN) or [(j)](#GS14@Gs2@Hpj@EN) of [subsection (2)](#GS14@Gs2@EN) ceases to exist, the Governor may, by order, amend that paragraph by substituting the name of a body which the Governor is satisfied substantially represents the interests represented by the first-mentioned body.
>
> > (9) [Schedule 5](#JS5@EN) has effect with respect to the membership and meetings of the Council.
