31Application of Part

31 Application of Part (1) This Part does not apply to a registered infringement fine to which any of the following provisions apply— (a) sections 89A to 89D of the **Road Safety Act 1986**; S. 31(1)(b) repealed by No. 41/2019 s. 117(Sch. 1 item 5.3). (c) sections 61A and 61BA of the **Marine (Drug, Alcohol and Pollution Control) Act 1988**. (2) This Part does not apply to a registered infringement fine to which any of the following provisions apply if the person was unaware of the infringement notice to which the fine relates having been served and that service of the infringement notice was not by personal service— (a) section 67 or 89B of the **Road Safety Act 1986**; (b) section 219A of the **EastLink Project Act 2004**; S. 31(2)(c) repealed by No. 41/2019 s. 117(Sch. 1 item 5.3). (d) section 61B of the **Marine (Drug, Alcohol and Pollution Control) Act 1988**; S. 31(2)(e) amended by No. 25/2025 s. 101(1). (e) section 87A of the **Melbourne City Link Act 1995**; S. 31(2)(f) inserted by No. 25/2025 s. 101(2). (f) section 52 of the **West Gate Tunnel (Truck Bans and Traffic Management) Act 2019**; S. 31(2)(g) inserted by No. 25/2025 s. 101(2). (g) section 90 of the **North East Link Act 2020**. (3) This Part does not apply in respect of a registered court fine.
