190 Enforcement orders with revocation proceedings in progress (1) Despite the repeal of Part 4 of the **Infringements Act 2006**, an application for revocation of an enforcement order made under that Part that has not been considered by an infringements registrar before that repeal is taken to be an application for enforcement review and must be dealt with by the Director accordingly. (2) Despite the repeal of Part 4 of the **Infringements Act 2006**, an application for revocation of an enforcement order that has been referred to the Court under that Part but which has not been heard and determined by the Court before that repeal is to be heard and determined in accordance with that Division 4 of that Part as if that Division had not been repealed. (3) If, on the hearing and determination of a referred revocation application under subsection (2), the Court decides to not to revoke the enforcement order— (a) the infringement penalty and prescribed costs the subject of the enforcement order are taken to be a registered fine under this Act; and (b) the Director may issue a notice of final demand to the infringement offender in respect of the matter.
