65 Effect of enforcement action on vehicle insurance
(1) A vehicle insurance policy is not affected by the suspension of the
registration of the vehicle or the suspension of the licence to drive
of the driver of the vehicle under this Division, and a claim under a
vehicle insurance policy cannot be refused merely because of the
Fines and Penalties (Recovery) Act 2001 35
suspension, despite anything to the contrary in a vehicle insurance
policy or any other agreement.
(2) In this section:
vehicle insurance policy includes:
(a) a policy of insurance in respect of a vehicle generally known
as a comprehensive policy; and
(b) a policy of insurance in respect of a vehicle generally known
as a third party property policy.
