42 Effect of payment under penalty enforcement order (1) The payment of an amount payable under a penalty enforcement order is not an admission of liability for the purpose of, and does not in any way affect or prejudice, any civil claim, action or proceeding arising out of the same circumstances. (2) If the full amount payable under a penalty enforcement order is paid or recovered, no person is liable for any further proceedings for the alleged offence concerned unless the order is annulled or withdrawn under this Part. (3) The payment of an amount payable under a penalty enforcement order does not affect the operation of the provisions of Division 3 relating to annulment of an order or the provisions of Division 6 relating to withdrawal of an order.
