#### 53 Application of penalty notice procedure to children 53 Application of penalty notice procedure to children > > (1) This Part applies to a person of any age. > > > (2) However, this Part does not apply to a person who is younger than 10 years or who, although 10 years or older, was younger than 10 years when the person is alleged to have committed the offence to which the relevant penalty notice relates. > > > (3) This Part applies despite anything in the [Children (Criminal Proceedings) Act 1987](/view/html/inforce/current/act-1987-055), except that the provisions of this Part relating to the hearing or determination of an alleged offence on the withdrawal or annulment of a penalty notice enforcement order is subject to that Act. > > **s 53:** Am 2019 No 13, Sch 1\[50\].
