sec.46 Effect of transfer under s 45 or of employees of QOFS becoming appointed to the Australian Public Service

This section applies if a person becomes an APRA employee under section 45. This section also applies if— a person is appointed to the Australian Public Service under the Public Service Act 1922 (Cwlth) , section 81B (1) , on or after the transfer date; and immediately before the appointment, the person was an employee of QOFS. If the person is the chief executive officer of QOFS, the officer’s appointment under the QOFS Act immediately ends. If the person is another employee of QOFS, the employee’s employment with QOFS immediately ends. A person is not entitled to receive any payment or other benefit, whether under a contract or otherwise, because the person’s appointment or employment ends under this section. (sec.46-ssec.1) This section applies if a person becomes an APRA employee under section 45. (sec.46-ssec.2) This section also applies if— a person is appointed to the Australian Public Service under the Public Service Act 1922 (Cwlth) , section 81B (1) , on or after the transfer date; and immediately before the appointment, the person was an employee of QOFS. (sec.46-ssec.3) If the person is the chief executive officer of QOFS, the officer’s appointment under the QOFS Act immediately ends. (sec.46-ssec.4) If the person is another employee of QOFS, the employee’s employment with QOFS immediately ends. (sec.46-ssec.5) A person is not entitled to receive any payment or other benefit, whether under a contract or otherwise, because the person’s appointment or employment ends under this section.

• (a) a person is appointed to the Australian Public Service under the Public Service Act 1922 (Cwlth) , section 81B (1) , on or after the transfer date; and
• (b) immediately before the appointment, the person was an employee of QOFS.
