What it does
The Financial Accountability Regulation 2019 sets four discrete, mechanical changes to the subordinate law framework under the Financial Accountability Act. First, it fixes its short title and commencement date: it may be cited as the Financial Accountability Regulation 2019 and it commenced on 1 September 2019 (s 1, s 2). Second, it supplies the identification of accountable officers for particular entities by reference to schedule 1: for the purposes of s 65(3) of the Act, a person named in schedule 1, column 1 is the accountable officer for the entity shown opposite in column 2 (s 3). Third, it prescribes what constitutes being "appropriately qualified" for nomination as chief finance officer and, separately, as head of internal audit, for the purposes of the Act,specifically implementing the definitions referenced in s 77 and s 78 of the Act (s 4, s 5). The prescribed qualifications are confined to membership or recognised qualifications from specified professional bodies (see below for the exact list). Fourth, it repeals the earlier Financial Accountability Regulation 2009, SL No. 81 (s 6).
Mechanically, this regulation does not amend the parent Act itself, nor does it create new statutory duties or criminal offences. Its operative content is twofold: (a) an administrative mapping of accountable officers through a schedule (s 3), and (b) a set of qualification gates that operate as eligibility criteria for particular nominations under the Act (s 4, s 5). The regulation therefore functions primarily as a definitions and appointments instrument; enforcement of compliance with the Act’s substantive duties remains the responsibility of the Act and any enforcement mechanisms contained there. The regulation contains no penalty provisions and does not itself assign sanctions (see "Penalties and enforcement").
Where the regulation references the Act it does so narrowly: s 3 is enacted for the purposes of s 65 of the Act, s 4 for the definition of "appropriately qualified" in s 77 of the Act, and s 5 for the definition of "appropriately qualified" in s 78 of the Act. The repeal provision in s 6 is absolute as to the 2009 regulation, with no savings or transitional provisions included in the text provided. Schedule 1’s content is not reproduced in the text supplied, but its legal role is affirmative: it names accountable officers and their entities (s 3).
