Further Action
In terms of future conduct, it is essential that the model terms and conditions reflect current market practices. Issues may change and further areas of contention may arise meaning that the Commission’s model terms and conditions may need amendment, revision or supplementation. The Commission, therefore, envisages that a determination will not be static and that the model terms and conditions will likely require further consideration at some point.31 As a consequence, this Determination should not necessarily be viewed as a once-off exhaustive exercise.
