25Exemptions

25 Exemptions

(1)  The Secretary may exempt any fertilizer from the operation of this Act.

(2)  A person who wishes a fertilizer to be exempted may apply in a form approved by the Secretary.

(3)  An application to exempt a fertilizer from the operation of this Act –

(a) is to be lodged with the Secretary; and

(b) is to be accompanied by the prescribed fee; and

(c) is to contain the following:

(i) the name of the fertilizer;

(ii) the reasons for seeking the exemption;

(iii) any other prescribed details.
