Fertilisers (Labelling and Sale) Act 1904

The central concept underlying the Act is “fertiliser”, yet after the 2020 amendments the Act no longer contains a definition of that term. Originally, the Act carried a definition of “fertiliser” in section 2 and later in the dictionary, but both were omitted by A2020-22. The legislation history records that the dictionary definition of “fertiliser” was inserted in 2007 and omitted in 2020. The Act therefore now relies on its ordinary meaning, subject to any elaboration in the approved code of practice or regulations. This creates real uncertainty about scope. Does the Act cover only traditional chemical fertilisers, or does it also extend to organic soil conditioners, composts, liquid plant foods, slow-release granules, biological inoculants, and products labelled as “soil improvers” or “plant tonics”? A vendor of any of these products cannot determine with confidence whether the Act applies. The Act’s long title refers to “the sale and prevent the adulteration of fertilisers”, but the Act as now framed does not prohibit adulteration; it only requires truthful labelling. The concept of “statement about the nature and quantities of the chemical constituents” is also imprecise. It does not specify the level of detail required (for example, whether percentages must be by weight, whether trace elements must be listed, or whether the form of nitrogen or phosphorus must be stated). The “chemical constituents” language suggests that only chemical (inorganic) components must be disclosed, potentially excluding organic matter, moisture, or microbial content. The term “vendor” is not defined, so it includes any person who sells fertiliser in trade or commerce, whether manufacturer, importer, wholesaler, retailer or perhaps even a private seller. The “purchaser” is the buyer. The “code of practice” (section 4A) is a new concept introduced in 2020 to provide an alternative compliance path. A code is approved by the Minister as a disallowable instrument, meaning it is subject to scrutiny by the Legislative Assembly. The code can set out detailed labelling requirements; a vendor who substantially complies with it has a defence to a charge of giving a false statement (but not to a charge of failing to give a statement at all). “Approved forms” (section 4) are notifiable instruments; if a form is approved for a statement, it must be used. The “prima facie evidence” provision in section 3(3) is a significant evidentiary concept: in proceedings, branding on a container or a matching mark on the statement and the container is enough to shift the burden of production to the vendor to rebut the presumption that the statement relates to the contents. This makes prosecution easier because the prosecution does not need to prove the chain of custody linking a particular physical sample to a particular statement.

The Act directly affects any vendor of fertiliser who conducts business in the ACT. This includes retail garden centres, hardware stores, agricultural supply outlets, online sellers who dispatch to ACT addresses, landscape suppliers, and possibly farmers who sell excess fertiliser to neighbours if the transaction occurs in trade or commerce (the Act uses “vendor” without limiting it to licensed or registered entities). Because the Act does not define “vendor”, it technically applies to any person who sells fertiliser, even a one-off private sale, though in practice prosecutions are unlikely against consumers. The secondary group affected is purchasers of fertiliser - farmers, horticulturists, market gardeners, domestic gardeners, and businesses purchasing in bulk. They receive the statement and have the right to expect it to be truthful. However, the Act does not give purchasers a private right of action for damages; enforcement is through criminal prosecution by the state. Purchasers who suffer loss from a false statement must rely on other laws (e.g., Australian Consumer Law) for compensation. The ACT Minister responsible for agriculture or fair trading is directly affected through the power to approve forms and codes of practice. The Minister exercises these powers under delegated legislation procedures, and the use of a disallowable instrument for the code gives the Legislative Assembly oversight. The Executive (the ACT cabinet) has the power to make regulations, which could significantly expand the Act’s scope, introduce testing requirements, or create licensing schemes. The Act also affects compliance professionals, lawyers, and accountants who advise fertiliser businesses. They must monitor whether a code of practice is in force and what approved forms look like. The Act’s lack of definition for “fertiliser” imposes a cost on all businesses in the chain because they must make a judgment about whether the Act applies to their products, with legal risk if they guess wrong. The Act has particular implications for small nursery and garden supply businesses, which may sell dozens of bagged products from different suppliers. Each bag must be accompanied by a statement, and if the manufacturer does not supply it, the retailer must generate one - a significant compliance burden for a low-margin item. Larger manufacturers with dedicated regulatory teams can more easily absorb these costs, creating a small competitive advantage over independent retailers who cannot as easily verify chemical constituents or manage paperwork.

The Act imposes two core duties on a vendor of fertiliser. First, under section 3(1), the vendor must give the purchaser a statement “on or before its delivery”. This duty is absolute: it applies regardless of whether the purchaser asks for a statement and regardless of the order size or transaction value. The statement must describe “the nature and quantities of the chemical constituents of the fertiliser”. The Act does not specify a format, content detail, or method of delivery beyond requiring a “statement”. It may be a separate document, a label affixed to the bag, or perhaps an invoice line if sufficiently detailed. The second duty, under section 3(2), is a negative duty: the vendor must not give the purchaser an “incorrect or false statement”. This covers both statements that are factually wrong (e.g., claiming 20% nitrogen when the product contains 10%) and statements that are misleading as to composition (e.g., listing ingredients that are not present). The Act does not require the vendor to have tested the fertiliser; a vendor who honestly but mistakenly gives a false statement still commits the offence unless a defence applies. The Act also implies a right for the vendor to rely on the defence of substantial compliance with an approved code of practice under section 3(4). This defence only applies to a charge under section 3(2) (false statement), not to a charge under section 3(1) (failure to give a statement). So even if a vendor follows the code perfectly, they can still be prosecuted for not giving a statement at all. The code’s provisions may be incorporated by reference, so vendors must have access to the instrument. The Act gives the Minister the right to approve forms and codes, and the Executive the right to make regulations. These are powers, not duties. The Act gives the purchaser no express rights except the right to receive the statement. There is no provision allowing the purchaser to reject the fertiliser if the statement is false, nor is there any right to a refund or damages. The Act’s evidentiary provisions (section 3(3)) give the prosecution a procedural right: branding on a container is prima facie evidence that the statement relates to the contents. This effectively reverses the evidential burden on that issue for the vendor. The Act also contains a saving clause: a vendor does not commit an offence under subsection 3(2) if the statement substantially complies with the code (section 3(4)). This creates an incentive for vendors to adhere to the code, but only as to falsity, not as to failure to provide a statement.

The only penalties specified in the Act are in section 3: a maximum of 5 penalty units for a contravention of either subsection (1) (failure to give statement) or subsection (2) (false statement). As at the republication date, the value of a penalty unit is $160 for an individual and $810 for a corporation (under the Legislation Act 2001, section 133). Therefore, the maximum fine is $800 for an individual and $4,050 for a corporation per offence. Each transaction with a false statement could theoretically be a separate offence, potentially leading to multiple charges for a vendor who sells many bags of mislabelled fertiliser. The Act does not prescribe any other penalty such as imprisonment, forfeiture of goods, or prohibition orders. Enforcement is by way of prosecution in the ACT Magistrates Court (presumably by the Director of Public Prosecutions, or possibly by a regulatory agency authorised under other legislation). The Act does not establish an inspectorate or empower any officer to issue infringement notices, seize fertiliser, or compel the production of records. This means enforcement relies on complaints from purchasers or competitors, or on proactive investigation by authorities under general laws (such as the Fair Trading (Australian Consumer Law) Act 1992). The burden on the prosecution is eased by section 3(3), which provides that branding on a bag or barrel, or a statement matched to a container by a common mark, is prima facie evidence that the statement relates to the contents. This means the prosecution need not prove chain of custody or chemical analysis linking a particular physical sample to the statement; they can rely on the branding alone. However, the vendor can rebut this presumption by evidence that the bag was tampered with, that the statement was not intended for that product, or that the branding was erroneous. The Act also provides a specific defence for false statements if the vendor’s statement substantially complies with an approved code of practice (section 3(4)). This is a complete defence; the vendor bears the evidential burden of showing substantial compliance. The defence is not available for failure to give any statement. The penalty of 5 penalty units is modest relative to the potential economic gain from mislabelling - for a large agribusiness, the fine may be a negligible cost of doing business. The absence of any civil penalty regime or power to issue stop orders means the Act has limited deterrence effect. Enforcement is further constrained by the fact that the Act does not oblige the government to publish approved forms or codes in an accessible format; they are notifiable or disallowable instruments, but actual awareness among small vendors may be low.

The Act operates as a specific, narrow piece of legislation within a much broader regulatory framework. Most significantly, the Australian Consumer Law (ACL), which is applied in the ACT by the Fair Trading (Australian Consumer Law) Act 1992, prohibits misleading or deceptive conduct in trade or commerce and false or misleading representations about goods. A false statement about fertiliser composition would almost certainly be a breach of the ACL as well as a breach of the Act. The ACL carries significantly higher penalties (up to $50 million for corporations for serious contraventions) and provides private remedies (damages, injunctions, corrective advertising). The Act’s narrow scope means it is rarely used in practice; the ACL is the primary tool for prosecuting false labelling. The Act also interacts with state and territory fertiliser laws - each other jurisdiction has its own fertiliser labelling and registration regime (e.g., New South Wales has the Fertilisers Act 1985, Victoria has the Agricultural and Veterinary Chemicals (Control of Use) Act 1992). Because the ACT is geographically small and many fertiliser products are distributed nationally, a vendor may need to comply with multiple regimes. A fertiliser bag sold in the ACT may also be sold in NSW, requiring compliance with both Acts. The Act contains no provision for mutual recognition or exemption for goods that comply with another jurisdiction’s standards. The Act also interacts with the Legislation Act 2001, which provides definitions that apply unless the contrary intention appears (e.g., “penalty unit”, “Executive”, “Minister”). The notifiable and disallowable instrument procedures under the Legislation Act apply to approved forms and codes. The Act’s reliance on a code of practice means that the code (when made) will be a disallowable instrument, giving it higher parliamentary scrutiny than a notifiable instrument but less than a regulation. The Act does not interact with the Work Health and Safety Act 2011 (ACT) directly, but the chemical constituents of fertiliser may be hazardous, and the safety data sheet requirements under that Act may overlap with the labelling requirements of this Act. The Act also does not interact with any specific environmental laws, but if fertiliser mislabelling leads to over-application and environmental harm, relevant pollution laws may be triggered. The Act is essentially a consumer protection measure, not an environmental or agricultural management law; its interaction with broader regulatory schemes is limited and often subordinated to more modern and comprehensive laws.

The Fertilisers (Labelling and Sale) Act 1904 has a long and somewhat convoluted history. It began as a New South Wales Act - the Fertilisers Act 1904 No 33 (NSW) - which was in force in NSW immediately before 1 January 1911, the date the Federal Capital Territory (later ACT) was established. The Seat of Government Acceptance Act 1909 (Cwlth) continued NSW laws in force in the territory, and the Seat of Government (Administration) Act 1910 (Cwlth) gave those laws effect as if enacted by the Commonwealth. On 11 May 1989 (self-government day), the Australian Capital Territory (Self-Government) Act 1988 (Cwlth) converted most former NSW laws into ACT enactments, allowing the ACT Legislative Assembly to amend and repeal them. From 10 November 1999, under the Interpretation Act 1967 (repealed), section 65, these laws became fully ACT laws made by the Assembly. The first significant amendment after self-government was the Self-Government (Consequential Amendments) Ordinance 1989 (Ord1989-38), which updated references. In 1998, the Statute Law Revision (Penalties) Act 1998 substituted the outdated fine amounts with a penalty unit system. The Legislation (Consequential Amendments) Act 2001 (A2001-44) made multiple changes: it omitted the old Schedule, substituted sections 4, 5, and 1A, and removed definitions. The Statute Law Amendment Act 2001 (No 2) (A2001-56) amended the name of the Act and redefined “fertiliser”. In 2007, the Statute Law Amendment Act 2007 (A2007-3) inserted the dictionary and notes sections. In 2009, the Statute Law Amendment Act 2009 (No 2) (A2009-49) renamed the Act to its current title (from “Fertilisers Act 1904” to “Fertilisers (Labelling and Sale) Act 1904”). The most recent and substantive amendments came from the Planning and Environment Legislation Amendment Act 2020 (A2020-22), which came into effect on 11 June 2020. This amendment removed the definition of “fertiliser” from both section 2 and the dictionary (sections 8, 9, 12 of the amending act), and inserted a new section 4A allowing the Minister to approve a code of practice for fertiliser labelling. It also amended section 3 to include the new defence of substantial compliance with the code (subsection (4)). The removal of the definition of “fertiliser” was a significant change because it made the Act’s scope uncertain. The amendment history shows that the Act has been modernised in form but remains substantively brief - essentially unchanged from its 1904 core of requiring a truthful statement.

No litigation is reported in the Act itself, its endnotes, or the republication details. The legislation history notes that the Act was originally a NSW Act and continued as an ACT law, but there is no mention of any court cases interpreting its provisions. Given the Act’s narrow scope, low penalties, and the existence of more powerful laws like the Australian Consumer Law, it is likely that very few prosecutions have been brought under this Act in the ACT. The absence of case law means there is no judicial guidance on key terms such as “nature and quantities of the chemical constituents”, “incorrect or false statement”, “vendor”, or “substantially complies” (the latter being a new defence inserted in 2020). The prima facie evidence provision in section 3(3) has also not been tested in the ACT courts. The lack of litigation might also reflect that the Act is not well known among regulators or the farming community. It is possible that enforcement has been handled under other Acts, such as the Fair Trading Act or the ACL, which offer higher penalties and broader remedies. The removal of the definition of “fertiliser” in 2020 could create uncertainty that may eventually lead to litigation if a vendor is prosecuted and challenges the scope of the Act. Without a definition, a court would need to decide whether a particular product falls within the ordinary meaning of “fertiliser”. That could be contested. Additionally, the new code of practice (if approved) could be the subject of judicial review if it is alleged to be ultra vires or procedurally defective. For now, the Act has a clean litigation record, but that could change if regulators decide to use it more aggressively in the future.

Several aspects of the Act can trap the unwary vendor. The most significant is the complete absence of a definition for “fertiliser” after the 2020 amendments. A vendor who assumes that only traditional synthetic fertilisers are covered may discover that a product they sell - such as compost, manure, seaweed extract, or a microbial inoculant - is held to be a fertiliser under the ordinary meaning of the term. The Act offers no guidance, so the vendor bears the risk of a prosecution if they fail to provide a statement. Conversely, a vendor who provides a statement for a product that is not a fertiliser is likely wasting effort, but there is no penalty for over-compliance. A second gotcha is that the defence of substantial compliance with a code of practice only applies to the offence of giving a false statement, not to the offence of failing to give a statement at all. So even if a vendor follows the code perfectly, they must still actually give the statement. The Act requires the statement to be given “on or before its delivery”, not at the point of sale or order. If the vendor delivers the fertiliser without a statement, they commit an offence even if they later provide one. The statement must be in writing; an oral statement is insufficient. A third trap is the prima facie evidence provision in section 3(3). If a bag of fertiliser is branded with a statement, that branding is taken to be a statement about the contents. This means a manufacturer who brands bags with a composition statement has effectively given that statement to every subsequent purchaser, whether the retailer realises it or not. If the brand statement is inaccurate, both the manufacturer and any vendor who sells that bag without correcting the statement may be liable. The Act does not require the vendor to verify the brand statement; but if it is false, the vendor who passes it on has given an incorrect statement. The only defence is substantial compliance with a code, which may or may not excuse reliance on manufacturer-supplied information. A fourth gotcha is that the Act does not specify what “chemical constituents” means. Does it require listing every element above a certain threshold, or only the primary nutrients (N, P, K)? The Act does not incorporate Australian Standards or industry norms. A vendor who lists only N-P-K may be found to have omitted other constituents that are “chemical” in nature. A fifth trap is that the Minister can approve forms at any time. If a form is approved for a statement, it must be used. A vendor using a different format is then non-compliant even if the information is accurate. Vendors must regularly check the ACT legislation register for new instruments. Finally, the penalty of 5 penalty units may seem small, but the Act allows for a separate offence for each transaction. A retailer selling 1,000 bags of mislabelled fertiliser could theoretically face 1,000 charges and a maximum fine of $4.05 million for a corporation. Realistically, a court would likely aggregate, but the risk exists.

Compliance with the Act requires a systematic approach from any vendor of substances that might be considered fertiliser. The initial step is to determine whether the Act applies to the products being sold. Because the Act no longer defines “fertiliser”, a vendor must make a reasonable assessment based on the ordinary meaning of the term: a substance that is applied to soil or plants to supply nutrients. This includes products labelled as fertiliser, plant food, soil conditioner, manure, compost, and any mixture of plant nutrients. If there is any doubt, the prudent approach is to comply rather than risk a prosecution. The core obligation is to give each purchaser a written statement before or at delivery. The statement must set out “the nature and quantities of the chemical constituents” of the fertiliser. Compliance requires the vendor to know or determine these constituents. If the vendor is a manufacturer or importer, they should have formulation data or independent laboratory analysis. If the vendor is a reseller (e.g., a garden centre), they should obtain a compliant statement from the manufacturer or supplier. It is not sufficient to rely on a product label alone if the label does not include quantities of all chemical constituents. For example, a label that reads “NPK 10-5-5” may not disclose trace elements or secondary nutrients. The vendor should ensure the statement includes at least the percentage by weight or similar measure of each chemical constituent that is present in more than trace amounts. The vendor must also ensure the statement is not incorrect or false. This means the information must be accurate at the time of delivery, not just when the product was manufactured. If the product is a blend that can segregate during transport, the vendor should consider testing or sampling to verify the composition. The vendor can reduce the risk of a false statement offence by complying with any code of practice approved under section 4A. Even before a code is approved, the vendor should follow industry best practice and include clear, accurate information. The vendor should also check whether the Minister has approved a form for statements under section 4. If so, that form must be used; using a different form, even if it contains the same information, will result in a technical non-compliance. The vendor should keep records of the statements given, including copies and evidence of delivery. The prima facie evidence provision means that if a bag is branded, the branding is presumed to be the statement. Therefore, any vendor who receives branded bags from a supplier should check that the branding matches the statement they intend to give. They should also keep the branding consistent with the statement to avoid confusion. The vendor should also note that the defence in section 3(4) applies only to the false statement offence, not to the failure to give a statement. Therefore, the vendor must always give a statement. In practice, the simplest method is to include the required information on a label that is attached to the bag or on a delivery docket. For bagged products, a printed label with the legal statement is advisable. For bulk deliveries, a weighbridge ticket or delivery note that includes the statement can satisfy the requirement. The vendor should also monitor the ACT legislation register for new regulations, new codes of practice, or new approved forms. The Act can be expanded significantly through delegated legislation. Compliance is an ongoing process, not a one-off task. A prudent vendor will incorporate the requirements into their standard operating procedures, train sales staff, and conduct periodic audits to ensure statements are accurate. Given the low penalties, the main risk is not financial but reputational; a prosecution would be public and could harm customer trust.
